Abstract

The existence of insurance in human life can provide a sense of security because in carrying out its duty, it is carried out in accordance with the principle of utmost good faith. However, the principle of utmost good faith cannot always be perfectly implemented. There are many factors that influence the implementation of the principle of utmost good faith in the world of insurance. One of them is related to the implementation of the principle of good faith by insurance companies during the suspension of payment (PKPU) period regarding the rights of policy holders. This research was carried out in a normative juridical manner using library approach techniques. The research results show that there is a polemic regarding the scope and time limits for applying the principle of utmost good faith as well as the position of policy holders in filing PKPU lawsuits. Thus, it is still necessary to evaluate the applicable laws and regulations and to provide legality to policy holders so that the rights and obligations of the parties can be carried out even though the insurance company is in the PKPU period.

Abstract

This research explores the role of mortgage rights in the context of managing the duration of building usage rights, with an emphasis on property law aspects. Utilizing a legal review approach, an analysis was conducted on the implications of mortgage rights on the expiration of building usage rights and their impact on property. The study identifies that mortgage rights play a crucial role in influencing the continuity of the duration of building usage rights, while conflicts of interest and the impact of regulatory changes become significant focuses in the dynamics of the relationship between these two rights. The conclusion emphasizes the need for a deep understanding of the role of mortgage rights in the sustainability of building usage rights, the handling of conflicts of interest, and adaptation to regulatory changes in the property law environment.

Abstract

The issue of foreign workers is increasingly receiving media and national attention. However, to date research into the nature and consequences of employing foreign workers in Indonesia is still limited. The introduction of significant changes in the recruitment phenomenon ended in a painful and traumatic atmosphere that was almost unacceptable for the local workforce in Indonesia. This research aims to look from an industrial relations perspective which plays an important role in employing foreign workers. The research results will show the employment status of local workers and the rights of local labor unions which are affected by the use of foreign workers. In addition, the research provides a number of recommendations, including the need for further development in reducing the employment of foreign workers and better targeting of vulnerable foreign workers in relation to labor laws.

Abstract

Technological advances are like two sides of a coin that have several conditions that are not only beneficial but need to be aware of the dangers, one of which is data leakage. Data leakage does not always occur intentionally, it can occur due to the negligence of a software itself due to the weakness of its device security system. Personal data is crucial in this era of digitalization, which all of them need, including in educational institutions such as private universities. Foundations and Private Universities have a legal relationship as stipulated in the Foundation Law adjusted to the agreement made by both. Foundations and Private Universities have their respective portions in terms of their duties, functions, authorities, and responsibilities including in the management of personal data if there is a data leak who is the data controller and data processor. The type of research used is doctrinal law through the search for library materials and secondary data consisting of primary documents, secondary legal documents and non-legal documents. The research conducted will later examine the relevant legislation that regulates associated with the legal issues raised whether appropriate or not in its implementation. The results showed that based on the legal relationship, the Foundation as a controller of personal data and the Cooperative as a personal data processor. Both have their respective portions of responsibility and if there is a data leak, the responsibility is borne by the foundation stakeholder as the controller of personal data and the corporation as the beneficiary.

Abstract

Layoffs or what is usually called one-sided termination of employment is something that is still problematic to this day and causes the emergence of industrial relations disputes, as happened in Decision Number 101/Pdt.Sus-PHI/2019/PNSmr where industrial relations disputes occurred between PT. NALA PALMA CADUDASA with 6 people from the Public Relations Team and Senambah Village Verification Team. There was a misunderstanding regarding the definition of a partnership relationship and working relationship between the two parties which led to disputes when the relationship was terminated. The research method used in this research is normative juridical with a case approach. A partnership relationship is a relationship based on a partnership agreement, while an employment relationship is a relationship based on a work agreement. The position between parties in a partnership relationship and an employment relationship is also different. In a partnership relationship, each party has the same position in terms of rights and obligations, whereas in an employment relationship the positions of the entrepreneur and employee are superior and subordinate. However, when a partnership relationship has elements of a work relationship, the partnership relationship turns into a work relationship.

Abstract

There are still many violations of workers' or laborers' rights that they should receive in situations where a company is merging or merging where there is legal uncertainty in protecting workers or laborers from companies that are merging or merging in violation of the 1945 Law. The aim of this research is to conduct research regarding the rights of workers or laborers who experience unilateral termination of employment by companies carrying out a merger. The method used in this research is a normative legal method with secondary data collection techniques through literature study. The results of this research show that the implementation of a company merger (merger) has a legal impact on employees, one of the impacts that can be received by employees is the loss of their job. As regulated in legal regulations both in the Limited Liability Company Law and in the Employment Law which provides legal protection for employees. . If the company does not want to take responsibility, employees can sue the company either through litigation or non-litigation.

Abstract

Commercial Court, Cassation, and Judicial Review judges set legal principles and uphold justice. Their bankruptcy decisions should be fair and certain, giving all parties legal advantages. Law No. 37 of 2004 on Bankruptcy and Suspension of Debt Payment Obligations is one bankruptcy judge's instrument. Thus, understanding Indonesian commercial court verdicts' legal grounds and how judges use certainty, fairness, and legal expediency is crucial. The subject is examined using a juridical-descriptive-analytical methodology based on Makassar, Medan, Surabaya, Semarang, and Jakarta commercial court cases. Cluster and stratified sampling, descriptive quantitative data tabulation, qualitative analysis, and interviews have shown three judge-used legal reasoning processes. Inductive patterns oriented to legal expediency by Supreme Court Judges at the Judicial Review level; deductive syllogism patterns oriented to legal certainty by Judex Facti judges in the Commercial Court (level I); and deductive patterns oriented to legal justice by Judex Yuris at the Cassation level. Indonesian commercial court judges apply certainty, fairness, and expediency: First, the legal principles and principles applied in the decision of the first instance judge of the Commercial Court (legal certainty) are debt requirements; bankruptcy decisions cannot be imposed on solvent debtors; bankruptcy decisions must be approved by the majority of creditors; silence; recognition of the separatist rights of creditors holding security rights; the bankruptcy decision process is short and open. Second, Supreme Court justices at the Cassation level use the following legal concepts (legal justice): balance, fairness, potential debtor debt restructuring, parity creditorium, pari passu prorate, and structural creditors. Third, the Supreme Court's Judicial Review judges apply the legal expediency principles of business continuity, integration, encouraging investment and business, providing benefits and protection, bankrupt company management must be personally liable, harming bankruptcy property as a criminal offense, debt collection, debt pooling, debt forgiveness, universal, and territorial

Abstract

Perjanjian perdagangan bebas menjadi salah satu instrumen penting dalam memperkuat kerja sama ekonomi antarnegara. Implementasi ASEAN-China Free Trade Area (ACFTA) sejak tahun 2010 telah memberikan dampak signifikan terhadap dinamika transaksi bisnis internasional, khususnya di sektor pertanian Indonesia. Penelitian ini bertujuan untuk menganalisis pengaruh ACFTA terhadap ekspor produk pertanian Indonesia dengan melihat peluang, tantangan, serta implikasi yang ditimbulkan. Metode penelitian yang digunakan adalah pendekatan deskriptif-kualitatif dengan dukungan data sekunder berupa laporan perdagangan internasional, jurnal akademik, dan publikasi resmi dari Kementerian Perdagangan serta Badan Pusat Statistik. Hasil kajian menunjukkan bahwa ACFTA mampu membuka akses pasar yang lebih luas bagi produk pertanian Indonesia melalui penurunan tarif bea masuk dan penyederhanaan prosedur perdagangan. Namun, di sisi lain, Indonesia menghadapi tantangan berupa persaingan ketat dengan produk pertanian dari negara anggota ASEAN maupun China yang memiliki daya saing harga dan kualitas lebih tinggi. Kesimpulannya, ACFTA memberikan peluang besar bagi peningkatan ekspor pertanian Indonesia, tetapi perlu strategi penguatan daya saing melalui peningkatan kualitas produk, efisiensi distribusi, dan diversifikasi pasar agar manfaat perjanjian perdagangan ini dapat dioptimalkan secara berkelanjutan.

Abstract

The United Nations Convention on Contracts for the International Sale of Goods (CISG) sebagai dasar hukum perdagangan internasional bertujuan untuk memberikan kepastian hukum terkait perjanjian jual beli internasional. Untuk dapat mengadopsi CISG, perlu adanya ratifikasi oleh pemerintah Indonesia. Ratifikasi adalah pengesahan perjanjian internasional, yang berarti bahwa negara turut menandatangani dan terikat dengan perjanjian internasional tersebut. Hingga saat ini Indonesia belum juga melakukan ratifikasi CISG. Pada kenyataannya, Indonesia banyak terlibat dalam kegiatan ekspor dan impor yang membantu meningkatkan kesejahteraan masyarakat dan perkembangan ekonomi. Kegiatan ekspor dan impor tidak lepas dari perjanjian jual beli internasional yang merupakan bahasan pokok dan tujuan utama dibentuknya CISG, sehingga ratifikasi CISG menjadi langkah yang esensial bagi pemerintah Indonesia demi kesejahteraan masyarakat dan perkembangan ekonomi Indonesia. Oleh sebab itu, penelitian ini mempunyai tujuan untuk membahas bagaimanakah pentingnya ratifikasi CISG untuk ekspor dan impor Indonesia. Penelitian ini menggunakan metode penelitian empiris dengan menerapkan pendekatan komparatif (comparative approach). Sumber hukum yang relevan bagi penelitian ini adalah sumber hukum primer, sekunder, dan tersier. Berdasarkan penelitian ini, penulis berpendapat bahwa adanya hukum yang berbeda-beda di setiap negara dapat menimbulkan permasalahan dalam pembuatan dan pelaksanaan perjanjian jual beli internasional, serta menghambat pertumbuhan ekonomi Indonesia, sehingga diratifikasinya CISG menjadi krusial bagi Indonesia.

Abstract

Hak cipta merupakan salah satu bagian dari Hak Kekayaan Intelektual yang memiliki peran penting dalam melindungi karya cipta, khususnya di bidang musik dan lagu. UU Hak Cipta memberikan perlindungan hukum terhadap pencipta melalui hak moral dan hak ekonomi yang melekat secara otomatis sejak karya diwujudkan. Namun, dalam praktiknya, pelanggaran hak cipta masih marak terjadi, terutama dalam bentuk pemanfaatan ciptaan untuk kepentingan komersial tanpa izin lisensi yang sah. Penelitian ini menyoroti kasus pelanggaran lisensi musik oleh PT Mitra Bali Sukses, pengelola gerai Mie Gacoan di Bali, yang dilaporkan oleh Lembaga Manajemen Kolektif Sentra Lisensi Musik Indonesia karena memutar lagu di ruang publik tanpa membayar royalti. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan deduktif, mengkaji norma hukum dalam UU Hak Cipta, Peraturan Pemerintah Nomor 56 Tahun 2021, serta literatur dan data sekunder lainnya, yang kemudian diaplikasikan pada kasus konkret. Hasil penelitian menunjukkan bahwa tindakan memutar musik di ruang publik tanpa lisensi merupakan pelanggaran hak ekonomi sebagaimana diatur dalam Pasal 9 jo. Pasal 95 UU Hak Cipta, dengan konsekuensi pidana dan perdata. Meskipun demikian, permasalahan dapat diselesaikan melalui kepatuhan pelaku usaha terhadap kewajiban lisensi musik melalui Lembaga Manajemen Kolektif. Penelitian ini menegaskan pentingnya penguatan mekanisme penegakan hukum serta sosialisasi lisensi musik agar hak pencipta terlindungi dan industri kreatif dapat berkembang secara adil dan berkelanjutan.
