Abstract

The research aims to examine the effect of treatment with the application of problem-based learning (PBL) on learning outcomes of student. The topic of teaching biology in this research is invertebrate material. During the conduct of this research, a quasi-experimental non-equivalent control group program was done. A total of 45 students who were divided into two classes (control = 20 students, experiment = 25 students) were taken randomly from a total of eight classes. The instrument for measuring student learning outcomes is seven items and has been validated by experts and empirically. The t test was used to compare data. The results of the research show that there is no difference in learning outcomes in the two classes (experimental and control) with sig. 0.825. This research concludes that problem-based learning has no impact on student learning outcomes on invertebrate material. The future research recommendation is to provide innovation in problem-based learning to increase its effectiveness on student performance.

Abstract

This study aimed to examine child rights and the requirements for custody determination for a child born as a result of rape based on the maqashid al-sharia perspective. This research employed a normative legal research method with the statute and comparative approaches. The collected legal materials were analyzed qualitatively to describe the problem and answer the research objectives. The results of this study indicate that maqashid al-sharia emphasizes the importance of guaranteeing hadhanah, or child custody, by considering the caregiver’s rights, the child’s rights, and the father’s or guardian’s rights. Furthermore, the Quran provides comprehensive guidance in protecting and fulfilling child rights, while the principles of maqashid al-sharia, such as hifz al-din, hifz al-nafs, hifz al-‘aql, hifz al-nasl, and hifz al-mal, serve as the foundation for fulfilling these rights. In cases of children born as a result of rape, maqashid al-sharia emphasizes the necessity of the state’s presence to protect the child through the mechanism of child custody determination through the courts, taking into account specific requirements, such as the age, health, and good conduct of the prospective guardian, to ensure proper care and the fulfilment of the child’s rights. Therefore, it is recommended that various parties, including the government, judges, and prospective guardians, synergize in protecting and fulfilling the rights of children born as a result of rape by the principles of maqashid al-sharia.

Abstract

Learning is a process that happens to everyone and lasts a lifetime (from infancy until death). One of the signs of learning is a change in behaviour in life (cognitive, psychomotor, and affective). Behaviourism is a philosophy in psychology based on the proposition that everything an organism does, including actions, thoughts, or feelings, can and should be considered behavioural. For learning to develop children's intellectual skills in learning something knowledge (for example, a mathematical concept), the subject matter needs to be presented by taking into account the child's stage of cognitive development/knowledge so that the knowledge can be internalized in the mind (cognitive structure) of the person. In meaningful learning, there needs to be development and collaboration of concepts. The way inclusive elements are introduced first and then in more detail.

Abstract

The criminal act of necrophilia is a rare phenomenon but has serious implications for the dignity of the deceased and human values. This study is motivated by the legal void in Indonesia’s Criminal Code (KUHP), which does not explicitly regulate this crime. However, the Draft Criminal Code (RKUHP) has begun to include provisions addressing inhumane treatment of corpses, including necrophilia. From the perspective of Islamic criminal law, this act is considered a severe violation of the sanctity of the deceased and religious values. The aim of this study is to examine the crime of necrophilia from the perspective of Islamic criminal law to provide theoretical insights and propose alternative legal regulations relevant to Indonesia. The study employs a normative juridical research method, using a statutory approach and an analysis of Islamic legal doctrines, particularly principles of ta'zir, diyat, and interpretations by Islamic scholars concerning the dignity of the deceased. The findings reveal that while Islamic criminal law does not explicitly regulate necrophilia, this act is classified as a serious offense violating the sanctity and dignity of the deceased. Punishments include ta'zir, which is left to the discretion of judges, and diyat as compensation to the victim's family. The study concludes that both Indonesia's positive law through the RKUHP and Islamic criminal law regard necrophilia as a grave offense requiring clear legal provisions and strict punishment. This research recommends strengthening legal regulations to protect the dignity of the deceased while reflecting the values of justice and humanity.

Abstract

This study aims to identify and analyze the strengths and weaknesses of the criminal liability system in environmental law and evaluate how Islamic jurisprudence can offer alternative or additional solutions to address environmental pollution problems. This study uses an empirical legal research method with qualitative procedures. The results of the study indicate that the act is considered to violate Islamic jurisprudence and environmental regulations in Indonesia, as shown in the findings. However, law enforcement still has obstacles related to evidence collection and time constraints that must be overcome in order to effectively pursue individuals or groups responsible for environmental damage. Therefore, to ensure environmental sustainability, it is important for the government to actively participate, for law enforcement to achieve effectiveness, and for business entities and the community to be aware of their obligations and be responsible for their behavior.
