Abstract

This study aims to analyze the level of students' critical thinking and communication skills in science learning, identifying areas of strength and weakness. A descriptive quantitative method was employed, with tests and questionnaires as instruments. This research involved 73 students from the eighth grade of a junior high school as respondents. The data analysis technique used in this research is quantitative descriptive analysis. The results of this study indicate that the level of critical thinking and communication skills of junior high school students has a significant gap in science learning. In this study for critical thinking skills, each indicator is providing simple explanations (65%) in the medium category, building basic skills (51%) in the low category, concluding (45%) in the low category, providing advanced explanations (41%) in the low category, and organizing strategies and tactics (28%) in the very low category. And for communication skills, each indicator is Expressing 45% (low), Evaluating 42% (low), Responding 59% (medium), Negotiating 49% (low). Students' critical thinking and communication skills are in the low category, this indicates the need to improve learning strategies that encourage active involvement and reflective thinking of students.

Abstract

Hak Paten merupakan hasil karya intelektual manusia yang diwujudkan dalam suatu bentuk dan fungsi tertentu, yang memiliki nilai immaterial dan nilai ekonomi, sehingga banyak pihak yang ingin mengambil keuntungan dengan cara melanggar hukum yang dapat menimbukan sengketa. Tipe penelitian yang digunakan dalam skripsi ini adalah yuridis normatif, yaitu penelitian yang ditujukan untuk mengkaji suatu kaidah- kaidah berdasarkan keabsahan bahan hukum utama dengan cara menganalisis teori, konsep, dan peraturan perundang-undangan yang berlaku yang sesuai dengan permasalahan yang dikaji. Hasil penelitian ini bahwa penyelesaian sengketa antara Nokia Technologies OY dengan PT Bright Mobile Communication awalnya diselesaikan secara damai di luar pengadilan, namun karena belum mendapatkan titik temu akirnya Nokia Technologies OY mengajukan gugatan ke Pengadilan Niaga dan selanjutnya mengajukan Kasasi ke Mahkamah Agung. Di Pengadilan Niaga, gugatan tersebut tidak diterima dengan pertimbangan kurang pihak dalam Tergugat dan pada tingkat Kasasi, Gugatan tersebut ditolak dengan pertimbangan hakim bahwa Hakim sependapat dan menguatkan putusan Pengadilan Niaga.

Abstract

Penelitian ini bertujuan untuk menganalisis hubungan hukum dan tanggung jawab Dinas Perhubungan (Dishub) Provinsi Jawa Timur dalam pelaksanaan Perjanjian Kerja Sama (PKS) dengan Perum DAMRI terkait pengoperasian layanan angkutan massal Trans Jatim Koridor I (Sidoarjo-Surabaya-Gresik). Fokus utama penelitian adalah pada kewajiban penyediaan, pemeliharaan, dan perbaikan sarana halte sebagai prasarana pendukung. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan (statute approach) dan konseptual (conceptual approach). Data dianalisis dari bahan hukum primer dan sekunder, termasuk peraturan perundang-undangan dan dokumen PKS. Hasil penelitian menunjukkan bahwa hubungan hukum antara Dishub Jatim dan Perum DAMRI adalah kemitraan strategis dengan skema Buy The Service (BTS), di mana Dishub berperan sebagai pembeli jasa dan penanggung jawab penuh atas infrastruktur, sementara DAMRI sebagai operator layanan. Tanggung jawab pemeliharaan dan perbaikan halte secara eksplisit dibebankan kepada Dishub Jatim berdasarkan PKS dan dimandatkan oleh peraturan perundang-undangan yang berlaku. Keterlambatan perbaikan halte yang terjadi karena kendala birokrasi anggaran dapat dikategorikan sebagai bentuk wanprestasi, karena alasan internal pemerintah tidak dapat dijadikan pembenaran hukum untuk menunda pemenuhan kewajiban kontraktual. Penelitian ini merekomendasikan agar Pemerintah Provinsi Jawa Timur melakukan evaluasi terhadap mekanisme pengelolaan dan penganggaran program Trans Jatim, salah satunya dengan mempertimbangkan model Badan Layanan Umum (BLU) untuk menciptakan fleksibilitas anggaran dan responsivitas yang lebih cepat terhadap kebutuhan operasional di lapangan.Kata Kunci : Perjanjian Kerja Sama, Wanprestasi, Pelayanan Publik.

Abstract

Penelitian ini bertujuan untuk menganalisis pertanggungjawaban korporasi dalam tindak pidana lingkungan pada sektor pertambangan batu bara di Indonesia, serta kerangka hukum yang mengatur sanksi terhadap korporasi tersebut. Penelitian ini didasari oleh banyaknya kasus kerusakan lingkungan yang disebabkan oleh kegiatan pertambangan batu bara, yang mencakup pencemaran udara, air, kerusakan lahan, dan hilangnya keanekaragaman hayati. Undang-Undang Nomor 32 Tahun 2009 tentang Perlindungan dan Pengelolaan Lingkungan Hidup (UU PPLH) dan Undang-Undang Nomor 3 Tahun 2020 tentang Perubahan Kedua atas Undang-Undang Nomor 4 Tahun 2009 tentang Pertambangan Mineral dan Batubara (UU Minerba) merupakan regulasi yang digunakan untuk menanggulangi masalah ini. Melalui penelitian ini, ditemukan bahwa korporasi seringkali mengabaikan peraturan lingkungan yang ada, yang menyebabkan terjadinya tindak pidana lingkungan. Kasus penting yang menjadi sorotan adalah putusan Mahkamah Agung 4068 K/Pid.Sus/2023 yang menegaskan bahwa korporasi dapat dimintai pertanggungjawaban pidana atas kerusakan lingkungan yang disebabkan oleh operasi mereka. Keputusan ini menunjukkan adanya langkah positif dalam penegakan hukum lingkungan di Indonesia, meskipun masih banyak tantangan dalam pelaksanaannya, terutama terkait dengan struktur perusahaan yang kompleks dan pengaruh politik serta keuangan yang besar. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan dan kasus. Hasil penelitian ini diharapkan dapat memberikan kontribusi bagi pengembangan hukum pidana korporasi, khususnya dalam penegakan hukum lingkungan di sektor pertambangan batu bara di Indonesia.

This article explores the legal consequences of agreements entered into by individuals or entities lacking proper legal authority to act on behalf of another party. Within the framework of Indonesian civil law, especially as outlined in the Kitab Undang-Undang Hukum Perdata (Civil Code), the validity of such agreements is subject to strict requirements concerning consent, authority, and legal competence. The study highlights the distinction between void and voidable contracts, emphasizing the legal implications of agreements made ultra vires or without representation. By examining doctrinal legal principles and relevant case studies, this paper demonstrates how the absence of authority affects the binding power of a contract, and under what conditions a third party may be held liable. The analysis also touches upon the principle of good faith, apparent authority, and ratification as possible legal remedies. This research contributes to a clearer understanding of the boundaries of legal representation and the protection of contractual rights in civil transactions.

Abstract

This study was conducted because students' HOTS is still relatively low because students are still unable to follow the HOTS learning pattern. The purpose of this study was to determine the increase in students' HOTS after the application of the PBL model assisted by KOKAMI media on the Earth and Solar System material. This study used a quasi-experimental design method and was carried out at SMPN 1 Pasean. The study population was all grade VII students in the 2024/2025 Academic Year. Sampling used a purposive sampling technique. The sample used was class VII-A. The analysis technique for increasing students' HOTS used the N-gain test. The results of the study showed that there was an increase in students' HOTS after the application of the PBL model assisted by KOKAMI with an average n-gain result of 0.71 in the high category.

Abstract

The level of digital technology development has changed the pattern of communication in society and opened up a wide space for expression in the public sphere. However, the freedom of expression guaranteed by the 1945 Constitution of the Republic of Indonesia often conflicts with the application of Article 27A in conjunction with Article 45 of Law Number 1 of 2024 concerning Electronic Information and Transactions (ITE Law). This provision is considered to be open to multiple interpretations, potentially leading to criminalisation and causing a negative deterrent effect that reduces public participation in democracy. This study aims to answer the main question: how does the application of this article affect the protection of freedom of expression in Indonesia, and to what extent is it consistent with the principles of legality, proportionality, and human rights standards? The research method uses a normative legal approach with a qualitative design. Data was collected through a literature study of legislation, legal doctrine, court decisions, and academic literature. The analysis was conducted deductively and comparatively to assess the conformity of legal norms with enforcement practices and international standards such as the ICCPR. The results of the study show that the application of Article 27A in conjunction with Article 45 of the ITE Law still causes legal uncertainty and is often used as a repressive instrument. The cases of Jerinx SID, Baiq Nuril, and Muhammad Kace illustrate how this article is used inconsistently, sometimes ignoring the principles of legality and proportionality. These findings confirm that there is a serious gap between the constitutional protection of freedom of expression and law enforcement practices. The conclusion of this study emphasises the need for restrictive interpretation and reformulation of the articles of the ITE Law to be more in line with the principles of a democratic state based on the rule of law. Theoretically, this study enriches the discourse on digital criminal law, while in practical terms, it provides recommendations for policymakers and law enforcement officials to prioritise substantive justice and a restorative justice approach. Further research is needed to explore the empirical practices of officials in implementing Constitutional Court decisions, as well as comparisons with other countries in regulating freedom of expression in the digital space.conflicts.

Abstract

The level of legal literacy among Indonesians is still relatively low, requiring more effective educational strategies that are closely related to everyday life. In the digital age, social media has become a communication channel that can reach a wide audience quickly, interactively, and participatively. One initiative that has been undertaken is the use of the Instagram account @spripimpoldajatim by the East Java Regional Police as a means of legal education. The urgency of this research lies in the importance of understanding the effectiveness of police social media in increasing public legal awareness. The main questions of this research are how the account is used as an instrument of legal education, what types of content are used, and to what extent it is effective in building public legal literacy. This study uses a descriptive qualitative approach with a combination of sociological and juridical perspectives. Data were collected through observation of the Instagram account content, interviews with account managers and active followers, documentation of uploaded archives, and literature studies. Data validity was strengthened through source triangulation, while data analysis was conducted using inductive, deductive, and comparative methods. The results show that @spripimpoldajatim actively presents legal education content in the form of infographics, short videos, and narratives of actual cases with a humanistic communication style. Visual and narrative strategies have been proven to increase public interaction, as evidenced by the high number of likes, comments, and shares. Content based on current issues and storytelling is the most effective format for attracting audience attention. These findings confirm that police social media can be an instrument of participatory digital legal literacy, although there are still limitations in reaching non-digital communities and risks of misperceptions of information. The conclusion of the study emphasises that the use of social media by the police contributes theoretically to the development of digital legal communication studies and provides practical benefits for legal education strategies in the information age. Further research using a mixed-method approach and comparisons between police accounts is recommended to strengthen the generalisation of the results.
