Abstract

The study purpose was to examine maqāṣid al-syarī‘ah as an ethical foundation in Islamic political economy and to analyze its implementation in Indonesia through zakat as a strategic policy instrument. The study emphasizes that Islamic political economy cannot be separated from ethical dimensions and sharia objectives, while highlighting the contemporary tendency to limit Islamic economics to micro aspects and neglect its broader political-economic role in regulating welfare distribution and social justice. Materials and methods. This study employed a library research method with a normative–conceptual approach. The analysis was conducted through classical and contemporary Islamic economic literature, zakat regulations in Indonesia, and the perspectives of scholars and academics. Data were examined qualitatively to identify the normative foundations of maqāṣid al-syarī‘ah and their relevance to economic and political policy frameworks. Results. The findings indicate that maqāṣid al-syarī‘ah positions public welfare as the primary orientation of economic and political policies, manifested through principles of justice, equity, sustainability, and protection of fundamental human rights. In the Indonesian context, zakat functions as a strategic instrument of redistribution, poverty alleviation, community empowerment, and sustainable economic development. However, zakat management still faces challenges related to collection optimization, supervision, and institutional transparency. Conclusions. Strengthening regulatory frameworks and governance of zakat institutions is urgently needed to ensure effective implementation of maqāṣid al-syarī‘ah within Indonesia’s Islamic political economy system. Enhanced accountability, coordination, and policy integration are essential to maximize zakat’s role in achieving social justice and sustainable welfare.

Abstract

The development of gender justice discourse in contemporary Islam demonstrates a significant diversity of paradigms of thought, particularly in responding to the tension between classical fiqh normative texts and modern equality demands. This study aims to analyze the differences in the characteristics of Islamic legal thought paradigms, their critical implications for the implementation of family law, and their values in the context of maqasid al-sharia. Using a descriptive-qualitative approach with a normative-empirical literature study, the analysis is carried out through mapping textual and contextual paradigms, critical evaluation, and transformational reconstruction based on the Qur'an and Hadith. The results show a gap between the ontological principle of equality in the Qur'an and formalistic legal practices that are still influenced by patriarchal culture, where the dominance of textual approaches has not fully realized the benefit (maslahah) for women. The study recommends a paradigm synthesis for the development of applicable, inclusive, and gender-just Islamic law.

Abstract

Tulisan ini akan mendeskripsikan peran dosen wanita UIN Alauddin Makassar dalam mewujudkan keluarga sakinah. Penelitian ini merupakan penelitian lapangan (field research) dengan jenis penelitian kualitatif deskriptif yang bertujuan mendeskripsikan pandangan dosen wanita UIN Alauddin Makassar tentang keluarga sakinah dan kontribusinya dalam mewujudkan keluarga sakinah. Lokasi penelitian ini di UIN Alauddin Makassar. Sumber data diambil hasil wawancara dengan beberapa dosen wanita di UIN Alauddin Makassar. Metode pengumpulan data yang digunakan adalah observasi, wawancara dan dokumentasi. Instrumen yang digunakan dalam bentuk peneliti sebagai instrumen utama, panduan wawancara, serta alat pendukung lainnya seperti kamera dan alat tulis. Teknik pengolahan data mulai pengumpulan data, reduksi data, mengatur data, dan memverifikasi data. Uji validasi data menggunakan teknik triangulasi. Hasil penelitian ini menunjukkan bahwa dosen wanita UIN Alauddin Makassar memandang keluarga sakinah sebagai sebuah keluarga yang bukan saja telah mapan secara rohani, ekonomi, dan sosial, melainkan juga telah mampu berkontribusi terhadap lingkungan sekitar bahkan masyarakat. Hal ini sejalan dengan konsep keluarga sakinah III plus menurut Kementerian Agama.Hambatan dalam usaha mempertahankan kesakinahan rumah tangga yaitu terbatasnya waktu untuk berkumpul bersama keluarga, dan kesibukan atau padatnya jam kerja diluar rumah, dan kedua hal ini saling berkaitan satu sama lain. Guna mengatasi hambatan tersebut para dosen wanita UIN Alauddin Makassar memilih untuk bersikap positif dan memanfaatkan secara maksimal waktu yang ada untuk keluarga, dan senantiasa membangun komunikasi dengan keluarga baik itu di dalam rumah maupun di luar rumah. Kontribusi dosen wanita UIN Alauddin Makassar terhadap pembentukan keluarga sakinah melalui empat aspek, yakni aspek agama, ekonomi, sosial, dan psikologis. Kontribusi mereka di aspek agama ditunjukkan melalui keterlibatan mereka dalam kegiatan-kegiatan agamis di dalam rumah tangga. Di aspek ekonomi, kontribusi mereka sangat nyata karena mereka telah menjadi salah satu pilar ekonomi rumah tangga. Di aspek sosial, mereka telah berhasil menaikkan status sosial rumah tangga dengan profesi mereka sebagai pendidik. Di aspek psikologis, segala konsekuensi positif dari profesi mereka sebagai pendidik telah membebaskan rumah tangga mereka dari perasaan inferior (minder) dan menghadirkan rasa bersyukur.

Abstract

The debate regarding gender justice in inheproporitance law arises from differing concepts, namely proportional distribution (2:1) as applied by some laws, while other laws adhere to the principle of equality (1:1). This study aims to analyze both concepts from the perspective of gender justice, while assessing their relevance in the modern social context. The method used is a literature study with a normative-comparative approach, which compares provisions from various legal systems, such as Islamic law, civil law, customary law, and court decisions, and analyzes them through the theory of gender justice and the maqāṣid al-syarī'ah framework. The results of the study show that both concepts have their own contextual justice. Proportionality is more appropriate when the responsibility for maintenance is entirely borne by men, while equality is more appropriate in situations where men and women both play a role in the family economy. This study confirms that gender justice in inheritance law cannot be understood absolutely, but must be viewed relatively in accordance with social realities and the configuration of roles within the family. The impact of this study is to provide a more neutral and comprehensive insight for the development of inheritance law studies within the framework of gender justice. Abstract

This research is motivated by the rapid development of Artificial Intelligence (AI), which poses new challenges to human rights, particularly regarding personal data protection and human dignity in the digital space. The objective of this study is to analyze the urgency of protecting digital human rights (DHR) in the AI era by employing the framework of Maqāṣid al-Sharī‘ah (the objectives of Islamic law). The method employed is normative-legal research with a conceptual and philosophical approach, examining the relevance of the principles of hifẓ al-nafs (preservation of self/life) and hifẓ al-nasl (preservation of offspring/future generations) in the digital context. The findings indicate that DHR, including the rights to privacy and data security, are an integral part of protecting the five fundamental Maqāṣid, particularly in ensuring individual integrity and autonomy from the threat of algorithmic manipulation and discrimination. The implication of this study is the need for the formulation of ethical AI governance policies and regulations, aligned with the values of Maqāṣid al-Sharī‘ah, to ensure that AI technology develops responsibly and upholds human dignity.

Abstract

The integration of Sharia legislation into the modern legal system is becoming increasingly relevant in the digital era. Advances in technology and globalization demand the harmonization of Islamic law with contemporary regulations to address social, economic, and political challenges. This study aims to analyze the opportunities and challenges of integrating Sharia law into modern legal systems, particularly in the context of digitalization. The research employs a qualitative approach with a descriptive-analytical method. Data is obtained through a literature review encompassing Islamic legal literature, statutory regulations, and academic studies on digital law and technology. The analysis is conducted using comparative and interpretative methods to examine the application of Sharia law in various countries. The findings indicate that despite challenges such as differences in legal concepts, social resistance, and digital infrastructure limitations, the digital era also presents significant opportunities for Sharia legislation. The use of technologies such as blockchain, artificial intelligence, and smart contracts can enhance transparency and effectiveness in applying Sharia law. With adaptive regulatory strategies and collaboration among scholars, academics, and technology experts, the integration of Sharia legislation into modern legal systems can be achieved in a more inclusive and applicable manner.

Abstract

The murder and mutilation case in Ngawi is a form of gross violation of Human Rights (HAM) which shows a clear contradiction between the theory of maq??id syar?‘ah and social practices in society. The problem of this research is based on the fact that the main objectives of maq??id syar?‘ah, namely the protection of religion (?if? al-d?n), soul (?if? al-nafs), reason (?if? al-‘aql), descendants (?if? al-nasl), and property (?if? al-m?l), are actually violated to the extreme in the practice of murder accompanied by mutilation. This research aims to analyze the application of maq??id syar?’ah not only as a normative concept, but in relation to real cases of human rights violations, as well as to provide perspectives on the role of maq??id syar?‘ah as a basis for law enforcement and prevention of violence. The research method used is a descriptive method with a normative approach, through a review of Islamic legal principles and analysis of legal and social facts in the case of mutilation murder in Ngawi. The results of the study indicate that mutilation murder is a serious crime triggered by emotional conflict, psychological pressure, and weak moral values, and comprehensively violates all principles of maq??id syar?‘ah, especially the protection of life as the highest goal of sharia. The implications of this research are expected to be educational material and reflection for the community regarding the importance of protecting the right to life and preventing violence as part of sharia values, as well as contributing to efforts to harmonize the ideal concept of maq??id syar?‘ah and the reality of law enforcement in dealing with extreme violent crimes. [Kasus pembunuhan mutilasi di Ngawi merupakan bentuk pelanggaran berat terhadap Hak Asasi Manusia (HAM) yang menunjukkan pertentangan nyata antara teori maq??id syar?‘ah dan praktik sosial di masyarakat. Masalah penelitian ini berangkat dari kenyataan bahwa tujuan utama maq??id syar?‘ah, yaitu perlindungan agama (?if? al-d?n), jiwa (?if? al-nafs), akal (?if? al-‘aql), keturunan (?if? al-nasl), dan harta (?if? al-m?l), justru dilanggar secara ekstrem dalam praktik pembunuhan disertai mutilasi. Penelitian ini bertujuan untuk menganalisis penerapan maq??id syar?‘ah tidak hanya sebagai konsep normatif, tetapi dalam kaitannya dengan kasus nyata pelanggaran HAM, serta memberikan perspektif mengenai peran maq??id syar?‘ah sebagai dasar penegakan hukum dan pencegahan kekerasan. Metode penelitian yang digunakan adalah metode deskriptif dengan pendekatan normatif, melalui telaah terhadap kaidah hukum Islam dan analisis fakta hukum serta sosial dalam kasus pembunuhan mutilasi di Ngawi. Hasil penelitian menunjukkan bahwa pembunuhan mutilasi merupakan kejahatan berat yang dipicu oleh konflik emosional, tekanan psikologis, dan lemahnya nilai moral, serta secara komprehensif melanggar seluruh prinsip maq??id syar?‘ah, khususnya perlindungan jiwa sebagai tujuan tertinggi syariat. Implikasi penelitian ini diharapkan dapat menjadi bahan edukasi dan refleksi bagi masyarakat mengenai pentingnya menjaga hak hidup dan mencegah kekerasan sebagai bagian dari nilai-nilai syariah, serta memberikan kontribusi dalam upaya harmonisasi antara konsep ideal maq??id syar?‘ah dan realitas penegakan hukum dalam menghadapi kejahatan kekerasan ekstrem.]

Abstract

The enforcement of Islamic law in Indonesia is still marked by various complexities, one of which is the unclear role of Judges, Law, Al-Mahkum Fih (object of law), and Al-Mahkum Alaih (subject of law). This study aims to analyze the crucial role of these four elements in the enforcement of Islamic law. Judges have a central role in the enforcement of Islamic law. They are tasked with trying cases based on Islamic law and ensuring justice for all parties. The role of judges is strengthened by a competent mastery of Usul Fiqh and an understanding of the developing social context. Islamic law used in law enforcement in Indonesia is sourced from the Qur'an and Hadith. The application of Islamic law must consider the local social and cultural context. A legal anthropology approach can be used to understand and accommodate local values ​​in the application of Islamic law. Al-Mahkum Fih is the act or action of mukallaf regulated in Islamic law. Al-Mahkum Alaih is an individual or legal entity that is the subject of Islamic law. Effective enforcement of Islamic law requires clear identification of Al-Mahkum Fih and Al-Mahkum Alaih.

Abstract

In Bugis society, the Hajj pilgrimage holds deep meaning, symbolizing both spiritual and social status. The symbols of ‘Aji’ and gold are often used to affirm a person's elevated position after completing the Hajj, indicating a rise in their social standing. This study is crucial to understanding how the Hajj influences the social and spiritual structure of Bugis society. This article aims to explore the symbolic meaning of ‘Aji’ and gold in the context of post-Hajj social-spiritual status within the Bugis community. The research utilizes library research methods with Islamic law and social anthropology approaches to analyze the relationship between the Hajj and social status. The findings indicate that the title ‘Aji’ not only symbolizes piety but also enhances the individual’s social status within the community. Gold as a status symbol further reinforces this social influence, creating a new hierarchy based on spiritual and economic achievements. Academically, it is recommended to view this phenomenon as an integration between religious values and local culture, and to deepen cross-disciplinary studies on the role of Hajj in the social structures of Muslim communities.

Abstract

Prayer is a ritual of worship that has the most legal basis in the Qur'an that prayer is an obligation for every Muslim as a form of submission and obedience to Allah SWT. Prayer is a pillar of religion in Islam, prayer also has a certain time in carrying it out. Prayer is considered as a form that humans must surrender themselves completely to ask for guidance and help from Allah SWT. This article aims to explore the role of prayer as the main pillar and the practice of prayer in influencing the moral and ethical integrity of a Muslim in Islamic philosophy. This research uses library research methods to analyze the philosophy of prayer from the perspective of Islamic law. The research results show that there are still many individuals and groups who perform prayers only as an obligation or habit, without understanding the deeper meaning of this worship. This phenomenon shows negligence in the implementation of prayer, even though this worship should have a deep spiritual dimension. Prayer, as a means of direct connection with Allah SWT, should be the right time for a Muslim to complain, ask for forgiveness, and reflect. Apart from that, prayer also functions as a cleanser for the soul, preventing bad deeds, and bringing peace to a Muslim's heart. Therefore, it is important for Muslims to dig deeper into the meaning of prayer so that they can carry it out with full awareness and devotion.
