Abstract

Nahdlatul Ulama (NU) has been an Islamic political party since its formal separation from Masyumi in 1952. Following this, the NU party maintained a close relationship with President Soekarno, particularly during the period of Guided Democracy, which was marked by the issuance of the Presidential Decree of 5 July 1959. However, NU's acceptance of Guided Democracy and its components was not immediate but involved a process of religious and political ijtihad (independent reasoning) by NU scholars. In this context, NU’s acceptance and support for the concepts of Guided Democracy, Nasakom (Nationalism, Religion, and Communism), and Manipol-Usdek (the Preamble to the 1945 Constitution) were framed through an Islamic approach. This paper aims to explore and analyze NU's siyasah-diniyyah (religious-political ijtihad) regarding these political concepts. This study employs a qualitative research approach, utilizing the historical method, which involves the stages of heuristics, criticism, interpretation, and historiography. Historical sources relevant to the theme of this research were gathered and analyzed. The findings indicate that the siyasah-diniyyah ijtihad of Nahdlatul Ulama represented support for the ideas and political thought of NU’s clerical leaders in responding to President Soekarno's new political system, particularly Guided Democracy, Nasakom, and Manipol-Usdek. NU’s religious and political stance can be seen in the thoughts of KH. Wahab Chasbullah, the Ro’is Syuriah (Chairman) of PBNU, who accepted Guided Democracy as consistent with Islamic teachings and viewed the 1945 Constitution as an embodiment of the Jakarta Charter. Additionally, the perspective of KH Idham Chalid, Chairman of Tahfidziyah PBNU, is also significant, as he contributed to bridging the gap between Guided Democracy and Islam through the concept of shuro, involving experts and emphasizing full responsibility in decision-making.

Abstract

The state policy regulating the concept of syibhul iddah for husbands as outlined in Circular Letter Number: P-005/DJ.III/HK.00.7/10/2021 has sparked debate among religious officials in Indonesia. This paper aims to discuss the chronology of the emergence of the concept of syibhul iddah for husbands and analyse the responses or perspectives of the heads of the Office of Religious Affairs (KUA) in Indonesia. In addition, it also discusses the relevance of the concept of syibhul iddah to the reform of Islamic family law in Indonesia. Methodologically, this research is a juridical-empirical research. Primary data was obtained through interviews with several religious leaders spread across various regions of Indonesia, while secondary data was obtained from reference materials such as scientific articles, scientific books, etc. The data analysis techniques used were data condensation, data presentation, and conclusion drawing. The results of the study show that the state policy through a circular letter regulating syibhul iddah is based on several reasons. First, the prevalence of covert polygamy in society, which can harm women’s rights. Second, as a legal measure to fill the legal vacuum regarding new marriages for husbands during their wives ‘iddah period. Third, as a legal measure to support the spirit of gender equality between men and women in carrying out responsibilities after divorce. However, in its application within the Office of Religious Affairs (KUA), the circular letter still causes differences of opinion among religious leaders in Indonesia. On the one hand, the majority of religious leaders are very responsive and supportive of the issuance of the circular letter. On the other hand, there are a small number of religious leaders who criticise the circular letter.

Abstract

Democracy is a government of the people, by the people and for the people. The popularity of the democratic system is arguably at its peak. This is proven by the many uses of the democratic system in modern countries in the world. Indonesia as a country that runs a democratic system does not give authority to the authorities to monopolize votes in an election. Because security and freedom for every citizen, free to choose as a representation of the sovereignty of the people. But on the side that democracy often happens is seen as freedom so that there are some elements mixing elements in democracy that actually damage democracy itself. Call it when campaigning for a candidate to hate speech, insult, and berate other candidates so that damage the good name in the eyes of the community. As reported in Detik.com in 2016, the National Police stated that there were 2,018 cases of hate speech that occurred. Then it increased by 44.99% in 2017 to 3,325 cases. Furthermore, in 2018 reported in January 2019 there were 3,884 cases of hate speech that occurred. This proves that in campaigning the candidates cannot be said to campaign peacefully, fairly and competitively. Whereas Allah s.w.t. It has been said in Surah al-Hujurat verse 11. Based on the description above the writer is interested in discussing and studying more about the campaign in the Elections in Indonesia and campaigning peacefully perspective of Surah al-Hujurat verse 11. This is important to discuss given the rampant hate speech cases that conducted by candidates in campaigning. This study aims to contribute knowledge to the candidates so that in campaigning, they do not utter hate speech, insult, and berate other candidates.

Abstract

This article investigates the Muslim cadre education and its role in shaping religious authority in nineteenth-century West Java through the case of KH Ahmad Syatibi Al-Qonturi and his pesantren (Islamic boarding school). This study conceptualises religious authority as a socially produced legitimacy sustained through epistemic credibility, moral exemplarity, and networked reproduction. The research employs a qualitative historical design, based on documentary sources, and applies qualitative data analysis procedures, including data condensation, data display, and conclusion drawing. The findings indicate that Mama Syatibi developed a pesantren-based infrastructure for Muslim cadre education that contributed to the consolidation of religious authority in West Java. This model of Muslim cadre education operated through three interconnected practices: regular teaching and recitation, da‘wah bil qalam (preaching with the pen) through extensive written works, and a role model as embodied moral discipline. These practices strengthened authority by making interpretive competence publicly verifiable, stabilising knowledge transmission through texts, and reinforcing communal trust through exemplary conduct. Moreover, the diffusion of his students —many of whom became Muslim scholars and founded or led pesantren across West Java— demonstrates how Muslim cadres reproduced religious authority through educational succession and institutional multiplication. The study contributes to scholarship on Islamic education and leadership by showing how pesantren-based education and training shaped religious authority in the West Javanese context from the nineteenth to the early twentieth century.

Abstract

Penelitian ini dilatarbelakangi adanya kebutuhan sebuah lembaga dalam menyelesaikan sengketa ekonomi syariah. Berbagai regulasi telah disusun untuk memberikan kewenangan kepada sebuah lembaga. Namun demikian, berbagai regulasi tersebut tentunya menimbulkan gejolak di masyarakat, akibat adanya ketumpangtindihan regulasi, dua kewenangan lembaga, dan substansi regulasi yang memiliki banyak penafsiran hukum. Tujuan penelitian ini mencoba memaparkan analisis dinamika regulasi penyelesaian sengketa ekonomi syariah dalam pandangan sosiologi hukum. Jenis penelitian ini menggunakan metode deskriptif kepustakaan dengan pendekatan yuridis normatif. Penelitian ini termasuk penelitian kualitatif. Teknik analisis data yang digunakan adalah kondensasi data, penyajian data, dan penarikan kesimpulan. Hasil penelitian menemukan fakta bahwa kedudukan sosiologi hukum memberikan pengaruh terhadap dinamika perubahan penyusunan regulasi penyelesaian sengketa ekonomi syariah melalui adanya gejolak kebutuhan, gejolak kepastian hukum dan gejolak efisiensi penyelesaian sengketa yang berasal dari masyarakat. Sehingga dinamika perubahan regulasi tersebut mencoba mewujudkan kebutuhan para pelaku bisnis ekonomi syariah dalam mencari keadilan dan kepastian hukum.
