Abstract

This study aims to evaluate the regulation and implementation of the principle of meaningful participation of vulnerable groups in the legislative process, and to identify factors influencing its effectiveness in realizing inclusive legislation through a comparative study between Indonesia and Poland. This study uses a normative legal research method with a legislative, conceptual, and comparative approach. The legal sources include primary legal materials in the form of constitutions, laws, and regulations related to public participation and legislation; secondary legal materials in the form of national and international scientific journals, textbooks, and reports from state and international institutions; and tertiary legal materials as conceptual support. The analysis was conducted qualitatively through legal reasoning and a comparison between norms and practices in Indonesia and Poland. The results show that normatively both countries have recognized the importance of public participation, including vulnerable groups, as part of the principles of democracy and the rule of law. However, the implementation of meaningful participation still faces gaps between regulation and practice, particularly regarding access to information, substantive involvement, and the actual influence of vulnerable groups on the substance of legislation. Factors determining the effectiveness of meaningful participation include the strength of the legal basis, the political commitment of lawmakers, institutional capacity, the role of civil society, and transparency and accountability mechanisms. This research makes a scientific contribution by enriching comparative law-based inclusive legislative studies and offering policy recommendations for strengthening meaningful participation of vulnerable groups.

Abstract

This study aims to analyze the legitimacy crisis of the House of Representatives (DPR) in Indonesia's democratic system through a philosophical reflection on formalistic meaningful participation practices. The research questions address the philosophical concept of legitimacy, the causes of formalistic participation, its implications for DPR legitimacy, and the ideal model of meaningful participation. The study employs normative legal research with statutory and conceptual approaches, using primary data from legislation and secondary data from scholarly literature and academic journals. The findings reveal that meaningful participation in the legislative process remains procedural and symbolic, thus failing to produce substantive legitimacy. This condition leads to declining public trust and the emergence of pseudo-legitimacy. Therefore, a transformation toward a more inclusive, deliberative, transparent, and outcome-oriented model of meaningful participation is necessary to strengthen the legitimacy of the DPR within a democratic system.

Abstract

This study examines the urgency of limiting the object of the House of Representatives’ right of inquiry in exercising its oversight function so that it does not exceed constitutional boundaries. The right of inquiry is an important instrument within the checks and balances mechanism; however, its regulation and implementation still raise legal problems because the objects and subjects that may be summoned by the House are formulated too broadly. This condition may create legal uncertainty, distort the oversight function, and transform the right of inquiry into a political pressure instrument. This research employs normative legal research using statutory, case, and conceptual approaches. The findings show that the broad interpretation of the object of inquiry affects legal certainty, weakens the rule of law, and shifts the House’s oversight function from constitutional control to political maneuvering. Constitutional Court Decisions Number 36/PUU-XV/2017 and Number 16/PUU-XVI/2018 emphasize the need for constitutional limits in the use of the right of inquiry, particularly to prevent interference with pro justitia processes or the independent functions of certain institutions. Therefore, the right of inquiry should be limited to the implementation of laws and/or government policies that are important, strategic, broadly impactful, and allegedly contrary to statutory regulations. It should also be exercised gradually, proportionally, and directed toward policy improvement and strengthening governmental accountability.

Abstract

This study aims to examine the exercise of judicial activism by the Indonesian Constitutional Court in decisions concerning the 2024 General Election, particularly its contribution to constitutional norm formation and its implications for electoral legal certainty. Employing doctrinal legal research, this study applies statutory, conceptual, and case approaches to selected Constitutional Court decisions that directly affected electoral regulation and raised questions concerning the scope of judicial authority and norm creation. The findings demonstrate that the Court’s constitutional interpretation extended beyond the conventional function of a negative legislator by modifying electoral thresholds, candidate eligibility requirements, and the institutional timing of elections. The analysis identifies four cumulative indicators through which constitutional interpretation may evolve into judicial law-making: departure from the ordinary textual meaning of legislation, formulation of standards not expressly established by the legislature, immediate normative consequences, and general binding effect (erga omnes). The novelty of this study lies in developing an integrated conceptual framework that uses these four indicators to distinguish legitimate constitutional interpretation from judicial activism and judicial norm creation within Indonesia’s constitutional system. The findings further indicate that judicial activism may strengthen constitutional rights protection and democratic participation when addressing genuine constitutional deficiencies, but excessive intervention may undermine separation of powers, legal certainty, and electoral stability. Accordingly, future constitutional adjudication in electoral matters should be grounded in constitutional text and principles, accompanied by institutional restraint and consideration of the temporal and systemic consequences of judicial intervention.

Abstract

Artikel ini mengkaji secara normatif penerapan prinsip rule of law dalam pengelolaan keuangan daerah sebagai upaya mewujudkan pemerintahan daerah yang transparan dan akuntabel. Pengelolaan keuangan daerah merupakan instrumen utama dalam penyelenggaraan otonomi daerah yang harus dilaksanakan sesuai dengan prinsip negara hukum. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan konseptual dan perundang undangan, melalui analisis terhadap bahan hukum primer, sekunder, dan tersier. Hasil kajian menunjukkan bahwa secara normatif prinsip rule of law telah diakomodasi dalam pengaturan pengelolaan keuangan daerah melalui prinsip legalitas, kepastian hukum, transparansi, dan akuntabilitas. Namun dalam praktik, penerapan prinsip tersebut masih menghadapi berbagai tantangan, terutama terkait konsistensi pelaksanaan, disharmoni regulasi, efektivitas pengawasan, dan penegakan hukum. Oleh karena itu, penguatan penerapan rule of law secara substantif menjadi kunci untuk memastikan pengelolaan keuangan daerah berjalan sesuai hukum, terbuka, dan dapat dipertanggungjawabkan demi terwujudnya tata kelola pemerintahan daerah yang baik.

Abstract

The rapid development of digital technology among students provides significant benefits for learning and social interaction while creating risks to children's privacy, security, and rights, including sextortion and online exploitation. This community service program aimed to enhance students' understanding of children's constitutional rights, digital security, personal data protection, and prevention of sextortion and online exploitation. The program was conducted on July 27, 2026, at SMK Negeri 2 Palangka Raya and involved 47 tenth- and eleventh-grade students. It employed a participatory-educational approach through preparation, interactive legal education, evaluation, and follow-up. Sessions combined lectures, questions, discussions, and case analysis addressing constitutional rights, digital security, personal data protection, sextortion, online exploitation, preventive measures, and protection mechanisms. Results indicate that participants understood children's constitutional rights, the importance of protecting personal data, sextortion characteristics, and preventive and protection measures. Participants also actively related legal concepts to digital technology use. The activity demonstrates the relevance of legal education in strengthening legal literacy and digital security awareness
