Abstract

Climate change has become a global issue that urges countries to take concrete steps to reduce carbon emissions. Carbon tax is seen as a strategic fiscal instrument to achieve low-emission development. This study aims to compare the legal frameworks and carbon tax policies in Singapore and Indonesia, while assessing their implementation within the context of fiscal justice and environmental law. This research use normative juridical comparative approach, which analyze laws and regulations. The study findings indicate that Singapore implements a fixed rate carbon tax based on emission threshold alongside mandatory emissions reporting. Whilst Indonesia has only just begun implementing carbon tax with a minimum rate that is deemed too low as well as the lack of adequate technical regulations. Substantively, Indonesia still faces obstacles in determining the allocation of revenue from the carbon tax and ensuring the effectiveness of tax rates to influence economic behavior. This study concludes to emphasize the need for reformulation of carbon tax policy in Indonesia by adopting the polluter pays principle, implementing a mandatory emissions reporting system, and strengthening derivative regulations to be more adaptive and responsive to the challenges of climate change. Singapore's experience can serve as an important reference in designing a fairer and more effective carbon tax policy in Indonesia

Abstract

The development of the digital economy has driven new dynamics in the e-commerce sector, including cross-border mergers and acquisitions involving foreign entities. The acquisition of Tokopedia by TikTok is an important case study for understanding the legal implications of vertical integration between global social media platforms and national e-commerce companies. This study aims to analyze TikTok's legal standing as a foreign entity in Tokopedia's ownership structure and examine the application of conditional clearance requirements by the Business Competition Supervisory Commission (KPPU) in maintaining fair competition and protecting national digital economic sovereignty. This study uses a normative juridical method with a legislative, conceptual, and case approach, with primary legal sources in the form of Law No. 40 of 2007, Law No. 5 of 1999, as well as KPPU Regulation No. 3 of 2019 and Permendag No. 31 of 2023. The results of the study show that TikTok formally complies with corporate law provisions, but its ownership structure continues to pose challenges to the principle of separation of foreign entities in the strategic digital sector. Meanwhile, the implementation of conditional clearance by the KPPU serves as a legal instrument to prevent market dominance, cross-platform data abuse, and anti-competitive practices, without hindering economic efficiency. Thus, strengthening supervision and synergy between institutions is key to balancing foreign investment openness with the protection of local businesses and national digital sovereignty

Abstract

General Background Patent protection plays a vital role in supporting technological innovation and economic development. Specific Background In Indonesia, the obligation to pay annual patent fees as mandated by Law No. 13/2016 and Law No. 65/2024 aims to ensure administrative order, yet in practice creates financial barriers for individual inventors, universities, and small enterprises. Knowledge Gap Existing policies do not fully resolve issues of accumulated arrears under earlier regulations and have not provided mechanisms that ensure fair treatment for patent holders with limited financial resources. Aim This study analyzes the urgency of reformulating annual patent fee regulations to prevent the loss of patent rights caused by delays in payment. Results Findings show that regulatory weaknesses, insufficient monitoring systems, and financial limitations among patent holders contribute to high patent deletion rates and low commercialization of research outcomes. Novelty This research proposes a new policy model including progressive fee structures, early warning systems, reinstatement opportunities, creation of a national patent support fund, and digital management through a Patent Information Management System. Implications These reforms are expected to build a more equitable and inclusive intellectual property governance framework that strengthens innovation-driven economic growth in Indonesia. Highlights: High annual fees cause loss of patent rights among financially limited holders. Policy reform is needed to improve fairness and administrative effectiveness. Abstract

General Background: Indonesia's rapid digital transformation has reshaped the creation, distribution, and use of copyrighted works, intensifying the urgency for adaptive legal protection. Specific Background: Despite the 2014 Copyright Law addressing digital elements, its provisions remain insufficient to manage algorithm-driven, cross-border infringements proliferating on user-generated content platforms. Knowledge Gap: Existing regulations have not fully anticipated technological developments nor clearly defined the responsibilities of digital platform operators, especially after the Constitutional Court’s reinterpretation of liability under Article 10. Aims: This study examines the legal politics underlying the amendment of the Copyright Law to strengthen protection mechanisms in the digital environment. Results: Findings reveal the need for more responsive regulation, expanded obligations for digital platforms, harmonized protection of moral and economic rights, and enhanced enforcement tools, including integrated digital surveillance and more effective access-blocking procedures. Novelty: The study offers a conceptual model that links legislation theory with legal protection theory to propose an adaptive copyright protection framework suited to digital-era challenges. Implications: These insights provide strategic direction for policymakers in formulating reforms that ensure legal certainty, fairness, and public benefit within Indonesia’s evolving digital copyright ecosystem. Highlights: The digital environment demands stronger, adaptive copyright protection responsive to technological change. Constitutional Court Decision No. 84/PUU-XXI/2023 expands platform liability, revealing gaps in current regulation. Abstract

General Background: The Indonesian civil justice system continues to face structural inefficiencies, including case backlogs, slow proceedings, and high litigation costs. Specific Background: These challenges are especially evident in resolving debt-related default disputes, where creditors—particularly concurrent creditors—often encounter uncertainty and weak enforcement. Knowledge Gap: Despite existing litigation and alternative dispute resolution (ADR) mechanisms, limited effectiveness, inconsistent legal certainty, and gaps in legal culture hinder optimal dispute settlement. Aims: This study analyzes the mechanisms for resolving debt-default disputes, the protection available for concurrent creditors, the application of legal certainty principles, and strategies to strengthen legal culture. Results: Findings show that dispute settlement operates through litigation and ADR; concurrent creditors receive preventive and repressive protections; legal certainty is grounded in Articles 1131–1132 of the Civil Code; and improving legal culture requires education, consistent enforcement, and institutional reform. Novelty: This research integrates doctrinal analysis with empirical judicial data to highlight systemic shortcomings in current debt-dispute resolution, particularly regarding creditor vulnerability and uneven implementation of reform policies. Implications: Strengthening legal frameworks, institutional capacity, and public legal awareness is essential to achieving a faster, simpler, and more affordable civil justice system in Indonesia. Abstract

General Background: The regulation of termination of employment for workers under Fixed-Term Employment Agreements (PKWT) has gained urgency following recent reforms in Indonesia’s labor market. Specific Background: The Job Creation Law and Government Regulation No. 35/2021 introduced new standards intended to enhance flexibility while reshaping the protection framework for contract workers. Knowledge Gap: Despite these reforms, inconsistencies in interpretation, weak enforcement, and uneven implementation continue to create legal uncertainty, particularly in cases of unilateral termination and compensation. Aims: This study conducts a normative juridical analysis to assess the alignment of PKWT termination regulations with core principles of national labor law. Results: The findings indicate that although the new regulations clarify compensation entitlements, they do not fully guarantee fairness or legal certainty due to limited worker awareness, regulatory overlap, and ineffective supervisory mechanisms. Novelty: This research offers an integrated assessment that connects statutory reform, judicial practice, and labor protection principles, exposing gaps between legal norms and practical application. Implications: Enhanced harmonization, stronger supervisory systems, and clearer technical regulations are necessary to achieve balanced labor flexibility and social justice within Indonesia’s evolving industrial relations framework. Abstract

General Background: Unilateral termination of employment (PHK sepihak) remains a persistent issue in Indonesia’s industrial relations, affecting workers’ economic and social stability. Specific Background: Despite the comprehensive regulation under Law No. 13/2003 on Manpower, gaps persist between legal norms and actual practices, particularly regarding procedural compliance and workers’ access to remedies. Knowledge Gap: Limited studies thoroughly examine how statutory provisions, post-MK decisions, and dispute-resolution mechanisms interact to shape the legality and consequences of unilateral termination. Aim: This study analyzes the legal framework governing unilateral termination, its legal consequences, and the protective mechanisms available to workers. Results: Findings show that unilateral termination is only lawful under conditions strictly regulated in the Manpower Law, including proven gross misconduct, corporate restructuring, or operational necessities, and must be accompanied by mandatory procedures such as negotiation and adjudication. Employers are obligated to provide severance, service appreciation pay, and compensation for rights, with variations depending on the grounds for termination. Novelty: This research integrates statutory analysis, judicial developments, and procedural safeguards to reveal persistent inconsistencies between legal standards and practical enforcement. Implications: Strengthening supervision, legal literacy, and procedural compliance is crucial to preventing arbitrary terminations and ensuring substantive worker protection. Highlights: The law strictly limits when employers may carry out unilateral termination. Workers are entitled to severance and other compensations based on legal provisions. Abstract

This research identifies challenges, obstacles and opportunities related to the issuance of Law No. 27 of 2022. Protection of personal data is crucial, especially in the use of information and communication technology in the current modern era. The contents of this article were analyzed using qualitative methods and secondary data in analyzing it. The research results show that: although the PDP Law was only implemented in 2022, regulations regarding PDP can actually be found in various pre-existing regulations, then there are principles and provisions that can be included in the PDP Law to better accommodate the need for protecting people's personal data, Furthermore, there are various challenges, obstacles and protections in implementing the PDP Law. The conclusion is that the passing of Law Number 27 of 2022 concerning Personal Data Protection in Indonesia marks a significant step in strengthening personal data protection for Indonesian citizens. However, implementing this law presents various challenges that the government must overcome.

Abstract

General background: The advancement of digital technology has revolutionized the logistics sector through application-based services that offer efficiency and convenience for consumers. Specific background: Nevertheless, the increasing reliance on digital logistics services has created new legal vulnerabilities, particularly when losses are caused by the actions of courier partners as third parties. Knowledge gap: Indonesia still lacks clear regulations governing the application of strict liability within digital logistics services, resulting in uncertainty regarding which party is legally responsible for consumer losses. Aims: This study aims to analyze the application of the strict liability principle in consumer protection within digital logistics services by examining the legal foundations, contractual structures, and implications of liability between companies and their courier partners. Results: The findings show that although the Consumer Protection Law requires business actors to bear consumer losses without proof of fault, its implementation remains weak due to standard contractual clauses that waive company responsibility, low consumer awareness, and limited government oversight. Novelty: This study provides a comprehensive understanding of the multilayered legal relationships between companies, partners, and consumers, highlighting the need for a vicarious liability approach within digital ecosystems. Implications: Strengthening the application of strict liability is essential to ensure fair compensation, increase public trust, and enhance accountability within Indonesia’s digital logistics services. Highlights: Strict liability strengthens consumer protection in digital logistics services. Legal ambiguity persists due to weak regulation and unclear contractual clauses. Abstract

General Background: The application of the Business Judgment Rule (BJR) in Indonesia plays a crucial role in protecting directors from liability for business decisions that result in losses, provided such decisions are made in good faith and for corporate interests. Specific Background: In corruption cases involving directors of State-Owned Enterprises (SOEs), Indonesian courts show inconsistency in applying BJR, particularly when cases intersect with lex specialis provisions of the Anti-Corruption Law. Knowledge Gap: Existing studies have not comprehensively examined how judicial disparities affect legal certainty, protection, and the substantive realization of justice in corruption adjudication. Aims: This study analyzes the implementation of BJR in corruption cases, assesses the impact of judicial disparities on legal objectives, and identifies appropriate BJR application within the national legal framework. Results: Findings show that BJR is applied inconsistently—some cases acknowledge it as a valid protective doctrine, while others disregard it when corruption elements are proven under lex specialis rules. Novelty: This research bridges doctrinal analysis and case-based judicial evaluation to demonstrate how BJR interacts with principles of justice, legal certainty, and public benefit in corruption enforcement. Implications: The study highlights the need for clearer judicial guidelines to ensure consistent application of BJR without undermining the fight against corruption, thereby strengthening preventive legal protection and substantive justice. Highlights: Courts apply the Business Judgment Rule inconsistently in corruption cases. Lex specialis principles often override BJR protection when corruption elements are proven.
