Abstract

This article examines the practice of joint custody after divorce from an Islamic legal perspective through a legal analysis of two Sharia Court decisions, namely the Idi Sharia Court and the Aceh Sharia Court. The purpose of this study is to assess the legal basis for joint custody and to compare the legal considerations used in the two decisions. This research employs a normative legal approach using case study and conceptual analysis methods. The results of the study show differences in legal reasoning: the Idi Sharia Court took a progressive approach by applying a joint custody model through the division of roles between both parents, while the Aceh Sharia Court took a conservative approach by prioritizing the psychological stability of the child and granting sole custody to the mother. This comparison confirms that although both are based on the principles of the best interests of the child and maqāṣid al-syarī‘ah, their implementation results in different rulings.

Abstract

The Constitutional Court Decision No. 150/PUU-XXII/2024 allows civil servant lecturers to engage in the legal profession as advocates, strictly within the framework of community service. This study aims to examine the normative structure of both the legal profession and the civil service, analyze the content of the Constitutional Court's decision, and assess its implications from the perspective of fiqh siyasah (Islamic constitutional political jurisprudence). This research employs a normative legal method using statute, case, and conceptual approaches, supported by classical and contemporary Islamic political theory. The findings reveal normative disharmony between the Court's decision and the Law on Advocates, the Civil Service Law, and the Law on Civil Servant Discipline. Although the ruling offers individual benefit (maslahah), from the perspective of fiqh siyasah, combining the roles of lecturer and advocate contradicts the principle of separation of power (ta'addud al-mas'uliyyah) and may trigger structural disruption within public institutions. Therefore, the policy should be accepted only under strict regulatory control and institutional ethical oversight to safeguard justice, neutrality, and governance stability

Abstract

Kegiatan Pengabdian kepada Masyarakat (PKM) ini bertujuan meningkatkan pemanfaatan limbah desa berupa kulit kakao, jerami padi, dan urine kambing sebagai bahan baku pupuk organik cair (POC) yang ramah lingkungan. Pelatihan dilaksanakan di Desa Arralle Utara, Kecamatan Arralle, Kabupaten Mamasa dengan metode sosialisasi, penyampaian materi, praktik pembuatan POC, serta diskusi interaktif. Hasil kegiatan menunjukkan peningkatan pengetahuan dan keterampilan masyarakat dalam mengolah limbah menjadi produk bernilai guna. Analisis SWOT mengidentifikasi kekuatan berupa ketersediaan bahan baku melimpah dan dukungan masyarakat, kelemahan pada keterbatasan fasilitas dan modal, peluang melalui tren pertanian organik, serta ancaman berupa dominasi pupuk kimia. Program ini berkontribusi pada pemberdayaan masyarakat desa, pengurangan limbah, serta mendukung pertanian berkelanjutan. Ke depan, diperlukan pendampingan lanjutan untuk penguatan kapasitas produksi dan pengembangan pasar POC berbasis lokal.

Abstract

This study explores the contribution of Shaykh Al-Zaytun in shaping Mahad Al-Zaytun as a school that promotes pluralism and diversity. The aim is to provide a better understanding of how Islamic education can adapt to modern society without the need for esoteric evidence. This study also uses Pustaka methodology to identify theories related to tolerance and tolerance, as well as literature relevant to developing a culture of tolerance through education at Mahad Al-Zaytun. This study also uses a case study approach to examine the influence of Shaykh Al-Zaytun on the modern Islamic education system. This study focuses on the school's vision and the committee's commitment to tolerance. This study also highlights the potential for collaboration with other institutions, both local and international, to strengthen tolerance education. This study concludes by highlighting the importance of Shaykh Al-Zaytun's transformational leadership in promoting tolerance in everyday life.

Abstract

Introduction: Hypertension is defined as a condition in which an individual has a systolic blood pressure ? 140 mmHg and a diastolic blood pressure ? 90 mmHg. Systolic blood pressure is the main measure used to diagnose hypertension. Hypertension is often referred to as a "silent killer" due to its asymptomatic nature, causing patients to be unaware of their condition. Globally, 1.28 billion people are affected by hypertension; in Indonesia, 70 million people (28%) have hypertension, with Jakarta ranking 9th among Indonesian provinces in 2017 with a prevalence of 33.43%. Methods: This study employed a descriptive narrative case study design. The subjects were three adult patients diagnosed with hypertension. Results: The case study showed a non-pharmacological effect of lavender aromatherapy in lowering blood pressure among hypertensive patients. All three patients were given lavender aromatherapy over three days. The goal was to reduce pain and stabilize blood pressure. Expected outcomes included decreased pain complaints, improved vital signs, and reduced BP. Conclusion: This study suggests that lavender aromatherapy can serve as an alternative nursing intervention for reducing blood pressure in hypertensive patients and can be independently administered by nurses as a non-pharmacological therapy.

Abstract

This study aims to determine the hard-working character of fifth-grade students at SDN 12 Singkawang and to examine their scientific literacy skills. It also aims to identify the relationship between the hard-working character and scientific literacy skills of fifth-grade students at SDN 12 Singkawang. This research employed a quantitative approach with a descriptive method and an associative correlational research design. The population of this study consisted of all fifth-grade students, divided into two classes, VA and VB, totaling 60 students. The sampling technique used was saturated sampling. The data collection instruments were questionnaires and essay tests. The data were analyzed using descriptive statistical analysis and correlation analysis. The results showed that the average score of the students’ hard-working character was 67.23, which falls into the “good” category. Meanwhile, the average score of students’ scientific literacy skills was 80, categorized as “high.” The correlation analysis revealed a significant relationship between the hard-working character and the scientific literacy skills of fifth-grade students at SDN 12 Singkawang, with a determinant coefficient of 17.64% and a t-value of 3.516, which is greater than the t-table value of 2.002.

Abstract

The phenomenon of tabattul, or living a bachelor life without the desire to marry, is increasingly found in Sei Bamban Village, Batang Serangan District, Langkat Regency. Based on observations, there are about twenty people over the age of forty who choose not to marry due to economic factors and concerns about not being able to provide for a spouse. This study aims to analyze this phenomenon from the perspective of maslahah mursalah. The approach used is descriptive qualitative through observation, interviews, and documentation techniques. The results of the study show that the practice of tabattul is not in line with the principles of Islamic teachings and does not meet the criteria of maslahah. According to the Indonesian Ulema Council of Batang Serangan Subdistrict, Islam encourages marriage as the sunnah of the Prophet Muhammad and a means of preserving lineage, honor, and social stability. This study concludes that the decision to remain single without a shar'i reason has the potential to cause social mafsadah, such as alienation and the weakening of family values. The implications of this study emphasize the need for contextual da'wah strategies and economic empowerment programs so that the community can re-understand the meaning of the maslahah of marriage in Islamic life.

Abstract

This study discusses the leadership rights of former corruption convicts in government, especially through the Constitutional Court Decision Number 03-03/PHPU.DPD-XXII/2024, highlighting how constitutional rights and ethics of leadership in government. This study uses a normative legal method to analyze the application of legal norms and collect data through literature studies, including the Constitutional Court Decision Number 03-03/PHPU/DPD-XXII/2024. This paper raises 2 (two) problem formulations, namely: (1) How is the leadership of corruption convicts in government based on the Constitutional Court Decision Number 03-03/PHPU/DPD-XXII/2024 and (2) What is the view of fiqh siyasah on the leadership of former corruption convicts in government. The results of this study indicate that the rights of former convicts to lead in government are recognized based on the Constitutional Court decision, which is a constitutional right that must be recognized and restored. However, this is considered contrary to Islamic principles and leadership ethics, which consider individuals with a history of corruption unfit to lead. From the perspective of siyasah fiqh, the opportunity for former convicts to participate in elections is considered not in accordance with the leadership criteria set by the sharia

Abstract

This study uses a qualitative research approach where qualitative research as a scientific method is often used and implemented by a group of researchers. Qualitative research is conducted to build knowledge through understanding and discovery. The results of this study regarding the Evaluation of Regional Regulation Number 7 of 2005 concerning the Prohibition, Distribution and Sale of Alcoholic Beverages in Tangerang City can be said to have been running well but still not optimal. This is because there are still shortcomings in the implementation of the Tangerang City Prohibition, Distribution and Sale of Alcoholic Beverages policy in the policy input so that it affects the process of implementing the policy. The conclusions of this study are as follows: First, based on the input dimension, on the aspect of human resources in implementing the policy, Second, based on the process dimension, the mechanism for implementing this policy is quite clear, starting from raids, data collection of evidence, to action to sanctions given. can be said to be sufficient but still has some shortcomings, Third, based on the output dimension of implementation, the results of the implementation process of this policy itself are still not optimal in accordance with the objectives stated in the regional regulation itself, Fourth, based on the outcome dimension, the real impact caused by the implementation of the Prohibition, Distribution and Sale of alcoholic beverages can be seen that there are changes in people's lifestyle patterns. Abstract

Joint Regulation of the Minister of Religious Affairs and the Minister of Home Affairs No. 9 and No. 8 of 2006 is a regulation that regulates the provisions of the establishment of houses of worship. In its implementation, this regulation has been debated because the provision to obtain a permit to establish a house of worship depends on the approval of others. This article aims to answer questions about the implementation of article 14 in the joint regulation of the minister of religion and the minister of home affairs No. 8 and 9 of 2006 concerning the establishment of houses of worship (Church) from the perspective of fikih siyasah. In this research using empirical juridical research approach that examines the provisions of the establishment of houses of worship (churches) found in Perlabian Village, Kampung Rakyat Subdistrict, Labuhanbatu Selatan Regency in the Joint Regulation of the Minister of Religion and the Minister of Home Affairs No. 9 and No. 8 of 2006. Furthermore, the regulation is analyzed by using the approach of legislation - invitation, and using library research techniques or literature studies in collecting legal materials. Furthermore, the legal material is processed and analyzed using siy?sah dust?riyyah studies systematically so that it becomes concrete data. The result of this research is the provision of the establishment of houses of worship in Perlabian village, Kampung Rakyat sub-district, has not been fulfilled optimally in its administration such as Building Permit and local community support of at least 60 people authorized by the local village head as contained in article 14 paragraphs 1, 2 and 3 of the Joint Regulation of the Minister of Religion and the Minister of Home Affairs No. 8 and No. 9 of 2006. In line with the above conclusions, the application of the articles in the law should be done by the government that does not cause chaos in the midst of society by enforcing and providing education - education on understanding the applicable law and the government must also be proactive in seeing the situation and conditions in the midst of society in applying the law balanced with local regulations (PERDA) (Labuhan Batu Selatan) to avoid the content of substance that is chaotic in order to have binding legal force.
