Abstract

Family disputes arise when there is a conflict or incompatibility between parties. In this sense, a problem can be interpreted as a situation in which the parties experience pros and cons or incompatibility with the agreement made between them. This is still related to the status of humans as social beings. The existence of disputes between humans inspires the birth of the desire to resolve the conflict/dispute that occurs between them.  In dispute resolution, Islam places great emphasis on peace to anyone who is in conflict, and the settlement of disputes arises more from the wishes and initiatives of the parties to the dispute, so that mediators play a petrified role in reaching agreements. In Islamic law, the mediation procedure used to resolve family disputes is called al-sulh, which means to settle, involving a hakam. The processes and facts of society are different. The mediation stage is not necessary if the couple can resolve conflicts within their families. In such situations, they can only resolve the issue with the agreement they made before, and there is no further process. However, when conflicts cannot be resolved simultaneously, families require a trusted family mediator or judge. Therefore, certain stages in this mediation process are necessary to reach an agreement between the two parties. First, each party to the conflict must be willing to present its grievances to the mediator. The second process is peace carried out by third parties. A third party does this by identifying the root cause of the conflict. The third process begins when the midpoint is determined. This process requires the approval of each family that has problems with the solution offered by a mediator. The fourth or an advanced process can be initiated. The mediator in the community is usually a religious figure or community leader, such as a kyai, a hamlet head, or maybe even a hakam, or a trusted family member.

Abstract

This study is motivated by the growing accusation that Islamic family law is inherently patriarchal and fails to protect women adequately. Such criticisms arise from the gap between Qur'anic principles of justice and socio-cultural practices, as well as traditional interpretations shaped by patriarchal structures. In response to this issue, this study aims to re-examine the principles of justice and women's protection in the Qur'an using a normative approach combined with Qur'anic feminist perspectives. The central question addressed is whether the Qur'anic text itself supports patriarchy or whether patriarchal tendencies originate from historical interpretations and cultural practices surrounding the text. This research employs a qualitative method using library research and thematic content analysis (maudhu'i). The primary data consisted of Qur'anic verses related to gender relations, marriage, divorce, and family responsibilities, while the secondary data included classical and contemporary tafsir literature as well as feminist Islamic scholarship. The analysis focuses on identifying patterns of meaning, moral objectives (maqāṣid), and substantive justice embedded within the Qur'anic discourse. The findings reveal that the Qur'an is inherently anti-patriarchal and strongly upholds principles of justice, reciprocity, and the protection of women's dignity. Verses such as Qur'an 4:1, 4:19, 2:231, and 9:71 emphasize women's spiritual, social, and economic rights. The study concludes that patriarchal bias does not originate from the Qur'anic text itself but from socio-historical interpretations shaped by patriarchal contexts. Therefore, reconstructing Islamic family law based on maqāṣid al-Qur'an is essential for developing a more just, humane, and gender-responsive model of family relations aligned with the Qur ‘an’s ethical spirit.

Abstract

ABSTRAK Pergeseran paradigma ke arah keadilan yang lebih inklusif serta berorientasi pada hak asasi manusia merupakan tuntutan modernisasi sistem peradilan pidana di Indonesia. Proses politik legislasi acap kali tidak menunjukkan adanya akomodasi kerentanan terhadap kelompok rentan, khususnya perempuan dan individu dengan identitas gender marjinal. Tulisan ini betujuan untuk menelaah arah politik legislasi dalam membangun sistem peradilan pidana yang responsif gender dengan mengutamakan pentingnya keadilan substantif. Pendekatan sosiolegal dengan menganalisis berbagai regulasi, termasuk Undang-Undang Tindak Pidana Kekerasan Seksual dan pembaruan Kitab Undang-Undang Hukum Pidana serta Kitab Undang-Undang Hukum Acara Pidana. Artikel ini menunjukkan bahwa meskipun terdapat kemajuan dalam pengakuan normatif terhadap perlindungan korban, sistem legislasi masih menghadapi hambatan struktural dan ideologis. Politik legislasi cenderung elitis dan tidak sepenuhnya memperhitungkan pengalaman korban dalam membentuk norma hukum. Oleh karena itu, modernisasi sistem peradilan pidana tidak hanya mensyaratkan pembaruan substansi hukum, tetapi juga pergeseran pendekatan politik hukum ke arah yang lebih partisipatif dan berkeadilan sosial. Artikel ini merekomendasikan penguatan perspektif keadilan gender dalam proses legislasi pidana sebagai fondasi sistem peradilan pidana yang benar-benar modern, adil, dan manusiawi.Kata Kunci: gender, keadilan substantif, kerentanan, legislasi, peradilan pidana.

Abstract

Krisis teologi Islam kontemporer ditandai oleh dominasi pendekatan normatif-formalistik yang cenderung ahistoris dan kurang responsif terhadap kompleksitas realitas sosial, politik, dan ekonomi masyarakat modern. Akibatnya, terjadi disorientasi antara keyakinan teologis dan pengalaman eksistensial umat, yang berimplikasi pada melemahnya fungsi transformatif agama dalam kehidupan publik. Meskipun sejumlah studi telah mengembangkan gagasan teologi sosial dan pembebasan, masih terdapat kesenjangan penelitian dalam mengintegrasikan kerangka teologi Islam dengan pendekatan Psikologi Humanistik–Eksistensial yang menekankan dimensi kesadaran, kebebasan, dan makna hidup manusia. Penelitian ini bertujuan untuk merekonstruksi Teologi Islam Transformatif berbasis pendekatan humanistik-eksistensial guna menjembatani ketegangan antara normativitas doktrinal dan praksis kehidupan multidimensional. Secara teoretis, penelitian ini menggunakan pendekatan Psikologi Humanistik–Eksistensial untuk memperkaya perspektif teologi Islam, dengan menekankan aktualisasi diri, autentisitas, dan tanggung jawab moral sebagai basis keberagamaan. Metode yang digunakan adalah penelitian kualitatif berbasis studi kepustakaan dengan analisis kritis-interpretatif dan konstruktif terhadap literatur klasik dan kontemporer. Argumen utama penelitian ini adalah bahwa teologi Islam perlu direorientasi dari kerangka doktrinal menuju praksis eksistensial-transformatif yang mampu menjawab problem konkret masyarakat dalam bidang teologis, sosial, politik, dan ekonomi. Kontribusi ilmiah penelitian ini terletak pada pengembangan model integratif antara teologi Islam dan Psikologi Humanistik–Eksistensial sebagai paradigma baru yang lebih kontekstual, reflektif, dan emansipatoris. Model ini menawarkan kebaruan (novelty) dalam studi Islam dengan menempatkan teologi tidak hanya sebagai sistem kepercayaan, tetapi sebagai praksis hidup yang membebaskan dan memberdayakan manusia secara multidimensional.

Abstract

The Pancasila student profile is one of the demands in the Independent Curriculum. The professionalism of PAI teachers plays a role in encouraging students to have Pancasila values within themselves. The aim of the study aims to analyze the role of PAI teacher professionalism in increasing the profile of Pancasila students. This study is qualitative research using a case study method at SD Tunas Harapan Pasar Kemis, Tangerang Regency. Data was collected through interview techniques, documentation studies and observations. After that, the data was collected, reduced, presented and concluded. The competency of PAI teachers at Tunas Harapan Elementary School shows that it is in accordance with the standards mandated by the 2003 National Education System Law. The roles of professional teachers that PAI teachers can play include, among others, uswatun hasanah, motivator, facilitator and evaluator. There are several efforts to improve the professionalism of PAI teachers to strengthen the profile of Pancasila students, including taking part in Diktats, Workshops, Webinars and playing a role in PAI subject clusters. Even as a professional teacher, there are obstacles and obstacles that we face, such as unsynchronized time, difficulties in determining dimensions and elements related to PAI teaching materials.

Abstract

Penelitian ini membahas mengenai pertanggungjawaban hukum Dewan Komisaris atas pelaporan keuangan korporasi sebagai salah satu aspek penting dalam tata kelola perusahaan yang baik. Pelaporan keuangan merupakan bentuk transparansi dan akuntabilitas korporasi kepada pemegang saham, kreditur, serta pihak-pihak berkepentingan lainnya. Dalam praktiknya, masih sering ditemukan kasus penyimpangan atau manipulasi laporan keuangan yang menimbulkan kerugian, sehingga menimbulkan pertanyaan mengenai sejauh mana tanggung jawab Dewan Komisaris dalam melakukan pengawasan terhadap direksi. Rumusan masalah dalam penelitian ini meliputi: Bagaimana Bentuk Pertanggungjawaban Hukum Dewa Komisaris atas Pelaporan Keuangan Korporasi serta apa saja implikasi hukum terhadap Dewa Komisaris apabila terjadi pelanggaran dalam pelaporan keuangan?. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan konseptual, dengan menganalisis ketentuan dalam Undang-Undang Perseroan Terbatas, peraturan pasar modal, serta prinsip-prinsip good corporate governance.Hasil penelitian menunjukkan bahwa Dewan Komisaris memiliki kewajiban melakukan pengawasan terhadap kebijakan pengurusan perusahaan, termasuk memastikan laporan keuangan disusun secara benar dan sesuai standar yang berlaku. Apabila Dewan Komisaris lalai menjalankan fungsi pengawasan, maka dapat dimintai pertanggungjawaban hukum baik secara perdata maupun pidana sesuai ketentuan peraturan perundang-undangan. Dengan demikian, peran Dewan Komisaris sangat penting dalam mencegah terjadinya pelanggaran pelaporan keuangan dan menjaga kepercayaan publik terhadap korporasi. Hal juga di temukan belum adanya secara tegas dan spesifik pertauran yang membahasa tetang fungsi dan tangungjawab dewan komisaris.

Abstract

Purpose of the study: The purpose of the study to find out whether or not clustering technique was effective on students’ achievement in writing recount text. Methodology: This research used quasi-experimental research. The sample was selected from the population that consisted of five classes at the tenth grade. The researcher selected X5 as experimental class and X4 as control class. Purposive sampling was used by the the researcher to select a sample. Purposive sampling was used by the the researcher to select a sample. The researcher used a test as research instrument.The data were analyzed by using descriptive statitics and t-test (independent sample test) in order to calculate the pretest and posttest results. Main Findings: It can be concluded that the students got better achievement by using clustering technique in writing recount text. Novelty/Originality of this study: The result of this research could inform to teachers that using of clustering technique was able to increase the student’s writing skill. It also could be used to help the teachers in developing student’s writing skill before they started to write.

Abstract

Kurikulum 2013 menekankan penggunaan pendekatan saintifik dalam proses pembelajaran untuk meningkatkan kemampuan berpikir kritis, kreatif, dan sistematis peserta didik. Penelitian ini bertujuan untuk menganalisis implementasi pendekatan saintifik dalam Kurikulum 2013 melalui studi literatur. Metode yang digunakan adalah kajian pustaka dengan mengumpulkan dan menganalisis berbagai sumber ilmiah, seperti jurnal, buku, dan dokumen resmi terkait. Hasil kajian menunjukkan bahwa pendekatan saintifik yang meliputi kegiatan mengamati, menanya, mencoba, menalar, dan mengomunikasikan memiliki peran penting dalam membentuk kompetensi pengetahuan, sikap, dan keterampilan peserta didik. Namun, implementasinya masih menghadapi berbagai kendala, seperti keterbatasan pemahaman guru, kurangnya sarana pendukung, serta variasi kemampuan peserta didik. Oleh karena itu, diperlukan pelatihan berkelanjutan bagi guru dan dukungan fasilitas yang memadai untuk mengoptimalkan penerapan pendekatan saintifik dalam pembelajaran.
