Abstract

The election of the President and Vice President serves as a fundamental pillar of democracy and a crucial moment in the democratic process in Indonesia. However, in recent decades, the hegemony of oligarchs has posed a significant threat to the fairness and integrity of the electoral system. Oligarchs, wielding substantial power and influence, frequently manipulate the electoral process for personal and group interests, often resorting to criminal activities such as bribery, political intimidation, and the misuse of state resources. These actions undermine the legitimacy of elections and erode public trust in the democratic process. This research seeks to analyze the methods employed by oligarchs in the presidential election as criminal acts that damage the integrity of the electoral process in Indonesia. Using a normative legal approach, this research examines various written sources, including books, journals, and empirical data from past elections. The findings reveal a consistent pattern of legal violations by oligarchs that significantly compromise the electoral process. Based on these findings, the research recommends reforms aimed at strengthening the enforcement of criminal laws related to elections and enhancing the capacity of electoral oversight institutions to prevent oligarchic interference. These reforms are crucial for preserving an inclusive and fair democracy in Indonesia.

Abstract

Environmental crime poses a significant threat to ecological health and community well-being. Traditional punitive approaches often fail to address the root causes of environmental harm and may neglect the needs of affected communities. This study explored the potential of restorative justice as an alternative framework for addressing environmental crime, focusing on its capacity to repair harm, foster accountability, and promote community participation in environmental protection. This research employed a qualitative documentary analysis approach. Relevant documents were analyzed, including legal frameworks and policy documents related to environmental crime and restorative justice, case studies and reports on restorative justice initiatives in environmental contexts, and media reports and online resources. Data were coded and thematically analyzed to identify key themes and patterns related to the application of restorative justice in environmental crime cases. The analysis revealed several key themes: (1) the diverse forms of harm caused by environmental crime, extending beyond ecological damage to include social, economic, and cultural impacts on communities; (2) the limitations of traditional legal responses in addressing the complex nature of environmental harm and providing redress to affected communities; (3) the potential of restorative justice to facilitate dialogue, foster accountability, and develop creative solutions that address the needs of victims, offenders, and the environment; (4) the emergence of innovative restorative justice models in environmental contexts, such as environmental mediation, community conferences, and ecological restoration projects. In conclusion, restorative justice offers a promising framework for addressing environmental crime by promoting healing, accountability, and community engagement. Further research is needed to evaluate the long-term effectiveness of restorative justice initiatives in environmental contexts and to develop best practices for their implementation.

Abstract

Prevention is the process of preventing or holding back something from happening. It is possible that the eradication efforts carried out before the violation were procedures to eliminate the crime of money laundering so that criminal acts would not occur which would result in state losses. Money laundering is an attempt to hide or disguise the source of money obtained from criminal acts and then converted into money that appears to come from legitimate actions. Therefore, it is not surprising that more complex crimes are evolving into more sophisticated types as technology and science advances. Because of this, laws to overcome it are difficult to create, and criminal law itself is difficult to cover crimes such as corruption that use sophisticated tools such as telephones and computers. This type of crime also occurs in banking institutions. Often, the perpetrators are the bank administrators themselves or collaborate with other parties who are not members of the bank, so that other people do not know about it or find it difficult to understand it.

Abstract

Prinsip keadilan restoratif merupakan pendekatan alternatif dalam sistem peradilan pidana yang berfokus pada pemulihan korban dan rehabilitasi pelaku. Penelitian ini bertujuan untuk mengkaji penerapan prinsip keadilan restoratif di Indonesia, termasuk kendala dan tantangan yang dihadapi. Meskipun konsep ini telah dikenal dalam konteks penanganan anak pelaku tindak pidana, penerapannya dalam kasus pidana umum masih terbatas. Faktor-faktor seperti regulasi yang mengedepankan pendekatan retributif, rendahnya pemahaman aparat penegak hukum, dan minimnya partisipasi korban menjadi hambatan signifikan. Selain itu, ketidaksiapan infrastruktur serta penerimaan masyarakat terhadap keadilan restoratif juga mempengaruhi efektivitas implementasi prinsip ini. Untuk mengatasi tantangan tersebut, diperlukan langkah strategis seperti revisi peraturan perundang-undangan, pelatihan bagi aparat penegak hukum, dan peningkatan sosialisasi kepada masyarakat. Dengan demikian, keadilan restoratif dapat menjadi bagian integral dari sistem peradilan pidana yang lebih humanis dan berkelanjutan di Indonesia.

Abstract

With the enactment of Law Number 1 of 2023 concerning the Criminal Code (New Criminal Code), there will be legal implications for several important aspects, namely the source of criminal law, the criminal justice system, and the practice of criminal law. This article aims to analyze predictions of implementing these 3 (three) aspects related to the provisions of Article 1 paragraph (1) and Article 2 of the New Criminal Code. In principle, Article 1 paragraph (1) of the New Criminal Code regulates the Principle of Legality, and Article 2 of the New Criminal Code regulates the existence and application of laws in society. The legal issue in this article is the potential difficulty of implementing 'living law'. It is necessary to substantially analyze several substantial things about the existence of the criminal law system and the criminal justice system that was formed with the enactment of Article 2 paragraph (1) of the New Criminal Code, as well as the potential juridical obstacles that exist in legal practice, with the existence of the newly formed criminal law system. This article uses legal research methods and doctrinal research types. This research uses a statutory approach and a conceptual approach. Analysis of legal materials uses prescriptive analysis with authentic and systematic interpretation. The analysis is intended to develop legal arguments regarding the juridical obstacles to enforcing 'laws that live in society.

Abstract

This paper explains the basis of legal protection for children who commit crimes according to the Republic of Indonesia Law Number 11 of 2012 concerning the Juvenile Criminal Justice System, which refers to the Convention on the Rights of the Child. The problems discussed also refer to the protection of children as perpetrators. The research method applied for this study is normative legal research, which is included in the realm of legal dogmatics and focuses on the analysis or study of legal regulations. This study, first, found that the provisions of punishment for children are in accordance with those regulated in Law Number 35 of 2014 which amends Law Number 23 of 2002 concerning Child Protection, which states that imprisonment may be imposed on children only if there is no other alternative, and must be separated from adult prisons. Second, efforts to protect children are carried out through the application of restorative punishment and diversion, if they meet the requirements stipulated in Law Number 11 of 2012 concerning the Juvenile Criminal Justice System.

Abstract

Family members who commit violence against each other are called domestic violence (KDRT). This form of violence can be physical, psychological, sexual or economic. Domestic violence often occurs in intimate relationships, but can also involve other family members, such as children or parents. One of the most common cases is violence against children, which can be found in various places throughout Indonesia's provinces. This is very paradoxical because parents are supposed to provide sincere love, guidance and education to children, who are supposed to be the next generation. The family, which should be a safe and comfortable place, actually creates fear for children. Children who experience physical, verbal, emotional, mental, or sexual abuse experience symptoms of mental disorders that can interfere with development and social interactions, according to research. To implement the Child Protection Law, the government, society and various parties must work together to create a positive environment that supports children's development. With the right steps, it is hoped that cases of violence against children can be minimized and victims receive the necessary protection.

Abstract

The historical journey of the Indonesian nation from the colonial era to independence can be understood as a paradigmatic journey. Politically, Indonesia underwent a transformation from a peripheral nation to an entity that took over the center of power through the proclamation of independence in August 1945, moving from the Dutch East Indies to the Republic of Indonesia. Not all nations that have achieved independence have tried to build a new life based on innovative principles. In this context, the role of Pancasila and the 1945 Constitution (1945 Constitution) has a very important significance to these fundamental changes. Pancasila, as a basic state norm (staatssfundamentalnorm), functions as a grand design  for society and a new life in Indonesia. Similarly, the establishment of Law Number 1 of 2023 concerning the National Criminal Code (KUHP) still reflects the values of Pancasila as the country's basic norm which will come into effect in 2026. Law Number 1 of 2023 (New Criminal Code) introduces a number of new criminal concepts that are different from the previous Criminal Code. This renewal is expected to be able to answer the legal challenges faced today and replace colonial concepts that have become obsolete and no longer relevant in overcoming contemporary problems. This update covers three main issues in criminal law: first, the formulation of unlawful acts; second, criminal liability, both against individuals as perpetrators and against legal entities; and third, the type of crime and actions that can be applied. The change in the concept of penal in the National Criminal Code is influenced by the development of criminal theory, which shows a shift from a retributive approach to restorative justice. Therefore, the purpose of criminalization is not only to focus on punishment, but also to try to balance two aspects of community protection, namely the victim and the perpetrator.

Abstract

Accountability of government officials' actions is strongly related to the exercise of government authority. In carrying out duties to realize the general welfare, the authority used by organs or government officials is based on the provisions of the laws and regulations (the principle of legality). However, it is not uncommon for the task to be carried out based on discretionary authority. The freedom of government officials to make decisions based on discretionary authority has a great potential to be abused which results in consequences from both point of view of administrative law as well as of criminal law. In the practice, there is discrepancy among law enforcers on the understanding of the principles related to the accountability of discretionary authority held by government officials.

Abstract

Dalam kajian hukum normatif yang juga dikenal sebagai penelitian hukum doktrinal, diungkap bahwa kejaksaan dan Komisi Pemberantasan Korupsi (KPK) berwenang menuntut pelaku Tindak Pidana Pencucian Uang (TPPU) berdasarkan Undang-Undang No. 8 Tahun 2010 tentang Tindak Pidana Pencucian Uang (UU TPPU), jika tindak pidana yang melatarbelakanginya adalah korupsi. Akan tetapi, Undang-Undang No. 30 Tahun 2002 tentang Komisi Pemberantasan Korupsi (UU KPK) tidak memberikan penjelasan mendetail tentang peran KPK dalam penanganan kasus TPPU yang bermula dari tindak pidana korupsi. Kajian ini mengedepankan analisis terhadap hukum positif yang relevan. Hal ini terjadi meskipun kepolisian dan kejaksaan, yang mendapat amanat eksplisit dari undang-undang, secara umum tidak mengalami kesulitan dalam mengatasi kasus-kasus TPPU. Menjadi penting untuk merevisi Pasal 76 agar kewenangan penuntut umum dari Komisi Pemberantasan Korupsi (KPK) dalam menangani kasus Tindak Pidana Pencucian Uang (TPPU) yang berkaitan dengan korupsi dapat disamakan, sebagaimana diatur dalam UU No. 8 Tahun 2010 tentang TPPU. Hal ini meniscayakan perlunya klarifikasi terhadap interpretasi Ayat (1) Pasal 76, yang menetapkan bahwa penuntut umum dari Kejaksaan Agung RI dan KPK adalah entitas yang bersatu dengan hak yang identik dalam mengelola kasus-kasus tersebut. Dengan demikian, hal ini akan mengakhiri kontroversi yang ada mengenai wewenang KPK dalam menangani kasus TPPU. Oleh karena itu, penuntut umum yang berasal dari KPK dianggap berwenang untuk menuntut dalam kasus TPPU dimana tindak pidana asalnya adalah korupsi.
