Abstract

This research aims to understand the relationship between the practice of polygamy and gender equality from the perspective of Pancasila, the constitution and Islamic teachings. This research uses a qualitative method with a case study approach. The research results show that the practice of polygamy, from the perspective of Pancasila, the Indonesian constitution and Islamic teachings, faces challenges in achieving the principles of justice and gender equality guaranteed by the state. Islam permits polygamy with strict conditions to ensure justice, but implementing this principle in practice often experiences difficulties and has significant social impacts. Therefore, more gender-sensitive legal reform is needed to protect women's rights and achieve gender equality in accordance with the principles of Pancasila and the values ​​of justice in Islam.

Abstract

This study aims to explore and analyze harmonization between Islamic law and national law in the perspective of Pancasila. As a country with the majority of Muslims and the secular constitution based on Pancasila, Indonesia faces unique challenges in integrating the values of Islamic law with the principles of national law. Qualitative approach to the descriptive method is used in this study to understand how these two legal systems can be demonized by considering the values contained in Pancasila, such as humanity, unity, and social justice. Research data was obtained through in-depth interviews with legal, ulama, and practitioners, as well as through literature studies on books, journals, and official documents. The results show that while there is a fundamental difference between Islamic law that is normative-ematic and secular national law, Pancasila values can serve as a strong foundation for achieving harmonization. An inclusive and dialogue-based approach between stakeholders is needed to tackle legal conflict that may arise and ensure that the resulting national legal system remains fair and reflects the diversity of Indonesian society. The proposed recommendations include an increase in dialogue between stakeholders, the clearer legal regulatory reform, Pancasila-based legal education and training, as well as increasing public awareness of the importance of harmonization laws. With these measures, it is hoped that the harmonization of Islamic law and national law in the perspective of Pancasila can be realized effectively, strengthen social justice, and maintaining the unity of the nation in the framework of an inclusive legal state.

Abstract

Pancasila, as Indonesia’s state ideology, serves as a guiding principle in regulating various aspects of life, including marriage law. Marriage, as both a social and religious institution, carries complex legal dimensions, particularly for Muslims where Islamic law holds significant influence. However, as a Pancasila-based state that values diversity, marriage regulations must reflect principles of justice, unity, and human rights while accommodating religious law. This article aims to analyze how Pancasila principles contribute to harmonizing Islamic law with national law in Indonesia’s marriage context. Using normative and socio-legal approaches, this study examines the Marriage Law No. 1 of 1974 and the Compilation of Islamic Law (KHI). Findings highlight that Pancasila’s principles of deliberation and social justice provide a foundation for integrating religious and national values. This harmonization ensures that marriage regulations not only align with Islamic legal principles but also uphold democratic values and constitutional rights. The article also emphasizes the need for inclusive policymaking to sustain religious values in a pluralistic society. This study aims to foster a deeper understanding of Pancasila’s role in reconciling Islamic law with national legal frameworks and its implications for developing fair and harmonious regulations. Such legal harmonization not only promotes social justice but also strengthens national unity within the framework of peaceful religious coexistence.

Abstract

The study of marriage guardians in Islamic law and Pancasila in Indonesia is particularly relevant, given that the majority of Indonesia's population is Muslim and Pancasila is the basis of the state. In Islamic law, the marriage guardian - usually a father or male relative - plays an important role as a condition of a valid marriage, with validity dependent on the guardian's consent as a protector of women's rights. In contrast, Pancasila emphasizes social justice and gender equality, which raises the question of how the role of the marriage guardian can be harmonized with the principles of Pancasila. This research uses a normative juridical approach and comparative law method to analyze the regulation of marriage guardians in Islamic law and the influence of Pancasila on its application in national law, including in Law No. 1 of 1974 and the MUI fatwa. Case studies of marriages in Indonesia show conflicts between the authority of the guardian and the will of the woman, but also attempts at legal convergence for a more equitable solution. The research concludes that the integration of Islamic legal principles and Pancasila requires a comprehensive approach, considering Indonesia's plural social and cultural context. The results of this research are expected to assist in the development of marriage law that is inclusive and responsive to the dynamics of society.

Abstract

This research discusses how Indonesia can integrate Pancasila values in anti-terrorism policies, amidst international pressure which often leads to harsher approaches based on the standards of Western countries. An approach that prioritizes security can conflict with Pancasila principles, such as respect for human rights and social justice. Pancasila as the basic ideology of the state emphasizes the importance of balance between individual rights and the interests of society. In facing the threat of terrorism, Indonesia needs to adopt policies that not only strictly enforce the law, but also prioritize prevention through education, community empowerment and strengthening human values. This research aims to analyze how Pancasila values are implemented in Indonesia's anti-terrorism policy and the challenges that arise in harmonization with international norms. Globalization and technological developments pose new challenges in the spread of radical ideology, so policies are needed that are responsive but still based on Pancasila. Indonesia's anti- terrorism legal policy must be able to balance tough law enforcement with a humanist and dialogical approach, in line with the spirit of Pancasila which upholds just and civilized humanity. It is hoped that this research can contribute to more humane and effective policies.

Abstract

This research examines the role of citizenship in law enforcement from the perspective of domestic and Islamic law, with a focus on cases in Indonesia. In the context of national law, citizenship reflects the legal relationship between individuals and the state, where citizens have the right and obligation to participate in the law enforcement process. Meanwhile, according to Islamic law, citizen participation is based on the principle of amar ma’ruf nahi munkar, which requires Muslim individuals to encourage good and prevent evil. This research employs a doctrinal legal methodology, which involves the process of identifying, analyzing, and interpreting legal principles, norms, and doctrines to address the issues at hand. The distinctive feature of this approach is its prescriptive nature, aiming to offer solutions or recommendations regarding legal problems. The methodological framework utilized is normative or doctrinal research, also referred to as library research. This type of research relies on canonical sources (doctrinal literature) and specifically involves the use of library materials such as journals, books, legal documents, religious texts, and other relevant sources. The research primarily focuses on examining and analyzing written sources to gain a comprehensive understanding of the legal issues being studied.The research results show that there are similarities in the basic concept of citizen participation. , implementation varies depending on the social, cultural and legal context. In Indonesia, the role of citizenship in law enforcement is influenced by political dynamics and public trust in legal institutions. This study recommends strengthening legal education, developing participatory technology and harmonizing national law with Islamic law as steps to strengthen the role of citizens in law enforcement. In this way, it is hoped that law enforcement can run more effectively, fairly and in accordance with the values held by society.

Abstract

This study aims to analyze the role of citizenship as a legal instrument in the resolution of transnational agrarian disputes, which often involve more than one country and raise complex legal issues. The study focuses on three countries, namely Indonesia, Brazil and South Africa, to understand how citizenship affects land ownership and dispute resolution mechanisms. The research method used is a qualitative approach, with interviews, secondary data analysis, and legal policy evaluation. The results show that citizenship plays an important role in determining land rights and influencing the course of dispute resolution. In this context, alignment of national legal frameworks with international legal standards, as well as increased cooperation between countries, is necessary to create more effective and equitable transnational agrarian dispute resolution. This research provides novelty in identifying the importance of legal harmonization and international collaboration in addressing transnational disputes.

Abstract

Pancasila, as the foundation of the Indonesian state, plays an important role as an ethical system that guides national and state life. This study aims to explore and analyze how the values of Pancasila as an ethical system. The research method used is a literature study. Through this approach, various sources of literature such as textbooks, journal articles, academic papers, and legal documents are collected and critically analyzed. The results of this study indicate that the five principles of Pancasila, namely Belief in the One Almighty God, Just and Civilized Humanity, Unity of Indonesia, Democracy Guided by the Wisdom of Deliberation/Representation, and Social Justice for All Indonesian People each contain fundamental values. This study identifies the need for a more integrative approach in translating the principles of Pancasila into real policies and actions.

Abstract

Customary law reform in Indonesia in the context of globalization raises significant challenges and opportunities. The values of Pancasila, as the ideological foundation of the nation, play an important role in ensuring that customary law reform remains relevant, fair and rooted in local culture. Globalization encourages the modernization and homogenization of the legal system, which often contradicts the principles of customary law based on local wisdom. This article examines how Pancasila values, such as humanity, social justice, unity, and deliberation, can be integrated in the process of customary law reform to remain relevant amid global dynamics. This research uses a qualitative approach with the methods of literature study, interviews, and document analysis. Literature study was conducted to understand the theoretical context of customary law reform and Pancasila values, while interviews were conducted with legal experts, academics, and traditional leaders to obtain empirical perspectives on challenges and opportunities in customary law reform. Document analysis was conducted on policies and regulations relating to customary law and the implementation of Pancasila values in Indonesia. The results show that customary law reform based on Pancasila has great potential to deliver a legal system that is more inclusive and responsive to the needs of local communities. Key challenges identified include difficulties in harmonizing customary law with national and international law and homogenizing pressures from global standards. However, opportunities are also found in the ability of updated customary law to provide more culturally and locally relevant dispute resolution alternatives. The integration of Pancasila values is believed to strengthen the position of customary law within national and global legal frameworks.ract
