Abstract

This article discusses one of the problems that often occurs in Indonesia, giving rise to legal uncertainty and conflict in society. This research discusses legal protection and judges' considerations regarding ownership of land rights in land title certificate disputes in deciding lawsuit cases at the State Administrative Court. The main focus of the research is to analyze the role of the National Land Agency (BPN) in preventing and resolving disputes, as well as the legal mechanisms adopted. The research method used is normative with a statutory approach and case studies. The research results show that holders of legally issued certificates do not necessarily have the right to obtain legal protection through a lawsuit to the State Administrative Court (PTUN) and settlement through mediation at BPN. Apart from that, implementing the principles of legal certainty and good faith in every certificate processing process is an important factor in avoiding disputes. This research recommends increasing supervision in the process of issuing land certificates and strengthening the technology-based land administration system to prevent future land ownership disputes.

Abstract

The effectiveness of insurance claim investigations in detecting and uncovering criminal acts of Fraud in motor vehicle accident claims, with a case study conducted at PT Tujuh Bintangmas Perkasa. The method used includes a normative and empirical approach, involving direct interviews with company management and investigation teams. The results from these interviews show that claim investigations serve not only as an administrative verification tool but also as a legal instrument to strengthen the company’s position during reporting and law enforcement processes. Based on Article 251 of the Indonesian Commercial Code (KUHD) and Articles 378 and 381 of the Criminal Code (KUHP), investigations play a crucial role in proving the presence of bad faith by the insured party, such as concealing the vehicle’s damage history or forging documents. The investigation team operates under strict Standard Operating Procedures (SOPs) that include scene reconstruction, visual and forensic evidence analysis, and cross-verification of data from the initial policy application. However, several challenges remain, including limited coordination between institutions and insufficient human resources. To improve effectiveness, it is necessary to integrate national data systems, provide regular training for investigators, and optimize technologies such as big data and artificial intelligence (AI). The study concludes that a systematic claim investigation process supported by strong regulations can serve as a primary defense mechanism against Fraud, while also promoting a more transparent and legally compliant insurance industry.

Abstract

This study examines the legal protection of land ownership in a land certificate dispute case in South Cikarang, Bekasi Regency, focusing on the District Court Decision Number 285/Pdt.G/2023/PN Ckr. The dispute involves the plaintiff as the legitimate owner of the land, proven by three lawfully issued land certificates from the 1980s to 1990s, and the defendant who obtained new certificates through allegedly invalid deeds of sale based on fictitious data. The legal issues analyzed include the court's legal reasoning in determining the existence of unlawful acts and the effectiveness of legal protection for rightful landowners. This research employs normative and empirical legal methods with a case approach, focusing on the court’s ratio decidendi. The findings reveal that the court fully granted the plaintiff’s claims by declaring the defendant’s certificates null and void, recognizing administrative negligence by the Ministry of Agrarian Affairs and Spatial Planning, and awarding substantial compensation. The ruling reaffirms the importance of due diligence in land administration and serves as an important precedent for legal protection of legitimate landowners in Indonesia.
