Abstract

To understand how the scholars of the Mazhab understand Dilalah Amr, both from the Qur'an and Hadith sources, the method used in determining a command (Amr) for obligation or others in the prayer ritual, and its implementation towards the procedures of performing the prayer ritual among the Muhammadiyah, Al Washliyah, and Nahdlatul Ulama communities. This research is a normative study with a literature research method using references from relevant literature related to Amr sourced from the Qur'an and Hadith verses. The jurists (Fuqoha) in understanding Dilalah Amr use several methods, namely: (1) using Qarinah Qauliyah and Haliyah, (2) giving weight to stronger evidence to be used as Qarinah, (3) using the method of Qiyas, (4) using the actions of the people of Madinah as reference, (5) using Ijma, and (6) using the method of Naskh. In relation to the prayer procedure of Muhammadiyah, they do not recognize the terms of pillars (rukun), obligatory (wajib), and recommended (sunnah) in prayer. What is recognized is the method of performing obligatory prayer. Meanwhile, among Al-Washliyah, they still use the terminologies of the scholars of Usul Fiqh such as pillars, obligatory, and recommended in prayer. Similarly, Nahdlatul Ulama adheres to the four Mazhabs.

Abstract

Conflict resolution of heritage is a problem that often occurs in Indonesian society. This conflict usually occurs due to disagreements in dividing inherited property between family members. In West Sumatra, Minangkabau women are essential in resolving inheritance conflicts. This article will explain the factors that support the position and role of Minangkabau women in resolving heritage conflicts in West Sumatra. This research is empirical legal research or (socio-legal research) with socio-empirical studies with qualitative research. The approach method used in this study is part of legal pluralism (mix or mix), including philosophical, sociological, phenomenological, and legal anthropological approaches. This article aims to provide an understanding of the role and position of Minangkabau women in resolving heritage conflicts in West Sumatra. The factors that support their role are Economic, Educational, Psychological, and Social factors. It is hoped that this article can provide a better insight into the importance of the role of women in resolving inheritance conflicts, as well as provide proper recognition for Minangkabau women for their contributions to society

Abstract

Ifrad pilgrimage is a form of Hajj where an individual intends only for Hajj upon entering the state of Ihram. The pilgrim declares Labbaik Bahaj and performs Tawaf Qudum after entering Mecca, remaining in the state of Ihram until the designated Hajj period. Subsequently, the pilgrim follows all the Hajj rituals, including the standing at Arafah, staying at Muzdalifah, casting stones at Jamarat Al-Aqabah, performing Tawaf Ifadhah, Sa'i between Safa and Marwa, and spending the night at Mina for stone throwing on the days of Tashriq. After completing all the Hajj rituals, the pilgrim performs the second Tahallul, exits Mecca, and begins the second Ihram with the intention of Umrah if planning to undertake Umrah rituals. Tamattu' pilgrimage involves initially intending to perform Umrah upon entering the Miqat by saying Labbaik in Umrah. Upon entering Mecca, the pilgrim completes all Umrah rituals such as Tawaf and Sa'i, then shaves or trims the hair, concluding the state of Ihram. On the 8th of Dhu al-Hijjah, the pilgrim enters into the Hajj Ihram, performs Hajj rituals like standing at Arafah, Tawaf, Sa'i, and others comprehensively. Qiran pilgrimage is when an individual intends to perform both Hajj and Umrah simultaneously upon entering Ihram by uttering specific words. The individual remains in the state of Ihram until completing the Hajj rituals. During the Hajj, there is no need for additional Tawaf and Sa'i for Umrah; performing the Tawaf and Sa'i for Hajj is sufficient. Among these three types of pilgrimage, the Ifrad model is considered the least burdensome for pilgrims. This model does not incur penalties, and the greater benefit in performing the Hajj pilgrimage is achieved through the Ifrad model.

Abstract

In particular, handling children's problems is included in the social rehabilitation sector which is under the Social Rehabilitation Section for Children and the Elderly Outside of Homes and/or Institutions, although it is also related to other sections within the Medan City Social Service. The importance of this study is to carry out integration between the concept of human rights in the global context and human rights in Islam. It still needs to be reduced to an integrated child protection concept, so that it can be implemented in the form of policies in the local context, especially in the field of social welfare. To derive these two concepts, a systems approach is needed that can explain the position and role of the CRC and Islamic law in child protection and the role of the Medan City Government, especially within the Medan City Social Service, in implementing existing policies. This research uses a qualitative approach to describe and analyze how Islamic law and the Convention on the Rights of the Child (CRC) view child protection from their respective perspectives and will then be analyzed as a whole. The role of the Medan City Social Service relating to the field of child protection is carried out through the duties of the Social Rehabilitation Sector, in point (g) that "Guidance, development and control of social service efforts in the field of social rehabilitation services for street children, abandoned children, delinquent children and service provision for neglected elderly people and social rehabilitation of delinquent children.

Abstract

Empirical facts show that the number of sexual violence in various forms is increasing, while victims still experience difficulties in obtaining protection which is the responsibility of the State. Sexual violence experienced by women is a manifestation of historical inequality in power relations between men and women and is a structural obstacle to achieving social justice, peace and sustainable self-development. The aim of this research is to analyze the protection of women from acts of sexual violence that fulfills the benefits and is gender equitable for women. Through a normative juridical method with a statutory approach and legal principles, research was conducted sourced from secondary data, reinforced by interviews coded via NVivo R1. The results of the research show that the strong patriarchal viewpoint in Indonesian society gives rise to gender inequality and is a contributing factor to sexual violence against women. Sadly, this action is still considered an immoral act by some people. Victims still experience revictimization due to society's mindset that does not side with women as victims and instead blames them for triggering sexual violence. For this reason, it is hoped that all elements of society will no longer be permissive regarding the issue of sexual violence, so that efforts are needed to make socio-cultural changes in Indonesia, one of which is through gender reconciliation by applying the principle of mubindah in life. So that sexual violence can be eliminated and victims can be protected.

Abstract

This study acknowledges about the illegal divorce that husbands have imposed outside the court of the perspective of Marriage Law in Indonesia. There are three problems that will be answered in this study. First, how are the illegal divorce law problems in the perspective of Indonesian Marriage Law and Islamic Jurisprudence? Second, how is the illegal divorce urgency in the perspective of Islamic Jurisprudence and Indonesian Marriage Law? Third, how is the Marriage Law solution in Indonesia against the illegal divorce? To answer these problems, a literature study has been done. Data about the illegal divorce is obtained from books or Islamic Jurisprudence books, laws or regulations, and electronic data through the website. These data are processed, analyzed, and used as materials to study about the illegal divorce by using the normative legal study methods. The results of the research have found answers to the problems above, first, there are four of the illegal divorce law problems, such as its validity, lack of legal protection, the illegal divorce couples can’t legally marry another person, and they also can’t get the rights after divorce.

Abstract

Purchase Back Guarantee is an agreement made by the bank and developer to provide collateral for the mortgage to the developer. Article 8 Paragraph (1) of Law Number 7 of 1992 concerning Banking as Amended by Law Number 10 of 1998 (Banking Law) stipulates that bank credit distribution must be based on confidence in the debtor, which in the provisions explaining this confidence refers to the existence of credit guarantee. In addition, Article 11 of the Banking Law regulates the provisions for providing guarantees by Bank Indonesia. However, these articles do not further regulate the collateral that can be provided for bank credit. This shows that this regulation is still rigid and many problems arise due to the implementation and execution of the Buy Back Guarantee. The aim of this study is to examine and analyze the validity of the implementation of the Buy Back Guarantee and efforts to resolve disputes. This study uses normative legal research methods with a legislative and decision approach. The study results show that the implementation of the Buy Back Guarantee is valid if it is carried out in accordance with applicable regulations and the agreements made relating to the implementation of the Buy Back Guarantee are valid and made before a Notary. Dispute resolution can be done through litigation and non-litigation. Litigation can be taken through the courts, and non-litigation can be done through Alternative Dispute Resolution, namely arbitration, negotiation or mediation.

Abstract

According to Law No. 28 of 2009, taxes are contributions from the community used for national purposes to ensure the prosperity of the people. This law also explains the existence of Regional Taxes and Levies (PDRD such as the Restaurant Tax. Each year, the Regional Tax and Levy Management Agency sets targets, but many of these targets are not achieve. For example, in 2020 and 2021, many tapping box devices were installed to optimize tax collection, but the targets were still not achieved. Therefore, the purpose of this study is to assess other factors that can optimize tax revenue through the analysis of determinants for the optimization of restaurant tax revenue in North Sumatra Province. This research will take samples from five cities and regencies in North Sumatra Province: Medan, Deli Serdang, Tebing Tinggi, Batu Bara, and Serdang Bedagai. The study will use a quantitative method with primary data collected through surveys. The results of this research indicate that tax audits, tapping box applications, and tax regulations significantly influence taxpayer compliance in paying restaurant taxes in North Sumatra Province. Additionally, tax audits and tapping box applications have a substantial impact on tax optimization, whereas tax regulations do not have a significant impact on the optimization of restaurant taxes in North Sumatra Province. Furthermore, taxpayer compliance does not significantly affect the optimization of restaurant taxes in North Sumatra Province. Finally, tax audits, tapping box applications, and tax regulations do not significantly influence the optimization of restaurant taxes through taxpayer compliance in paying restaurant taxes in North Sumatra Province.

Abstract

This study investigates the key factors influencing the success of business units within Dayah (Islamic boarding schools) in Aceh Province, Indonesia. Employing the Analytical Network Process (ANP), the research gathers expert opinions and insights from academics, government officials, and practitioners. The analysis reveals that both internal and external factors significantly impact the management of Dayah business units. Internal factors identified as crucial for success include public relations resources, leadership capabilities, business management practices, natural resource availability, and adequate business capital. Externally, technological advancements, demographic shifts, political/governmental support, socio-cultural influences, and economic conditions all play a role in determining success. This research highlights the importance for stakeholders to consider these diverse factors when optimizing Dayah business unit management. It further offers practical recommendations for managing such units within the context of Aceh, Indonesia.==============================================================================================================ABSTRAK – Optimalisasi Unit Bisnis Dayah di Aceh: Studi ANP. Penelitian ini bertujuan untuk menganalisis faktor yang menjadi penentu kesuksesan dalam mengelola unit bisnis Dayah atau Pondok Pesantren yang ada di Provinsi Aceh, Indonesia. Penelitian ini menggunakan Analytical Network Process (ANP) untuk mengumpulkan opini dan pendapat dari akademisi, pejabat pemerintah dan praktisi. Analisis ANP menemukan bahwa kesuksesan dalam pengelolaan unit bisnis dayah di Aceh ditentukan oleh faktor internal dan faktor eksternal. Faktor internal yang teridentifikasi menjadi penentu keberhasilan adalah SDM, kepemimpinan yang kapabel, praktik manajemen bisnis, ketersediaan sumber daya alam, dan kecukupan modal usaha. Sementara dasi sisi eksternal, faktor penentu kesuksesan adalah kemajuan teknologi, perubahan demografi, dukungan politik/pemerintah, pengaruh sosial budaya, dan kondisi ekonomi. Hasil ini berimplikasi bagi para pemangku kepentingan dalam optimalisasi pengelolaan unit bisnis pada dayah-dayah di Aceh untuk memperhatikan faktor-faktor kesuksesan tersebut. Penelitian ini juga memberikan rekomendasi praktis yang bisa dijadikan acuan dalam pengelolaan unit bisnis yang dikelola oleh Dayah/Pondok Pesantren di Aceh, Indonesia.

Abstract

An Islamic bank is a type of financial institution that operates by Islamic principles and rules and provides various banking services using different types of contracts or agreements that comply with Sharia law. These banks, in terms of Islamic banking, Qardh contracts are one of the most commonly used contracts. This study aims to engage the effect of the kafalah (guarantee or surety) component and the role of loan capital in implementing the qardh concept. Time series data obtained from the Financial Services Authority from 2018 to 2022 is used for this quantitative research. This study used multiple linear regression as the analysis to evaluate the effect. The results show that the Kafalah variable does not significantly impact the Qardh variable. Although the two types of contracts are most commonly used in Islamic banking practices, the main difference between them lies in the way they are implemented and applied. In Islamic bank guarantee products, the contract is known as kafalah. Qardh variables are affected by the loan capital. Qardh contracts do not impose any reward on the borrower of money or the recipient of assets. Due to its nature, the Qardh contract does not aim to generate financial profit; instead, it aims to help small businesses, social causes, and other organizations.
