Abstract

This study aims to determine the regulation of the prevention of criminal acts of sexual harassment in educational institutions based on positive law, as well as the forms of prevention efforts. This study uses a normative research method with a law approach with a qualitative presentation model. The results of the study indicate that the legal regulation of preventing sexual harassment in educational institutions consists of the regulation of the prevention of sexual harassment through criminal law instruments, both the criminal law code and the child protection law, as well as through the regulation of the minister of education and culture as a technical instrument. Against prevention can be done in three forms, first; implementation of the Pre-Emptive function in the form of inculcating good general values ​​and norms in individuals, secondly; the implementation of the Preventive function in the form of the implementation of the third extension: is the internal efforts of Higher Education Institutions through an implosive approach. These results gave birth to recommendations in the form of the need to maximize enforcement, the need to hasten the issuance of the Law on the Protection of Victims of Sexual Violence, as well as to maximize the guidelines for interacting within the respective Education Units Keywords: Sexual Harassment Prevention, Sexual Harassment In College

Abstract

The development of the Islamic finance industry continues to experience good the choice of Islamic financial products is increasingly diverse. Sharia bank financing products consist of buying and selling, leasing, and profit-sharing schemes. Financing in Islamic banks is still dominated by consumptive financing with Murabaha contracts. Islamic banks have financing products with profit-sharing schemes that can be used for productive financing. This study aims to describe the application of musyarakah contracts in working capital financing at Bank Panin Dubai Syariah Branch Makassar. As well as outlining the application of the musyarakah contract in conformity with sharia principles. The research method used is qualitative research with field research, related to musyarakah contract financing for working capital at Bank Panin Dubai Syariah Makassar. The data sources used are primary data, data obtained directly by interviews, and secondary data from data previously presented. Data collection techniques by direct interviews with parties related to musyarakah financing and through documentation from several relevant sources. The data analysis technique used is descriptive qualitative which describes the application of musyarakah contracts in working capital financing at Bank Panin Dubai Syariah. The study results show that applying a musyarakah contract for working capital is adjusted to the type of business owned by the customer. Financing intended for a project provided that both the bank and the customer contribute capital to run a business project with profits divided according to the capital contribution portion (nisbah). The application of the musyarakah contract for working capital financing at Bank Panin Dubai Syariah branch Makassar is by Sharia principles.

Abstract

Stunting has become a global and national issue in recent years, nationally the government in the 2020-2024 National Medium Term Development Plan targets the stunting prevalence rate in Indonesia to decrease to 14% while Bantaeng Regency sets 14.5 percent where the previous year was 22.1%. Stunting is one of the indicators in the Sustainable Development Goals (SDGs), namely the second goal of ending hunger, achieving food security and good nutrition, and promoting sustainable agriculture. The purpose of this research is to look at the implementation of stunting prevention policies using the SDGs approach, local government strategies, and the challenges of implementing stunting prevention policies using Edwards' theory. This research uses descriptive qualitative research methods through direct interviews with all stakeholders who play a role in stunting prevention, documentation, and direct observation or observation. While the data analysis uses an approach according to (Miles et al., 1994), including data collection, data reduction, data presentation, and drawing conclusions. Based on the researcher's findings that the implementation of stunting prevention policies with the SDGs approach from the economic, social, and environmental aspects, while the local government strategy in overcoming stunting is cooperation between regional apparatus, specific and sensitive interventions, while the challenges of implementing stunting prevention policies include communication, resources, disposition, and bureaucratic structure have been implemented, but are still facing various challenges in all aspects of policy implementation.

Abstract

Islamic Religious Education is an important and inseparable part of the educational curriculum in Indonesia. Besides being an obligation for its adherents, Islamic learning can instill the values of faith and make students possess noble morals (akhlakul karimah). This study aims to examine and discuss how the implementation process of Islamic education in instilling noble morals in students of Madrasah Tsanawiyah (Islamic Junior High School). This study uses a qualitative approach with data reduction, data presentation, and conclusion drawing as the data analysis. The sample of this study was the principal of the madrasah, vice-principal, students, and teachers of Islamic education in Madrasah Tsanawiyah Negeri 1 Makassar. The results of the analysis of this study indicate that through the implementation of Islamic Religious Education, the students could possess noble characters. There are eight behaviors that are applied to instill the noble characters, namely habituating the smiles, salaam, and greetings, mutual respect (tolerance), sunnah fasting on Monday and Thursday, performing the Duha prayer, performing dhuhr prayers, reciting the Quran, congregational prayer, and getting used to alms giving (infaq). These eight commendable behaviors are recommended for teachers and principals to be applied in their respective schools.

Abstract

Constitutional courts serve as guardians of constitutional supremacy through judicial review mechanisms. This study examines the authority and practices of Indonesia's Constitutional Court in comparative perspective with international best practices. Using comparative legal analysis, this research evaluates judicial review systems in Germany, South Korea, South Africa, and the United States to identify effective governance models. The study reveals that while Indonesia's Constitutional Court possesses comprehensive constitutional review authority, challenges remain in enforcement mechanisms, case backlog management, and institutional independence. International best practices demonstrate the importance of clear jurisdictional boundaries, efficient case processing, and robust enforcement powers. The research concludes that Indonesia can strengthen its constitutional court system by adopting selective best practices including streamlined procedures, enhanced enforcement mechanisms, and improved institutional safeguards while maintaining its unique constitutional framework.

Abstract

This paper aims to examine the Dimensions and Challenges of E-Government Application in Bantaeng Regency and the factors that influence it. This paper uses a descriptive method. Data collection techniques are used by observation, interviews, and documentation then the data obtained in the field will be analyzed with qualitative techniques. The results showed that the application of the digital/electronic dimension of government in information services has not been optimally carried out by the bantaeng district government, while the digital/electronic dimensions of government include ease of use, trust, functional of interaction from the environment, reliability, content, and display of information, and support. Meanwhile, the influencing factors include supporting and inhibiting factors, from supporting aspects, namely leadership, and institutions, while the inhibiting aspects are community culture and lack of socialization in the community

Abstract

This research aims to determine the causes of violations committed by prisoners in detention centers and what the legal consequences are for prisoners who commit violations in detention centers. This research uses a normative-empirical research type. The results of this research show that the cause of criminal violations in detention is mostly due to overcapacity in the Pinrang class IIB state detention center and also because of feelings of resentment that have not been resolved previously outside detention and when they are reunited, these feelings of resentment reappear which cause emotions towards These prisoners also lack awareness for these prisoners, and as for the legal consequences for prisoners who commit criminal offenses in class IIB Pinrang state detention centers, these prisoners receive different sanctions according to the criminal offenses they have committed, which are categorized into three levels, namely moderate. For light, light, and heavy sentences, the prisoner is given a warning not to commit the same offense and the prisoner makes an oral or written statement not to repeat the act, then the medium sentence is given a sanction where the prisoner is put in a red cell or cell. exile for 6 (six) days and deprived of his rights for a while, such as not having visits from his family finally, this punishment is serious, this punishment is included in serious offenses where the prisoner will be put in solitary confinement for 6 (six) times 2 (two), and have their rights removed, such as not having visits from their family and their remission period could be revoked.

Abstract

Indonesia, as a multicultural country, possesses diverse traditions, including those related to marriage. In the Bugis-Makassar society, uang panai’ is a deeply rooted tradition that serves as an integral part of marriage, symbolizing respect for women and the responsibility of the groom. Despite its profound philosophical meaning, the practice of uang panai’ has undergone a shift in meaning, often becoming a status symbol, which has led to delays or even cancellations of marriages. This study aims to examine the legal status of uang panai’ in the Indonesian legal system and its role within Bugis-Makassar society. This research employs a normative legal research method, focusing on a statutory approach, a conceptual approach, and an Islamic legal approach. The findings indicate that uang panai’ is classified as customary law, which is recognized within Indonesia’s legal framework. Its legal status can be found in Fatwa MUI Sulsel No. 2 of 2022 on Uang Panai’, although this fatwa does not carry binding legal authority as legislation. Within Bugis-Makassar society, uang panai’ functions as a customary norm with moral binding force; however, its implementation must be proportional to ensure it does not become an excessive burden on the groom and his family.

Abstract

Tujuan penelitian ini adalah untuk mengetahui bagaimana pengaruh harga dan promosi terhadap minat beli konsumen pada Toko Sentra Tani. Metode penelitian ini menggunakan Teknik analisis data yang dilakukan untuk menganalisis dan menginterpretasikan data yang telah diperoleh untuk kemudian diberikan simpulan. Sebagaimana tujuan penelitian ini, yaitu untuk mengetahui pengaruh harga dan promosi terhadap minat beli, maka alat analisis yang digunakan adalah analisis regresi linear berganda. Selanjutnya untuk mengetahui serta membuktikan pengaruh signifikansi masing-masing variabel independen terhadap variabel dependen secara parsial, maka digunakan uji-t, sedangkan untuk mengetahui pengaruh signifikansi variabel independen terhadap variabel dependen secara simultan, maka digunakan uji-F. Hal ini menunjukkan bahwa sebesar 66,10% minat beli pada Toko Sentra Tani dipengaruhi oleh variasi kedua variabel independen, yaitu harga (X1) dan promosi (X2). 3) Pengujian Hipotesis dengan pengujian serempak (Uji F) sehingga dapat disimpulkan bahwa terdapat pengaruh positif dan signifikan antara harga dengan minat beli pada Toko Sentra Tani. dan terdapat pengaruh positif dan signifikan antara promosi dengan minat beli pada Toko Sentra Tani
