Abstract

Indonesia implemented a nickel ore export ban as part of its mineral downstreaming policy to increase domestic value added, strengthen industrial development, and secure long-term economic growth through local processing and refining activities. This policy is legally grounded in Law Number 4 of 2009 as amended by Law Number 3 of 2020 on Mineral and Coal Mining, as well as Ministerial Regulation of Trade Number 96 of 2019. This study aims to examines the impact of Indonesia’s nickel ore export ban on value-added economic development and its compatibility with World Trade Organization (WTO) rules, particularly General Agreement on Tariffs and Trade (GATT) 1994 Article XI:1 and Article XX. The research employs a normative legal research method using qualitative analysis of legal instruments, WTO dispute rulings, and relevant literature. The findings show that the export ban has encouraged investment in smelters, increased downstream industrial capacity, and supported strategic sectors such as electric vehicle batteries. However, the WTO found the policy violated with GATT Article XI:1 and unjustified under Article XX exceptions. While Indonesia’s policy successfully promotes domestic value addition, it also demonstrates the need to align national resource-based industrial policies with international trade obligations to ensure sustainable and legally compliant economic development.

Abstract

Ideally, the policy on Non-Taxable Income (Penghasilan Tidak Kena Pajak/PTKP) functions as an instrument for minimum economic protection and reflects fiscal justice within the taxation system. However, in reality, the current PTKP threshold has not been adequately aligned with inflationary dynamics and the declining purchasing power of taxpayers, thereby generating substantive injustice, particularly for low- and middle-income groups. This study aims to analyze the urgency of adjusting the PTKP threshold in response to inflation from the perspective of Gustav Radbruch’s theory of legal justice. The research employs a qualitative normative legal method based on library research, utilizing statutory analysis, conceptual approaches, and legal-philosophical inquiry. Primary sources include tax legislation and related regulations, while secondary sources consist of scholarly literature in law and economics. The findings indicate that an inflexible PTKP policy prioritizes legal certainty over justice and utility, resulting in a distortion of the redistributive and welfare-oriented functions of taxation. Consequently, this study argues that periodic and inflation-responsive adjustments to PTKP are essential to achieving substantive legal justice and reinforcing the constitutional mandate of social welfare under the 1945 Constitution of Indonesia.

Abstract

Commercial Court, Cassation, and Judicial Review judges set legal principles and uphold justice. Their bankruptcy decisions should be fair and certain, giving all parties legal advantages. Law No. 37 of 2004 on Bankruptcy and Suspension of Debt Payment Obligations is one bankruptcy judge's instrument. Thus, understanding Indonesian commercial court verdicts' legal grounds and how judges use certainty, fairness, and legal expediency is crucial. The subject is examined using a juridical-descriptive-analytical methodology based on Makassar, Medan, Surabaya, Semarang, and Jakarta commercial court cases. Cluster and stratified sampling, descriptive quantitative data tabulation, qualitative analysis, and interviews have shown three judge-used legal reasoning processes. Inductive patterns oriented to legal expediency by Supreme Court Judges at the Judicial Review level; deductive syllogism patterns oriented to legal certainty by Judex Facti judges in the Commercial Court (level I); and deductive patterns oriented to legal justice by Judex Yuris at the Cassation level. Indonesian commercial court judges apply certainty, fairness, and expediency: First, the legal principles and principles applied in the decision of the first instance judge of the Commercial Court (legal certainty) are debt requirements; bankruptcy decisions cannot be imposed on solvent debtors; bankruptcy decisions must be approved by the majority of creditors; silence; recognition of the separatist rights of creditors holding security rights; the bankruptcy decision process is short and open. Second, Supreme Court justices at the Cassation level use the following legal concepts (legal justice): balance, fairness, potential debtor debt restructuring, parity creditorium, pari passu prorate, and structural creditors. Abstract

Perkembangan pesat Artificial Intelligence (AI) telah membawa perubahan mendasar dalam struktur pasar tenaga kerja, termasuk di Indonesia, dengan meningkatnya risiko penggantian pekerjaan manusia oleh teknologi otomatisasi. Fenomena ini tidak hanya menimbulkan persoalan ekonomi, tetapi juga memunculkan tantangan hukum terkait perlindungan hak pekerja, keadilan sosial, serta keberlanjutan sistem ketenagakerjaan. Penelitian ini bertujuan untuk menganalisis bagaimana hukum ketenaga kerjaan Indonesia, khususnya melalui Undang-Undang Cipta Kerja dan peraturan turunannya, mengklasifikasikan dan menjustifikasi Pemutusan Hubungan Kerja (PHK) akibat adopsi AI, serta menilai kecukupan perlindungan hukum yang tersedia bagi pekerja terdampak. Selain itu, penelitian ini juga mengkaji kebutuhan akan dasar hukum bagi penerapan model kompensasi inovatif, seperti Universal Basic Income (UBI), pajak otomasi, dan skema distribusi manfaat produktivitas AI, serta mengeksplorasi kemungkinan adaptasi kerangka hukum nasional untuk melegitimasi pendekatan tersebut. Lebih lanjut, penelitian ini menyoroti pentingnya reskilling dan upskilling dalam menghadapi disrupsi teknologi, serta mengkaji urgensi pengakuan “hak atas pengembangan keterampilan berkelanjutan” sebagai bagian integral dari perlindungan pekerja di era digital.Metode yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan, konseptual, dan komparatif, yang didukung oleh analisis literatur dari jurnal nasional terindeks SINTA dan jurnal internasional bereputasi. Hasil penelitian menunjukkan bahwa kerangka hukum ketenagakerjaan Indonesia saat ini masih bersifat reaktif, dengan fokus pada kompensasi pasca PHK yang belum mampu menjawab dampak jangka panjang dari disrupsi AI. Selain itu, belum terdapat pengaturan eksplisit mengenai kewajiban pelatihan ulang maupun mekanisme distribusi manfaat teknologi secara adil. Oleh karena itu, diperlukan reformasi hukum yang lebih progresif dan adaptif, termasuk penguatan sistem jaminan sosial, pembaruan kebijakan fiskal, serta pengakuan hak atas pembelajaran sepanjang hayat. Dengan demikian, hukum diharapkan tidak hanya berfungsi sebagai alat perlindungan, tetapi juga sebagai instrumen strategis dalam mengelola transisi menuju masa depan kerja yang lebih inklusif, adil, dan berkelanjutan di era kecerdasan buatan.

Abstract

Contract law in Indonesia is still often viewed as rigid and unchanging, even though in practice particularly in long-term contracts changes in circumstances can occur unexpectedly; therefore, this study examines the urgency of recognizing hardship in Indonesian contract law in the context of extraordinary events that cause fundamental changes in circumstances, focusing on the regulatory gaps within the national legal system, its comparison with developments in modern contract law, as well as the legal implications of adopting such norms through normative legal research using legislative, conceptual, and comparative approaches, and a case study of Judgment No. 28/Pdt.G.S/2021/PN.DPS, The results indicate that the force majeure mechanism in the Civil Code is insufficient to address contractual imbalances resulting from unforeseen changes in circumstances, while comparative analysis and case studies confirm that the absence of a hardship doctrine limits judicial discretion to the conventional framework of breach of contract. Consequently, this study argues that the integration of hardship can be achieved through normative reconstruction grounded in the principles of good faith and contractual balance, thereby balancing legal certainty and substantive justice within Indonesian contract law.

Abstract

The dispute between PT Pertamina and Karaha Bodas Company is an important example in international law practice related to investment contracts in the energy sector. This dispute originated from the collaboration on the development of a geothermal project in Karaha Bodas, which was disrupted due to Indonesian government policies during the economic crisis, leading to differing interpretations of contractual obligations and force majeure. This research aims to analyze the background of the dispute, the application of international arbitration mechanisms, and the legal implications of the arbitration award on Indonesia. The research method used is normative juridical with an approach based on legislation and case studies. The data used consists of primary, secondary, and tertiary legal materials that are analyzed qualitatively. The research results show that resolving disputes thru international arbitration provides a neutral and professional forum with final and binding decisions. However, the enforcement of arbitration awards still faces challenges, particularly in the aspect of cross-border execution. The legal implications of the arbitration ruling have a significant impact on Indonesia, particularly in increasing demands for legal certainty, investment protection, and government policy consistency. This case also underscores the importance of the principle of pacta sunt servanda in international legal relations and the state's responsibility for the actions of state-owned enterprises.

Abstract

This article examines legal protection and the certainty of taxpayers’ rights and obligations from the perspective of Government Regulation Number 50 of 2022, as well as the position of the Taxpayer Charter in strengthening legal protection and encouraging tax compliance in Indonesia. This study employs a normative legal research method using a statutory approach and a conceptual approach. The results of the discussion show that Government Regulation Number 50 of 2022 provides a clearer foundation regarding the procedures for the implementation of taxpayers’ rights and the fulfillment of their obligations, thereby functioning as an important instrument in realizing legal certainty, justice, and a balanced legal relationship between the state and taxpayers. These regulations cover the rights to information, services, data protection, restitution, objection, appeal, and complaint, as well as administrative obligations such as taxpayer identification number registration, tax return submission, tax payment, bookkeeping, and a cooperative attitude during tax audits. In addition, the Taxpayer Charter is understood as a complementary instrument that codifies taxpayers’ rights and obligations in a simpler and more understandable manner, thereby supporting the creation of better services, more concrete legal protection, and voluntary compliance within the self-assessment system. Thus, the clarity of the regulation of rights, obligations, law enforcement mechanisms, and tax dispute resolution becomes an important factor in building a tax system that is fair, transparent, credible, and based on legal certainty.

Abstract

Legal protection for workers within the social security system is one form of the state's responsibility in realizing societal welfare as mandated by the constitution. This research aims to analyze juridically the forms of legal protection for workers within the social security system in Indonesia and to examine the effectiveness of its implementation. The research method used is normative legal research with a legislative approach and a conceptual approach. The data sources used include primary, secondary, and tertiary legal materials that are analyzed qualitatively. The research results show that normatively, the legal protection of workers within the social security system has a strong legal basis. Guaranties designed to provide comprehensive protection against various risks faced by the workforce. However, in its implementation, there are still various obstacles, such as the low participation rate, especially in the informal sector, and the suboptimal law enforcement against employers who do not fulfilll their obligations. Based on these results, it can be concluded that although the labor social security system in Indonesia has an adequate legal framework, the effectiveness of legal protection still needs to be improved thru enhanced supervision, strict enforcement of sanctions, and increased awareness and compliance from all parties involved.

Abstract

ABSTRAK Penyelesaiaan persoalan data pribadi di Indonesia sekarang ini diselesaikan melalui pengadilan negeri, karena belum adanya aturan hukum yang mengatur hadirnya peradilan khusus data pribadi di Indonesia. Hal ini tercermin dalam permasalahan beberapa kasus, seperti Putusan Nomor 438/Pid.Sus/2020/PN.JKT.UTR, kasus a quo yang dijatuhkan berdasar Undang-Undang Informasi dan Transaksi Elektronik. Putusan Nomor 438/Pid.Sus/2020/ PN.JKT.UTR yang sejatinya juga terdapat ketidaktepatan pada pertanggungjawaban pihak perusahaan. Selain itu ada pula masalah efesiensi dan penegakan hak korban. Kasus ini mencerminkan adanya kesulitan dalam mewujudkan terlaksananya hak yaitu right to be forgotten pada hukum positif di Indonesia. Gambaran membuat satu lembaga independen yang menjadi quasi peradilan dan kelak bisa menegakkan prinsip right to be forgotten di Indonesia, belum lagi kasus data pribadi yang sangat banyak di Indonesia. Hal itu menjadi latar belakang ketertarikan penulis mengulas persoalan ini. Metode penelitian yang digunakan yaitu normatif, dengan beberapa pendekatan yaitu: pendekatan perundang-undangan, pendekatan konseptual, pendekatan historis, pendekatan kasus, dan pendekatan perbandingan. Data yang digunakan dalam penelitian terdiri dari bahan hukum primer, bahan hukum sekunder, dan bahan non hukum. Analisis yang digunakan yaitu kualitatif. Berdasarkan dari analisis dan penelusuran, ditemukan peluang untuk Komisi Perlindungan Data Pribadi ini menjadi quasi peradilan di ranah data pribadi. Analisis berhasil memetakan terkait korelasi kehadiran Komisi Perlindungan Data Pribadi ini dengan penegakan prinsip right to be forgotten, dan quasi yudisial di Indonesia. Kesimpulan ditemukan Komisi Perlindungan Data Pribadi kelak bisa menjadi quasi peradilan perlindungan data di Indonesia dan menegakkan prinsip right to be forgotten. Sebaiknya pemerintah segera menunjuk badan yang menyelenggarakan fungsi Komisi Perlindungan Data Pribadi ini.Kata kunci: quasi peradilan; perlindungan data pribadi; komisi independen; right to be forgotten. ABSTRACTSince there is no statutory regulation governing the special court for personal data, its settlement in Indonesia is currently being resolved in the district court. Reflecting on several decisions, such as Decision Number 438/ Pid.Sus/2020/PN.JKT.UTR, the quo case which was decided by the Information and Electronic Transactions Law, or Decision Number 438/Pid.Sus/2020/PN.JKT.UTR which actually also contains inaccuracies in corporate accountability, not to mention the problem of efficiency and enforcement of victims’ rights. This case reflects the difficulty of realizing the implementation of ‘right to be forgotten’ in positive law in Indonesia. This is like creating an independent institution that becomes a quasi-judicial court capable of upholding the right to be forgotten principle in Indonesia, apart from the many cases of personal data in Indonesia. This is discussed in this analysis using normative research methods, including statutory, conceptual, historical, case-based, and comparative approaches. The research data consisted of primary, secondary, and non legal legal materials, analyzed by qualitative analysis methods. Based on analysis and tracking, the Personal Data Protection Commission has the possibility of becoming quasi judicial in terms of personal data. The analysis succeeded in mapping the correlation between the presence of this Personal Data Protection Commission for enforcing the right to be forgotten, and quasi-judicial principles in Indonesia. In conclusion, the Personal Data Protection Commission might become a quasi-judicial court for data protection in Indonesia and uphold the principle of the right to be forgotten. For this reason, the government should immediately appoint a body that will carry out the functions of this Personal Data Protection Commission. Abstract

The development of digital technology has significantly transformed international trade activities, particularly through cross-border e-commerce platforms that are increasingly accessible to the public. This condition provides consumers with efficient access to obtain products from various countries without geographical barriers. On the other hand, such convenience also gives rise to various legal issues, especially in relation to consumer protection in international trade transactions. Differences in legal systems, jurisdictions, and dispute resolution mechanisms pose significant challenges in ensuring the fulfillment of consumer rights. This research aims to analyze legal protection for consumers in cross-border e-commerce transactions and to identify the challenges in its implementations. The research employs a normative-juridical method with a statutory and literature approach. The results indicate that consumer protection in international e-commerce transactions still faces various obstacles, primarily due to differences in regulations among countries and limitations in law enforcement. Therefore, regulatory harmonization and enhanced international cooperation are necessary to establish effective consumer protection and ensure legal certainty in cross-border transactions.
