Abstract

The formation of national law which is the basis for realizing justice in Indonesia has gone through a long process. Starting from the entry of Islam into Indonesia and is still ongoing now. In the formation of the national law, there are at least four theories that explain how the struggle for legal sources that have been integrated with Indonesian society has crystallized into the main guideline in regulating the lives of Indonesian people. The sources of law are Religious Law, Customary Law, and Dutch Law. Combining these three sources of law to become national law is not simple. So that clashes often occur which results in the birth of various conflicts in the community. In particular, when the Dutch Colonial tried to apply their laws in Indonesia, they set rules according to their interests in order to strengthen their grip on the colonized country. So to explain how the process of forming national law, there are several theories that can explain it, namely: Receptie in Complex, Receptie, Receptie a Contrario, and Eclecticism. This research is in the form of qualitative which tends to be analytical and descriptive. Data were collected from various relevant literature and then analyzed using interactive methods. Thus, the findings of this study are that the theory of Receptie in Complex, Receptie, Receptie a Contrario, and Eclecticism explains that national law and religious law have a strong relationship. So national law and religious law will always be united in their principles because the majority of Indonesian people are Muslims.

Abstract

Islam merupakan agama dakwah yaitu agama yang mengandung nilai-nilai luhur sebagai pedoman dalam kehidupan untuk disampaikan kepada seluruh umat manusia. Tidak hanya terbatas pada kelompok tertentu, golongan tertentu, suku tertentu ataupun bangsa tertentu. Akan tetapi untuk kaffatan linnasi (seluruh umat manusia) kapanpun dan dimanapun. Dakwah Islam berisikan ajakan kepada yang ma’ruf (kebaikan) dan menjauhi segala hal yang munkar (keburukan). Sebab dengan melaksakan kebaikan dalam kehidupan dan menjauhi segala keburukan maka terciptalah kehidupan yang harmoni dan penuh dengan kebahagiaan. Dalam setiap aktivitas dakwah, ada enam hal yang harus diperhatikan dengan baik, agar dakwah yang dilakukan tersebut berhasil dan mendatangkan kebaikan. Enam hal tersebut adalah: dai`, mad`u, pesan dakwah, media dakwah, feedback dakwah dan metode dakwah. Sedangkan tujuan dari sebuah dakwah adalah untuk memperbaiki kehidupan manusia agar bahagia dunia dan akhirat. Kenagarian Harau, Kecamatan Harau, Kabupaten Lima Puluh Kota yang merupakan wilayah tempat kami melakukan kegiatan pengabdian. Di sana ditemukan beberapa permasalahan yang dihadapi oleh masyarakat terkait dengan aktifitas dakwah. Diantaranya, Pertama, kurangnya jumlah personel da`i sehingga tidak terpenuhinya kebutuhan masyarakat untuk kegiatan da`wiyah. Kedua, kurangnya kompetensi sebagian para da`i sehingga hal-hal atau tradisi lama yang tidak sesuai dengan syara menjadi kebiasaan masyarakat. Ketiga, kurangnya keterampilan da`I dalam beberapa aktivitas keagamaan terutama pada pelaksanaan ibadah shalat Jum`at dan penyelenggaraan jenazah.

Abstract

Legal protection and certainty for foreign students in higher education have become global concerns. Even former U.S. President Donald Trump's policy on the presence of foreign students at Harvard University sparked international controversy. This highlights the importance of legal protection and certainty for international students in all countries that serve as destinations for higher education. Universitas Negeri Padang (UNP) has hosted foreign students since 2016, and their numbers continue to grow in line with the university’s rising popularity and global ranking. The presence of international students must be supported by guaranteed legal protection and certainty so that they can pursue their studies under a clear legal framework. This study aims to explore the forms of legal protection provided to foreign students at Universitas Negeri Padang, Indonesia. The research adopts a qualitative case study approach. Data were collected through in-depth interviews with eleven informants, including the head of the International Office and foreign students from Malaysia and Myanmar, selected through purposive sampling. To strengthen the interview data, the researcher also conducted document analysis using a normative juridical approach relevant to the research topic. The data were analyzed thematically using Miles and Huberman's interactive model. The findings reveal that legal protection for foreign students is implemented in several forms: (i) ensuring safety, security, and health; (ii) providing excellent administrative services throughout the academic process; and (iii) guaranteeing the right to practice their faith and religion. These findings serve as a preliminary reference for future researchers to further investigate this topic in different contexts and objectives. As a globally reputable university, Universitas Negeri Padang has fulfilled the standards, requirements, and key elements of legal protection in accordance with both global and Islamic principles.
