Abstract

The purpose of implementing land registration is to provide legal certainty and legal protection. The Agrarian Law that is used in Indonesia adheres to a negative system that is tied to a positive system. The land registration activity for the first time produced proof of rights, in the form of certificates as a means of proof of land rights. Certificate as a strong proof of rights means that physical data and juridical data in a certificate have the strength of evidence and must be accepted as true information, as long as it is not proven otherwise with other evidence in the form of certificates or other certificates. In Subari’s case, there was a double land certificate in the same plot of land. Subari has the ownership of land rights that is got from his parents and from purchasing with two buffaloes. But, there are other people who dominate the land that is belong to Subari and they also have the certificate to proof their ownership of the land rights. Settlement of multiple land certificates can be done through the Court, to obtain legal certainty that the certificate of ownership of land rights which has stronger evidence is based on evidence. The district court ruled that ownership of land rights belonged to Subari, and this decision was reinforced by high court and a Supreme Court.[F1]  [F1]Paragarf single

Abstract

The Deed of Sale is the deed made by the land deed official as evidence of a legal act of transfer of rights by way of buying and selling. Therefore, if the contents of the Deed of Sale contain legal defects, the transfer of rights can be said to be invalid. Then, what is the responsibility of the Land Deed Official for a legal defect in the Deed of Sale? The author in examining the problem using the normative method. The primary data that the author uses comes from interviews with those relating to the Land Deed Official, while secondary data comes from books that relate to the agrarian sector. Research suggests that the authority of the Land Deed Official was the making of an authentic deed related to agrarian/lands. Therefore, when legal defect exist in the Deed of Sale due to the mistake of the Land Deed Official, the Land Deed Official could be charged with administration sanction, civil sanction, and criminal sanction as a form of accountability. Thus, the responsibility for the Land Deed Official who erred in the making of Deed of Sale is administrative responsibility, civic responsibility, and criminal responsibility. It is good the be sure that before the Land Deed Official make the Deed of Sale, the Land Deed Official is consulted first about the data from Indonesian National Land Office.

Abstract

The certificate is a proof of ownership that is strong, this certificate comes from land rights which are the right to use and exploit the land which it occupies. Rights to land are also divided into Property Rights, Cultivation Rights, Building Use Rights, Use Rights, Rental Rights for Buildings, Use Rights and Temporary Land Rights. In this case the author will only explain the ownership rights related to legal issues, namely the right of ownership. Property rights are the strongest and most complete rights that humans can have. This right is obtained based on land registration. Own land registration is carried out by the authorized party, namely the National Land Agency. But in this case on the island of Pari, the certificate was declared maladministration by the ORI which caused the author to write about the validity of the certificate of land ownership based on law. With the formulation of the problem, how is the validity of the Certificate of Property Ownership according to uupa and Government Regulation Number 24 of 1997 related to the statement of maladministration by the ORI? and What are the legal consequences for certificate holders due to the administrative maladministration? By using explanatory research methods. In this case the researcher gets the result that in the process of land registration the measurement process is not carried out which is one of the requirements to obtain physical data and there is no announcements must be made because to provide an opportunity to file an objection.

Abstract

Mortgage rights can be said as collateral for land to pay off certain debts. Mortgage can be transferred through cessie. A cessie is a form of transfer of receivables on behalf of a creditor holding a mortgage that relates only to an agreement to hand over something to another party. Cessionary cannot directly have the object of Mortgage because the legal system in Indonesia that recognizes the prohibition of beding. In this case, the cessionary named Niko Septian made a request to the Mempawah District Court to request the name of the certificate so that the object of Dian Romadhon Siagian's debt security belonged to the cessionary. An application submitted by Niko Septian was granted by the District Court. Settlement that can be done so as not to violate the system of prohibition belonging to the beding is able to register the object of collateral receivables to the auction hall.

Abstract

Law Number 5 of 1960 concerning Basic Regulations on Agrarian Principles (UUPA) has already been enacted in Indonesia, but in the Special Region of Yogyakarta (DIY) it is in conflict with the Deputy Head of DIY Regional Instruction Number K.898/I/A/1975 regarding prohibition of ownership and control of land rights for Non-Indigenous Indonesians in Yogyakarta. Problems encountered in writing this thesis are how the application of the principle of equal rights in the control and use of land in the Special Region of Yogyakarta and how judges consider it in the Decision of the Yogyakarta District Court Number 132/Pdt.G/2017/PN.Yyk, is it in accordance with the principle of legal subjects in the LoGA. The research method used in writing this thesis is normative legal research. The results showed that the provisions on granting land rights to a Non-Indigenous Indonesian citizen in DIY based on the Instruction of Deputy Regional Head of DIY Number K.898/I/A/1975 were due to 2 reasons namely historical reasons and secondly because of fear of land being controlled by non-indigenous Indonesian citizens and the issuance of Instruction Deputy Regional Head of DIY is not without reasoning and thought. According to the author, the publication of this circular letter was a decision taken by Sri Sultan Hamengkubowono X as a leader as well as a King who protected the region and its people.

Abstract

Flats development is one of the alternative solutions for the Government in the field of housing and settlement regulated in Law Number 20 of 2011 concerning Flats. In order for the purpose of the construction of flats can be carried out, the management is needed to maintain harmony in the flats environment, especially in terms of supervision of the owner and its occupants, because in the elements of flats there are individual rights, some parts that can only be used by the owner (unit flat), and shared rights that can be used and managed together because it involves the interests of peoples. The management is performed by the Association of Owners and Residents of Flats (PPPSRS) as a legal entity that must be authorized by the Government. This research is using the normative legal research method. The main problem of this research is the problematics of the formation of the Association of Owners and Residents of Flats in terms of Law Number 20 of 2011 concerning Flats and regarding the application of PPPSRS functions in Robinson Apartment. In fact, the management in flats will not work properly if there are problems with the formation of PPPSRS. Therefore, regular monitoring and socialization are needed by the Government and the Housing and Settlement Area Office in terms of the management of flats so that the objectives of the implementation of flats can be implemented well.

Abstract

Infrastructure development for the public interest is indeed very urgent to be held immediately given that some infrastructure development facilities are still very alarming so that it becomes a priority in the development program. In addition, land acquisition for public interest development is supported by high population growth and increased community aspirations and improved development for the public interest which continues to increase. Filling land for development in the public interest, valuation of compensation by appraisers is carried out per field, parcels of land and underground land, buildings, plants, objects related to land, or other losses that can be shared. In carrying out activities, the appraiser is guided by standards, while in carrying out his duties the appraiser approves the code of ethics. In the evaluation of community change, weak decisions that cannot be refused by the government asking for land, like it or not, like it or not the community requires land to the government, the community must accept and leave the environment where they were raised, returned and memories of their homes. Related to the writer interested in doing an analysis of the problem of determining the value of compensation in the framework of land acquisition for the construction of the Kunciran-Serpong toll road. This analysis is carried out using normative research methods with the aim of appealing to the principles of law and searching for theoretical scientific truths of the problems discussed.

Abstract

The law of the land Indonesia in the act of no. 5 1960 basic provisions concerning this agrarian law based on article 33 paragraph 3 constitution of the Republic of Indonesia 1945. In long-term development the role of land to meet various purposes will increase, good as a live and for business activities.  The high level of demand will ground , present us on various problems quaint and still unsolved in an unsatisfactory manner for all parties. Usage rights business have had the use as agricultural land, fisheries, or farmers usage rights a business are also was in directly controlled by the state with a term 25 years or 35 years old and if necessary it could be prolonged 25 years, the broad at least usage rights business at least 5 acres. The various kinds of problems land around land and land together have a Cultivation Rights Title itself such a delicate and complicated it feels conflict land that is just keep on coming from the opening of the land and forest , damage to the customary overlapping permission and many other conflict certain harming other parties. The results of the investigations and analysis Forest Watch Indonesia has indicated the occurrence of violations of related to the licensing of some companies by the district government Long Bentuq area. Forest watch indonesia found the existence of overlapping permission between companies the oil palm with a company from various sectors which are all active operating in the same location but it happened to the forest customary, eviction cemetery land and sengon and cocoa plantations belonging to society is in the village Long Bentuq. The approach used by the writer among others is the approach comparative and law.
