Abstract

The procurement of goods/services for government purposes is one of the instruments driving the economy; therefore, budget absorption through procurement is crucial. However, no less important is the implementation of effective, efficient, and economical procurement to maximize the benefits of budget utilization. This research is normative and employs a statutory approach. The data analysis method used is descriptive qualitative, in which data is presented descriptively and analyzed qualitatively. This study focuses on legal protection for goods/services providers in procurement agreements. Such legal protection is regulated under Article 85 of Presidential Regulation No. 12 of 2021, which establishes mechanisms for contract dispute resolution through dispute resolution services, arbitration, the Construction Dispute Board, or court proceedings. In the era of Disruption 4.0 and the challenges of VUCA (Volatility, Uncertainty, Complexity, Ambiguity), the government encourages the involvement of the private sector and society through e-purchasing via electronic catalogs. E-procurement serves as a solution to improving the efficiency of national financial management. Disputes arising from defaults in government procurement of goods/services may result in administrative sanctions or civil lawsuits, as stipulated in Presidential Regulation No. 12 of 2021.

Abstract

Legal protection of trademarks in the fashion industry has a crucial role in maintaining the identity and competitiveness of products in the midst of increasingly fierce business competition. This study aims to analyze the effectiveness of existing regulations in protecting trademark rights and identify challenges in their implementation in the digital era. The research method used is a normative juridical approach by analyzing laws and regulations, court decisions, and policies related to trademark protection. The results of the study show that although Law Number 20 of 2016 concerning Trademarks and Geographical Indications has provided a comprehensive legal framework, its implementation still faces obstacles, especially in terms of supervision of trademark infringement, lack of legal awareness among business actors, and suboptimal brand protection in digital trade. Strengthening legal protection requires a revision of regulations that are more adaptive to technological developments and strengthening dispute resolution mechanisms, including the implementation of online mediation platforms to reduce the burden of litigation. In addition, optimizing the role of the Directorate General of Intellectual Property (DJKI) through digitization of brand registration and technology-based supervision such as blockchain is a strategic step in increasing the effectiveness of legal protection. Legal education for business actors and the public must also be improved to build awareness of the importance of brand protection as a business asset with economic value. A more holistic and collaborative approach between governments, industry associations, and non-governmental organizations, the legal protection system for trademarks can be more effective, innovative, and in accordance with the dynamics of the fashion industry in the era of globalization.

Abstract

The southern coast of Trenggalek District is prone to tsunami disasters, because it is located north of the megathrust zone. This study aims to map the level of tsunami inundation risk in The Trenggalek District, especially of the coast of Watulimo Subdistrict. This mapping was done with the help of Model Builder in ArcGIS software, using scenarios of tsunami wave heights on the shore of 1 m, 2 m, 5 m, 15 m, 27 m, and 30 m. The risk map of tsunami inundation was obtained by combining the tsunami hazard map with the vulnerability map. The study results show that the area of tsunami inundation at a high-altitude scenario with wave heights of 1 m has low, medium, and high-risk levels covering 0.254 km², 0.240 km², and 0.032 km², respectively. In the 27 m scenario, which is the worst-case scenario according to Meteorology, Climatology, and Geophysics Agency (BMKG), the areas of inundation at low, medium, and high-risk levels reach 23.032 km², 16.471 km², and 7.904 km², respectively. In this 27 m scenario, four villages in Watulimo Subdistrict are almost entirely inundated by the tsunami. The results of this study are expected to be used as the material for tsunami disaster mitigation in the Trenggalek District.

Abstract

This study examines seawater intrusion in the southern part of Kebumen District, focusing on the impact of various geological formations on groundwater salinity. Groundwater samples were systematically collected from 11 locations representing alluvial, volcanic, coastal sediment, and karst geological conditions. The samples were analyzed for major ions, including calcium (Ca²⁺), magnesium (Mg²⁺), chloride (Cl-), and bicarbonate (HCO₃-), as well as Total Dissolved Solids (TDS). Ion ratios such as Mg²⁺/Ca²⁺, Cl⁻/HCO₃⁻, and Mg²⁺/(Mg²⁺+Ca²⁺), along with the Fraction of Seawater (fsea), were calculated to assess the extent of seawater intrusion. The study employed the Gibbs diagram method to identify the primary processes controlling groundwater chemistry, revealing that water-rock interactions are dominant in most samples, particularly in those affected by seawater intrusion. The results indicate significant seawater intrusion in alluvial and karst regions, especially at sampling points TP 2, TP 4, and TP 10, while volcanic and coastal sediment areas show minimal intrusion. These findings underscore the critical influence of geological conditions on seawater intrusion and highlight the need for targeted groundwater management strategies. Further research focusing on long-term monitoring is recommended to better understand and mitigate the impacts of seawater intrusion in this region.

Abstract

The Build-Operate-Transfer (BOT) Agreement is one of the cooperation schemes between local governments and the private sector in the management of regional assets, especially to finance public infrastructure development without directly burdening the regional budget. However, juridically, BOT has a unique characteristic (sui generis) because it is located at the intersection between the civil law regime and state administrative law. On the one hand, BOT was born from an agreement that is subject to the principle of freedom of contract as stipulated in the Civil Code, but on the other hand, its implementation is greatly influenced by public authority, licensing, and administrative arrangements derived from laws and regulations. This study aims to analyze the juridical characteristics of BOT agreements in regional asset management and determine the tendency of the legal regime that dominates the agreement. The research method used is normative legal research with a statutory approach and a conceptual approach. Primary legal materials include the Civil Code and Government Regulation Number 28 of 2020 concerning the Management of State/Regional Property, while secondary legal materials are in the form of doctrine and the results of previous research. The results of the study show that the BOT agreement has a dual nature, but the dominance of state administrative law is more prominent because of the existence of government authority, supervision, and restrictions on freedom of contract through regulations. Therefore, BOT cannot be understood solely as a private contract, but rather as an agreement with a public character that requires a balance between the certainty of civil law and the public interest. These findings make a normative contribution to understanding the legal position of BOT in the Indonesian legal system.

Abstract

The persistently low level of science literacy among Indonesian students, as evidenced by stagnant PISA 2022 results remaining below the OECD average, underscores a critical need to transform teaching materials to be more adaptive to technological advances. This research addresses the lack of pedagogically integrated materials on technological aspects, which often hinders students' ability to interpret scientific phenomena. To bridge this gap, the study aimed to develop science learning modules based on the Technological Pedagogical Content Knowledge (TPACK) framework and to test their validity, practicality, and effectiveness in improving junior high school students' science literacy. Following the 4D developmental model, Define, Design, Develop, and Disseminate, the research involved 120 seventh-grade students from the former Besuki Residency and 25 teachers from the East Java Science Teacher Working Group. Data collection employed expert validation sheets, user-response questionnaires, and science literacy tests, which were analyzed using the Normalized Gain (N-gain) formula. The results indicated that the TPACK-based module demonstrated high validity, with a score of 88.97% from media and materials experts. In terms of practicality, the module earned an average of 90.9%, supported by a 91.55% positive student response rate. The effectiveness test demonstrated a significant increase in science literacy, with an average N-gain of 0.70 (high category), with the problem-solving indicator showing the most substantial growth. During the dissemination stage, the module was distributed digitally to the East Java Science Teacher Working Group, where validation by 25 practicing teachers yielded a 92.4% feasibility score. This study concludes that TPACK-based modules are highly effective modern instruments for enhancing scientific competence. By integrating interactive simulations and virtual laboratories, these modules overcome physical facility limitations, making them highly suitable for widespread adoption within the national science curriculum to foster a more technologically literate generation. Keywords: science literacy, students, teaching module, TPACK, the development.

Abstract

Penelitian ini dilatarbelakangi oleh meningkatnya tindak pidana penipuan kredit yang dilakukan melalui penggunaan identitas pihak lain serta instrumen keuangan yang tidak sah. Perbuatan tersebut tidak hanya menimbulkan kerugian bagi korban, tetapi juga memunculkan persoalan hukum dalam praktik peradilan pidana, khususnya terkait penerapan ketentuan penipuan dalam Kitab Undang-Undang Hukum Pidana. Fokus penelitian ini adalah menganalisis pertimbangan hukum Majelis Hakim dalam menerapkan Pasal 378 KUHP pada perkara penipuan kredit serta menilai kesesuaiannya dengan unsur-unsur tindak pidana penipuan dan asas-asas pertanggungjawaban pidana. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan kasus. Adapun studi kasus yang dikaji secara khusus adalah Putusan Pengadilan Negeri Mojokerto Nomor 83/Pid.B/2024/PN Mjk. Data penelitian diperoleh melalui studi kepustakaan dengan menelaah peraturan perundang-undangan, doktrin hukum pidana, serta putusan pengadilan yang relevan. Hasil penelitian menunjukkan bahwa Majelis Hakim mendasarkan pertimbangannya pada pembuktian unsur-unsur penipuan, yaitu adanya rangkaian kebohongan atau tipu muslihat, kesengajaan pelaku, serta timbulnya kerugian nyata pada korban, yang dibuktikan melalui fakta persidangan dan alat bukti yang sah. Meskipun demikian, dari perspektif akademik, pertimbangan hakim masih cenderung menitikberatkan pada aspek yuridis formal. Analisis mengenai relasi kausalitas antara perbuatan pelaku dan kerugian korban, serta pendalaman asas proporsionalitas dalam pemidanaan belum diuraikan secara komprehensif. Oleh karena itu, penelitian ini diharapkan dapat memberikan kontribusi bagi penguatan kualitas pertimbangan hakim dalam perkara penipuan kredit di Indonesia.
