Abstract

Perkembangan teknologi finansial telah melahirkan berbagai inovasi layanan keuangan digital, salah satunya adalah aplikasi Buy Now Pay Later (BNPL) yang memungkinkan konsumen membeli barang atau jasa dengan pembayaran tertunda. Meskipun menawarkan kemudahan, penggunaan BNPL juga berpotensi menimbulkan risiko bagi konsumen, seperti bunga tersembunyi, denda keterlambatan, dan penyalahgunaan data pribadi. Penelitian ini bertujuan untuk menganalisis bentuk-bentuk perlindungan hukum yang tersedia bagi konsumen pengguna BNPL, serta mengevaluasi efektivitas regulasi yang mengatur layanan tersebut di Indonesia. Metode penelitian yang digunakan adalah pendekatan hukum normatif dengan memanfaatkan kerangka regulasi dan kajian pustaka. Temuan penelitian menunjukkan bahwa perlindungan konsumen dalam layanan BNPL belum sepenuhnya optimal karena belum adanya regulasi khusus yang mengatur skema BNPL. Namun, perlindungan sementara dapat ditemukan dalam Undang-Undang Perlindungan Konsumen, Undang-Undang Informasi dan Transaksi Elektronik, serta regulasi dari Otoritas Jasa Keuangan dan Bank Indonesia. Konsumen dilindungi dalam hal hak atas informasi, data pribadi, dan penyelesaian sengketa. Disarankan agar pemerintah memperkuat regulasi, penyedia BNPL bersikap transparan dan akuntabel, serta konsumen lebih berhati-hati dalam menggunakan layanan.

Abstract

This study aims to examine the elements of criminal acts committed by perpetrators of illegal online financing services in Indonesia. With the rapid development of financial technology (fintech), online funding services have become an alternative for the public to access financing. However, the proliferation of illegal online funding services operating without permission from the Financial Services Authority (OJK) has given rise to various legal and social problems, such as misuse of personal data, extortion, and unethical collection practices. This study uses a normative juridical method with a legislative, conceptual, and case approach to analyze the legal sanctions that can be imposed based on the Electronic Information and Transaction Law (EIT Law) and the Criminal Code (KUHP).

Abstract

This normative legal research analyzes the legal protection afforded to public transport passengers in Indonesia. Grounded in the concept of a rule-of-law state (Rechtsstaat), as stipulated in Article 1 Paragraph (3) of the 1945 Constitution, this study examines the existing legal framework—specifically Law No. 22 of 2009 on Road Traffic and Transportation and Law No. 8 of 1999 on Consumer Protection—to understand how passenger rights are guaranteed constitutionally and implemented sectorally. Using a normative legal research approach with a focus on doctrinal analysis of legislation, the study finds that passenger legal protection originates from the legal relationship created by a carriage agreement. This relationship establishes mutual rights and obligations, with the carrier held responsible for the passenger's safety and comfort, often under the principle of strict liability. Various forms of legal protection, such as mandatory insurance schemes, dispute resolution mechanisms, and prohibitions against unfair standard clauses, serve to balance the unequal bargaining power between carriers and passengers. The research concludes that legal protection for passengers is an essential pillar for ensuring safety and justice within the transportation ecosystem. As technology advances, this protection will continue to evolve to accommodate new challenges posed by autonomous vehicles and Mobility as a Service (MaaS) systems. Therefore, it is recommended that regulations be updated proactively, law enforcement strengthened, and public education promoted to ensure that passenger rights remain protected in the future

Abstract

This study uses a normative legal research method with a conceptual approach (Conceptual Approach) and a case approach (Case Approach). The main data sources are primary legal materials (the 1945 Constitution of the Republic of Indonesia, Law No. 39 of 1999 concerning Human Rights, regulations related to food safety) and secondary legal materials (scientific journals, proceedings, and news reports related to the MBG poisoning incident in East Java). The mass poisoning incident in the MBG program in East Java indicates a violation of the state's obligation to guarantee human rights. The state, through the program implementing apparatus, was negligent in applying the principle of due diligence. The results of the study indicate a lack of substantive norms related to minimum hygiene standards (SLHS/HACCP) and accountability in the food supply and supervision chain. The legal impacts that arise include criminal, civil, and administrative liability for catering providers and related officials who are proven negligent, as well as violations of Article 28H paragraph (1) of the 1945 Constitution concerning the right to a prosperous life physically and mentally. Systemic reforms in the governance of the MBG program, strengthening of food safety regulations, and transparent legal accountability mechanisms are needed to restore victims' rights and prevent recurrence of incidents.

Abstract

Civil dispute resolution in Indonesia is generally conducted through litigation; however, court proceedings are often time-consuming, costly, and tend to produce win-lose outcomes that may harm the relationship between the disputing parties. As an alternative, Alternative Dispute Resolution (ADR) offers a more efficient and constructive approach to resolving civil disputes. This study aims to examine the background of ADR as a strategy for civil dispute resolution and to analyze the effectiveness of mediation in court proceedings. This research employs a normative legal method using statutory and conceptual approaches. Primary legal materials include Law Number 30 of 1999 concerning Arbitration and Alternative Dispute Resolution and Supreme Court Regulation (PERMA) Number 1 of 2016 on Mediation Procedures in Courts. Secondary materials such as legal literature and scholarly journals support the analysis. The data are analyzed descriptively and qualitatively. The findings indicate that ADR is philosophically grounded in the values of Pancasila, particularly deliberation and consensus, and sociologically aligned with Indonesia’s customary tradition of peaceful settlement. Although mediation is mandatory in civil cases, its effectiveness remains limited due to a lack of good faith from disputing parties, insufficient public understanding, and suboptimal implementation. In conclusion, ADR, particularly mediation, serves as a relevant and strategic mechanism for resolving civil disputes in Indonesia, but its success depends on the parties’ willingness to settle and the effective role of mediators and courts.

Abstract

This study aims to examine legal liability and forms of legal protection for terminal operators in dealing with complaints regarding accidents and losses within the terminal area. The research method used is normative, employing statutory and conceptual approaches. The findings indicate that the liability of terminal operators may arise from negligence or strict liability. Complaints filed by service users are often not only administrative in nature but may also develop into legal disputes. Therefore, terminal operators must be able to perform their role as mediators in non-litigation dispute resolution. Legal protection for operators can be carried out through preventive measures such as the implementation of SOPs and MSS, as well as repressive measures through mediation and legal assistance. In addition, within the context of consumer protection and traffic insurance systems, terminal operators also play a role in supporting the restoration of victims’ rights. This study concludes that terminal operators occupy a strategic position between legal liability and the need for balanced legal protection

Abstract

This study examines the legal consequences of default in loan agreements made without notarial deeds in Indonesia, focusing on three key aspects: the legal standing of such agreements, implications of default, and dispute resolution mechanisms. The research addresses critical issues including legal uncertainty due to the absence of notarial authentication, evidentiary challenges in court proceedings, and the effectiveness of various dispute resolution approaches.  The study employs a normative juridical method with statutory, conceptual, and case law approaches, analyzing provisions in the Indonesian Civil Code (particularly Articles 1238, 1243, 1320, and 1870), relevant court decisions, and legal doctrines from various scholarly works. The findings reveal that while loan agreements without notarial deeds remain valid under Article 1320 of the Civil Code provided they meet the four validity requirements, the lack of authentic documentation creates significant evidentiary complications. Default in such agreements entitles creditors to demand performance or compensation (Article 1243), but the burden of proof often relies on weaker evidence like witness testimony. Dispute resolution may proceed through either litigation in courts or alternative methods such as mediation and arbitration, though litigation tends to be more time-consuming and costly. This study recommends formalizing loan agreements through written notarial deeds to enhance legal certainty. Additionally, it suggests public legal education about the risks of informal agreements and regulatory improvements to better protect parties involved in non-notarized loan agreements

Abstract

This study was motivated by the importance of legal protection for passengers as consumers of public transportation services, especially in relation to the responsibility of transportation companies in the event of an accident. The research question in this study is what form of responsibility public transportation companies have for accidents that befall passengers and what legal measures passengers can take to obtain compensation. The method used is normative juridical research with a legislative and conceptual approach. The results show that public transportation companies have full responsibility for passenger safety from departure to arrival at their destination, in accordance with Law Number 22 of 2009 concerning Road Traffic and Transportation and the Civil Code. Passengers who suffer losses due to accidents have the right to claim compensation through civil, criminal, or administrative mechanisms in accordance with the level of fault committed. Thus, the role of public transportation companies is very important in providing legal certainty, protection, and a sense of security for the community who use transportation services

Abstract

Diversion for children with disabilities needs to be properly understood, considering that the implementation of diversion requires the perpetrator to meet and consult with the victim. Communication is key to successful diversion. Furthermore, understanding the perpetrator, namely the child with a disability, cannot be ignored. Investigations of crimes committed by children with special needs continue to refer to Law Number 11 of 2012 concerning the Juvenile Criminal Justice System and other relevant laws and regulations. However, adjustments and special attention to the conditions of children with special needs during the investigation process are necessary to ensure the fulfillment of their rights and the best interests of the child. While the principle of legal certainty remains the foundation, investigations of children with special needs who commit crimes must be conducted with attention to the child's special needs. Diversion is based on the principle of restorative justice, which emphasizes restoring relationships between the perpetrator, victim, and community. Implementation of Diversion for Children with Special Needs: Identifying Special Needs: It is important to identify the child's special needs, such as intellectual disabilities, physical disabilities, or other developmental disorders.

Abstract

Popular peer-to-peer lending fintech is also called online lending. As an innovation in the financial sector, online loans offer financial assistance to people in need and applying for loans is quite easy. Online lenders as financial service providers are regulated by the Financial Services Authority, which is an institution legally authorized to regulate, supervise, audit and investigate the financial services sector. However, in practice, online loan management in Indonesia often causes problems even though it is regulated and supervised by the OJK. These problems are related to personal data breaches, resolving intimidation, and several other problems. The purpose of this research is to find out what the legal regulations for online loans are in Indonesia and what legal protection is given to borrowers who make online loans through legal regulations in order to avoid problems related to online loans. This research uses normative legal research methods, the approach used is a legal approach. The results of this research show that the basis for regulating online loans is in OJK Regulation Number 10/POJK.05/2022 concerning Technology-Based Community Financing Services. The legal protection for online borrowers is divided into preventive protection, namely protection against criminal acts, and contains prohibitions on online borrowing. And law enforcement protection to resolve disputes that arise, support through out-of-court dispute resolution tools, the Alternative Financial Services Sector Dispute Resolution Institute (LAPS SJK) and legal defense of debtor interests by assisting in the initiation of legal efforts
