Abstract

The rapid development of artificial intelligence technology has opened up new opportunities in the transformation of education, including Islamic education. This research aims to analyze the use of AI in personalizing Islamic learning in the era of Society 5.0, with a constructivism-based theoretical approach. The method used is a qualitative-descriptive analysis of the literature and phenomena related to the application of AI in Islamic education. The results show that AI has great potential in creating learning that is more adaptive and meets individual needs, especially through the use of personalization algorithms and in-depth data analysis. This article makes a novel contribution by offering a new perspective on the application of AI technology based on constructivism theory, which highlights the importance of the interaction between technology, learners and the social environment. The implication is that the application of AI can encourage innovation in curriculum design and teaching strategies, while ensuring alignment with Islamic values in the digital age.

Abstract

In life, Islam teaches its adherents to strive for happiness in the world and the hereafter. Likewise with happiness when living life in the world, namely physical and spiritual prosperity. In preventing economic chaos, conflicting interests in economic problems must be minimized, supported by all legal regulations in a society. So it is very necessary a system that regulates the rights and obligations of the community in the state, especially in the economic sector based on the Qur‘an and Sunnah. The economic system implemented in Indonesia at the moment is arguably not good. When viewed from all existing systems, the capitalist system has mastered various lines to make society range to poverty. To measure economic growth the welfare indicators of a community are used. This success was marked by an increase in per capita income. This paper will discuss how the Islamic economy perspective of the Qur‘an. And how is the urgency to build the economic community in Islam? This is important to discuss, to remind the public about the existence of capitalists in the economic system and to provide mutual understanding to help fellow members of society, between the rich and the poor so that from these aids help social inequalities and social stratification can be minimized and then narrowed even can overcome.

Abstract

The emergence of the concept of religious moderation initiated by the Ministry of Religion of the Republic of Indonesia and set forth in the 2020-2024 National Medium-Term Development Plan (RPJMN) indicates that the program for internalizing and strengthening the values of religious moderation is very important and urgent to implement. The values of religious moderation consist of four points, namely national commitment, tolerance, anti-radicalism, and accommodative to local culture. The direction to internalize the four values of religious moderation is also played by the Anak Jalanan At-Tamur Islamic Boarding School, Bandung. This article aims to reveal the role of the Anak Jalanan At-Tamur Islamic Boarding School in internalizing the values of religious moderation to students. This article uses qualitative research methods that are field research. The research data were obtained from two sources, namely field data sources and library data sources. Data collection techniques used are observation, interviews, and documentaries. The data analysis techniques used are data condensation, data presentation, and drawing conclusions. The results showed that success in internalizing the values of religious moderation to students could be seen from the indicators or values of religious moderation. The four indicators (values) of religious moderation are reflected in the routine activities and attitudes of students of the Anak Jalanan At-Tamur Islamic Boarding School. Commitment to nationalism, tolerance, anti-radicalism and accommodativeness to local culture is imprinted in the personalities of the students of the Anak Jalanan At-Tamur Islamic Boarding School. This is also due to two things: firstly, interfaith dialogue events are often held and secondly, the leader of the Anak Jalanan At-Tamur Islamic Boarding School who has a broad and open view and emphasizes morality in his education.

Abstract

The rights of women and children after divorce are often neglected. The article examines the reality of children's and women's rights in Pekalongan City, Central Java, Indonesia, focusing on the causes of non-fulfillment and the legal consequences. Data from 10 court decisions from the Pekalongan City Religious Court revealed a gap between post-court decision reality and the fulfillment of these rights. The research found that the non-fulfillment of children's and women's rights after divorce in Pekalongan is due to a lack of public knowledge about post-divorce execution procedures and related rights. The difficulty of spouses in ensuring the fulfillment of these rights is also reflected in the lack of application of Islamic legal knowledge on the obligation to provide maintenance by husbands. The legal consequences are devastating, emphasizing the need for improvements in the legal system, increased public knowledge, and the application of Islamic legal principles.

Abstract

This research aims to critically analyze and deconstruct the rules and theoretical rules of ijtihad and its implementation in resolving contemporary Islamic inheritance law issues that develop in the Supreme Court. The focus of this research is on the wasiat wajibah (compulsory testament) as an alternative for non-Muslim heirs. This field research uses a descriptive-analytical method to explain the conception of ijtihad comprehensively. The primary data for this research came from interviews and observations. Interviews were conducted with several Religious Court Judges and Religious High Court Judges. Meanwhile, observation was conducted in several religious courts and high religious courts. Secondary data came from library data such as Supreme Court decisions on compulsory testaments for non-Muslim heirs. In addition, this library data is also supported by classical books (yellow book), scientific articles, internet websites, etc., related to the research topic. In several of its decisions, this study found that the Supreme Court has carried out modern ijtihad in Islamic inheritance law by providing an alternative law in the form of a compulsory testament for non-Muslim heirs to enjoy the inheritance of Muslim heirs. This alternative law is a product of the ijtihad of judges through the renewal of ijtihad methodology in the context of legal discovery (rechtvinding), which aims to distribute a sense of justice to parties prevented from getting inherited property.  The birth of several Supreme Court decisions, such as decisions number 16 K/AG/2010, 218 K/AG/2016, and 331 K/AG/2018, which provide legal alternatives in the form of compulsory testaments for non-Muslim heirs, is a historical necessity that must be interpreted positively for the sake of future history.

Abstract

This article aims to find and explain several government policies in dealing with Micro, Small and Medium Enterprises (MSMEs) in Indonesia with a review of the problems in the era of the Covid-19 pandemic. This research is a qualitative research approach, namely the statute approach, the case approach, and the philosophical approach. The results showed that the rules put forward by the government aimed to uphold people’s rights, especially in matters of the economy. Based on the review of the issue, this is justified, and indeed MSME assistance from the government is to revive the decline of MSMEs caused by the Covid-19 pandemic. Besides, this policy is also in line with Islamic law’s objectives, such as protecting religion, soul, descent, reason, and property. Keywords: MSMEs, Covid-19, Maslahah, The Purpose of Islamic Law Abstrak Artikel ini bertujuan untuk mencari dan menjelaskan tentang beberapa kebijakan pemerintah dalam penanggulangan Usaha Mikro Kecil dan Menengah (UMKM) di Indonesia dengan tinjauan maslahah di era pandemi Covid-19. Penelitian ini merupakan penelitian kualitatif dengan pendekatan yaitu statute approach, case approach, dan philosophical approach. Hasil penelitian menunjukkan bahwa aturan yang disodorkan oleh pemerintah bertujuan untuk menegakkan hak-hak rakyat khususnya dalam perihal ekonomi. Berdasarkan tinjauan maslahah hal tersebut dibenarkan dan memang bantuan UMKM yang berasal dari pemerintah untuk membangkitkan kembali keterpurukan UMKM yang diakibatkan oleh pandemi covid-19. Selain itu, kebijakan tersebut juga sepaham dengan tujuan-tujuan hukum Islam seperti perlindungan terhadap agama, jiwa, keturunan, akal, dan harta. Abstract

Penelitian ini memaparkan pemikiran Imam Al-Ghazali dalam bidang ekonomi yang dijadikan prinsip dan patokan dasar tentang penerapan sistem ekonomi Islam di Indonesia. Artikel ini bertujuan menganalisis pemikiran ekonomi Islam menurut Imam Al-Ghazali dan melihat relevansi dengan konteks saat ini, khususnya Indonesia. Artikel menggunakan penelitian kualitatif yang bersifat studi kepustakaan. Data-data diambil dari buku, jurnal, laporan penelitian, dan sumber-sumber lain mengenai permasalahan yang dibahas yaitu tentang pemikiran ekonomi Islam menurut Imam Al-Ghazali. Teknik analisis data yang digunakan adalah reduksi data, penyajian data, dan penarikan kesimpulan. Hasil penelitian menunjukkan bahwa kegiatan ekonomi harus berjalan sesuai dengan syariat Islam demi kemaslahatan. Secara umum pemikiran ekonomi Imam Al-Ghazali membahas tentang peranan negara dalam membangun ekonomi seperti dalam aspek makro dan mikro perekonomian. Penerapan sistem ekonomi di Indonesia memaparkan bahwa di dalam kegiatan ekonomi harus berpegangan penuh terhadap Al-Qur’an dan Sunnah sebagai acuan serta pedoman untuk mencapai perekonomian berbasis syariah, seperti pengimplementasian akad-akad hukum ekonomi syariah di perbankan syariah terhadap larangan riba dan penimbunan uang yang menjadikan perekonomian tidak stabil.

Abstract

Nahdlatul Ulama (NU) has been an Islamic political party since its formal separation from Masyumi in 1952. Following this, the NU party maintained a close relationship with President Soekarno, particularly during the period of Guided Democracy, which was marked by the issuance of the Presidential Decree of 5 July 1959. However, NU's acceptance of Guided Democracy and its components was not immediate but involved a process of religious and political ijtihad (independent reasoning) by NU scholars. In this context, NU’s acceptance and support for the concepts of Guided Democracy, Nasakom (Nationalism, Religion, and Communism), and Manipol-Usdek (the Preamble to the 1945 Constitution) were framed through an Islamic approach. This paper aims to explore and analyze NU's siyasah-diniyyah (religious-political ijtihad) regarding these political concepts. This study employs a qualitative research approach, utilizing the historical method, which involves the stages of heuristics, criticism, interpretation, and historiography. Historical sources relevant to the theme of this research were gathered and analyzed. The findings indicate that the siyasah-diniyyah ijtihad of Nahdlatul Ulama represented support for the ideas and political thought of NU’s clerical leaders in responding to President Soekarno's new political system, particularly Guided Democracy, Nasakom, and Manipol-Usdek. NU’s religious and political stance can be seen in the thoughts of KH. Wahab Chasbullah, the Ro’is Syuriah (Chairman) of PBNU, who accepted Guided Democracy as consistent with Islamic teachings and viewed the 1945 Constitution as an embodiment of the Jakarta Charter. Additionally, the perspective of KH Idham Chalid, Chairman of Tahfidziyah PBNU, is also significant, as he contributed to bridging the gap between Guided Democracy and Islam through the concept of shuro, involving experts and emphasizing full responsibility in decision-making.

Abstract

The state policy regulating the concept of syibhul iddah for husbands as outlined in Circular Letter Number: P-005/DJ.III/HK.00.7/10/2021 has sparked debate among religious officials in Indonesia. This paper aims to discuss the chronology of the emergence of the concept of syibhul iddah for husbands and analyse the responses or perspectives of the heads of the Office of Religious Affairs (KUA) in Indonesia. In addition, it also discusses the relevance of the concept of syibhul iddah to the reform of Islamic family law in Indonesia. Methodologically, this research is a juridical-empirical research. Primary data was obtained through interviews with several religious leaders spread across various regions of Indonesia, while secondary data was obtained from reference materials such as scientific articles, scientific books, etc. The data analysis techniques used were data condensation, data presentation, and conclusion drawing. The results of the study show that the state policy through a circular letter regulating syibhul iddah is based on several reasons. First, the prevalence of covert polygamy in society, which can harm women’s rights. Second, as a legal measure to fill the legal vacuum regarding new marriages for husbands during their wives ‘iddah period. Third, as a legal measure to support the spirit of gender equality between men and women in carrying out responsibilities after divorce. However, in its application within the Office of Religious Affairs (KUA), the circular letter still causes differences of opinion among religious leaders in Indonesia. On the one hand, the majority of religious leaders are very responsive and supportive of the issuance of the circular letter. On the other hand, there are a small number of religious leaders who criticise the circular letter.
