Abstract

The position of the President in the presidential system places the President's function as head of state and head of government. The unification of those functions doesn’t negate the differences in the President’s functions as head of state and head of government. This affects the President's authority in issuing decrees. The absence of such affirmation creates legal uncertainty over the resolution of the President's decision, especially the President's decision as head of state. The formulation of the problem raised is 1) how is the model of the using Presidential Decrees in terms of the President’s function as head of state and head of government; and 2) how is the competence of State Administrative Court in adjudicating Presidential Decree as head of state. The research method used normative juridical with a statutory and contextual approach. The results show there are different models of using Presidential Decrees in his position as chief of state and chief of government. Then, the President's decision regarding his position as chief of state becomes a necessity to be differentiated with following elements, First, the President issued it in his capacity as head of state, Second, the President did not have beslissing in issuing it, Third, the decision was issued by the President based on his authority obtained by attribution from the Constitution

Abstract

This article discusses the role and function of prosecutors in enforcing ethics and behavior, with a case study at the Central Kalimantan High Prosecutor's Office. This research analyzes how the Central Kalimantan High Prosecutor's Office carries out internal and external oversight functions to ensure the ethical and professional behavior of prosecutors. The research results show [mention the main findings briefly, for example: the effectiveness of existing monitoring mechanisms, obstacles faced, and recommendations for improvement]. This study contributes to a better understanding of the importance of integrity and accountability in the justice system, especially in the context of law enforcement in Indonesia.

Abstract

Dalam penelitian ini akan melakukan pengujian untuk menunjukan bagaimana minat mahasiswa untuk berpartisipasi di pasar modal syariah dengan meliputi faktor-faktor apa saja yang bisa mempengaruhi minat mahasiswa dalam berinvestasi di pasar modal syariah. Penelitian ini bertujuan untuk mengetahui variabel-variabel yang mempengaruhi minat mahasiswa dalam berinvestasi di pasar modal syariah. Faktor-faktor yang dianalisis meliputi pemahaman mahasiswa mengenai kelebihan dan kekurangan investasi tersebut, literasi digital, kendala keuangan, serta pengaruh lingkungan terhadap minat mereka dalam mengelola uang dan berinvestasi. Penelitian ini menggunakan metode kuantitatif dengan pengukuran skala. Data dikumpulkan melalui kuesioner yang diberikan kepada partisipan, dengan pilihan jawaban skala 1 hingga 4. Data kemudian dianalisis menggunakan program SPSS dengan tujuan untuk mengolah dan mengevaluasi data tersebut. Hasil penelitian menunjukan bahwa variabel bebas yang terdiri dari literasi digital, risiko investasi, pengaruh lingkungan dan keterbatasan finansial serta variabel terikat yang di olah dengan uji validitas dan reabilitas memberikan hasil bahwa semua variabel independent tersebut dinyatakan valid dengan nilai r hitung lebih besar dari r table dan Tingkat signifikan < 0,05 serta semua variabel juga dinyatakan reliabel dengan nilai Cronbach alpha > 0,60. Kesimpulan dari penelitian ini menyatakan bahwa variabel yang berpengaruh signifikan terhadap minat investasi mahasiswa di pasar modal syariah adalah Literasi Digital (X2), Variabel (X1) (X3) (X4) tidak memiliki pengaruh yang signifikan secara individu.

Abstract

Time is one of the greatest blessings given by Allah SWT to humans and has an important role in the life of a Muslim. This article analyzes the hadith of Rasulullah SAW which says, “Take advantage of five things before five things,” which teaches the importance of time management in various aspects of life. This hadith emphasizes the use of youth, health, wealth, free time and life before the arrival of a more challenging phase. By understanding this hadith, Muslims are invited to manage their time productively, not only for worldly interests, but also to achieve spiritual blessings. This article also provides a guide to the practical implementation of time management according to Islamic teachings.

Abstract

Warisan merupakan salah satu cara mengatur hubungan hukum dalam masyarakat, dan meninggalnya seseorang sedikit banyak menimbulkan kesulitan. Penyelesaian hak dan kewajiban atas meninggalnya seseorang diatur dalam hukum waris. Akan tetapi dalam hal ini hak waris tidak selalu untuk satu orang saja melainkan juga sanak saudara yang juga merupakan ahli waris, hal ini lah yang bisa menyebabkan konflik dalam pewarisan. Metode yang akan diaplikasikan ke dalam penelitian yang kami buat ini merupakan metode penelitian hukum normatif yakni memprioritaskan pada pengkajian kepustakaan yang dilakukan dengan mengamati atau merevisi dokumen - dokumen hukum yang berkaitan dengan tema dan gagasan pokok bahasan penelitian sistem penyelesaian konflik sengketa waris yang terjad dalam keluarga sedarah. Selain berfokus pada dokumen-dokumen hukum, penelitian ini juga berpusat pada peraturan perundang-undangan dan kebijakan-kebijakan yang sesuai atau terkait dengan pendekatan hukum di indonesia. Umumnya konflik waris timbul hanya pada pembagiannya saja, karena salah satu yang merupakan ahli waris tidak mendapat haknya, atau salah satu ahli waris hanya ingin menguasai warisannya sendiri secara egois. Untuk perkara waris hakim harus menawarkan proses mediasi, karena jika tidak dilakukan oleh hakim maka putusan itu setelah keluar bisa batal demi hukum, di dalam masyarakat sosial masih cukup besar angka perkara sengketa terkait penyelesaian warisan dikarenakan diantara mereka yang sering mengklaim warisan menyesuaikan dengan pribadi masing- masing, Salah satu cara penyelesaian konflik yakni melalui jalur mediasi ataupun jalur hukum, pada dasarnya konflik ini merupakan konflik yang bersifat privat oleh karena itu menyelesaikan nya cukup dengan kekeluargaan berdasarkan kebijakan-kebijakan yang berlaku.

Abstract

In waste management, the general practice in many villages still focuses on landfilling waste which is then thrown into final disposal sites. Apart from that, burning waste is often used as an alternative to reduce the volume of existing waste. However, this method causes negative environmental impacts such as increased air pollution and soil damage around village areas. This article, with the title "Optimizing Waste Through Biopori Technology in Kota Besi Hilir Subdistrict", will explain how biopori technology can be an effective solution in dealing with waste management issues in this subdistrict. Biopori technology works by speeding up the process of decomposing waste and turning it into compost that is useful for farmers and local communities. The approach applied in this project consists of two phases: first, a persuasive approach, which involves outreach to increase public awareness and interest regarding biopore holes; second, a practical approach, where students are directly involved in the process of making biopore holes. From the results of this activity, a biopore hole has been installed as an example that can be adopted and further developed by the community. Apart from that, solid organic fertilizer is produced that can be used by farmers, and there has been a change in mindset in the way people manage their waste.

Abstract

International trade disputes have been successfully settled by the London Court of International Arbitration (LCIA), a component of the international arbitration system. The decision of a breach of contract dispute involving an aircraft leasing agreement between Helice Leasing S.A.S (Helice) and Atterissage S.A.S (Atterissage) with PT. Garuda Indonesia Tbk (GI), decided by the LCIA, reflects this. After concluding that GI had violated the agreement, the LCIA ordered it to pay Helice and Atterissage the past-due rent as well as the remaining rent. Analysing the international arbitration procedure for resolving disputes and the award's enforcement is the goal of this research. Using a normative legal methodology, the study analyses case studies and legislation. The results show that arbitration uses a multi-step procedure to resolve disputes, including hearings, mediation or conciliation, the selection of an arbitration panel, the presentation of the parties' arguments and supporting documentation, and the arbitrator's ruling. The LCIA effectively resolved the disagreement, demonstrating the efficacy and efficiency of this approach. The enforcement of the award is permitted in Indonesia under Article 65 and Article 66 of Law No. 30 of 1999 on Arbitration and Alternative Dispute Resolution (AAPS Law), provided that the Central Jakarta District Court has recognised the arbitration award and it does not contravene public order.

Abstract

أسئلة البحث هي كيف قدرة طلاب الصف الثاني بمعهد محمدية كولا مادو في مهارة الكلام؟ وما المشكلات التي يواجهها الطلاب الصف الثاني بمعهد محمدية كولا مادو في مهارة الكلام؟ هذا البحث بحث الكيف الوصفي الميداني، والطريقة المستعملة في جمع البيانات هي طريقة الملاحظة، والمقابلة، والوثيقة. وطريقة المستخدمة تحليل البيانات الوصفي. تأكدت نتائج البحث التي تم الحصول عليها من أن قدرة طلاب الصف الثاني الثانوي بمعهد محمدية كوالا مادو على إتقان التحدث لا تزال ناقصة عند النظر إليها من هدف تعلم اللغة العربية في المعهد، بينما في النظر إليها من طريقة معايير المجلس الأمريكي لتعليم اللغات الأجنبية ACTFL فإن قدرة الطلاب في إتقان التحدث باللغة العربية تكون في المستوى المتوسط.وأما المشاكل التي يواجهها طلاب الصف الثاني في إتقان التحدث هي أنه ليس كل الطلاب متخرجين في المعهد ، وبعضهم يرغب في مواصلة دراسته في الجامعات الحكومية ، و قلة اهتمام الطلاب في تعلم اللغة العربية والتحدث باللغة العربية.

Abstract

The purpose of this study is to analyze the price review of Cryptocurrencies in Indonesia. This research uses qualitative research methods with the nature of literature review. qualitative research conducted and research purposes, sampling may not be necessary in qualitative research with a literature review. In this case, the researcher did not collect data from respondents or informants, so there was no need to take samples. The results of the study show that cryptocurrency prices in Indonesia are still considered digital assets and have not been recognized as legal currency. Nonetheless, Cryptocurrency transactions still occur in Indonesia and several Cryptocurrency exchanges also operate in Indonesia by complying with regulations set by the government. The development of blockchain technology and Cryptocurrency adoption continues to increase in Indonesia, and the Indonesian government has also introduced initiatives such as the Blockchain Indonesia program to increase awareness and adoption of blockchain technology in Indonesia. As an investor, keep in mind that Cryptocurrency is still very risky and very volatile. Therefore, it is necessary to be careful and carefully consider the risks before deciding to invest. It is also important to always follow the regulations and policies related to Cryptocurrency set by the Indonesian government.

Abstract

This study aims to obtain descriptions of ROA, LDR and CAR at Bank BCA and Bank BRI and to analyze the differences in ROA, LDR and CAR at Bank BCA and Bank BRI which are listed on the Indonesia Stock Exchange (IDX) for 2019-2021. the variables in this study are ROA, LDR and CAR. The population of this study are BCA Banks and BRI Banks which are registered on the IDX in the 2019-2021 period. The sampling method used is a saturated sample (all populations are sampled) Bank BCA and Bank BRI in 2019-2021 with computer aids that use the SPSS program. 23 for windows. Analysis of the financial statements in the form of these ratios includes the first liquidity ratio, this ratio shows aspects of the company's ability to meet obligations that are due in the short term. ROA, LDR and CAR are aspects that can be used to measure the performance of a company. This research was carried out using a comparative approach, a comparative research approach is a comparative research, which is carried out to compare the similarities and differences of 2 or more characteristics and facts of the object under study based on a certain frame of mind. The type of data in this study is quantitative data in the form of financial report figures at Bank BCA and Bank BRI. The data analysis technique used in this research is comparative analysis, which is a technique using the independent sample T-test. From the results of research that has been done to look at the financial performance of Bank BCA and Bank BRI with CAR ratios there is no difference in the financial performance of the two banks, while there are differences in the ROA and LDR ratios. By conducting independent differential tests the T-test samples on ROA and LDR values ​​can be used as benchmarks to measure the financial performance of the two banks.
