Abstract

This article discusses the comparative law between Indonesia and Malaysia regarding bankruptcy of inheritance left by a deceased testator. In Indonesia, Bankruptcy of Inheritance and Responsibility of Heirs Based on the "Burgerlijk Wetboek", with 2 (two) main issues, namely bankruptcy petitions based on debts from the testator and the responsibility of heirs who have received inheritances from deceased debtors. The main focus of this discussion is how each country regulates the possibility of inheritance being declared bankrupt, as well as the position of the heirs in the bankruptcy process. The method used in this study is normative juridical with a comparative law approach. The results of the analysis show that although Indonesia and Malaysia have similar legal system roots (civil law influenced by the Netherlands and England), there are differences in principle in the treatment of bankruptcy of inheritance. Indonesia allows bankrupt inheritance assets to be subject to bankruptcy under certain conditions, while Malaysia emphasizes the inheritance administration process without a formal bankruptcy approach. This study is important to provide an understanding for legal practitioners in dealing with inheritance dispute cases burdened with debt.

Abstract

Pretrial proceedings play a strategic role in Indonesia's criminal justice system as a judicial oversight mechanism to ensure the legality of law enforcement actions and the protection of suspects’ human rights. In corruption cases, however, pretrial motions are often exploited as procedural loopholes to invalidate ongoing investigations due to the absence of rigid legal standards and inconsistent interpretations by judges sometimes extending into the merits of the case, which should fall outside the scope of pretrial jurisdiction. This study examines the ideal concept of pretrial review using a normative juridical approach, emphasizing the due process of law principle, the primacy of lex specialis under Article 26A of the Anti-Corruption Law, and its harmonization with the Criminal Procedure Code (KUHAP). The research concludes that pretrial mechanisms should function solely as limited judicial review, restricted to evaluating procedural legality. Additionally, the study highlights the significance of establishing Preliminary Examination Judges (Hakim Pemeriksa Pendahuluan) as proposed in the Draft Criminal Procedure Code. These judges would proactively supervise investigative actions, ensuring procedural compliance and minimizing the misuse of pretrial remedies by corruption suspects. Strengthening normative frameworks and judicial guidelines is thus essential to foster coherent, fair rulings and support the integrity and effectiveness of anti-corruption law enforcement.

Abstract

This study examines the legal standing of DNA evidence as a sole means of proof within the criminal justice systems of Indonesia and the United States. DNA, known for its scientific reliability and high accuracy in identifying perpetrators, has received substantial recognition in the United States. Under the “beyond a reasonable doubt” standard, DNA evidence in the U.S. can independently substantiate a conviction and serve as the sole basis for a guilty verdict. In contrast, Indonesia's evidentiary framework remains governed by the negatief wettelijk principle, which requires at least two valid pieces of evidence supported by the judge’s conviction to establish criminal liability. As a result, DNA evidence in Indonesia is generally considered corroborative rather than conclusive and cannot stand alone in court. This research adopts a normative juridical method, combining statutory analysis and conceptual interpretation to assess the legal treatment of DNA evidence in both jurisdictions. The findings emphasize the urgent need for Indonesia to reform its criminal procedure law to accommodate modern scientific evidence, such as DNA, as primary proof in specific cases. Recommendations include amending provisions in the Indonesian Criminal Procedure Code (KUHAP), enhancing forensic infrastructure, strengthening legal regulations, and improving the capacity of law enforcement personnel. With appropriate procedural safeguards and human rights protections, DNA evidence holds significant potential to be recognized as standalone proof within Indonesia’s criminal justice system. Abstract

The purpose of this study is to examine the exploitation of natural resources by State-Owned Enterprises (SOEs), particularly in forest management and mining, which do not contribute to the prosperity of the people. The scope of this research focuses on SOEs that control vital natural resources affecting the livelihoods of many people. This research employs a normative juridical method with a historical approach to privatization and an analysis of John Ruggie’s principles regarding Government and Private Responsibility for Human Rights (“Protect, Respect and Remedies”), as well as collecting data as library research.  The findings indicate that such exploitation is carried out by SOEs (with share-persero) as a result of the privatization in the 1980s and 1990s, leading to liberalization. The study of John Ruggie’s principles highlights the obligation of both the State and SOEs to prevent the exploitation of natural resources. The study concludes that the SOE engaged in resource management operate as “persero” entities, with shares partially owned by the private sector, leading to unfair business competition. Article 33 (2) and (3) of the Constitution mandates that natural resource management should be carried out by SOEs of which ownership is 100% by the State (“perum”) or through Cooperatives, as stipulated in Article 33 of the Constitution. The authors have proposed the liberalization results in the of SOEs (Persero), enabling private management, which raises concerns over monopolistic practices, unfair competition, and rationally impacts the potential of natural resources based on privatization and liberalization factors.

Abstract

Melalui PERMA No.14 Tahun 2019, Mahkamah Agung (MA) memperbaharui hukum terkait gugatan sederhana, salah satu isinya merubah total nilai kerugian materi yang bisa diterima pada gugatan sederhana maksimal jadi 500 juta rupiah. Bagi pelaku usaha serta konsumen yang bersengketa perdata umum utamanya pada jalannya perjanjian yang terganggu sebab ada sejumlah pihak yang tidak bisa mencukupi prestasi atau kewajiban kontraktualnya dengan mendalilkan keadaan memaksa (force majeure) menjadi angin segar. Force majeure baik dalam hukum perjanjian Indonesia maupun Malaysia memicu sebuah sengketa kontrak yang berlangsung mesti dinilai sesuai kasus per kasus serta memfokuskan kesesuaiannya dengan beragam aturan yang berlaku. Sehingga gugatan sederhana dapat dilakukan sebagai upaya efektif dikarenakan durasi penuntasan yang cepat serta murah. Gugatan Sederhana di Malaysia di kenal dengan nama “Small Claims Procedure” dijalankan sejak 2012 hingga sekarang, dengan total maksimal kerugian materi yang diterima 5000 RM. Dengan melihat komparasi hukum terkait gugatan sederhana antara Indonesia dan Malaysia maka bakal tampak bahwa gugatan sederhana yang dijalankan di Indonesia lebih baik pada hal total nilai kerugian materi yang bisa diterima serta kecepatan prosesnya. Karenanya, kelebihan tata cara gugatan sederhana ini mesti diberdayakan dengan masif dan berkelanjutan lewat seminar, webminar, talkshow, penulisan artikel, jurnal oleh pemerintah, akademisi, praktisi hukum, pemilik usaha, atau oleh siapapun” agar jadi budaya hukum pilihan utama saat menjalani sengeketa perdata umum dengan kerugian tertentu.

Abstract

Currently, nutritional problems in Indonesia are still in the spotlight, one of which is the problem of stunting in toddlers. The government shows its commitment to tackling stunting by making regulations regarding the acceleration of stunting reduction as stated in Presidential Regulation No. 72 of 2021. The health financing system is an effort to fund the health sector to support the implementation of health with the aim of achieving the highest health status. This study aims to provide an overview of the Bekasi City government's policy in financing stunting prevention in Bekasi City. The research method used is normative juridical, with a statutory approach. The policies issued by the Bekasi City Government regarding the Prevention and Control of Stunting are contained in the Bekasi Mayor's Instruction No: 440/1914/Bappeda and the establishment of the Task Force for the Acceleration of Stunting Prevention and Control is contained in Decree Number: 440/Kep.277-Bappelitbangda/V/ 2020. The results of this study show that the participation of the Bekasi City government has been very good from issuing policies related to stunting reduction efforts, forming and implementing 8 integration actions by involving multi-sectoral roles in government which is an effort to prevent stunting. The financing used in the stunting prevention process is funded by the Bekasi City Government from the Regional Revenue and Expenditure Budget (APBD) and or other funds that can be utilized by the relevant government sector to be in charge of 8 integration actions.

Abstract

Investigative journalism plays a crucial role in upholding democratic values by exposing legal violations, corruption, and systemic injustices within Indonesia’s criminal justice system. However, various challenges, including political interference, restrictive legislation, and threats to press freedom, hinder its effectiveness. This study aims to analyse the impact of investigative journalism on legal reforms in Indonesia, focusing on its role in uncovering miscarriages of justice, judicial corruption, and human rights violations. Employing a qualitative research approach, this study utilises a case study method to examine high-profile cases. Data collection involves reviewing secondary sources, including investigative reports, legal documents, and media coverage. This study indicate that investigative journalism has significantly contributed to legal reforms by exposing judicial corruption, wrongful convictions, and abuses of power. Key cases such as Sengkon and Karta, Baiq Nuril, Artalyta Suryani, Munir, and Ferdy Sambo illustrate how media exposure generates public pressure, prompting institutional accountability and policy changes. Despite ongoing challenges including legal intimidation, defamation laws, and press freedom constraints investigative journalism remains a critical instrument for democratic oversight and legal transformation. Compared to other jurisdictions, Indonesia’s legal framework remains inadequate in safeguarding journalistic freedom and press independence.

Abstract

Sikap bela negara itu sendiri merupakan kekuatan Negara Indonesia bagi proses pembangunan nasional menuju tujuan nasional dan merupakan kondisi yang harus diwujudkan agar proses pencapaian tujuan nasional tersebut dapat berjalan dengan sukses. Oleh karena itu, diperlukan suatu konsepsi ketahanan nasional yang sesuai dengan karakteristik bangsa Indonesia. Dengan adanya kesadaran akan Bela Negara, kita harus dapat memiliki sikap dan prilaku yang sesuai kejuangan, cinta tanah air serta rela berkorban bagi nusa dan bangsa. Dalam kaitannya dengan pemuda penerus bangsa sangat penting ditanamkan sikap cinta tanah air sejak dini sehingga kecintaan mereka terhadap bangsa dan negara lebih meyakini dan lebih dalam. Sumber daya manusia menjadi titik sentral potensi bangsa yang berperan melaksanakan pembangunan dan mengatasi segala bentuk ancaman, baik dari dalam ataupun dari luar negeri. Pertengkaran antar pelajar menjadi perhatian utama dalam lingkungan pendidikan di berbagai negara. Oleh sebab itu, Adapun kegiatan yang akan dilaksanakan antara lain penguatan Bela Negara; sosialisasi Peraturan Perundang-Undangan Pidana; dan pelaksanaan model pembelajaran Role Play. Kegiatan penguatan bela negara yang dilaksanakan di tingkat SMA terbukti berhasil mencapai tujuan yang ditetapkan, ditandai dengan meningkatnya pemahaman dan kesadaran siswa terhadap pentingnya peran mereka dalam menjaga keutuhan bangsa. Kegiatan ini juga mendapat respons positif dari para peserta, guru, dan pihak sekolah, yang menilai bahwa materi serta metode yang digunakan mampu membangkitkan semangat nasionalisme dan tanggung jawab sebagai warga negara.

Abstract

Land Ownership in Indonesia, is regulated in Article 5 of the Basic Agrarian Law (UUPA) No. 5 of 1960. UUPA regulates various types of land rights in Indonesia, such as ownership rights, lease rights, use rights, and business use rights. This regulation aims to distribute natural resources, ensure legal certainty over land, and protect the rights of communities affected by land use policies. Meanwhile, Malaysia has a land ownership legal system influenced by British law due to its colonial period. In this context, land law in Malaysia is regulated by various laws, including the National Land Code (NLC) 1965, which regulates land rights, land registration, and land-related rights. In Malaysia, land is divided into several categories of rights, such as freehold and leasehold. The land registration system in Malaysia is more centralized, and land regulations are also implemented through state institutions. Unlike Indonesia, which prioritizes customary rights in land management, Malaysia tends to prioritize national land regulation and administration through a more modern and structured system.

Abstract

Organ transplantation serves as a critical solution for patients in need of organ donors. However, the pressing demand for organs, coupled with donors' economic hardships, has raised concerns about organ transplants being conducted for commercial purposes. This study aims to analyze the legal framework governing organ transplantation and explore the practices observed within society. Using secondary data comprising legislation, scholarly articles, scientific research, and online news reports, this study identifies significant inconsistencies and potential ambiguities within the regulatory framework. Current legal provisions stipulate that organ transplants must be conducted solely for humanitarian purposes and explicitly prohibit commercialization. Yet, government regulations create a loophole by allowing donors to receive awards, which could be exploited for commercial gains. To prevent the commercialization of organ transplants, it is essential to ensure that the relationship between donors and recipients is based on familial or kinship ties. Such relationships foster the principles of voluntariness and altruism, which are central to ethically sound transplantation practices. Strengthening the legal framework to eliminate ambiguities and promoting public awareness about ethical transplantation practices are imperative steps to uphold the integrity of organ donation and transplantation. This study underscores the importance of aligning regulatory frameworks with ethical principles to address the challenges posed by commercialization while ensuring equitable access to life-saving organ transplants.
