Abstract

Zakat and taxes are two obligations that must be fulfilled. This study starts from the question of whether zakat can replace taxes and how both contribute to public health. This study aims to analyze and expose it in a role to create the benefit and stability of the economy. In this study, using a qualitative approach, the method of library research through the review of books, scientific journals, and articles related to the theme discussed. This invention explains that zakat and taxes both have a foundation and legal provisions, but have the same goal to achieve the benefit and Shari'a. The study concluded that zakat and taxes cannot replace each other, but can collaborate so that zakat and taxes are managed properly, and increase awareness in the community.

Abstract

Fenomena nikah siri di Indonesia mencerminkan dinamika pluralisme hukum yang kompleks, khususnya dalam relasi antara hukum Islam dan hukum nasional. Praktik ini menempatkan individu dan keluarga dalam ruang interlegality, yakni wilayah tumpang tindih antara keabsahan agama dan pengakuan hukum negara. Artikel ini mengkaji nikah siri dalam konteks era digital, dengan menyoroti perluasan praktik nikah siri melalui media daring serta implikasinya terhadap perlindungan hukum perempuan dan anak. Penelitian ini menggunakan pendekatan yuridis normatif dengan menelaah sumber hukum Islam klasik dan kontemporer, peraturan perundang-undangan, fatwa, serta fenomena empiris terkait layanan nikah siri online. Hasil kajian menunjukkan bahwa meskipun nikah siri dapat dipandang sah secara agama apabila rukun dan syaratnya terpenuhi, ketiadaan pencatatan perkawinan menyebabkan tidak adanya pengakuan hukum negara dan berimplikasi pada lemahnya perlindungan hak-hak keluarga, terutama perempuan dan anak. Perkembangan teknologi digital memperluas ruang interlegality tersebut dan meningkatkan potensi penyalahgunaan praktik nikah siri. Oleh karena itu, diperlukan upaya sinkronisasi antara hukum Islam dan hukum nasional melalui penguatan kebijakan pencatatan perkawinan, edukasi hukum, serta ijtihad kontekstual yang berorientasi pada kemaslahatan dan keadilan substantif. Harmonisasi ini diharapkan dapat memperkecil ruang interlegality yang merugikan dan memperkuat perlindungan hukum dalam institusi perkawinan di Indonesia.

Abstract

Raja Ampat as the center of world marine biodiversity faces serious threats from nickel mining, including sedimentation, air pollution, ecosystem damage, and socio-economic impacts on coastal communities, thus creating a conflict between positive legal regulations that grant mining permits and Islamic legal principles on environmental conservation. This study aims to identify marine and terrestrial environmental phenomena resulting from the presence of mining in Raja Ampat, analyze the mechanisms of positive legal regulations in managing these impacts, and explore Islamic legal perspectives and solutions to formulate integrative policy recommendations. Using a qualitative normative juridical approach through secondary data literature study with comparative content analysis and source triangulation, the study found that PT Gag Nikel's activities caused net deforestation of 52.42 hectares, coral bleaching of up to 70%, heavy metal pollution that threatens the food chain, and the loss of fishermen's livelihoods; positive law shows the inconsistency of old regulations with the prohibition of mining on small islands, while Islamic law emphasizes the principle of caliphate, the prohibition of facade fi al-ard, la dharar wa la dhirar, and Maqashid Syariah to encourage conservation management such as ecotourism and sustainable fisheries. In conclusion, the integration of both legal frameworks can produce operational policies to stop mining exploitation, prioritize ecosystem preservation, and ensure the welfare of local communities, with implications for sustainable collaborative governance in conservation areas.

Abstract

This study examines the transformation of Islamic law in addressing the challenges of religious and ideological plurality in the digital era. Drawing on a qualitative, descriptive-analytical approach, the research explores how Islamic legal norms adapt to the complexities of online religious discourse, the decentralization of authority, and the rise of interpretive subjectivities. Using the framework of maqāṣid al-sharī‘ah, wasatiyyah (moderation), and Islamic multiculturalism, the study highlights the dynamic role of Islamic law as both a normative system and a socio-ethical mechanism. Findings indicate that Islamic law, when recontextualized through digital realities and pluralistic values, remains responsive to contemporary issues such as freedom of expression, extremism, and identity diversity. However, the fluidity of online interpretations and the erosion of traditional legal authority pose challenges to legal stability and epistemological coherence. The study concludes that a renewed interdisciplinary approach - integrating Islamic legal theory, digital sociology, and pluralism studies - is essential to ensure the continued relevance of Islamic law in shaping justice and coexistence in a globally connected society.

Abstract

The development of Artificial Intelligence (AI) has brought significant changes in various aspects of life, including the government, economy, education and public services sectors. However, the implementation of AI also raises various ethical, legal and social challenges that require proper regulation and supervision. This research aims to analyze the government's role in implementing Artificial Intelligence (AI) based on Maqasid al-Sharia, identify the opportunities and challenges faced by the government in its implementation, and examine the impact of the government's role on implementing AI that is in line with sharia values. This research uses a qualitative method with a library research approach sourced from scientific journals, books, policy documents and literature related to AI and Maqasid al-Sharia. The research results show that the government has a strategic role as a regulator, facilitator, supervisor, and policy director in ensuring the development and use of AI in accordance with the principles of protecting religion (hifz al-din), soul (hifz al-nafs), reason (hifz al-'aql), descendants (hifz al-nasl), and property (hifz al-mal). Opportunities for implementing AI based on Maqasid al-Sharia include increasing the efficiency of public services, strengthening government governance, and accelerating digital innovation that is oriented towards the benefit of society. Meanwhile, the challenges faced include regulatory limitations, human resource readiness, data security, and potential misuse of technology. An effective government role in implementing Maqasid al-Sharia-based AI can have a positive impact in the form of creating ethical, fair, transparent and sustainable use of technology oriented towards the welfare of society. [Perkembangan Artificial Intelligence (AI) telah membawa perubahan signifikan dalam berbagai aspek kehidupan, termasuk sektor pemerintahan, ekonomi, pendidikan, dan pelayanan publik. Namun, implementasi AI juga menimbulkan berbagai tantangan etika, hukum, dan sosial yang memerlukan regulasi serta pengawasan yang tepat. Penelitian bertujuan untuk menganalisis peran pemerintah dalam implementasi Artificial Intelligence (AI) berbasis Maqasid al-Sharia, mengidentifikasi peluang dan tantangan yang dihadapi pemerintah dalam penerapannya, serta mengkaji dampak peran pemerintah terhadap implementasi AI yang selaras dengan nilai-nilai syariah. Penelitian  menggunakan metode kualitatif dengan pendekatan studi pustaka (library research) yang bersumber dari jurnal ilmiah, buku, dokumen kebijakan, dan literatur terkait AI serta Maqasid al-Sharia. Hasil penelitian menunjukkan bahwa pemerintah memiliki peran strategis sebagai regulator, fasilitator, pengawas, dan pengarah kebijakan dalam memastikan pengembangan dan penggunaan AI sesuai dengan prinsip perlindungan agama (hifz al-din), jiwa (hifz al-nafs), akal (hifz al-'aql), keturunan (hifz al-nasl), dan harta (hifz al-mal). Peluang implementasi AI berbasis Maqasid al-Sharia meliputi peningkatan efisiensi pelayanan publik, penguatan tata kelola pemerintahan, serta percepatan inovasi digital yang berorientasi pada kemaslahatan masyarakat. Sementara itu, tantangan yang dihadapi mencakup keterbatasan regulasi, kesiapan sumber daya manusia, keamanan data, serta potensi penyalahgunaan teknologi. Peran pemerintah yang efektif dalam implementasi AI berbasis Maqasid al-Sharia dapat memberikan dampak positif berupa terciptanya pemanfaatan teknologi yang etis, adil, transparan, dan berorientasi pada kesejahteraan masyarakat secara berkelanjutan.]

Abstract

This study discusses feminist perspectives on morality and rationality in fighting for women's rights by highlighting how traditional moral and rational structures are often built on a patriarchal perspective that ignores women's experiences and judgments. Philosophical feminism views that morality and rationality, which have been understood in a patriarchal manner, have placed women in a position of subordination and limited their mobility in both the public and private spheres. This study uses a literature review method by collecting various sources such as books, scientific journals, and articles discussing feminist philosophy and the concept of freedom. The results of the study show that feminism emphasizes the importance of legal and public policy reform to achieve gender equality, as well as fighting for women's freedom in determining their personal and professional life choices. In addition, third-wave feminism, influenced by postmodernism, affirms the diversity of women's identities and experiences, rejecting a single generalization about women. In the context of law, feminism plays a role in criticizing systems that reinforce patriarchy and limit women's access to justice. Thus, the feminist perspective makes an important contribution to reinterpreting morality and rationality towards a more gender-equitable social order.

Abstract

The phenomenon of granting clemency to narcotics prisoners in Indonesia, as part of the president's prerogative, raises tensions between legal certainty and humanitarian considerations. This research aims to analyze the mechanism and legitimacy of granting clemency through the ethical perspective of Islamic law, especially maqāṣid al-syarī' ah. By using normative legal research procedures through legislative, conceptual, and problem analysis approaches, this research examines primary and secondary legal materials. The main findings say that maqāṣid al-Syarī'ah provides a comprehensive evaluation framework, in which clemency can be morally justified if it is oriented towards the protection of the soul (ḥifẓ al-nafs), the restoration of ideas (ḥẓ al-aql) via rehabilitation, and restorative justice. However, research concludes that this prerogative should not ignore the public interest (maslaḥah'āmmah) as the highest consideration. The implication is that the clemency policy requires extreme prudence to avoid weakening law enforcement and justify balancing the justice of people and the protection of citizens from the dangers of narcotics.

Abstract

The rapid development of global society, characterized by accelerating modernity and the expanding influence of globalization, poses significant challenges to the relevance and application of Islamic law. On the one hand, Islamic law is deeply rooted in the normative and textual tradition of classical fiqh; on the other hand, contemporary social realities demand legal responses that are adaptive, contextual, and oriented toward justice. This tension between tradition and change highlights the urgent need for a transformation of contemporary Islamic legal thought that preserves the normative legitimacy of the sharīʿah while responding effectively to modern challenges. This study aims to analyze the transformation of contemporary Islamic legal thought in addressing the challenges of tradition, modernity, and globalization, as well as to examine the normative framework that enables such transformation. The research employs a normative juridical method, using conceptual, philosophical, and statutory approaches by examining the Qur’an, Sunnah, principles of maqāṣid al-sharīʿah, and relevant national legislation. The findings indicate that Islamic law possesses inherent flexibility that allows for legal reconstruction through ijtihād, textual reinterpretation, and the strengthening of a maslaḥah-oriented approach. This transformation enables Islamic law to function as a living law capable of harmonizing with national legal systems and global values without losing its normative identity. Consequently, contemporary Islamic legal thought plays a crucial role in promoting a responsive, just, and public interest–oriented legal framework.

Abstract

Digital transformation has brought fundamental changes to various aspects of social, political, and religious life. The rapid development of social media and online platforms has not only expanded public participation but has also generated new challenges in the form of the dissemination of extremist ideologies, commonly referred to as digital radicalism. Digital radicalism refers to the spread of radical and extremist ideas through social media that occurs rapidly, massively, and is difficult to control. This phenomenon poses not only a threat to national security but also a serious challenge to ideological security, particularly to the values of Pancasila, pluralism, tolerance, and democracy in Indonesia. This article aims to comprehensively examine the phenomenon of digital radicalism, including its driving factors, the role of social media in the process of radicalization, and its implications for ideological security. The research employs a qualitative descriptive approach through a literature review by analyzing 30 scholarly references consisting of academic books, research reports, and relevant national and international journal articles. The findings indicate that digital radicalism develops as a result of a combination of ideological, social, political, and technological factors, reinforced by low levels of digital literacy and ideological awareness within society. Social media plays a significant role in accelerating the radicalization process through algorithmic mechanisms and information echo chambers. Therefore, strengthening Pancasila-based ideological education, enhancing digital literacy, promoting religious moderation, and revitalizing local wisdom are essential and sustainable strategies to address the challenges of digital radicalism in the era of social media.

Abstract

The phenomenon of femicide, or the killing of women based on gender-related motives, in Indonesia has shown a troubling increase, while the national legal system has yet to establish specific regulations addressing this crime. This legal vacuum results in the handling of femicide cases being limited to general homicide provisions under the Criminal Code (KUHP), without adequately considering the gender-based dimensions inherent in such acts.This study aims to analyze the protection of women as victims of femicide from the perspectives of Islamic law and positive law, as well as to examine how the principles of maqāṣid al-syarī‘ah and siyāsah syar‘iyyah can serve as a philosophical foundation for formulating national legal policies capable of preventing femicide and protecting women.The research employs a normative juridical approach with comparative and conceptual analysis, utilizing primary sources such as the Qur’an, Hadith, and principles of Islamic law, alongside secondary sources including the Criminal Code (KUHP), the Law on Sexual Violence Crimes (UU TPKS), and relevant legal literature.The findings indicate that Islamic law firmly prohibits all forms of violence and the killing of women, as such acts fundamentally contradict the principles of ḥifẓ al-nafs (protection of life) and the overarching notion of justice within Islamic jurisprudence. Meanwhile, the national legal system urgently requires regulatory reform through the integration of the values of maqāṣid al-syarī‘ah and siyāsah syar‘iyyah into the formation of a Gender-Just, Humanistic, and Comprehensive Anti-Femicide Law.
