Abstract

Child sexual exploitation is a severe violation of human rights that demands a firm and multidimensional legal response. This study aims to identify the underlying causes of child sexual exploitation and to analyze and compare law enforcement practices against such crimes within the legal systems of Indonesia and Malaysia. The research employs a normative juridical method with a comparative law approach. The findings reveal that the contributing factors in both countries include weak legal enforcement, socio-economic vulnerability, misuse of digital technology, and prevailing cultural norms. In terms of punishment, Indonesia has introduced chemical castration as an additional sanction under Government Regulation No. 70 of 2020, while Malaysia imposes imprisonment and caning based on the Penal Code and the Child Act 2001. Despite having comprehensive legal frameworks, Indonesia continues to face challenges in implementation, such as inadequate law enforcement sensitivity and insufficient psychosocial support for victims. The comparative analysis indicates that legal effectiveness relies not only on statutory provisions but also on institutional commitment to uphold justice and child protection.

Abstract

The children of terrorism perpetrators are indirect victims of acts of terrorism committed by their parents. They often face stigmatization, discrimination, and bullying within their communities. Under the Child Protection Law, the children of terrorism offenders are categorized as children who are victims of terrorist networks and therefore require special protection. This study aims to identify the ideal concept of legal protection for children of terrorism offenders against acts of bullying. The research method used is normative juridical with a statute approach, comparative approach, and conceptual approach. The findings show that optimizing legal protection for children of terrorism offenders against bullying should focus on both preventive and repressive measures. Preventive actions to protect children of terrorism perpetrators from bullying. Repressive measures include optimizing the roles of the National Counterterrorism Agency (BNPT), relevant ministries, and institutions through coordinated actions to address the needs and protection of children of terrorism perpetrators.

Abstract

Abstract Revenge Porn is booming among children or high school students who meet. More than that, there are rules for revenge porn itself in the laws and regulations. Therefore, there is a need for further research on revenge porn as a crime, the regulation of revenge porn is reviewed by Law Number 11 of 2008 concerning Information and Electronic Transactions and Law Number 12 of 2022 concerning the Crime of Sexual Violence, and to know the reporting procedure when there is a porn revenge case. The research method used is normative research with an approach to laws and regulations. The data collection method used in this research is literature study. The results of this study indicate that revenge porn is a crime if there is an intention of the perpetrator to take revenge on the victim due to several factors such as the hurt experienced by the perpetrator. In addition, there can also be coercion and extortion that can aggravate the perpetrator when it is reported by the victim. In the ITE Law, there is a provision for revenge porn which is contained in Article 27 Paragraph (3). The relevance between the ITE Law and TPKS is the opening of electronic devices in the ITE Law that can be used for the needs of victims in reporting victim evidence with the TPKS Law. The procedure for reporting porn revenge cases can be seen in the Regulation of the Head of the Indonesian Police Number 6 of 2019 concerning Criminal Investigations.

Abstract

Abstract Apart from the many conveniences that are felt, of course there are also negative effects from the current rapid development of technology, the rise of hate comments that occur on social media is a form of the negative impact of current technological developments. This journal was created with the aim of studying the meaning of hate comments and researching the regulations in Indonesia that regulate hate comments, and to understand more about the impact of hate comments so that hate comments can be reduced. This study uses the literature study research method in which the author seeks data and information from various types of references such as documents, both written documents, documents in the form of photographs, documents in the form of images, and documents in electronic form that can be used as sources in research process. It can be concluded that hate speech is a word, deed, writing or action that can lead to acts of violence that demean the dignity of fellow human beings, resulting in stigma from those who commit or are called perpetrators or those who are victims of these actions. hate comments that are often carried out on social media are included in hate speech. Indonesia has several regulations governing hate comments including the ITE Law, the Criminal Code, and the Chief of Police Circular Number: SE/06/X/2015 concerning Handling Hate Speech. Abstract

Untuk memberikan pemahaman yang lebih mendalam mengenai pencegahan perundungan, sikap disiplin, dan tanggung jawab diperlukan adanya pemberian edukasi yang tepat dan terarah kepada peserta didik. Edukasi dengan cara edukasi menjadi salah satu langkah untuk mencegah adanya kasus perundungan khususnya di SDN Rawa Barat 05 Pagi, edukasi ini melibatkan 30 peserta didik. Pengabdian ini menggunakan metode ceramah, edukasi, dan diskusi yang berjudul Edukasi Sadar Hukum Terhadap Bullying Serta Pendidikan Disiplin dan Tanggung Jawab. Target dari pengabdian ini adalah siswa Sekolah Dasar yang duduk di kelas 4 dan kelas 5. Adapun tujuan dari pengabdian ini adalah untuk membentuk sikap disiplin serta tanggung jawab agar tindakan perundungan di sekolah diminimalisasi. Peningkatan pemahaman peserta didik dapat dilihat dari hasil posttest yang memperlihatkan peserta didik dapat memahami materi yang dibawakan.

Abstract

The role of autopsik expert witnesses is very important in the process of proving criminal cases, especially murder. The process of examining criminal cases in court, there must be two valid pieces of evidence as a minimum standard. In relation to murder cases, judges need autopsik experts to find out the causes of a crime. The autopsik expert's testimony in the Visum et Repetrium plays an important role in deciding a criminal case, because it contains information about the causes that are the result of murder.

Abstract

Human organ transplantation has become a prominent topic alongside the advancement of law and technology. Through the transplantation process, an individual may obtain an organ from another person. This study aims to examine the debate between humanitarian principles and economic considerations in the practice of organ transplantation, as well as the legal framework governing organ transplantation in Indonesia. This study is a doctrinal legal study employing conceptual and statutory approaches, and using secondary legal materials analysed qualitatively to address the central issues concerning the discourse on organ transplantation in Indonesia. The findings indicate that human organ transplantation remains ethically complex, as economic pressures and poverty often influence consent, leading to exploitation and commercialisation. Despite existing legal prohibitions, the tension between humanitarian objectives and economic necessity persists, revealing gaps in ensuring voluntary donation, fairness, and the protection of human dignity. The Government of Indonesia, through Law Number 17 of 2023 on Health (Articles 124 to 134) and Government Regulation Number 28 of 2024 (Articles 325 to 381), stipulates the procedures, medical requirements, and ethical and legal aspects of organ transplantation for humanitarian and health recovery purposes, while explicitly prohibiting any form of commercialisation.

Abstract

Salah satu kendala dalam pembuktian kasus kekerasan seksual yaitu minimnya alat bukti karena tempat terjadi perkara berada di area privat. Tulisan ini bertujuan menganalisis kerangka regulasi dalam pengaturan psikologi forensik sebagai alat bukti bagi perkara kekerasan seksual terhadap anak dan kekuatan pembuktiannya. Metode yang digunakan dalam tulisan ini pendekatan perundang-undangan yang menganalisis secara deduktif-induktif mengenai pengaturan psikologi forensik dalam hukum positif di Indonesia dan kekuatan pembuktiannya. Dalam konteks kekerasan seksual, kehadiran psikologi forensik membawa prespektif berbeda bahwa modus kekerasan atau ancaman kekerasan seksual tidak hanya berbentuk kekerasan yang bersifat fisik namun dapat berupa intimidasi fisik yang mempengaruhi psikis korban. Berdasarkan hasil penelitian secara implisit KUHAP maupun beberapa undang-undang mengatur mengenai penggunaan psikologi forensik sebagai alat bukti. Mengacu pada Pasal 24 ayat (3) UU TPKS hasil pemeriksaan psikologi forensik dikategorikan sebagai alat bukti surat. Keterangan satu saksi dan/atau korban disertai dengan hasil pemeriksaan forensik cukup untuk membuktikan kesalah terdakwa. Namun dalam praktek peradilan, sebelum UUTPKS disahkan masih ditemukan hakim yang tidak mengimplementasikan psikologi forensik sebagai instrumen untuk membantu hakim dalam membuktikan kekerasan seksual terhadap anak dan memidana pelakunya. Berdasarkan hasil penelitian agar kedepannya dibuat kebijakan teknis di lingkungan masing-masing institusi penegak hukum untuk dapat mengoptimalkan penggunaan psikologi forensik dalam proses peradilan.

Abstract

Forensic Psychology contributes to interpreting how psychological factors can influence a criminal act because Forensic Psychology has a crucial role in assessing the criminal responsibility of a perpetrator. The purpose of this study is to analyze how the results of forensic psychological examinations are used in the process of proving criminal cases and to what extent these results influence the judge's decision in determining the defendant's criminal responsibility. The research method used is a normative legal approach, by examining the provisions of the Criminal Code, the Criminal Procedure Code, and other related regulations, and supported by a case approach to court decisions involving perpetrators with indications of mental disorders. The position of forensic psychological examination results in the criminal law evidence system in Indonesia is in an important position, but is not yet fully strong normatively. The results of Forensic Psychological examinations have a significant influence on the determination of criminal responsibility by the judge, although their nature is not absolutely binding. The testimony of Forensic Psychological experts is one of the important considerations in determining whether or not there is an element of fault in the perpetrator, especially in the context of the principle of geen straf zonder schuld (no crime without fault).

Abstract

This article examines the constitutional implications of the Indonesian Constitutional Court Decision No. 83/PUU-XXI/2023 on the use of digital forensics in criminal tax enforcement. The decision restricts the preliminary evidence examination under Law No. 7 of 2021 on Tax Harmonization by prohibiting coercive measures, thereby creating significant legal dilemmas for the Directorate General of Taxes (DGT) in investigating tax crimes classified as white-collar offenses. The legal challenge emerges from the temporal and evidentiary vulnerability of digital evidence, which requires immediate acquisition during preliminary examination to maintain data integrity and admissibility. Unlike traditional evidence, digital data can be readily altered, deleted, or manipulated if acquisition is delayed until the investigation phase. The Court's restrictive interpretation of preliminary examination authority consequently diminishes the DGT's practical capacity to employ digital forensic techniques essential for uncovering sophisticated tax evasion schemes, particularly those involving aggressive tax planning and Base Erosion and Profit Shifting (BEPS) strategies. The article employs normative legal research methodology with statutory and conceptual approaches to analyze the decision's impact on tax crime enforcement effectiveness. Findings indicate that post-constitutional interpretation, the DGT's usage of digital forensic investigation has declined substantially, with investigating officers (PPNS) hesitant to utilize these methodologies due to heightened vulnerability to pre-trial objections regarding alleged coercive conduct. The study recommends explicit statutory codification of digital forensic activities within the framework of preliminary examination to clarify their legitimacy, protect investigating officers from legal challenge, and maintain the efficacy of tax law enforcement while respecting constitutional protections.
