Abstract

Religion as a societal ideology is believed to enable it to become a paradigm for solutions to various conflicts. Islam is a religion that upholds he al-alamin in human life, builds conflict resolution in relation to customary law (ethics, moral values, morals and culture) and state law, which actually originates from Islamic legal discourse. Religion becomes a balancer for conflicts that arise from various indicators, because Islam is a legal consensus that covers various conditions and situations. Religion as an effort to mediate conflict and social friction for the benefit of society. Therefore, Islam as a principle, as a regulator of the order of human life, is a solution to the conflict theory of thought by several experts who show the existence of Islam in it.

Abstract

The purpose of this research is to reveal the history of the emergence of Ahmadiyya and its entry into Indonesia, the facts of violence against the Ahmadiyya Congregation in Indonesia and the government's role in protecting the Ahmadiyya Congregation, as well as social justice for the Ahmadiyya Congregation in Indonesia in the perspective of Islam and Pancasila. This qualitative research is a library research that collects data through literature such as journals and books. The results show that Ahmadiyya is a faith-based organization initiated and propagated by Mirza Ghulām Ahmad. There are two sects within this organization; Lahore and Qadian. The Lahore Ahmadiyah sect was spread to Indonesia through Mirza Wali Ahmad and Maulana Ahmad in 1924. Meanwhile, the Ahmadiyah Qadian sect was spread by Rahmat Ali in 1925. The Lahore sect stated that Ahmadiyah was born in 1888 while the Qadian sect stated that Ahmadiyah was born the next year. The existence of the Ahmadiyya Congregation in Indonesia is marked by a series of episodes in the form of neglected facts of social justice. Various acts of attacks, violence, persecution, and so on are portraits of the life of the Ahmadiyya Muslim Community in Indonesia as legal citizens before the law. It is understandable that the government's role in protecting the Ahmadiyya Congregation has not been maximized due to various acts of violence against the Ahmadiyya Congregation in Indonesia. Based on the fifth precept of Pancasila and from an Islamic perspective, in this case the preservation of life, lineage, property and reason, social justice has not been realized for the Ahmadiyya Congregation in Indonesia with violent attacks in the form of indiscriminate acts. vigilantes against the Ahmadiyya Congregation are still found.

Abstract

Ushuliyyah rules are the basis for understanding Islamic law which is very important to study. This article aims to explain the main concepts in ushuliyyah rules such as Manthuq and Mafhum, Dzahir and Muawwal, Nasakh, and Muradif and Musytarak. The research method uses a qualitative approach with literature study as the main data source. Research findings show that a deep understanding of the rules of ushuliyyah is very crucial for the development of dynamic and contextual Islamic fiqh. This study finds that the application of ushuliyyah rules in contemporary cases, such as legal interpretations of modern financial transactions, provides relevant and contextual solutions. These conclusions provide an important academic contribution to the study of ushul fiqh as well as offering suggestions for further research in this area.

Abstract

Mass protest provocation has become one of the most pressing challenges in maintaining social stability and public order in Indonesia. This phenomenon not only shapes public perception of demonstrations but also generates complex legal, social, and moral issues. Using an istislahi (public interest–oriented) framework, this study examines how the principle of maslahah can serve as a normative foundation for developing ethical and legal guidelines to prevent and mitigate provocation during demonstrations. Employing a library research method, this study explores relevant literature on mass action and contemporary Islamic legal thought to identify intersections between socio-political dynamics and maslahah-based legal constructions. The findings reveal that provocation within protests creates public harm (mafsadah) by triggering violence, damaging public property, and disrupting public order. The istislahi approach offers potential solutions through ethical protest guidelines, multidisciplinary collective ijtihad, and harmonization between Islamic legal values and public policy. Nevertheless, its implementation faces methodological, epistemic, institutional, and legitimacy challenges. This study highlights the urgency of integrating maslahah principles into public policy design to ensure that demonstrations remain safe, dignified, and free from provocation.

Abstract

This study examines the role of women in the agricultural sector, which often receives insufficient attention despite their significant contributions to food security and economic development. The research aims to analyze women's contributions in this sector from the perspective of Islamic law, highlighting the social, cultural, and structural challenges they face. The research employs a literature review methodology, encompassing the analysis of various academic sources, Islamic legal documents, and relevant empirical studies. The findings indicate that women play a vital role in every stage of agricultural processes, from production to the distribution of crops. However, barriers such as limited access to land, capital, technology, and education often impede their full potential. Islamic law upholds the principles of gender justice and equality, affirming women's rights to actively participate in economic activities, including agriculture. The study underscores the importance of empowering women through policies that enhance resource access, education, and legal protection while addressing patriarchal norms that restrict their role in decision-making.

Abstract

The development of contemporary Islamic economics demonstrates a significant diversity of paradigms of thought, particularly through three main schools of thought: Iqtishaduna (Muhmmad Baqir al-Sadr), which rejects Western economic theory and emphasizes distributional inequality; Mainstream (Chapra, Mannan, Siddiqi), which integrates conventional concepts with sharia values; and Alternative-Critical (Timur Kuran), which criticizes the lack of originality of the islamic system. This study aims to analyze the differences in the characteristics of these paradigms, their critical implications for the implementation of modern Islamic economics, and their values in the context of maqasid al-syariah. Using a descriptive-qualitative approach with a normative-empirical literature study, the analysis is carried out through paradigm mapping, critical evaluation, and transformational reconstruction based on the Qur’an, Hadith, and Islamic economic literature. The results show a gap between normative theory and formalistic practice in Islamic financial institutions, where the dominance of pragmatic approaches has not fully realized social justice. The study recommends a paradigm synthesis for the development of an applicable, inclusive, and sustainable Islamic economy.

Abstract

The transformation of Indonesian criminal law through Law Number 1 of 2023 opens opportunities for integrating Islamic sharia values within the national legal pluralism framework. This research examines the compatibility of qisas and diyat concepts with Indonesia's positive punishment system through a normative juridical approach analyzing philosophical convergence, juridical legitimacy, and sociological acceptability. Qisas as proportional retributive sanction and diyat as financial compensation represent a restorative justice paradigm aligned with contemporary punishment theories. Analysis of Articles 2, 51-52, and 96-97 of the new Criminal Code demonstrates that national legislation has accommodated living law in society, including religious values, as the basis for criminal case resolution. Philosophical convergence is identified through alignment between maqasid al-shariah (al-zajr, al-tashfiyah, al-islah) and national punishment objectives emphasizing preventive, rehabilitative, and restorative aspects. Juridical legitimacy is strengthened by the implementation experience of qanun jinayat in Aceh Province based on Law Number 11 of 2006 concerning Aceh Governance. The recommended implementation model encompasses diversion and restorative justice mechanisms for case resolution through penal mediation, formal application in autonomous regions, and integration of diyat as alternative sanction with judicial discretion

Abstract

The phenomenon of family involvement in acts of terrorism in Indonesia indicates a shift in the pattern of radicalization from the public sphere to the private sphere. This research aims to trace the sociological roots of terrorism by emphasizing the role of family dysfunction and reviewing the relevance of Islamic family law principles in preventing the radicalization process early on. The method used is qualitative with a case study approach, through document analysis, literature study, and in-depth interviews with relevant resource persons, such as former terrorists, sociology experts, and Islamic law experts. The results show that most terrorists come from dysfunctional families, characterized by a lack of communication, neglectful or harsh parenting, and the absence of moderate spiritual role models. The radicalization process takes place within the home, through closed recitations, digital extreme content, and internal indoctrination. These findings indicate the non-implementation of maqashid sharia principles in family life, such as the protection of the soul, mind and offspring. Therefore, the de-radicalization approach must be multidisciplinary by integrating the perspectives of sociology, Islamic law and family education. Islamic family law not only functions as a legal-formal norm, but also as an ethical and practical guideline in building family resilience as the first bulwark against violent ideologies.

Abstract

This study aims to analyze the sociological measurement of the emergence of terrorism in Indonesia, as well as the development of terrorism and its prevention. The purpose of the research is to look at the sociological roots in more detail to find more comprehensive steps in preventing terrorism in Indonesia. This study uses qualitative description. The research method uses library research which obtains secondary data including literature books, laws and regulations, official documents, and other relevant data. In this writing, the author uses a sociological history approach. The result of this paper is that terrorism has many dimensions, namely the local dimension, the regional dimension, and the global dimension to unravel the sociological roots of the emergence of terrorism in Indonesia, then the overcoming steps need cooperation from all parties, the government, the community, and the international world because the overcoming action is not by using repression so that it can violate human rights, but also using a socio-cultural approach by inviting all components including the so that the seeds of terrorism that exist in society can be minimized, and cut off the roots of its development to grow radicalism in common life.

Abstract

Pendidikan adalah pondasi utama yang berperan penting dalam mengoptimalkan potensi peserta didik, khususnya pada era yang menuntut inovasi pembelajaran berbasis teknologi. Motivasi belajar siswa kelas XE-2 MAN 1 Kota Bandung pada materi logaritma cenderung rendah karena penggunaan media pembelajaran yang kurang bervariasi, sehingga menimbulkan kejenuhan dan menurunkan partisipasi aktif. Untuk mengatasi hal tersebut, Quizizz sebagai media pembelajaran interaktif diperkenalkan melalui kegiatan pendampingan belajar. Penelitian ini bertujuan untuk mengevaluasi efektivitas penggunaan Quizizz dalam meningkatkan keterlibatan dan hasil belajar peserta didik. Metode yang digunakan adalah pendampingan belajar dengan tiga tahap, yaitu persiapan, pelaksanaan, dan evaluasi. Model pembelajaran yang diterapkan adalah Student Teams Achievement Division (STAD) dengan pendekatan Technological Pedagogical Content Knowledge (TPACK). Hasil penelitian menunjukkan bahwa penggunaan Quizizz mampu meningkatkan antusiasme dan keterlibatan peserta didik, dengan capaian rata-rata hasil belajar sebesar yang termasuk dalam kategori Baik. Meskipun masih terdapat kesalahan akibat keterbatasan pemahaman dan kecerobohan, sebagian besar siswa berada pada kategori Sangat Baik. Dengan demikian, Quizizz direkomendasikan sebagai media ajar yang efektif untuk menciptakan suasana belajar yang lebih variatif, menyenangkan, serta meningkatkan motivasi dan hasil belajar matematika.
