Abstract

Penyelesaian kasus kejahatan mengalami perkembangan cukup pesat. Pasalnya, penyelesaianmelalui pengadilan dan non pengadilan menghiasi rana peradilan pidana diIndonesia. Secara subtantif, terjadi pergeseran pemidanaan yang semulanya menititikberatkan pada pembalasan (retributif) menjadi pemulihan (restoratif). Konsep keadilan restoratif (restorative justice) hadir sebagai jawaban atas kekhawatiran masyarakat utamanya korban yang mengalami kerugian secara materil maupun inmateril.Dalam perjalanannya, keadilan restoratif telah menjadi instrumen fundamentaldalam sistem peradilan nasional, misalnya tindak pidana anak melalui diversi.  Bahkan tercatat dalam sejarah, keadilan restoratifmelalui Komisi Kebenaran dan Rekonsiliasi pernah diberlakukan sebagai jalan penuntasan kejahatan HAM. Akan tetapi, pada akhirnya Undang-Undang Komisi Kebenaran dan Rekonsiliasi dicabut atas Putusan  Mahkamah Konstitusi Nomor 6/PUU-IV/2006dan kembali menjadi Program Legislasi Nasional 2015-2019. Dengan demikian, restorative justice bagi kejahatan HAM mengalami pasang surut dan dimungkinkan adanya prospek keadilan restoratif pada praktik peradilan pidana di Indonesia.Kata Kunci: Keadilan Restoratif; Kejahatan; HAM; KKR.

Abstract

The purpose of this study is to determine the legal position of the digital credit service financing agreement (PayLater) according to the fiqh school, to determine the legal position of the digital credit service financing agreement (PayLater) according to positive law. To find out how to resolve disputes over digital credit service financing agreements (PayLater) due to default. In answering these problems, the author uses normative (syar'i) and juridical theology. This research is classified as library research (library research), data collected using library data in the form of books, journals, articles in both electronic media and print media as data, then analyzes the contents of the literature relating to the problems discussed, then reviews and The results of this study show that the scholars of the madhhab agree that in this transaction it is not allowed to qardh which aims to bring profit to the borrower. Meanwhile, according to positive law, the position of debt and receivables is explained in OJK Regulation Number 77/POJK.07/2016 concerning Information Technology-Based Money Loan Services which regulates the implementation of Fintech peer to peer lending (P2PL) as business actors who pay attention to the form of registration and licensing of the organizing institution, future governance and risk management and periodic reports to the OJK as well as a form of education to consumers regarding legal protection. And based on the positive law that applies in Indonesia, there are two routes that can be used in dispute resolution, namely the litigation route and the non-litigation route. In dispute resolution carried out by the lender and the loan recipient, they do not choose to use dispute resolution methods with these channels, but the lender and loan recipient prefer to carry out internal settlements, and provide administrative sanctions for defaulters.

Abstract

Divorce can be done by anyone who has been married including Civil Servants. The main point of this research is the Implementation of Government Regulation No. 45 of 1990 concerning Divorce Permits for Civil Servants (PNS) in Maros Class 1B Religious Court. This study aims to determine the extent of implementation/application of Government Regulation Number 45 of 1990 concerning divorce licenses for civil servants in the Maros Religious Court. The type of research used is Qualitative Field Research with descriptive methods and sociological approaches. The results showed that the Maros Religious Court class IB has implemented the mandate of Government Regulation number 45 of 1990 concerning divorce permits for civil servants in the Maros Religious Court class IB in terms of providing services. Because every civil servant who wants to carry out a divorce first gets permission from the superior.

Abstract

The subject matter of this study is the Islamic Law view on Reimbursement of Witness Costs in Fulfilling Summons Based on Article 229 of the Code of Criminal Procedure in Gowa District from an Islamic legal perspective. The type of research used in this study is a type of qualitative descriptive field research, as for the approach used, normative juridical and normative theological approaches, then the primary data sources are interviews conducted at the Gowa Police Station, the Gowa Prosecutor's Office and the community who have been witnesses in solving cases in Gowa district. Both secondary data sources are sourced from books, journals, and other sources related to this research. Data collection methods carried out, namely observation, interviews, documentation and literature studies. The results of the research obtained are that the reimbursement of witness summoning costs in Gowa district has not been carried out in accordance with what is stipulated in Article 229 of the Code of Criminal Procedure. The inhibiting factors are because the budget items given each year only increase by a few percent while the increase in the number of cases that occur and those reported soar every year, and causes the reimbursement of witness summoning costs has not been optimally applied. In Islamic law, the reimbursement of the cost of summoning witnesses is not specifically regulated but in the Qur'an is equated with the granting of the right to all to create justice for human beings.

Abstract

Peran perguruan tinggi dalam dunia pendidikan adalah untuk menyebarkan ilmu pengetahuan kepada masyarakat luas. Salah satu bentuk penyebaran ilmu pengetahuan adalah melalui Pengabdian Kepada Masyarakat.Program Studi Ilmu Komputer merupakan salah satu program studi di STMIK Kreatindo yang mempunyai tugas dan tanggung jawab dalam melaksanakan pengabdian pada masyarakat. Pondok Pesantren Hidayatullah Manokwari memiliki Pendidikan tingkat Madrasah Ibtidayah, Madrasah Tsanawyah, Madrasah Aliyah. Sejak diberlakukannya pembelajaran daring oleh pemerintah, mata pelajaran TIK sudah tidak diajarkan lagi disekolah-sekolah untuk sementara waktu.Tujuan yang ingin dicapai melakui pelaksanaan kegiatan PKM ini adalah membantu meningkatkan kemampuan dan pemahaman TIK siswa-siswi Pondok Pesantren Hidayatullah Manokwari sehingga dapat menyelesaikan tugas-tugas yang berhubungan dengan TIK yang diberikan oleh guru kelas mereka. Mampu mengaplikasin tugas-tugas yang diberikan menggunakan database Ms. Access. Mampu membuat aplikasi sederhana menggunakan database Ms. Access. Membina kerjasama dengan berbagai pihak terkait, terutama pihak sekolah Pondok Pesantren Hidayatullah Manokwari.Kegiatan PKM yang dilaksanaan dengan cara hybrid yaitu offline dan online serta praktik langsung di ruang laboratorium Pondok Pesantren Hidayatullah Manokwari menggunakan aplikasi Ms. Office 2013. Dalam pelatihan ini, siswa-siswi mengikuti pelatihan dengan sangat antusias. Kemampuan dan pemahaman para siswa sangat baik dalam menerima materi yang telah diberikan. Hal ini terlihat ketika para siswa-siswi dapat menyelesaikan setiap tugas yang diberikan oleh pemateri. Hasil dari pelatihan ini, para siswa-siswi telah mengenal tools-tools dasar dari Ms. Access, memahami cara membuat database menggunakan Ms. Access kemudian ditampilkan menggunakan design view dan datasheet view, menyaring data menggunakan perintah dasar sql, membuat database menggunakan wizard, serta menampilkan laporan dari database.

Abstract

Pondok Pesantren Hidayatullah Manokwari memiliki adalah Lembaga Pendidikan agama islam yang terdiri dari Pendidikan tingkat Madrasah Ibtidayah, Madrasah Tsanawyah dan Madrasah Aliyah. Sayangnya, sejak diberlakukannya pembelajaran daring oleh pemerintah akibat wabah covid-19 yang mengharuskan Masyarakat tetap tinggal dirumah, sehingga mata pelajaran TIK untuk sementara waktu sudah tidak diajarkan lagi disekolah-sekolah. Oleh karena itu, siswa harus memiliki kemampuan untuk belajar TIK secara mandiri saat mereka mengerjakan tugas-tugas yang diberikan oleh guru mereka di kelas. Mata pelajaran TIK sangat penting karena dapat meningkatkan kemampuan siswa dan membentuk karakter mereka. Kondisi dan situasi seperti ini membuat tugas sekolah yang diberikan oleh guru TIK menjadi sulit bagi siswa untuk menyelesaikannya. Selain itu, siswa kekurangan pengetahuan dan pemahaman tentang cara menggunakan komputer dan aplikasi Microsoft Office. Tujuan dari kegiatan PKM ini adalah Meningkatkan keterampilan dan pemahaman siswa Pondok Pesantren Hidayatullah Manokwari tentang teknologi informasi khususnya mengenai penggunaan Microsoft Office, sehingga mereka dapat menyelesaikan tugas-tugas yang berkaitan dengan teknologi informasi yang diberikan oleh guru kelas mereka. Hasil dari pelatihan ini yaitu Para siswi telah mengenal tools-tools dasar dari Ms. Word, Excell dan PowerPoint. Telah memahami penggunaan menu-menu dasar yang ada di Ms. Office. Pada ms. Excell mereka telah memiliki kemampuan untuk menyelesaikan kasus-kasus sederhana menggunakan rumus rumus dasar pada excell seperti melakukan operasi dasar statistik. Telah mampu membuat presentasi yang menarik dengan menggunakan tools-tools dari Microsoft power point dan penggunaan animasi untuk slide dan animasi untuk content dari slide yang telah buat.

Abstract

The purpose of this study is to explain the preliminary research stage that was conducted at Jambi City Elementary School as preliminary data for research on the development of scientific and Islamic interactive multimedia based on discovery learning for digital era. The descriptive technique utilized in this study explains the preliminary research stage of the PLOMP development model. Interview guidelines and student digital literacy surveys were utilized as study instruments. According to the findings of the investigation, pupils’ digital literacy was in the good category, with percentages ranging between 62% and 65%. This implies that students can keep up with technical advancements in digital-era learning. This is an opportunity to create an ICT-based multimedia. This study will create scientific and Islamic interactive multimedia based on discovery learning to promote learning in the digital age while also exposing scientific principles and truths that are believed to exist in Islam.

Abstract

This study aims to produce a product in the form of an android-based floor exercise application learning at SD Negeri 113 Jambi City. The background of the problem in this study is that some students at school are still not able to do good and correct basic gymnastic movements because some students still do not understand the correct steps of movement so that they experience obstacles in learning. This floor exercise application has been developed accurately, incorporating the latest movements, techniques, and practical, easy-to-use rules in learning. This research was conducted at Public Elementary School 113 with research subjects namely students of SD N 113 Jambi City. The research method used is the ADDIE model development research. The steps of this research start from analysis, design, development, implementation to evaluation. The results of the analysis of the research data show that the percentage score of the product trials carried out is 80% to 90% in the good category so that it can be concluded that this android-based floor gymnastics application product is suitable for use by students and teachers, especially sports.

Abstract

The purpose of this qualitative study was to investigate and understand the students’ perception of Class V at one private university in Jambi. The qualitative method was used to carry out this study using semi-structured interview by asking questions to the participants in relation to what the students’ perceived about subjects presented using Class V in the endemic era. A semi-structure interview was employed as the technique of collecting the data. There were four participants who were willing to join the interview process. The findings of this study depicted that the role of Class V is very helpful for the students related to their assignment, presence, module and others helpful features. Through Class V the students feel easy to get the material, they could download the material or upload the assignment anytime and anywhere as they have already dealt it with the lecturer. The three salient themes appeared in this research were general perceptions about Class V, the role of Class V and problems of using Class V and the solution. As a part of Blended Learning system Class V is an alternative way for students in this endemic era.

Abstract

In an era of dynamic legal development, this research aims to optimize the selection process of Constitutional Court judges in order to improve the integrity of just decisions. The background of this research is based on the need for a transparent and trustworthy judicial system for the community. This need arises from concerns about fraud and manipulation in the judicial process that can undermine public confidence in the legal system. The accuracy of the use of research approaches and methods plays an important role in this research, so this research uses a quantitative approach with a literature study method, namely by analyzing data from various sources such as relevant books or journals. The results show that the selection process of Constitutional Court judges still needs to be improved to ensure the integrity of the decisions produced. This improvement is important to ensure the sustainability of the Indonesian legal system and the integrity of decisions in accordance with the law and state administration. Clear and standardized selection process reforms and effective oversight are needed to improve the quality of constitutional judges and ensure high decision integrity. In conclusion, there is a need to increase transparency and accountability in the selection process of Constitutional Court judges in order to create more equitable justice that is recognized by the community. The implication of the results of this study is the need for reform in the judge selection system to ensure the upholding of the rule of law and public trust in the judiciary. Abstrak Pada era perkembangan hukum yang dinamis, penelitian ini bertujuan untuk mengoptimalkan proses seleksi hakim Mahkamah Konstitusi guna meningkatkan integritas putusan yang berkeadilan. Latar belakang penelitian ini berdasarkan pada kebutuhan akan sistem peradilan yang transparan dan dapat dipercaya bagi masyarakat. Kebutuhan ini timbul dari kekhawatiran akan kecurangan dan manipulasi dalam proses peradilan yang dapat merusak kepercayaan masyarakat terhadap sistem hukum. Ketepatan penggunaan pendekatan dan metode penelitian berperan penting dalam penelitian ini, sehingga penelitian ini menggunakan pendekatan kuantitatif dengan metode studi pustaka yakni dengan analisis data dari berbagai sumber seperti buku atau jurnal yang relevan. Hasil penelitian menunjukkan bahwa proses seleksi hakim Mahkamah Konstitusi masih perlu diperbaiki guna memastikan integritas putusan yang dihasilkan. Perbaikan ini penting untuk memastikan keberlangsungan sistem hukum Indonesia dan integritas putusan yang sesuai dengan hukum dan ketatanegaraan. Reformasi proses seleksi yang jelas dan baku serta pengawasan yang efektif diperlukan untuk meningkatkan kualitas hakim konstitusi dan memastikan integritas putusan yang tinggi. Sebagai kesimpulan, perlu adanya peningkatan transparansi dan akuntabilitas dalam proses seleksi hakim Mahkamah Konstitusi agar mampu menciptakan keadilan yang lebih merata dan diakui oleh masyarakat. Implikasi dari hasil penelitian ini adalah perlunya reformasi dalam sistem seleksi hakim guna memastikan tegaknya supremasi hukum dan kepercayaan publik terhadap lembaga peradilan.
