Abstract

Euthanasia is an attempt to end a person's life when they experience incurable pain, in order to end their suffering. In Indonesia, euthanasia cannot be carried out and is an illegal act. Both positive law and the medical code of ethics stipulate that euthanasia is not permitted. When studied from the perspective of Islamic law, it is regulated that active euthanasia is an act that is forbidden and is threatened by Allah SWT with the punishment of hell for those who do it. The author is of the opinion that Euthanasia is considered a criminal offense in Indonesia because it is a form of crime against life which is regulated in Article 344 of the Criminal Code (Criminal Code/KUHP: "Whoever takes the life of another person which is clearly done intentionally, is threatened with imprisonment for a maximum of twelve years" The Declaration of Human Rights has established the "right to life" which is fundamental and inherent in human nature. It is universally recognized and an eternal gift from God. However, there is no provision regarding the right to die and therefore Euthanasia is a violation of human rights and contrary to divine principles. However, the right to die is regulated in the laws of several developed countries, such as several countries in Europe. AbstrakEuthanasia merupakan upaya untuk mengakhiri hidup seseorang ketika mengalami sakit yang tidak dapat disembuhkan, guna mengakhiri penderitaannya. Di Indonesia, euthanasia tidak dapat dilakukan dan merupakan perbuatan yang ilegal. Baik dalam hukum positif maupun dalam kode etik kedokteran diatur bahwa melakukan euthanasia tidaklah diperbolehkan. Bila dikaji dalam perspektif Hukum Islam, diatur bahwa euthanasia aktif adalah perbuatan yang diharamkan dan diancam oleh Allah SWT dengan hukuman neraka bagi yang melakukannya. Penulis berpendapat bahwa Eutanasia dianggap sebagai tindak pidana di Indonesia karena merupakan salah satu bentuk kejahatan terhadap nyawa yang diatur dalam Pasal 344 KUHP (Kitab Undang-Undang -Undang Hukum Pidana/KUHP: “Barangsiapa mencabut nyawa orang lain yang jelas dilakukan dengan kesengajaan, diancam dengan pidana penjara paling lama dua belas tahun” Deklarasi Hak Asasi Manusia telah menetapkan “hak untuk hidup” yang bersifat fundamental dan melekat pada kodrat manusia. secara universal mengakui dan anugerah abadi dari Tuhan. Namun, tidak ada ketentuan tentang hak untuk mati dan oleh karena itu euthanasia merupakan pelanggaran hak asasi manusia dan bertentangan dengan prinsip ketuhanan. Tapi, hak untuk mati sudah diatur dalam beberapa undang-undang negara maju, seperti beberapa negara di Eropa.

Abstract

Child marriage has become prevalent in Indonesia due to various factors such as education, economics, personal desire, environment, and pregnancy outside of marriage. This paper aims to educate the public to avoid being influenced to marry off someone who is underage and to discuss the controversy surrounding child marriage. This research is developmental in nature, employing a scientific approach and Islamic legal methodology. The results show that child marriage not only violates individual rights but also breaches the law. The majority of scholars do not permit child marriage, with some explicitly forbidding it, and none expressly allowing it. Furthermore, the study identifies several factors leading to child marriage: education, economics, personal desire, environment, and pregnancy outside of marriage. To address these factors, this research offers the following solutions. Education, Enhance access to education through technology and free learning applications, and integrate curricula about the dangers of child marriage. Economics, Encourage marriage while ensuring continued education. Personal Desire, Collaborate with the National Population and Family Planning Board to provide education on child marriage. Environment, Supervise and enforce laws. Pregnancy Outside of Marriage, Tighten supervision of children and teach religious knowledge to prevent sinful behavior. With these solutions, it is hoped that the issue of child marriage in Indonesia can be effectively addressed. Abstrak Pernikahan dini telah banyak terjadi di Indonesia dengan berbagai faktor penyebab, seperti pendidikan, ekonomi, keinginan pribadi, lingkungan, dan kehamilan di luar nikah. Tulisan ini bertujuan untuk mengedukasi masyarakat agar tidak terpengaruh untuk menikahkan seseorang yang masih di bawah umur, serta membahas kontroversi pernikahan dini. Penelitian ini bersifat pengembangan dan menggunakan pendekatan keilmuan serta metodologi hukum Islam. Hasil penelitian menunjukkan bahwa pernikahan dini tidak hanya melanggar hak individu, tetapi juga melanggar hukum. Mayoritas ulama tidak membolehkan pernikahan dini, dengan beberapa ulama yang secara tegas melarangnya dan tidak ada ulama yang dengan tegas membolehkannya. Selain itu, penelitian ini mengidentifikasi beberapa faktor yang menyebabkan pernikahan dini, yaitu pendidikan, ekonomi, keinginan pribadi, lingkungan, dan kehamilan di luar nikah. Untuk menanggulangi faktor-faktor tersebut, penelitian ini menawarkan solusi-solusi yaitu, Pendidikan, Meningkatkan akses pendidikan melalui teknologi dan aplikasi belajar gratis serta memasukkan kurikulum tentang bahaya pernikahan dini. Ekonomi, Mendorong pernikahan tetapi tetap menempuh pendidikan. Keinginan Pribadi, Bekerja sama dengan Badan Kependudukan dan Keluarga Berencana Nasional (BKKBN) untuk memberikan edukasi tentang pernikahan dini. Lingkungan, Mengawasi dan menegakkan hukum. Kehamilan di Luar Nikah, Memperketat pengawasan terhadap anak-anak dan mengajarkan ilmu agama untuk menghindari perbuatan dosa.  Dengan solusi-solusi tersebut, diharapkan dapat menanggulangi permasalahan pernikahan dini di Indonesia. Abstract

This research aims to determine how the view of the Al-Azhar interpretation book and the Ministry of Religion of the Republic of Indonesia relates to religious moderation. These two interpretations both discuss the notion that Muslims have a unique concept of thinking in religious matters. This research is a field research (field research). This study's data includes descriptive qualitative research that explains and describes Religious Moderation: A Comparative Study of the Views of Al-Azhar and the Ministry of Religion of the Republic of Indonesia.

Abstract

The presence of social media which facilitates interaction and provides openness of information not only produces positive impacts, but there are also negative impacts, such conflicts between social media users. This research aims to analyze the causes of conflicts easily occurring on social media and their implications as well as the response of Islamic law in providing solutions to conflicts on social media. By gathering information from online news sources along with relevant research findings, this study was conducted in a literary style. The collected data was then descriptively examined utilizing an Islamic legal framework. This study discovered that publishing about SARA topics, miscommunication, sensitivity, the propagation of misleading information, and cyberbullying were the main causes of conflict on social media. The conflict that occurred resulted in the opening of space for conflict and violence offline, loss of trust between social media users and the disintegration of the nation through the spread of fake news or mutual arguments, which had implications for the breakdown of unity and diversity in society. The construction of Islamic law exists as a response to conflicts that occur on social media, including mutual respect for fellow social media users, prioritizing tabayyun before receiving or forwarding news, being moderate towards differences of opinion and grounding the concept of Islamic social values as a construction of Islamic legal thought in answering problems based on digitalization.

Abstract

The process of developing a scientific train philosophy is a human problem considering its position as a new scientific philosophy and requires a strong epistemological construct in terms of its source, structure, method and validity. The presence of a new scientific philosophy in the UIN Alauddin Makassar environment as a development of the scientific philosophy of the house of civilization, of course has consequences for tridharma activities including the epistemology of siyasah Syar'iah studies. To answer this problem, this study applies a descriptive-analytical qualitative research model using a multidisciplinary approach. The results showed that the study epistemology of Siyasah Syar'iyah in the UIN Alauddin Makassar environment from the source of the study had been developed by combining various normative bases in line with the vision and mission concept as a faculty and program study and supported by a curriculum of practical elaboration of the vision and mission. In line with that, the paradigm of Siyasah Syar’iyah study in the spectrum of scientific train philosophy places the study of siyasah syariyah to be more inclusive and is required to accommodate various sources, structures, methods and validity of syariyah syariyah that are relevant and constructed.Keywords: Epistemology; Siyasah Syar'iyah; Scientific Train.

Abstract

Islam in its form has two forms. First, Islam as an ideal transcendental religious system. That is as stated in various Islamic sciences which are the result of the interpretation or contextual understanding of the ulama' of the Qur'an and the example of the Prophet Saw. Second, Islam is reflected in the historical reality of Muslim culture, civilization and society. This means how Islam as a religion that contains divine teachings can be spoken and implemented by humans, so that to be able to translate the message of Allah through the Qur'an as a book of guidance for Muslims, it is necessary to have a thought or study of science to understand the message conveyed by the Qur'an, so that the Qur'an can be grounded in each of the heartstrings of Muslims.Islam dalam wujudnya memiliki dua bentuk. Pertama, Islam sebagai sistem keagamaan yang bersifat transendental yang ideal. Yaitu sebagaimana tertuang dalam berbagai ilmu keislaman yang merupakan hasil interpretasi atau pemahaman secara kontekstual para ulama’ terhadap Al- Qur’an dan keteladanan Rasulullah Saw. Kedua, Islam yang tercermin dalam realitas sejarah kebudayaan, peradaban dan masyarakat muslim. Ini artinya bagaimana Islam sebagai agama yang memuat ajaran-ajaran Ilahi dapat dibahasakan dan dilaksanakan oleh manusia, sehingga untuk dapat menerjemahkan pesan Allah melaui Al-Qur’an sebagai kitab tuntunan umat Islam, maka perlu adanya suatu pemikiran atau kajian ilmu untuk memahami pesan yang disampaikan Al- Qur’an, sehingga Al-Qur’an dapat membumi di masing-masing hati sanubari umat Islam.

Abstract

Diversity is a sunnatullah that every community must contemplate and believe in. Awareness of religious communities is the key to continuity in practicing their respective religions. Every religion has a substance of truth, in preennial philosophy a concept in philosophical discourse that discusses the nature of God as an absolute being is the source of all sources of existence. Pluralism is a condition of a pluralistic society (related to social and political systems) or a cultural condition of various different cultures in a society, or a situation where large groups and small groups can maintain their identity in society without having to oppose the dominant culture. This research is qualitative in nature so the method used is a qualitative method, where the focus of the research is centered on in-depth observation. In this research, data collection was carried out using the library study method, namely searching authentic written sources. Furthermore, the data that was successfully collected was analyzed to be able to understand and reach conclusions in this research.

Abstract

Plurality in Indonesia is not a new problem, but something that has existed for a long time. Indonesia was built from a nation-state structure that cannot avoid the inevitability of diversity. History has written its reality through the form of Indonesian independence as a result of working together from the pluralistic strength of this nation. This research is a library research (Library Research) which aims to analyze the form of harmonization of plurality within the frame of Islamic law in Indonesia and the implementation of plurality within the frame of Islamic law in Indonesia. In this research, the authors used a normative approach, namely an approach with the aim of finding plurality in Indonesia, so that it is hoped that they can analyze the form of harmonization and implementation of plurality within the framework of Islamic law in Indonesia. Based on the research results, the form of harmonization of plurality within the framework of Islamic law is emphasized in QS. al-Hujurat/33. Islam does not deny plurality in society, because plurality itself is considered something that is God's law. The plurality of religions that have existed for a long time in Indonesia should be accepted by all religious adherents if we want to create a harmonious, harmonious and peaceful nation even though theology is different. In terms of implementation, it can be seen from the presence of religious tolerance in Indonesia. Recognition of religious, ethnic and racial diversity in Islamic law will create an inclusive and fair foundation for all Indonesian citizens. If the understanding and implementation of plurality within the framework of Islamic law is successfully achieved, then society will experience progress towards harmony and justice.

Abstract

This research discusses Imam Al-Ghazali's views on the judiciary and Islamic political ethics. This research aims to explain Al-Ghazali's political thoughts which explain the judiciary in Islam and also explain the concept of justice as applied to life. Al-Ghazali emphasized the need for judges who are well trained, have in-depth knowledge of Islamic law, and high moral integrity. This research highlights the importance of transparency in the judicial process to ensure fairness in decisions and strengthen the legitimacy of judicial institutions in the eyes of the public. The independence of the judiciary from political or other external influences is also considered crucial to ensure decisions are based on the law and principles of justice. Al-Ghazali's views provide a valuable framework for understanding how the justice system can be built and strengthened in the context of a just and civilized society. The research method used is a qualitative method by conducting a literature study from one source. Then the data collected will be studied and analyzed to be analyzed carefully in order to get answers to the problems being studied.

Abstract

This article discusses the condition of interfaith marriages in Indonesia after the emergence of SEMA No. 2 of 2023. Before the emergence of SEMA, interfaith marriage was something that was often debated by academics because there were no regulations that clearly regulated legal interfaith marriage. The emergence of SEMA is considered to provide legal certainty to support the implementation of Law no. 1 of 1974 so that marriage is based on the provisions of each religion. The SEMA is considered effective in closing the way for interfaith marriages, but its reach is limited to the judicial environment, while the reality in society is still happening even after the SEMA was established. This is because there is still a gap, namely through registration at the Disdukcapil Office. So it is considered necessary to harmonize norms in a number of laws and regulations such as the Marriage Law and the Administering Law. This research uses library research methods. Research data was obtained through literature study, namely reading and analyzing documents relevant to this research.
