Abstract

In criminal justice, forensic autopsies play a critical role in determining the cause and manner of death. Current provisions are unclear, leading to inconsistencies in the criminal investigation process. This study examines weaknesses in Indonesian law, particularly the ambiguity in regulating forensic autopsies, the obligation to conduct autopsies in suspected criminal deaths, and the procedures for notifying the victim's family. This study aims to provide an interpretation of the legal regulations concerning autopsies and to formulate regulatory reforms related to the conduct of autopsies in criminal investigation processes. The results of this study indicate that in criminal investigations, autopsies are crucial for determining the cause and manner of death, as well as providing scientific evidence linking the perpetrator's actions to the victim's death. However, ambiguity in interpreting the obligation to conduct autopsies under Article 134 of the Criminal Procedure Code (KUHAP) leads to inconsistencies. To address this, clear regulations are needed to define when an autopsy is considered "very necessary," providing consistent guidance to investigators. Mandatory autopsies for all unnatural deaths would ensure thorough examinations. While families must be informed, their consent is not required, and obstructing an autopsy is a criminal offence, supported by Article 222 of the Criminal Code, as amended by Article 283 of Law No. 1 of 2023 concerning the Criminal Code.

Abstract

The increasing incidence of serious crimes committed by juveniles, particularly murder, raises concerns about the adequacy of Indonesia’s juvenile justice system, which emphasizes rehabilitation over retribution. In contrast, the United States applies the "trial as an adult" concept, allowing juveniles to be tried in adult courts under specific conditions. This study employs a normative legal method using statute and comparative approaches to examine the potential application of this concept in Indonesia. It compares Indonesia's child protection-oriented framework with the U.S. waiver of jurisdiction mechanism. The findings reveal a legal gap in Indonesia’s system for handling grave offenses by juveniles, which often fails to provide substantive justice for victims. Therefore, the study proposes a hybrid judicial model that balances child protection with victim justice by introducing a dual-track court system and proportional sentencing tailored to juvenile maturity and offense severity

Abstract

This research analyzes the legal development of Islamic banking in Indonesia and Malaysia through a comparative law approach. Islamic banking has become an important component of the global financial system, yet its growth varies across countries. Indonesia's Islamic banking industry, while experiencing significant progress in recent years, still faces regulatory and institutional challenges. In contrast, Malaysia has emerged as a global hub for Islamic finance due to its integrated regulatory framework, strong government support, centralized Shariah compliance system, and established human resource development. This study employs normative legal research using primary and secondary legal sources, and applies comparative legal theory. The findings highlight the importance of legal harmonization, centralization of fatwa authorities, active government involvement, and comprehensive infrastructure development in supporting the growth of Islamic banking. Lessons from Malaysia's experience can serve as valuable references for Indonesia to enhance its Islamic banking industry and improve its competitiveness in the global market.

Abstract

Copyright royalties as an economic object in intellectual property are of particular concern in family law, especially when associated with their status as joint property in marriage. This study aims to examine and compare how the Indonesian and Malaysian legal systems regulate the distribution of copyright royalties in the context of divorce. In Indonesia, the concept of joint property is regulated in Law Number 1 of 1974, which was updated by Law Number 16 of 2019, as well as in the Compilation of Islamic Law. Meanwhile, in Malaysia, different Islamic family laws between states provide a basis for the division of joint property, including royalties, by considering the contribution of the spouse. This study uses a normative-comparative approach through literature study and analysis of legal documents. It was found that despite the differences in legal systems, both countries in principle recognize copyright royalties as part of joint property if they meet certain requirements, especially regarding the time of acquisition and the contribution of the spouse. This study emphasizes the importance of the principle of justice in the division of intangible assets in the context of a household.

Abstract

This study discusses the comparison of labor law between Indonesia and Malaysia, focusing on the regulation of employment relations, worker protection, wage systems, and outsourcing practices. Indonesia, through Law Number 6 of 2023, strengthens labor regulations by emphasizing worker protection, whereas Malaysia, through the Employment Act 1955, emphasizes flexibility in employment relationships with minimum protection. This research uses normative legal research methods and a comparative law approach. The results show that Indonesia prioritizes structural and formal worker protection, while Malaysia emphasizes administrative efficiency. This study recommends strengthening worker protection in both countries and the need for harmonization of labor standards within the ASEAN region.

Abstract

This study discusses the comparison of green economic policies implemented between Indonesia and Malaysia in supporting inclusive sustainable national development, which is examined normatively through a comparative study approach. Indonesia, through Law No. 30 of 2007 on Energy, Law No. 21 of 2014 on Geothermal Energy, and other regulations, has established a national green program encompassing environmental quality improvement, disaster resilience and climate change mitigation, low-carbon development, and renewable energy development as pillars of national development. Meanwhile, Malaysia's National Energy Policy 2022-2040 and other regulations stipulate that a green economy can be achieved through economic development, the utilization of sustainable energy resources, and environmental quality. Research findings indicate that Indonesia has not maximized the implementation of a green economy due to the ease of business permits granted to investors and limited regulations within specific scopes, while Malaysia has established more complex regulations regarding green investments, ensuring that permits are not issued arbitrarily.

Abstract

The selection of the head of government is a fundamental aspect of the constitutional system that reflects the political and legal character of a state. Although Indonesia and Malaysia share similar historical roots, they adopt significantly different systems of governance. This study addresses two core issues which are about the structure and mechanism of executive and legislative power, and the impact of the presidential threshold and parliamentary coalition on governmental stability. Using a normative juridical method with statutory and comparative approaches, the findings reveal that Indonesia, under a presidential system, applies a nomination threshold to ensure political stability, yet it may restrict political access. Meanwhile, Malaysia’s parliamentary system is more flexible but vulnerable to instability due to coalition dynamics. This study recommends a reassessment of Indonesia’s presidential threshold for a more democratic process and strengthening of political stability mechanisms in Malaysia.

Abstract

The intensification of economic relations between both countries, reaching USD 19.2 billion in 2022, creates an urgent need for effective and predictable dispute resolution mechanisms. Employing normative juridical methods with comparative legal approach, this study examines the arbitration legal framework of both countries through comprehensive analysis of Indonesia's Law No. 30/1999 and Malaysia's Arbitration Act 2005. The findings reveal fundamental differences in philosophical approaches, where Indonesia implements a hybrid system integrating UNCITRAL Model Law with civil law characteristics and national legal values, while Malaysia adopts a direct adoption approach with minimal intervention principles. Significant disparities are identified in arbitrability concepts, formal requirements for arbitration agreements, and award enforcement mechanisms. Indonesia applies a restrictive approach with intensive court supervision, whereas Malaysia employs a liberal approach with an integrated system. Institutional capacity differences between BANI and AIAC also create challenges in harmonizing bilateral arbitration practices. This research recommends developing bilateral arbitration protocols, establishing joint arbitration panels, and harmonizing legal frameworks to enhance the effectiveness of Indonesia-Malaysia commercial dispute resolution. Abstrak: Intensifikasi hubungan ekonomi kedua negara yang mencapai USD 19,2 miliar pada tahun 2022 menciptakan kebutuhan mendesak akan mekanisme penyelesaian sengketa yang efektif dan dapat diprediksi. Menggunakan metode yuridis normatif dengan pendekatan perbandingan hukum, penelitian ini mengkaji framework hukum arbitrase kedua negara melalui analisis komprehensif terhadap UU No. 30/1999 Indonesia dan Arbitration Act 2005 Malaysia. Hasil penelitian mengungkapkan perbedaan fundamental dalam pendekatan filosofis, dimana Indonesia menerapkan sistem hibrida yang memadukan UNCITRAL Model Law dengan karakteristik civil law dan nilai hukum nasional, sementara Malaysia mengadopsi pendekatan adopsi langsung dengan prinsip minimal intervention. Disparitas signifikan teridentifikasi dalam konsep arbitrabilitas, persyaratan formal perjanjian arbitrase, dan mekanisme pelaksanaan putusan. Indonesia menerapkan pendekatan restriktif dengan pengawasan pengadilan intensif, sedangkan Malaysia menggunakan pendekatan liberal dengan sistem terpadu. Perbedaan kapasitas institusional antara BANI dan AIAC juga menciptakan tantangan dalam harmonisasi praktik arbitrase bilateral. Penelitian ini merekomendasikan pengembangan protokol arbitrase bilateral, pembentukan panel arbitrase bersama, dan harmonisasi kerangka hukum untuk meningkatkan efektivitas penyelesaian sengketa komersial Indonesia-Malaysia. Abstract

The development of the global financial system has encouraged various countries to adopt bullion banks as an alternative to the gold-based financial system. However, in Indonesia, the concept of bullion banks is still relatively new and does not yet have a clear legal framework. This study aims to examine the need for bullion bank regulation in Indonesia and to assess the suitability of the national legal framework with international practices. The method used is normative juridical with a statutory approach and comparative studies. The results of the study show that Indonesia does not yet have specific regulations regarding bullion banks, which has the potential to cause legal uncertainty for business actors and investors. Therefore, it is necessary to formulate comprehensive regulations to regulate bullion bank activities specifically to support the stability of the national financial system. This study recommends that policy makers immediately formulate regulations related to bullion banks by referring to best practices in other countries.

Abstract

Forced marriage of child victims of rape is a phenomenon that places children in a position of double victimization, both as victims of sexual crimes and as subjects who lose their human rights to determine their future freely and with dignity. This research aims to examine forced marriage in the framework of sexual violence against children from the perspective of criminal law and human rights. In its approach, this research uses a normative juridical method with a statutory approach, conceptual approach, comparative approach, and case approach. The results show that forced marriage not only violates children's rights to protection from sexual violence as stipulated in Law Number 12 of 2022 concerning Criminal Acts of Sexual Violence, but also violates the principles of non-discrimination, the best interests of the child, and the right to physical and psychological integrity as guaranteed in the Convention on the Rights of the Child (CRC) and other international human rights instruments. This research emphasizes the importance of legal recognition of forced marriage as a form of sexual violence and the need for a comprehensive policy in the handling and recovery of child victims.
