Abstract

Artikel ini membahas pemikiran maqāṣid al-syarī‘ah pada periode modern melalui perspektif dua tokoh penting, yaitu Alal al-Fasi dan Ahmad al-Raisuni. Kajian maqāṣid al-syarī‘ah memiliki peran strategis dalam pengembangan hukum Islam agar tetap relevan dalam merespons dinamika sosial dan tantangan modernitas. Penelitian ini bertujuan untuk mendeskripsikan konsep maqāṣid al-syarī‘ah menurut Alal al-Fasi, menganalisis teori maqāṣid al-syarī‘ah dan maqāṣid al-Qur’an menurut Ahmad al-Raisuni, serta membandingkan pemikiran keduanya dalam konteks hukum Islam kontemporer. Penelitian ini menggunakan pendekatan kualitatif dengan metode studi kepustakaan (library research). Data diperoleh dari karya-karya primer kedua tokoh serta literatur sekunder yang relevan, kemudian dianalisis menggunakan metode deskriptif dan komparatif. Hasil penelitian menunjukkan bahwa Alal al-Fasi menekankan maqāṣid al-syarī‘ah sebagai ruh syariat yang harus diwujudkan dalam kehidupan sosial melalui ijtihad, pendidikan, dan pembaruan pemikiran Islam. Sementara itu, Ahmad al-Raisuni mengembangkan maqāṣid secara lebih sistematis dan metodologis dengan membagi maqāṣid ke dalam maqāṣid umum, khusus, dan parsial, serta mengaitkannya dengan maqāṣid al-Qur’an. Perbandingan kedua pemikiran ini menunjukkan adanya kesinambungan antara dimensi praksis dan metodologis maqāṣid al-syarī‘ah, yang berkontribusi dalam memperluas cakrawala hukum Islam agar lebih kontekstual dan berorientasi pada kemaslahatan umat.

Abstract

Artikel ini menyajikan kajian mendalam tentang landasan teologis dan implementasi nilai-nilai wahyu (Al-Qur'an dan Hadith) dalam pengelolaan pendidikan Islam kontemporer. Berangkat dari pemahaman bahwa pendidikan Islam bukan sekadar transfer pengetahuan tetapi merupakan manifestasi dari konsep tarbiyah yang holistik, artikel ini mengidentifikasi berbagai disorientasi dalam praktik pengelolaan lembaga pendidikan Islam, seperti dikotomi kurikulum agama-umum, pendekatan pembelajaran yang doktriner, manajemen yang kurang mencerminkan prinsip syariah, serta evaluasi yang terlalu kognitif. Melalui metode penelitian kepustakaan (library research) yang bersifat preskriptif-normatif dengan pendekatan analisis isi tematik terhadap teks suci, kajian ini berhasil merumuskan prinsip-prinsip manajemen pendidikan Islam yang meliputi keutamaan ilmu, tanggung jawab kolektif, akhlak sebagai inti, kepemimpinan yang bermusyawarah, efisiensi profesional, dan keadilan inklusif. Lebih lanjut, artikel ini menawarkan solusi strategis berupa rekonstruksi paradigma yang berporos pada tauhid, desain kurikulum integratif, transformasi kepemimpinan yang berlandaskan amanah, syura, dan mas'uliyyah, pemanfaatan teknologi digital sebagai wasilah, serta reformasi sistem evaluasi holistik berbasis muhasabah. Dengan memaparkan studi kasus historis dan kontemporer, artikel ini menyimpulkan bahwa integrasi nilai-nilai wahyu secara sistemik dan kontekstual sangat mungkin dan mendesak untuk dilakukan. Tujuannya adalah membentuk generasi Muslim yang unggul secara intelektual (fathanah), kuat secara spiritual (rabbaniyah), dan berakhlak mulia (akhlakul karimah), guna menghadapi kompleksitas era modern sekaligus berkontribusi membangun peradaban Islam yang berkeadaban

Abstract

This study examines the practice of breast milk donation in a village and its impact on nasab (lineage) status from Yusuf Qaradawi's perspective on breastfeeding regulations. The research aims to analyze how this practice influences mahram relationships in the village community. A qualitative approach with a case study method was used, employing in-depth interviews and documentation. The findings show that 19 residents have participated in breast milk donation. Among them, 10 individuals are considered mahram according to Yusuf Qaradawi’s criteria, having been breastfed more than five times, while eight individuals are not mahram as they were only breastfed once. A unique case was found where a couple unknowingly married their milk sibling, leading to their children performing tajdidunnikah (marriage renewal). The village community believes that a single instance of breastfeeding establishes a mahram relationship, differing from Yusuf Qaradawi’s view. The novelty of this research lies in its analysis of real cases within the context of Islamic family law and its application in rural society. This study contributes to the development of Islamic legal understanding regarding breast milk donation and provides a sociological perspective through Emile Durkheim's Structural Functionalism theory, demonstrating that mechanical solidarity plays a role in shaping legal norms in society.

Abstract

ABSTRAKKajian maqāṣid syariah merupakan upaya memahami tujuan dan hikmah di balik pensyariatan hukum Islam. Meskipun istilah maqāṣid belum diformulasikan secara sistematis pada periode awal Islam, praktik dan kesadaran maqāṣid telah tampak sejak generasi sahabat hingga tabiin. Pada periode sahabat, orientasi hukum lebih menekankan aspek tekstual-normatif dengan berpegang pada Al-Qur’an dan Sunnah. Pertimbangan maslahat dilakukan secara terbatas, dengan kehati- hatian tinggi dalam berijtihad, terutama untuk menjaga agama dan persatuan umat. Sementara itu, pada periode tabiin, orientasi maqāṣid semakin berkembang melalui penggunaan qiyās, istihsān, dan ra’yu yang lebih luas. Hal ini didorong oleh meluasnya wilayah Islam, kompleksitas sosial, dan kebutuhan akan fatwa kontekstual. Tabiin menunjukkan keberanian lebih besar dalam menekankan maslahat sosial seperti perlindungan harta, jiwa, akal, dan keturunan, meskipun belum sampai pada perumusan teoritis. Dengan demikian, maqāṣid syariah pada periode sahabat dan tabi‘in menunjukkan kesinambungan, sekaligus perbedaan: sahabat cenderung konservatif dan tekstual, sedangkan tabi‘in lebih adaptif dan progresif. Perbedaan ini menjadi fondasi penting bagi perkembangan konseptual maqāṣid syari’ah pada era ulama ushul fiqh klasik, hingga kemudian mencapai bentuk sistematis dalam karya al-Juwaynī, al-Ghazālī, dan al-Syāṭibī.

Abstract

This research is based on the shortage of functional penghulu officers, which has become a serious issue for the government, particularly the Ministry of Religious Affairs of Indonesia. This condition can affect the quality of services in marriage registration, family guidance, and the provision of legal certainty to the community. To overcome the emergency of penghulu personnel, it is necessary to propose that the position of penghulu also be granted equal access to women, whereas until now the position of penghulu has been dominated only by men. Therefore, this research aims to conduct a comprehensive study on the provisions regarding the opportunities and problems of female penghulu within Indonesia’s civil law system, in which civil law is the official positive legal umbrella governing penghulu affairs. This research is normative legal research employing a statutory approach and a conceptual approach. Meanwhile, the primary legal materials of this research consist of various laws and regulations directly related to penghulu affairs. The results of this research indicate that the opportunities for female penghulu within the civil law system are very open, constitutionally valid, and not subject to any normative prohibition. The problems arise when female penghulu are requested to act as guardians appointed by the court (wali hakim) or entrusted with the delegated guardianship of marriage (taukil wali). This is because, under Indonesia’s civil law, a wali hakim or a person receiving taukil wali is required to be male. In addition, another problem is the existence of a specific requirement to be male that must be fulfilled in the recruitment of penghulu personnel as stated in the Announcement Letter on the Recruitment of Candidates for Civil Servants of the Ministry of Religious Affairs.

Abstract

Abstract: The phenomenon of “househusbands” has become increasingly relevant in the context of modern family life. This study aims to explain the dynamics of husband-wife relationships in situations where the husband assumes domestic responsibilities while the wife works outside the home, and to analyze this phenomenon through the lens of qirā'ah mubādalah, as conceptualized by Faqihuddin Abdul Kodir. Employing empirical legal research with a phenomenological and sociological approach, this research was conducted in Singotrunan Subdistrict, Banyuwangi District, Indonesia. Primary data were collected through in-depth interviews, observation, and documentation from four families experiencing this role shift, along with supporting informants such as neighborhood leaders and religious figures. The findings indicate that the shift in roles does not diminish the husband's authority or self-worth within the family. These men still feel valued due to their contributions in childcare, household management, and emotional support for their partners. Wives also feel appreciated and supported in their dual roles as breadwinners and mothers. The relationship is built on mutual understanding, open communication, and shared agreements. Viewed through the framework of qirā'ah mubādalah, these relationships embody principles of justice and gender reciprocity emphasized in progressive Islamic thought. This concept reinterprets spousal roles as complementary and context-based, rather than strictly determined by gender. Thus, the househusband phenomenon is not a deviation, but rather a reflection of adaptive and equitable family dynamics.Keywords: Househusband, Qirā'ah Mubādalah, Spousal Roles, Gender Equality.Abstrak : Fenomena “bapak rumah tangga” menjadi topik yang semakin relevan dalam dinamika kehidupan keluarga modern. Penelitian ini bertujuan untuk menjelaskan bagaimana relasi suami istri terbentuk dalam situasi di mana suami mengambil peran domestik, sementara istri bekerja di ranah publik, serta menganalisis fenomena ini melalui perspektif qirā'ah mubādalah yang ditawarkan oleh Faqihuddin Abdul Kodir. Menggunakan metode penelitian hukum empiris dengan pendekatan fenomenologi dan sosiologis, penelitian ini dilakukan di Kelurahan Singotrunan, Kecamatan Banyuwangi, Kabupaten Banyuwangi. Data primer dikumpulkan melalui wawancara mendalam, observasi, dan dokumentasi dari empat keluarga yang mengalami pembagian peran tersebut, serta informan pendukung seperti ketua RT dan tokoh agama.Hasil penelitian menunjukkan bahwa pergeseran peran ini tidak serta merta mengurangi otoritas atau harga diri suami dalam keluarga. Para suami tetap merasa dihargai karena kontribusi mereka dalam pengasuhan anak, pengelolaan rumah tangga, dan dukungan emosional terhadap pasangan. Istri pun merasa didukung secara penuh dalam menjalani peran ganda sebagai pencari nafkah dan ibu. Relasi keduanya terjalin atas dasar kesalingan, komunikasi terbuka, dan kesepakatan bersama. Dalam kerangka qirā'ah mubādalah, relasi tersebut mencerminkan nilai keadilan dan kesalingan gender yang ditegaskan dalam prinsip-prinsip Islam progresif. Konsep ini menafsirkan relasi suami istri secara setara, di mana peran dan tanggung jawab tidak ditentukan secara kaku berdasarkan gender, melainkan disesuaikan dengan kondisi dan kesepakatan bersama. Dengan demikian, fenomena bapak rumah tangga bukanlah bentuk deviasi, melainkan refleksi dari dinamika relasi yang adil dan adaptif.Kata kunci: Bapak Rumah Tangga, Qirā'ah Mubādalah, Relasi Suami Istri, Kesetaraan Gender.

Abstract

The issue of Islamic law and culture is one of the central issues that generates different judgments in society. Some people think that Islamic law should be culturally sterile. while others believe that Islamic law can dialogue with culture with several aspects that must be considered to maintain the purity of Islamic law. This is closely related to the phenomenon where the model of understanding religious law and the religious behavior of adherents of religion (Islam) changes. This article attempts to consider the phenomenon of dialogue between religious law and culture in society and to describe the different characteristics of local Islamic law.

Abstract

Divorce rates in certain Southeast Asian countries remain a growing concern, with some regions experiencing one divorce in every four marriages. Formal mediation in religious courts has proven largely ineffective in mitigating this trend. However, two Muslim-majority regions, namely Rembang in Indonesia and Melaka in Malaysia, consistently demonstrate significantly lower divorce rates. This study seeks to explore the underlying factors contributing to this pattern. Employing a qualitative comparative method, this empirical research investigates how religious leadership contributes to family conflict resolution in both communities. The study involved interviews with six (6) informants in Indonesia and six (6) in Malaysia. The findings reveal that the presence of a strong religious ecosystem, in which religious leaders act as informal mediators, plays a central role in preventing divorce and promoting reconciliation. In these communities, religious figures such as imams or kiai are widely respected and trusted, and are often consulted before legal proceedings are considered. In Malaysia, the role of religious leaders has been institutionalised through state-supported programs that integrate them into official family protection and dispute resolution mechanisms. In contrast, Indonesia has not yet developed formal policies that support the role of religious leaders in marital mediation, despite their substantial influence in rural and coastal communities. This study concludes that religious leaders function not only as moral authorities but also as effective mediators who connect community values with personal disputes. Strengthening collaboration between religious institutions and state authorities is crucial to enhancing non-litigation divorce prevention strategies. The integration of faith-based mediation into public policy could significantly contribute to sustaining family resilience in Southeast Asian Muslim societies.Keywords: religious authority; mediation; divorce; marriage.
