Abstract

Regional autonomy entails the rights, authorities, and responsibilities granted to autonomous regions, allowing them to oversee and manage their own government affairs and address local community interests in accordance with established laws and regulations. This research aims to identify the entities responsible for collecting market service fees and directing them to the local revenue office. The discussion is based on previous research findings. From these discussions, it becomes evident that several factors influence the contribution of market retribution collection to locally generated revenue. The research employs a descriptive qualitative analysis method to interpret various conditions and situations. Data collection includes interviews conducted at the Yogyakarta city regional revenue service and Yogyakarta city market. With this approach, it is anticipated that the contribution from market service levies to local revenue services will be realized. The research results conclude that by using market fees as one of the main sources of income, local governments can reduce their dependence on fund transfers from the central government.

Abstract

This study analyzes the sanctions for adultery in interfaith marriages based on the Indonesian Criminal Code (KUHP) and Islamic criminal law (fikih jinayah). Using a normative legal method, this research applies both Islamic law and comparative law approaches to evaluate the differences in the regulation of adultery within the two legal systems. The data sources consist of primary legal materials (KUHP, Compilation of Islamic Law, the Book of Fikih Jinayah, and the Marriage Law) and secondary legal materials (academic literature and court decisions). The analysis is conducted descriptively-analytically using the triangulation of legal sources technique. The findings show that the KUHP only criminalizes adultery as infidelity within a marriage, whereas in fikih jinayah, any sexual relationship outside a lawful marriage is considered adultery. In Islam, interfaith marriage is not recognized. Thus, such a relationship is categorized as adultery. In contrast, under Indonesia's positive law, interfaith marriages can still be recognized through specific legal mechanisms. Additionally, apostasy (murtad) has different legal consequences: In fikih jinayah, the marriage is automatically annulled, while under the KUHP, the marital status remains valid until a court decision is made. This inconsistency presents challenges in harmonizing national criminal law. Legal reform is needed to balance social norms, state law, and the principles of Sharia to create a more inclusive legal system that is adaptive to the needs of Indonesian society.

Abstract

This study aims to analyze the legality of abortion for fetuses diagnosed with Down Syndrome from the perspective of Maqasid Sharia. The research method used is normative research with a literature study approach, collecting and analyzing Islamic legal sources, scholars' fatwas, and medical research findings. The results show that, according to the majority of scholars, abortion is prohibited after the fetus reaches 120 days as it is believed that the soul has been breathed into it. However, before this period, opinions among Islamic schools of thought vary; some allow abortion under urgent necessity (darurah) or compelling need (hajat), while others strictly prohibit it. In conclusion, from the Maqasid Sharia perspective, the legality of aborting a fetus with Down Syndrome must consider the principles of protecting life (hifdz an-nafs) and lineage (hifdz an-nasl). Therefore, decisions regarding abortion should be based on the principle of public interest (maslahah), taking into account the mother's and fetus's condition and medical recommendations. Keywords: Abortion, Down Syndrome, Maqasid Sharia.

Abstract

This research aims to describe the value-based local wisdom of the Karo Batak community, especially in the customary inheritance law system. This research uses a qualitative approach with a case study method. Data were obtained from various sources, including literature, interviews with traditional leaders, and direct observation of inheritance law practices in the Karo Batak community. Data collection techniques included in-depth interviews, document studies, and participatory observation. Data analysis was conducted through data reduction, data presentation, and inductive inference. The results showed that the Karo Batak customary inheritance law is based on a patrilineal system, where the eldest son is the main heir. However, in certain situations, women also have the right to inherit property, especially if there are no sons in the family. Inherited property, especially land or hereditary property, tends to be passed down patrilineally to maintain the continuity of the lineage. In addition, the role of ancestors is very influential in the process of distributing inheritance, with strong customary mechanisms to resolve conflicts. The conclusion of this study shows that although Batak Karo customary inheritance law is still practiced, modernization has brought challenges and adaptations to this system. Urbanization, education, and the influence of national laws have led some families to adopt a combination of customary and state laws to suit social and economic needs. Therefore, policies that accommodate cultural values and aspects of justice in inheritance practices in the Karo Batak community are recommended to remain relevant to the times.
