Abstract

Interfaith marriages are a crucial aspect of human life today. The clash of norms that exist in society makes this even more crucial and triggers the birth of propaganda and complex problems in the lives of Muslim communities, especially when there is an absolute ban on interfaith marriages in Indonesia. This research will examine Abdullah Ahmad An-Na'im's thoughts regarding the permissibility of interfaith marriages and their implications in Indonesia. The type of research used in this research is library research with a theoretical approach to normative Sharia, normative juridical and socio-legal theories. Primary data sources come from Abdullah Ahmad An-Na'im's books and literature/rules discussing interfaith marriages. Meanwhile, secondary data comes from literature or data that supports the object of study, such as journals and so on. The data was then analyzed using exploratory analysis. The results of this research show that Abdullah An-Na'im's thoughts regarding the prohibition of interfaith marriages are a form of religion-based discrimination. So if it is correlated with the situation in Indonesia, interfaith marriage in Indonesia is not appropriate because it imposes a prohibition that is not based on humanism, especially because Indonesia is not an Islamic country. The implication of this research is that the provisions regarding the prohibition of interfaith marriages in Indonesia should be revoked and permitted with exceptions in emergency situations.

Abstract

The essence of strengthening Islamic political ethics in Indonesia which underlines the need for harmony between religious principles and political governance. This requires integrity, transparency and justice as the basis for leaders and society in carrying out politics based on Islamic values. The theoretical aim of this research is to provide an academic contribution related to moral guidance for political leaders and the general public which will later provide an understanding regarding the essence and strengthening of ethics by integrating Islamic values into political practice in Indonesia which can form better political policies. a political system that is fair, transparent and socially just. The leadership system generally does not explain the role of politics and community participation, this is what encourages researchers to examine the essence and strengthening of Islamic political ethics. The research method used is a qualitative-interpretive method by conducting a literature study from one source. Then the data obtained will be collected, studied and synthesized and then analyzed carefully to get answers to the problems posed.

Abstract

The Qur'an is the first and main authority in the Islamic religion, in viewing a law or resolving a problem faced by humans on this earth. Fiqh proposals present various ways with various aspects to capture the legal messages presented by the Koran and Sunnah, as well as solutions that can be implemented if there is a contradiction between several equivalent propositions or between other propositions. Legally, the research method used is normative juridical. In this type of legal research, law is often conceptualized as what is written in statutory regulations (law in books). Ta'arud al-Adillah is a term in the science of ulus fiqh which refers to the conflict or contradiction between the postulates of sharia law. The essence lies in how the ulama and mujtahid resolve the conflict to reach the right legal conclusion. The Ta'arud al-Adillah method of interpretation, which refers to the conflict between legal postulates in the science of ulus fiqh. The scholars use principles such as tarjih (preference), talfiq (combination), or takhsis (special explanation) to complete ta'arudh al-adillah. The al-jam'u method on this problem is more appropriate than using the al-naskh method. One way to apply the al-jam'u method is by discussing the propositions of 'aam. The implementation of Ta'arud al-Adillah in Islamic legal practice involves systematic steps and careful principles. First of all, fiqh experts must recognize the existence of conflicts between various legal propositions that are relevant in a particular context.

Abstract

Pesatnya kemajuan teknologi pada era ini, institusi pernikahan mengalami transformasi yang signifikan. Salah satu fenomena menarik yang muncul adalah pelaksanaan akad nikah secara virtual, di mana saksi-saksi dan mempelai dapat menyaksikan upacara melalui layar perangkat telekomunikasi. Pemanfaatan telepon sebagai media untuk melaksanakan akad nikah menjadi opsi yang semakin umum, memunculkan suatu bentuk ijtihad atau pemikiran hukum Islam untuk mengatasi kendala geografis dan situasional.. Fenomena ini menimbulkan pertanyaan seputar keabsahan akad nikah via telepon, karena hukum positif dan hukum Islam tidak secara spesifik membahasnya. Penelitian ini bertujuan untuk mengkaji keabsahan akad nikah via telepon dari perspektif ulama Islam kontemporer. Pada penelitian ini menggunakan metode kajian pustaka sebagai bahan rujukan dalam penelitian ini serta metode tersebut dielaborasikan dengan pendekatan teologis normatif, yakni mengaji terkait pendapat Ulama Islam kontemporer mengenai pelaksanaan akad nikah via telepon, apakah sah menurut hukum Islam ataukah tidak. Dalam hal ini masih diperlukan penelitian mendalam yang melibatkan ahli hukum Islam dan juga ahli teknologi informasi untuk mengkaji implikasi hukum dan teknis penggunaan telepon sebagai sarana dalam prosesi akad nikah. Dialog lintas disiplin ilmu dan kerjasama antara ahli dapat menghasilkan pandangan yang holistik serta menciptakan pedoman hukum yang jelas dan merespon perkembangan teknologi dengan bijak sesuai dengan nilai-nilai Islam.

Abstract

In the context of conflicts of interest in legislative institutions, the Islamic legal perspective highlights the moral and ethical principles that underlie the duties of leaders and decision makers. This research explains that integrity, honesty and justice are very important values in making public policies according to Islamic teachings. In this research, what will be studied is what is the perspective of Islamic law in handling and resolving social conflicts? And what are the conflicts of interest in legislative institutions from an Islamic legal perspective? The research method used in this research is a qualitative research method using books, journals and several legal regulations as primary data in this research. In conclusion, the results of this research explain that conflicts in government institutions can be overcome if the implementation adopts sharia values, one of which is transparency. This can prevent conflicts within the Institution.

Abstract

The discussion of Maqashid Al-Syari'ah, or the purpose of Islamic law, is an important discussion that has received great attention from Islamic scholars and legal experts. Some scholars include this topic in the study of ushul fiqh, while others discuss it as a separate material and expand it in the context of Islamic legal philosophy. If examined, all of Allah's commands and prohibitions in the Qur'an, as well as the teachings and prohibitions of the Prophet Muhammad SAW in the sunnah which are arranged in fiqh, clearly have a specific purpose and none of them are in vain. All these rules have deep wisdom, namely as a form of mercy for humanity, as confirmed in several verses of the Koran, including Surah Al-Anbiya' verse 107 which explains the purpose of the sending of the Prophet Muhammad. In this verse, mercy for all nature is defined as the benefit of the people. In simple terms, benefit can be interpreted as something that is good and accepted by common sense. The meaning of "accepted by reason" shows that reason is able to understand the motives behind the enactment of a law, namely because the law brings benefits to humans, either by direct explanation from Allah or through a process of rationalization.

Abstract

The purpose of this study is to investigate the formulation of the dilemma concerning the incorporation of revelation and reason in the foundation of Islamic law in the contemporary era. The inquiry that has been posed for investigation is as follows: In what ways might the combination of reason and revelation have an impact on the evolution of Islamic law in the present day? The method that is utilized is library research with a descriptive-analytical approach. In this method, the author examines relevant material in order to get insights into this integration. The findings of this study suggest that the combination of reason and revelation has the potential to not only offer solutions to the problems that are currently confronting Islamic law, but also to encourage the construction of laws that are more sensitive to the advancements that have occurred in the areas of social governance, politics, and the economy. It is anticipated that this research will make a contribution to the creation of Islamic law that is both adaptable and just in the context of the modern world.

Abstract

Gender equality in Islamic law plays an important role in supporting women’s participation in the professional world, especially in the digital era which offers many new opportunities. Even though the principle of equal rights and obligations is recognized, women often face challenges in the form of their dual roles as professionals and housekeepers, as well as obstacles related to social standards. Gender equality means that men and women have the same rights and responsibilities in the work environment. Islamic law, which regulates all aspects of life, strives to remain alive along with the times. This research is qualitative in nature and collects data through literature study and descriptive approaches. The collected data was then analyzed using a gender analysis approach. The results of this research show that Islamic law supports gender equality and recognizes women’s rights and responsibilities, including in their careers. In the digital era, opportunities for women to develop careers are increasingly open. Technology provides space for women to have a career from anywhere. Career women are not prohibited in Islam, as long as their professional activities are in accordance with the provisions of the Shari’a and Islamic principles. Islamic law allows women to play an active role in society without ignoring religious values.

Abstract

This study aims to analyze the sociological measurement of the emergence of terrorism in Indonesia, as well as the development of terrorism and its prevention. The purpose of the research is to look at the sociological roots in more detail to find more comprehensive steps in preventing terrorism in Indonesia. This study uses qualitative description. The research method uses library research which obtains secondary data including literature books, laws and regulations, official documents, and other relevant data. In this writing, the author uses a sociological history approach. The result of this paper is that terrorism has many dimensions, namely the local dimension, the regional dimension, and the global dimension to unravel the sociological roots of the emergence of terrorism in Indonesia, then the overcoming steps need cooperation from all parties, the government, the community, and the international world because the overcoming action is not by using repression so that it can violate human rights, but also using a socio-cultural approach by inviting all components including the so that the seeds of terrorism that exist in society can be minimized, and cut off the roots of its development to grow radicalism in common life.

Abstract

Religion as a societal ideology is believed to enable it to become a paradigm for solutions to various conflicts. Islam is a religion that upholds he al-alamin in human life, builds conflict resolution in relation to customary law (ethics, moral values, morals and culture) and state law, which actually originates from Islamic legal discourse. Religion becomes a balancer for conflicts that arise from various indicators, because Islam is a legal consensus that covers various conditions and situations. Religion as an effort to mediate conflict and social friction for the benefit of society. Therefore, Islam as a principle, as a regulator of the order of human life, is a solution to the conflict theory of thought by several experts who show the existence of Islam in it.
