Abstract

Human Rights (HR) is a fundamental issue in social and religious life that has become the focus of various circles, including Islamic studies. This research aims to analyze the concept of Human Rights in the Qur'anic perspective through a thematic interpretation approach (tafsir maudhu'i), identify HR terms in the Qur'an, and examine the relevance of Qur'anic HR concepts to universal human rights principles. This study employs a qualitative method with a thematic interpretation approach, collecting data through library research by examining classical and contemporary tafsir literature, as well as documents related to universal human rights. The analysis uses content analysis techniques to identify patterns and themes related to HR in the Qur'an. The results show that the Qur'an contains fundamental HR concepts manifested through terms such as al-haqq (rights/truth), al-'adl (justice), al-hurriyyah (freedom), al-musawah (equality), and al-karamah (dignity). The Qur'an emphasizes human dignity (Q.S. al-Isra' [17]: 70), equality (Q.S. al-Hujurat [49]: 13), right to life (Q.S. al-Ma'idah [5]: 32), religious freedom (Q.S. al-Baqarah [2]: 256), and social justice. Qur'anic HR concepts have strong relevance to universal HR principles in the Universal Declaration of Human Rights (1948), though with a theocentric approach emphasizing balance between rights and obligations. This research contributes to strengthening understanding that Islam has a value system aligned with universal HR principles, while offering spiritual and moral dimensions that enrich modern HR discourse.

Abstract

The independence of the General Elections Commission (KPU) as an election organizing institution is constitutionally guaranteed; however, in practice, KPU's authority to create regulations is often constrained by the obligation to consult with the People's Representative Council (DPR) and the Government. This study uses a normative legal method with a statutory approach to analyze the legal politics behind the consultation requirement between KPU, DPR, and the Government in the process of forming KPU regulations. The research findings indicate that this obligation is not based on a strong philosophical or legal foundation, but rather on DPR's concern about the possibility that KPU may refrain from consulting with them. Therefore, a change in phrasing from “must” to “may” in the consultation norm is necessary to restore KPU's position as a truly independent institution, in accordance with the constitutional mandate. This change will allow KPU to operate more freely and objectively in making decisions without unnecessary pressure or intervention, in line with the spirit of electoral reform that aims for greater transparency and accountability.

Abstract

The principle of civilian supremacy is a constitutional foundation of Indonesia’s state system, affirming that the highest authority in governance belongs to civilian institutions rather than the military. This study examines the constitutionality of restrictions on civil positions for active Indonesian National Armed Forces (TNI) members as an instrument for strengthening civilian supremacy, and analyzes the appointment of active TNI members to civil positions against this principle. This research employs a doctrinal legal approach, utilizing statutory, theoretical, historical, and comparative methods, with the Philippines as a comparative country. The findings reveal that Article 47 of Law No. 3 of 2025 on TNI has not fully functioned as a consistent instrument for strengthening civilian supremacy, as it still includes four agencies—Bakamla, BNPB, BNPP, and BNN—that lack substantive connection to national defense functions. The appointment of three active TNI officers based on Decree No. Kep/1545/XII/2024 to agencies outside the limitatively enumerated list, without prior resignation or retirement from active military service, violates Article 47(2) of the TNI Law and reflects a substantive blurring of the boundary between defense and civil governance functions, resembling the dual-function (dwifungsi) practice of the ABRI era. These findings indicate that without normative correction, the consolidation of civilian supremacy built since the 1998 reform is at risk of regression. The study recommends that the Parliament harmonize Article 47 by limiting the list exclusively to agencies with substantive defense functions, that the Constitutional Court provide authoritative interpretation in the ongoing material review, and that the TNI Commander establish administrative verification procedures prior to issuing appointment decrees for active soldiers to civil positions.

Abstract

Penelitian ini bertujuan untuk menganalisis potensi nilai ekonomi Bontang Mangrove Park (BMP) sebagai kawasan hutan konservasi dan ekowisata, serta mengevaluasi pengaruhnya terhadap kesejahteraan masyarakat di sekitarnya. Ekosistem mangrove di Taman Nasional Kutai, khususnya di wilayah Bontang, menghadapi ancaman serius akibat aktivitas manusia seperti pertambakan ilegal yang menggerus keanekaragaman hayati. Oleh karena itu, diperlukan model konservasi yang mampu mengintegrasikan nilai ekonomi dengan kesejahteraan masyarakat guna memastikan keberlanjutan lingkungan. Metode yang digunakan dalam penelitian ini adalah pengamatan langsung, wawancara, dan penyebaran kuesioner kepada responden masyarakat serta pengunjung. Analisis nilai ekonomi dilakukan dengan pendekatan Total Economic Value (TEV), yang mencakup Travel Cost Method (TCM) dan Contingent Valuation Method (CVM). Data dianalisis secara statistik deskriptif dan menggunakan uji korelasi serta regresi melalui perangkat lunak SPSS. Hasil penelitian menunjukkan adanya korelasi yang sangat signifikan (R = 0,98) antara variabel potensi ekonomi dan program konservasi terhadap tingkat kesejahteraan masyarakat. Analisis SWOT merekomendasikan strategi kekuatan-peluang (SO) melalui optimalisasi fasilitas ekowisata, seperti jalur tracking dan menara pandang, serta penguatan keterlibatan masyarakat lokal sebagai pemandu wisata dan penyedia produk lokal. Penelitian menyimpulkan bahwa pengelolaan BMP melalui pendekatan eduwisata dan kolaborasi multipihak efektif dalam meningkatkan kesadaran lingkungan sekaligus memberikan manfaat ekonomi yang nyata bagi masyarakat pesisir.

Abstract

Unsafe household waste management is still an environmental health problem in Indonesia, especially the practice of burning waste which has the potential to cause air pollution and health problems. In Panyangkalang Hamlet, Belabori Village, Parangloe District, Gowa Regency, most of the people still burn garbage as the main method of disposal. This activity aims to increase public knowledge about proper waste management through health counseling. The method used is a pre-experimental design with a one group pre-test post-test approach. The intervention was carried out in the form of counseling for 10–20 minutes to 15 participants, with knowledge measurement using structured questionnaires before and after the counseling. The results showed an increase in knowledge scores from an average of 60.67% in the pre-test to 81.33% in the post-test. The Wilcoxon Signed-Rank statistical test showed a significant difference between the score before and after the intervention (p = 0.002). These findings show that health counseling is effective in increasing public knowledge about proper waste management. It is hoped that this increase in knowledge can encourage changes in people's behavior towards safer and more sustainable waste management practices.
