Abstract

The reform of Islamic family law represents a complex political arena where religious doctrines, state authority, and civil society interests intersect in shaping gender norms. This study examines the political dynamics underlying Islamic family law reform across several Muslim-majority countries and its implications for gender equality. By analyzing case studies from the Middle East, South Asia, and Southeast Asia, the research highlights how the success of legal reform is influenced by the power of state actors, the role of religious scholars, international pressure, and the strength of women’s movements. In many contexts, family law remains one of the few legal domains where patriarchal norms are legally entrenched, despite constitutional commitments to human rights. Conversely, countries like Morocco and Tunisia illustrate that meaningful reforms are possible through strategic political engagement and strong alliances between state institutions and civil society organizations. These progressive reforms have led to greater protection of women’s rights in areas such as marriage, divorce, child custody, and inheritance. Nevertheless, reform efforts often face strong resistance from conservative groups who claim to defend the authenticity of Islam. This study concludes that Islamic family law reform is not merely a theological issue but a contested political struggle that shapes the trajectory of gender justice in contemporary Muslim societies. Therefore, reform strategies must be tailored to the socio-political context of each country, embracing a dynamic fiqh (Islamic jurisprudence) approach and ensuring the active participation of women in legislative processes.

Abstract

This paper discusses the dynamics of punishment for khalwat perpetrators which is habitually inclined to implement the rule of law underlined in Aceh. The aim of this research is to analyze the provision of legal sanctions carried out by Acehnese for khalwat perpetrators based on the maqashid sharia perspective. This study was conducted by using empirical juridical research with law sociology approach, and the source of the main data was an interview which was completed by supporting data such as significant articles related to the khalwat cases in Aceh. The results of this study point out that normatively the provision of sanctions for khalwat perpetrators in Aceh are regulated into two forms, namely Jinayat Law Qanun, and the Development of Traditional Life and Custom Qanun. Each of these regulations has differences in the provision of law sanctions for the khalwat perpetrators that cause law dualism. Practically, the sanctions determined by Acehnese for the khalwat perpetrators are various depending on each region. There are four kinds of sanctions enforcement, namely; First: Jinayat Law Qanun, Second: Customary Law, Third: the sanction of punishment in the name of customary law, Fourth: persecution. Based on maqashid al sharia aspect, some of these punishments are considered not in accordance with sharia principles, law of persecution, and in the name of customary law. Indeed, these regulations tend to be decided arbitrarily and even followed by torture.

Abstract

This article criticizes MUI Fatwa Number 24 of 2017 concerning guidelines for naming through social media, wherein the decision of its legal provisions the fatwa has given many restrictions that can be understood as an effort to close the space for freedom of expression and opinion on social media, the impact of which social media users feel afraid and restrained to views. The existence of this fatwa is fundamental because it provides clues regarding the rights of free speech for social media users from an Islamic perspective. This paper uses Jasser Auda's maqasheed sharia approach, namely system theory, as a normative analysis in criticizing fatwas against the interpretation of ghibah behavior, the concept of tabayyun, the public domain in the torso of the general provisions of fatwas. This article argues that the performance of the behavior of the ghibah, the concept of tabayyun, the public domain, in the general conditions of the fatwa body is very influential in the understanding of Islamic law itself towards a direction that is contrary to the purpose of maqasheed sharia, namely the law for the benefit of the people. This is because the interpretation of the fatwa is not ideal for realizing the goal of protecting the human right to opinion for social media users in a country that applies the concept of democracy. This argument is based on the researchers' reading of the MUI Fatwa using a system theory that says the purpose of the law is to achieve the universal benefit, which is inseparable from all points of view of Islamic law. In the end, this article concludes that there is a need to reconstruct the interpretation of the ghibah concept of tabayun, the public domain in the Majelis Ulama’s fatwa.

Abstract

This article aims to examine; 1. The effect of financial literacy on the financial behavior of MSME entrepreneurs in Binjai City. 2. The effect of financial inclusion on the financial behavior of MSME entrepreneurs in Binjai City. 3. The influence of Islamic Smart City on the financial behavior of MSME entrepreneurs in Binjai City. This study used a quantitative method with a research instrument in the form of a questionnaire. The research sample was 154 MSME actors in Binjai City. While the data analysis technique uses PLS-Structural Equation Modeling (SEM) analysis based on variance or Partial Least Square (PLS). The results of the study show that: 1. Financial literacy which consists of indicators of general financial knowledge, savings and loans, insurance, and investment has no significant effect on the financial behavior of MSME entrepreneurs in Binjai City. 2. Financial inclusion consisting of indicators of the dimensions of access, dimensions of use, dimensions of quality, and dimensions of welfare has a significant effect on the financial behavior of MSME entrepreneurs in Binjai City. 3. Islamic Smart City which consists of Smart Economy, Smart Mobility, Smart Environment, Smart People, Smart Living and Smart Governance indicators has a significant effect on the financial behavior of MSME entrepreneurs in Binjai City. 4. Financial literacy and inclusion as well as Islamic Smart City have a significant effect on the financial behavior of MSME entrepreneurs in Binjai City.

Abstract

Decree of the Director General of Islamic Community Guidance No. 379 of 2018 concerning the Implementation of Premarital Marriage Guidance, which aims to create a happy and peaceful family and reduce the divorce rate But in reality, in the city of Medan, the divorce rate continues to increase every year. This study focuses on the issue of implementing premarital marriage guidance based on the Decree of the Director General of Islamic Community Guidance Number 379 of 2018 at the KUA in Medan City, as well as the extent of the impact of fostering premarital marriages. based on the Decree of the Director General of Islamic Community Guidance No. 379 of 2018 concerning reducing the divorce rate in Medan City. The research model (mode of inquiry) is a type of qualitative research oriented to field research (empirical), which is related to the Islamic education approach and premarital guidance. The results of the research are oriented towards the effectiveness of coaching and education for premarital marriages that are not working as well as they should. There are still many married couples who do not get premarital marriage guidance but get a marriage certificate, and premarital marriage coaching should be an administrative requirement by showing proof of marriage certificate for couples who are getting married. There is also a lack of understanding of the implementation of Islamic educational values, and the government must give authority to the KUA as a follow-up to premarital marriage development activities to mediate between married couples who are about to divorce before going to the Religious Courts.

Abstract

This research looks at what Acehnese scholars think about the customary punishments for people who break the khalwat qanun in Aceh Tamiang District, based on Aceh Province Qanun Number 6 of 2004 about Jinayat Law in the progressive Islamic education model. This research method is normative and empirical. It looks at legal principles and norms in laws and regulations, legal doctrine, and how legal norms are used in society. It then looks at the problem from the point of view of Acehnese scholars regarding violations of the khalwat qanun. The results of the study show that when putting customary life into practice, regions can set up different policies to help adat and traditional institutions in their areas that are based on Islamic law and work in line with it. Gampong or village residents who break the khalwat or make the Sharia look bad can first go to a Gampong Traditional Meeting (RAG). One reason why khalwat offenders aren't caned in Aceh Tamiang is because the case was settled in a way that was unfair to both local elites and the general public. A number of Khalwat cases were resolved through customary mechanisms. Sanctions such as the "banquet of bad luck," handing over tens of sacks of cement for village infrastructure development, and washing and humiliating in public places are forms of settlement for indigenous peoples. Many indigenous peoples outside Aceh also carry out sanctions like this. considerations of efficiency, expediency, and trustworthiness. Through customary mechanisms, khalwat cases are handled more quickly and efficiently than in the Sharia Court. In addition, the implementation of Qonun Jinayah can be carried out using a progressive education model approach that aims to raise awareness in every individual community about the enforcement and implementation of Qonun Jinayah in the Aceh Tamiang region.

Abstract

This research focuses on seeing how the integration between Islamic education and science, by looking at the case of pig eye cornea transplantation based on Al-Shatiby's perspective. Islamic education is important to adjust Islamic law as a guide for every Muslim to be a reference in carrying out all the activities of his life both his relationship with Allah and his relationship with fellow human beings even towards himself and other creatures. The development of medical technology today requires health experts to transplant / replace human eye corneas that experience blindness due to corneal abnormalities to be overcome while corneal donors derived from human eye corneas are very rare to obtain, one of which is due to the unwillingness of humans to become corneal donors, so doctors replace human eye corneas that experience corneal blindness with corneas derived from pigs that have been genetically engineered.  Islamic law comes from the Quran and the Sunnah of the Prophet, but if no clear text is found in a problem faced by humans, the scholars make ijtihad to determine the law through Ijmak and Qiyas. With the development of technology today, not all problems can be answered from existing sources and arguments of Islamic law, so other legal arguments are needed, such as Maslahah Mursalah. This also requires Islamic education in the medical field, so that patients and families understand the problems that exist, and understand the medical process. The integration of Islamic education in science, especially in the context of medical science can encourage the determination of Islamic law on pig corneal transplants as a substitute for human corneas, especially by using the Maslahah Mursalah Theory approach from Imam Al-Shatiby.

Abstract

Fenomena yang terjadi dikalangan Mahasiswa Universitas Darma Agung yang sudah menggunakan Tiktok Shop karena dianggap praktis, dapat menghemat waktu dan tenaga. Walaupun demikian, ternyata masih ada masalah yang terjadi ketika Mahasiswa Universitas Darma Agung menggunakan TikTok Shop untuk berbelanja. Salah satunya adalah terdapat cacat pada barang yang dibeli. Pada saat inilah hak pembeli dapat membatalkan atau tidak meneruskan akad jual beli jika ada kecacatan pada barang yang dibelinya menurut Fiqh Muamalah. Penelitian ini merupakan jenis penelitian kepustakaan, yakni serangkaian penelitian tentang metode pengumpulan data kepustakaan atau penelitian yang objek penelitiannya. Hasil penelitian ini menurut Pandangan fiqih Muamalah terhadap transaksi online relevan karena penjual memberikan data rinci mengenai pokok barang yang diperjualbelikan, dan pembeli berhak menerima hak khiyar yang diberikan penjual. Detail objek produk sebagai tujuan untuk memeriksa tingkat kualitas dari produk itu sendiri sehingga pembeli dapat melanjutkan atau membatalkan pembelian. Kontrak yang terkait dengan jenis transaksi ini adalah Akad Salam yang disepakati (yang akadnya telah dibuat) akan dikirimkan kepada pembeli di kemudian hari, sesuai dengan DSN Fatwa MUI Nomor 5/IV/ Tahun 2000 tentang Jual Beli Salam, hak atas khiyar berlaku jika pembeli menentukan bahwa barang tersebut tidak sesuai dengan rincian yang diberikan penjual.

Abstract

This study aims to understand and analyze the concept of religious ethics in the Maqasid al-Shariah approach according to Thaha Abd al-Rahman. The method used is a qualitative method with a philosophical approach and textual analysis. Data were collected through literature studies, interviews, and document analysis. The results of this research indicate that the thoughts of Thaha Abd Al-Rahman provide valuable contributions to the development of a contextual, ethical, and relevant Islamic paradigm for the current era. By integrating alternative modernity concepts, belief as a foundation, religious ethics, and maqasid shariah, Taha Abd Al-Rahman forms a solid foundation for the realization of a just, equitable, and ethical society in the modern era. The implication of this research is that the concept of religious ethics in the Maqasid al-Shariah approach by Taha Abd al-Rahman can be a guide for Muslims in their daily lives. It is recommended that educational institutions, both formal and informal, introduce this concept to the community to improve their understanding of religious ethics in Islam.

Abstract

The practice of developing sharia financing has actually experienced massive developments, especially in ensuring the existence of legal certainty in transactions. One of the developmental practices of sharia financing is the existence of a contract formulated in the form of a notarial deed. This research focuses on the legal vacuum related to the arrangement of making a shari'ah financing contract in the form of a notarial deed. This research is a normative legal research with a concept and statutory approach. The results of the study show that a sharia financing contract made in the form of a notarial deed according to Islamic law must still refer to the provisions of syar'i law. In the process of shari'ah financing contracts, it is necessary to refer to several syar'i aspects, such as paying attention to the provisions contained in the Qur'an and sunnah, the Sharia Banking Law, to the JN Law. The model for making sharia financing contracts in the form of a notary deed based on the principles of agreement in Islamic law places the position of a notary to guarantee neutrality, professionalism and integrity including fulfilling and complying with the code of ethics. Notaries need to understand the provisions of syar'i or Islamic law in formulating a syari'ah financing contract requiring certification and special training in making sharia banking contracts for notaries
