Abstract

Islamic law occupies a distinctive position within Indonesia’s pluralistic legal system, where religious, customary, and state legal norms interact within a constitutional framework. This article examines the constitutional position and contemporary development of Islamic law within the Indonesian rule of law through a qualitative descriptive-analytical library research approach. Secondary sources published between 2020 and 2025, including scholarly articles, academic books, and relevant legislation, were selected purposively and analyzed using content analysis and thematic synthesis. The findings demonstrate that Islamic law has acquired significant constitutional and sociological recognition through statutory regulations, the institutionalization of religious courts, and its continued operation as living law. Nevertheless, its interaction with customary and national law generates normative tensions, overlapping institutional authority, and potential legal uncertainty, particularly where different legal norms regulate similar social domains. The analysis indicates that a substantive approach grounded in maqāṣid al-sharī‘ah can provide a normative framework for reconciling Islamic legal values with constitutional principles, justice, and human rights protection. The study contributes to the discourse on legal pluralism by positioning Islamic law not merely as a religious normative system but as an integral component of Indonesia’s evolving legal order. Harmonized legislation, consistent judicial interpretation, and inclusive legal policymaking are essential for managing pluralism while maintaining constitutional coherence.

Abstract

Kontekstualisasi konsep Jihad mengacu pada pemahaman yang lebih luas dan menyeluruh tentang arti dan makna Jihad dalam Islam. Jihad bukan hanya sekadar berperang atau menggunakan kekerasan, melainkan juga meliputi usaha untuk meningkatkan kualitas kehidupan, memperjuangkan kebaikan, dan keadilan sosial. Tantangan Islamophobia juga perlu diperhatikan dalam konteks ini, karena seringkali Jihad disalahartikan dan dianggap sebagai tindakan kekerasan yang dilakukan oleh kaum Muslim. Penelitian ini merupakan penelitian kualitatif dengan studi pustaka (literature review) yang diharapkan dapat memberi pemahaman yang tepat tentang konsep Jihad perlu ditekankan, serta perlu dilakukan upaya untuk mengatasi Islamophobia agar tidak memengaruhi pandangan masyarakat terhadap umat Muslim secara keseluruhan.

Abstract

The development of international relations in the era of globalization demands a system of relations between states capable of realizing peace, justice, and cooperation. In this context, Islamic constitutional law offers principles that are relevant to the modern constitutional system. This study aims to analyze the principles of international relations from the perspective of Islamic constitutional law and examine their relevance and harmonization with the modern constitutional system. This research is a normative legal study with a conceptual approach and a legislative approach, supported by a literature study of the Qur'an, hadith, books, and scientific journals. The results of the study indicate that the principles of international relations in Islamic constitutional law, namely peace, justice, cooperation, respect for agreements, and state sovereignty, are in accordance with the principles in the modern constitutional system. The harmonization of the two systems indicates that the values of Islamic constitutional law are universal and remain relevant in addressing the dynamics of contemporary international relations. This study recommends strengthening the study of fiqh siyasah as a foundation for the development of constitutional law and international relations that are just and oriented towards the welfare of the people.

Abstract

This article examines the paradigm of maqāṣid syarī‘ah as the basis for Islamic legal reform in the thinking of Jasser Auda. The study focuses on the concept of maqāṣid, the systematic thinking, and the methodological reconstruction offered by Auda in responding to contemporary Islamic legal challenges. This research uses a qualitative method with a literature review approach, sourced from the works of Jasser Auda and relevant scientific literature, and analyzed through a descriptive-analytical approach. The results show that Auda places maqāṣid syarī‘ah not merely as a normative goal of law, but as a comprehensive philosophical and methodological paradigm. Maqāṣid is reconstructed from a normative protection orientation towards development, fulfillment of rights, and human welfare. Through a systemic approach, Auda formulates Islamic legal reform that emphasizes epistemological reconstruction, integration of universal values, social impact orientation, and continuous evaluation of ijtihad. This paradigm affirms the relevance of maqāṣid syarī‘ah in responding to the complexities of modern law without losing the normative legitimacy of sharia.

Abstract

Penelitian ini mengkaji distorsi makna jihad yang berkembang melalui propaganda digital serta dampaknya terhadap meningkatnya radikalisasi di Indonesia. Fokus kajian diarahkan pada pergeseran pemahaman jihad dari makna autentik yang bersifat spiritual, moral, dan sosial menuju interpretasi radikal yang mengarah pada kekerasan. Penelitian ini menggunakan pendekatan kajian pustaka dengan menelaah literatur akademik terkait jihad, radikalisme, propaganda digital, dan strategi deradikalisasi. Hasil kajian menunjukkan bahwa algoritma media sosial, visualisasi heroik, dan narasi emosional berperan signifikan dalam membentuk persepsi jihad yang keliru, terutama di kalangan generasi muda. Propaganda digital memperkuat narasi ekstrem dengan membingkai kekerasan sebagai bentuk perjuangan religius. Oleh karena itu, pelurusan makna jihad perlu dilakukan melalui penguatan literasi keagamaan dan literasi digital, penyediaan konten keislaman moderat yang kompetitif, serta pelibatan pendakwah muda yang adaptif terhadap dinamika ruang digital. Upaya ini menegaskan kembali jihad sebagai perjuangan moral dan intelektual demi kemaslahatan, perdamaian, dan keadilan sosial.

Abstract

This study examines the characteristics of digital transaction disputes in online buying and selling and evaluates the mechanisms for resolving these disputes based on Islamic law principles. The rapid development of digital technology has significantly transformed commercial activities in Indonesia, yet it has also contributed to a sharp increase in consumer complaints, particularly in e-commerce transactions. Secondary data from Bank Indonesia and the Ministry of Trade indicate that more than 90% of consumer complaints from 2022 to 2025 originated from online transactions, demonstrating the vulnerability of digital consumers to misinformation, delivery issues, unilateral cancellations, fraud, and product mismatch. Using a qualitative method with a normative legal approach complemented by conceptual, statutory, and empirical analysis, this study investigates the legal framework governing digital transactions and compares it with the principles of fiqh muamalah. Findings reveal that most disputes arise from violations of fundamental Islamic contractual principles, including uncertainty (gharar), unclear object of contract (ma’qud ‘alaih), imbalance of information, and failure to uphold honesty and good faith. While positive law provides consumer protection through the Consumer Protection Law and the Electronic Information and Transactions Law, its implementation remains limited, particularly in resolving digital disputes. Islamic law, through principles of justice (‘adl), transparency, prevention of harm, and amicable settlement (shulh), offers a comprehensive foundation for fair and efficient dispute resolution. The study concludes that integrating these Islamic legal principles within modern Online Dispute Resolution (ODR) mechanisms can enhance legal certainty, consumer protection, and ethical standards in digital commerce.

Abstract

This study examines the reform of Islamic constitutional law through the Maqasid alShariah approach from the perspective of Jasser Auda. Reform of Islamic constitutional law in the contemporary era faces complex challenges related to the adaptation of sharia principles to the dynamics of modernity, democracy, and respect for human rights. The method used is a qualitative literature study to analyze classical and contemporary literature. The results of the study indicate that the existence of Islamic constitutional law is adaptive and normative, emphasizing the principles of justice, public welfare, and public participation. The mechanism for implementing constitutional law requires the application of good governance principles based on accountability, transparency, and trustworthiness. Jasser Auda's assessment of maqasid emphasizes the need for a multidimensional systemic approach, where the success of law implementation is measured by the achievement of public welfare and social justice, not merely the textual aspects of the law. This framework is expected to become a reference in the renewal of the Islamic constitutional system that is relevant to the needs of the modern state.

Abstract

The development of information technology has transformed political participation, particularly among Generation Z in Indonesia. Social media platforms such as TikTok function not only as entertainment spaces but also as mediums for political participation, allowing users to express opinions, influence public discourse, and engage with political content creatively. This study aims to analyze the essence of political participation in the digital space of TikTok, the mechanisms of digital political participation through the platform, and provide solutions based on the perspective of Maqasid Shariah. The research employs a qualitative descriptive approach, utilizing literature review and content analysis. The findings indicate that TikTok serves as an interactive and visual tool for political participation, yet it also carries potential negative impacts such as the spread of misinformation and social polarization. From the perspective of Maqasid Shariah, it is crucial to uphold public welfare, prevent harm (mafsadah), and prioritize ethical values in digital political engagement. This study recommends enhancing digital literacy and political ethics grounded in Maqasid Shariah principles to optimize Generation Z’s political participation on TikTok.

Abstract

Gender equality in Islamic education in Indonesia is increasingly relevant amid growing awareness of women's roles. Normatively, Islamic law emphasizes al-musāwah (equality) and al-‘adl (justice), but its implementation faces structural and cultural barriers, creating a gap between syariah ideals and practices in educational institutions. This research analyzes the concept of gender equality in Islamic law, identifies legal-social obstacles, and formulates syariah-based solutions for inclusive Islamic education. Employing qualitative library research and descriptive-analytic analysis, the study explores maqāṣid al-syarī‘ah, contextual ijtihād, and khalīfah fī al-arḍ.Findings: Equality is theologically recognized but remains formal; barriers stem from patriarchal fiqh interpretations and cultures that subordinate women. Solutions: Contextual reinterpretation and gender-just policies for equitable Islamic education. The research findings show that although gender equality is recognized in Islamic theological principles, in practice, significant obstacles stem from patriarchal and cultural interpretations of Islamic jurisprudence that place women in a subordinate position. Therefore, contextual reinterpretation and the implementation of more gender-just policies in Islamic education are needed to create a just and equitable learning environment.

Abstract

The gender-equitable distribution of gono-gini property in Indonesia still faces challenges even though the principle of equality has been regulated in the Compilation of Islamic Law (KHI) and the Marriage Law. The principle of gender justice in Islamic law is rooted in sharia values that emphasize balance, benefits, and equality between men and women in acquiring and managing family property. However, practice in the field shows that there is a wrong understanding of society, patriarchal culture, and differences in judges' interpretations that often harm women. This research aims to analyze the form of distribution of gono-gini property according to Islamic law and national law, understand its implementation in the practice of religious justice, and formulate Islamic legal solutions that can realize a gender-fair distribution. The research method used is a literature review with a normative-qualitative approach through the study of primary, secondary, and tertiary legal materials. The results of the study show that the equitable distribution of gender is not only understood as a 50:50 division according to Article 97 of the KHI, but also includes recognition of economic and non-economic contributions, including the domestic role of the wife. Implementation in the religious courts still faces inconsistencies in judges' interpretations, low legal literacy, and socio-cultural barriers. The solutions offered by Islamic law include the application of the principles of shirkah, benefit, deliberation, and ijtihad of judges based on substantive justice.
