Abstract

This study aims to provide a comparative analysis of the regulatory frameworks governing digital health platforms for telemedicine services in Indonesia and Malaysia. By examining the legal structures, challenges, and opportunities in implementing telemedicine through private digital platforms, the study identifies key differences and similarities between the two countries. The study uses a normative legal approach, combining legislative analysis and comparative law. The study evaluates relevant laws and regulations in both countries, including Law No. 17 of 2023 concerning Health in Indonesia and the Telemedicine Act 1997 in Malaysia. The analysis focuses on platform-based models, such as Halodoc in Indonesia and BookDoc in Malaysia, to assess regulatory compliance, data protection measures, and their implications for healthcare access and patient safety. The findings reveal significant regulatory gaps in Indonesia, particularly regarding legal recognition of private platforms and unclear accountability mechanisms. In contrast, Malaysia's more integrated regulatory framework facilitates smoother collaboration between the public and private sectors. The study concludes with recommendations for policy improvements in Indonesia, emphasizing the need for clearer regulations to ensure legal certainty, patient protection, and service quality in telemedicine practices.

Abstract

Land Ownership in Indonesia, is regulated in Article 5 of the Basic Agrarian Law (UUPA) No. 5 of 1960. UUPA regulates various types of land rights in Indonesia, such as ownership rights, lease rights, use rights, and business use rights. This regulation aims to distribute natural resources, ensure legal certainty over land, and protect the rights of communities affected by land use policies. Meanwhile, Malaysia has a land ownership legal system influenced by British law due to its colonial period. In this context, land law in Malaysia is regulated by various laws, including the National Land Code (NLC) 1965, which regulates land rights, land registration, and land-related rights. In Malaysia, land is divided into several categories of rights, such as freehold and leasehold. The land registration system in Malaysia is more centralized, and land regulations are also implemented through state institutions. Unlike Indonesia, which prioritizes customary rights in land management, Malaysia tends to prioritize national land regulation and administration through a more modern and structured system.

Abstract

Organ transplantation serves as a critical solution for patients in need of organ donors. However, the pressing demand for organs, coupled with donors' economic hardships, has raised concerns about organ transplants being conducted for commercial purposes. This study aims to analyze the legal framework governing organ transplantation and explore the practices observed within society. Using secondary data comprising legislation, scholarly articles, scientific research, and online news reports, this study identifies significant inconsistencies and potential ambiguities within the regulatory framework. Current legal provisions stipulate that organ transplants must be conducted solely for humanitarian purposes and explicitly prohibit commercialization. Yet, government regulations create a loophole by allowing donors to receive awards, which could be exploited for commercial gains. To prevent the commercialization of organ transplants, it is essential to ensure that the relationship between donors and recipients is based on familial or kinship ties. Such relationships foster the principles of voluntariness and altruism, which are central to ethically sound transplantation practices. Strengthening the legal framework to eliminate ambiguities and promoting public awareness about ethical transplantation practices are imperative steps to uphold the integrity of organ donation and transplantation. This study underscores the importance of aligning regulatory frameworks with ethical principles to address the challenges posed by commercialization while ensuring equitable access to life-saving organ transplants.

Abstract

This study describes the problems and solutions related to differentiating sentences for the parallel integration of restorative justice in Indonesian courts. This study is normative-legal research using statute, comparative, and conceptual approaches. This study utilizes primary legal materials and secondary legal materials. This study is based on 25 (twenty-five) cases decided by judges in Indonesian courts. The research results indicate that the values of restorative justice are very relevant to the cultural values of gotong royong in Indonesia. Judges must consider the community’s cultural values and the implementation of restorative justice in their decisions. Parallel integration of justice has been re-applied in Indonesian courts. Still, in practice, judges do not have guidelines for parallel integration, so it is very possible that there will be differences in punishment for applying parallel integration. Therefore, as a solution to the problem of differentiation of sentences, the authors propose 2 (two) concepts of court decisions, namely (1) the verdict of the indictment cannot be accepted, and (2) the decision of the public prosecutor cannot be accepted.

Abstract

The position of children who have special rights in the law makes children get special treatment. In the juvenile justice system in Indonesia, there are two systems of sanctions, namely criminal sanctions and actions, and this is done to realize the protection of children who are dealing with the law.  This research is a normative juridical review, using a statute, comparative and conceptual approaches. The results show that the imposition of sanctions on children is based on the child's age, where children aged 12 to before 14 years can only be sanctioned with actions, and children aged 14 to before 18 years may be subject to criminal sanctions or actions.

Abstract

This study provides an overview of the principles of good governance in health services in Indonesia. This needs to be known considering that health services are a constitutional right for citizens and their services must be carried out as well as possible. Providing health services is a state obligation and getting good and guaranteed health services are the right of citizens. This research is normative-legal research using statute, comparative and conceptual approaches. The results show the principles of good governance in health services that are reflected in the principles of participation, the principles of openness and transparency, the principles of effectiveness and efficiency, and the principles of accountability. Providing health services and covering all health insurance costs for the poor and underprivileged will automatically unconditionally be the responsibility of the government following the mandate of the constitution.

Abstract

Abstract Evidence plays a pivotal role across legal, scientific, and academic domains, serving as the linchpin in distinguishing guilt from innocence. In criminal investigations, it guides law enforcement, unraveling narratives and holding perpetrators accountable. However, with the complexity of crimes, evidence can take various forms, and the clarity of accuracy may be uncertain. This study aims to investigate the diverse types of evidence and sorting procedures crucial for proving crimes. The results of this study indicate that evidence plays a crucial role in determining guilt or innocence, especially in criminal cases. Various evidence types create a nuanced dynamic in proving cases, each with distinct characteristics influencing the proof process. Sorting evidence, whether individually or through comparison, becomes pivotal in identifying the most relevant elements for legal determinations.

Abstract

Child sexual exploitation is a severe violation of human rights that demands a firm and multidimensional legal response. This study aims to identify the underlying causes of child sexual exploitation and to analyze and compare law enforcement practices against such crimes within the legal systems of Indonesia and Malaysia. The research employs a normative juridical method with a comparative law approach. The findings reveal that the contributing factors in both countries include weak legal enforcement, socio-economic vulnerability, misuse of digital technology, and prevailing cultural norms. In terms of punishment, Indonesia has introduced chemical castration as an additional sanction under Government Regulation No. 70 of 2020, while Malaysia imposes imprisonment and caning based on the Penal Code and the Child Act 2001. Despite having comprehensive legal frameworks, Indonesia continues to face challenges in implementation, such as inadequate law enforcement sensitivity and insufficient psychosocial support for victims. The comparative analysis indicates that legal effectiveness relies not only on statutory provisions but also on institutional commitment to uphold justice and child protection.

Abstract

The children of terrorism perpetrators are indirect victims of acts of terrorism committed by their parents. They often face stigmatization, discrimination, and bullying within their communities. Under the Child Protection Law, the children of terrorism offenders are categorized as children who are victims of terrorist networks and therefore require special protection. This study aims to identify the ideal concept of legal protection for children of terrorism offenders against acts of bullying. The research method used is normative juridical with a statute approach, comparative approach, and conceptual approach. The findings show that optimizing legal protection for children of terrorism offenders against bullying should focus on both preventive and repressive measures. Preventive actions to protect children of terrorism perpetrators from bullying. Repressive measures include optimizing the roles of the National Counterterrorism Agency (BNPT), relevant ministries, and institutions through coordinated actions to address the needs and protection of children of terrorism perpetrators.

Abstract

Abstract Revenge Porn is booming among children or high school students who meet. More than that, there are rules for revenge porn itself in the laws and regulations. Therefore, there is a need for further research on revenge porn as a crime, the regulation of revenge porn is reviewed by Law Number 11 of 2008 concerning Information and Electronic Transactions and Law Number 12 of 2022 concerning the Crime of Sexual Violence, and to know the reporting procedure when there is a porn revenge case. The research method used is normative research with an approach to laws and regulations. The data collection method used in this research is literature study. The results of this study indicate that revenge porn is a crime if there is an intention of the perpetrator to take revenge on the victim due to several factors such as the hurt experienced by the perpetrator. In addition, there can also be coercion and extortion that can aggravate the perpetrator when it is reported by the victim. In the ITE Law, there is a provision for revenge porn which is contained in Article 27 Paragraph (3). The relevance between the ITE Law and TPKS is the opening of electronic devices in the ITE Law that can be used for the needs of victims in reporting victim evidence with the TPKS Law. The procedure for reporting porn revenge cases can be seen in the Regulation of the Head of the Indonesian Police Number 6 of 2019 concerning Criminal Investigations.
