Abstract

This study aims to examine the limitations of judges' authority in issuing civil case decisions based on the principle of ultra petitum partium. The main problem in this study is that there are still judges' decisions that exceed the petitum, thus raising questions about the limits of judicial authority and the consistency of the application of the principles of procedural law. The principle of ultra petitum partium is one of the fundamental principles in civil procedural law which emphasizes that judges may not issue decisions beyond the demands of the disputing parties. This principle functions to maintain objectivity, neutrality, and balance in the role of judges in resolving cases. This study uses a normative legal method with a statutory approach and analysis of a number of court decisions directly related to the application of this principle. The results of the study show that the application of this principle is important to prevent abuse of authority by judges. However, in certain conditions such as cases concerning the public interest, public order, or protection of vulnerable parties, judges are allowed to issue decisions exceeding the petitum. Therefore, the application of this principle must be carried out proportionally and contextually in order to create a fair and just trial.

Abstract

This article discusses the architectural history of Rumah Bolon in Pematang Purba Village, Simalungun Regency. Rumah Bolon is a typical Batak traditional house which is usually the residence of the king and his entire extended family. This research uses qualitative research methods, with a historical approach. In the historical approach, there are four writing steps, namely: heuristics, verification or criticism, interpretation, and historiography. Bolon's house is a symbol of the greatness and beauty of Simalungun's distinctive architecture. In its construction, it must go through various kinds of long and strict ceremonies. Not all wood can also be used as raw material for dast in its manufacture. In the Rumah Bolon architecture, the design from top to bottom, has been arranged in great detail. In addition, in the Rumah Bolon building there are also Simalungun colors; red; white; and black. There are also several carvings in Rumah Bolon that symbolize the meanings of greatness, mutual cooperation, and togetherness.

Abstract

Penelitian ini bertujuan untuk mengetahui pertimbangan hukum hakim dalam mengabulkan permohonan dispensasi kawin yang masuk ke Pengadilan Agama, terutama di Era Pandemi Covid 19 yang mana Permohonan dispensasi kawin meningkat secara signifikan sejak akhir tahun 2019 sampai akhir tahun 2022 sekitar 30 % kenaikan setiap tahunnya. Dispensasi Kawin atau keringanan yang diberikan Pengadilan Agama kepada calon mempelai yang belum cukup umur untuk melangsungkan perkawinan diatur dalam pasal 7 ayat (1) Undang-undang No.16 Tahun 2019 Tentang Perkawinan, Perubahan usia minimal 19 tahun pria dan wanita melangsungkan perkawinan menimbulkan ekspektasi yang tinggi dalam rangka meminimalisir pernikahan anak di bawah umur di Indonesia, akan tetapi masih tercantumnya klausul dispensasi kawin  dalam ketentuan Pasal 7 ayat 2 Undang-undang perkawinan memberikan kesan hilangnya ketegasan hukum pemerintah terhadap pengentasan perkawinan dibawah umur. Kemudian dalam ketentuan yang terbaru tidak dicantumkannya mengenai sanksi atau hukuman bagi pasangan yang melangsungkan perkawinan usia muda. perkara dispensasi kawin sangat dilematis dan debatable karena secara simultan perkara tersebut bias nilai, antara kemaslahatan, kemudharatan, dan perilaku masyarakat. penelitian ini menggunakan metode yuridis normatif dengan spesifikasi penelitian prespektif analisis. Penelitian ini sangat penting dibahas karena lebih mengedepankan sebuah teori baru (novelti) mengenai Pendidikan Islam bagi anak bawah umur (the best education of the child) senada juga dengan Slogan “pendidikan untuk  manusia  bukan  manusia untuk  pendidikan” Perspektif Hukum Progresif.

Abstract

This study discusses the practice of engine modification on motorcycles in the Medan Tembung District, specifically at the MRT Garage workshop. The modifications are carried out at the request of customers to increase engine capacity. However, this practice is often considered illegal because it does not comply with safety standards and existing regulations in Indonesia. This study analyzes the phenomenon from the perspective of Sadd Adz-Dzari’ah in Islamic law, which prohibits actions that have the potential to lead to harm, even if initially permitted. The study also examines Indonesian legal regulations such as Government Regulation No. 55 of 2012 and Law No. 22 of 2009, which regulate the technical aspects of motor vehicle modifications. The findings show that such modification practices violate both Islamic law and government regulations, as they cause harm such as vehicle instability and an increased risk of accidents. This study contributes to the understanding of motor vehicle modification regulations from both Islamic and Indonesian positive law perspectives.

Abstract

The aim of this research is to analyze obstruction of justice from a criminal law perspective. The type of legal research method used in this research is a normative research method. The approach methods that will be applied are the Statute Approach and the Case Approach. The data collection technique uses library research (normative legal research) which focuses on secondary data, so the author conducted research on laws and government regulations relating to this research. Data collection tools in normative juridical research come from secondary data with the aim of obtaining concepts, theories and information as well as conceptual thoughts from previous researchers in the form of statutory regulations, scientific works, journals and others. The data analysis technique begins with examining the collected data, then conducting direct and directed interviews, then conducting qualitative data analysis, that is, the data obtained is arranged systematically and then analyzed qualitatively in the form of rules. The results of this research found that the criminal act of obstruction of justice as regulated in the provisions of Article 21 Article 21 of Law no.31 of 1999 Jo Law no. 20 of 2001 concerning Eradication of Corruption Crimes and Article 22 of Law no. 21 of 2007 concerning the Eradication of the Crime of Human Trafficking is a crime in which the perpetrator commits acts by obstructing the justice process against laws that are actually clear and against law enforcement such as giving false information, committing violence, destroying evidence, premeditated crimes and make threats. As stated in Article 221 paragraph (1), the Criminal Code threatens with criminal penalties for anyone who hides or helps someone who commits a crime so that the person avoids investigation or detention. In the criminal act of obstructing the legal process (obstruction of justice) apart from being viewed from the act which contains a mistake on the part of the perpetrator which must be considered as intentional as intended, and the act is clearly in conflict with the applicable laws and regulations then the act can be is said to be a criminal act/criminal act.

Abstract

This study looks at the fairness of restorative justice, the goal of punishment, and the need of legal certainty. According to the study's findings, restorative justice is still only being applied theoretically. In this instance, it emphasizes that the formalistic, long-established ideas of justice that have arisen in society and are applied in Indonesian customary law assemblies serve as the foundation for the genuine aim of sentencing. In contrast, the notions of individual deterrence and general deterrence call for actions to be absolute in order to produce a deterrent impact. Afterward, the idea of reform or rehabilitation was further developed. The use of restorative justice emphasizes the recovery of victims' material losses as a result of the perpetrators' unlawful acts, both physically and psychologically. This is done through a consensus-building process involving the perpetrator, the victim, the perpetrator's family, and the victim's family, as well as, if necessary, the community and the appropriate authorities. With relation to legal norms and values, this research methodology is normative juridical along with theories, legal doctrine, jurisprudence, applicable rules and regulations, as well as pubiications pertinent to the research topic. According to the study's findings, restorative justice is a noble form of justice when instances of illegal behavior have happened. Therefore, repair or restoration is crucial if the victim is to be rehabilitated or healed from the suffering he has endured on a material, physical, or psychic level. To be clear, restorative justice does not apply to all crimes; rather, it only does so in circumstances involving crimes against children, minor offenses, women in conflict with the law, and drug-related offenses. In order to provide clarity, there should be a firmness if the offender does not want to make restitution even though it is deemed capable of doing so in terms of material capabilities. There also needs to be concrete sanctions so that restorative justice is not only limited to other options; the legal framework for it should be expanded to the Constitution.

Abstract

Jual beli merupakan salah satu bentuk interaksi antara orang lain dan dilakukan sebagai upaya orang tersebut untuk mempertahankan dan memenuhi kebutuhan hidupnya. Jual beli, jual beli, melibatkan permasalahan dan kerumitan yang rumit. Jika dilakukan tanpa aturan dan norma yang tepat, bencana, kerugian, dan kerusakan dapat menimpa masyarakat. Penelitian ini bertujuan untuk menganalisis Jual beli yang benar menurut Hukum Islam Agar transaksi penjualan dapat berjalan lancar maka perlu memperhatikan hak dan kewajiban penjual dan pembeli dalam melakukan jual beli. Jenis penelitian ini menggunakan penelitian hukum deskriptif normatif, dengan menggunakan pendekatan konseptual.  Jenis dan sumber bahan adalah Al-Qur’an, dan hadist serta pendapat para ulama tafsir, bahan yang diperoleh dan di analisis secara kualitatif untuk selanjutnya disajikan secara deskriptif.

Abstract

Artikel ini membahas tentang perdebatan para Mujtahid tentang teori maslahah-mursalah, Mayoritas ulama menerima qiyas sebagai sumber hukum Islam yang keempat setelah al-Qur’an, as-Sunnah dan ijma’ para sahabat. Sedangkan metode istinbath hukum yang lainnya, termasuk maslahah-mursalah atau istishlah yang diperkenalkan oleh Imam Malik selalu diperdebatkan, bahkan ditolak oleh mayoritas penganut mazhab asy-Syafi’iyah. Penelitian ini bersifat normatif atau penelitian kepustakaan, yaitu dilakukannya penelitian dengan meninjau bahan pustaka untuk mengetahui bagaimana pendapat para mujtahid tentang teori maslahah mursalah. Hasil dari penelitian ini menurut Jumhur ulama berpendapat bahwa maslahah mursalah hujjah syara’ yang dipakai sebagai landasan penetapan hukum. Karena kejadian tersebut tidak ada hukumnya dalam nash, hadist, ijma’ dan qiyas. Maka dengan ini maslahah mursalah ditetapkan sebagai hukum yang dituntut untuk kemaslahatan umum.

Abstract

The purpose of writing this scientific journal is to find out the regulations and legal protection for investors who suffer losses due to misleading information, which is one of the practices of market manipulation in stock trading in the capital market, viewed from the aspect of legal protection for investors from the perspective of DSN MUI fatwa No. 80 of 2011. Misleading information is a form of market manipulation that can harm investors and requires legal protection. Investors and the public need to know more clearly about market manipulation practices found in the capital market, especially in the Sharia capital market. In the capital market, there is fraud in the form of market manipulation, one form of which is the act of providing misleading information. The research method used in this writing is a normative juridical approach. The normative juridical approach is an approach carried out by examining theories, concepts, legal principles, and statutory regulations related to this discussion. The research results show that in most cases that occur in the capital market, the object is information that can influence securities prices and investment decisions for investors. The practice of misleading information is an activity used to create a false picture regarding buying and selling activities and prices on the stock exchange. This activity is usually carried out by individuals in the capital market with the aim of influencing securities prices and disseminating incomplete and misleading information. Legal protection that can be carried out is preventive and repressive protection. Preventive legal protection is carried out by providing education to the public and monitoring transactions carried out by the Financial Services Authority (OJK), while repressive legal protection includes litigation, non-litigation, and sanctions. Suggestions for future research are that researchers can find research results that lead to examples of preventive and repressive protection that have been implemented in Indonesia.

Abstract

This research aims to examine more deeply the level of divorce cases in young families during the COVID-19 pandemic in 2021 at the Binjai City Religious Court. Specifically, this research aims to answer two problem formulations: (1) the percentage rate of divorce in young families during the pandemic; and (2) the factors that influence the increase in divorce. This research includes qualitative research using a case approach. This type of empirical research uses primary data, namely data from the Religious Court of Binjai City regarding contested divorce in young families and data from the Supreme Court Decision Repository. Secondary data in the form of interviews with Binjai religious court employees, books, journals, and literature regulations related to this research. From this study, the researchers found that divorce cases in young families in 2021 increased compared to the years before the pandemic. The results showed an increase in the percentage of divorce in young families by 15%, namely 408 cases in 2021 compared to 2020, which was only 347 cases. The main factors are economic and psychological pressures due to the pandemic.
