Abstract

Legal voids or the lack of written regulations nowadays often cause judges to face difficult legal dilemmas. Judges are not permitted to refuse cases, but they also face psychological and theological pressures when making new rulings. This article discusses the concept of ijtihad in the courts by examining the theological guarantees found in the Hadith of Prophet Muhammad SAW regarding the reward for judges who exercise ijtihad. This research employs a normative qualitative method with Hadith studies (content analysis) and takhrij, as well as analysing the main narrations from Amr bin al-Ash. The results indicate that the reward of twofold for correct ijtihad and onefold for incorrect ijtihad is a way to avoid criminalising unintentional legal errors. These theological guarantees help reduce judges' psychological pressure and encourage progress in legal discovery (rechtsvinding). However, these guarantees only apply to judges who meet methodological requirements and possess high moral integrity to prevent malpractice in the court.

Abstract

This study examines the Qur'anic perspective on work ethic as a normative foundation for shaping productive, honest, and God-oriented work character. The problem addressed is the low productivity among Muslims despite the Qur'an's strong emphasis on diligent work. This library research employs a thematic exegetical approach (maudhu'i), collecting and comprehensively analyzing Qur'anic verses related to work ethic. The findings reveal that the Qur'an views work as integral to humanity's caliphal mission on earth, encompassing principles such as sincerity (ikhlāṣ), honesty (ṣidq), professionalism (itqān), diligence, and balance between worldly and otherworldly affairs. Verses analyzed include QS. At-Taubah: 105 (universal command to work), QS. Al-Jumu'ah: 10 (balance between worship and economy), QS. An-Najm: 39-41 (certainty of reward for effort), QS. Ar-Ra'd: 11 (causality of change), and QS. Al-Qasas: 77 (world-hereafter balance). This study concludes that the Qur'anic concept of work ethic contributes philosophically and practically to developing excellent, integral, and competitive human resources without abandoning spiritual values.

Abstract

This study examines the concept of ecotheology from the perspective of Hadith, focusing on the contribution of the Prophet Muhammad’s teachings in fostering environmental awareness and ecological ethics. The research employs a normative approach by analyzing hadiths concerning tree planting narrated by Imam al-Bukhari, Muslim, al-Tirmidhi, Abu Dawud, al-Nasa’i, and Ibn Majah. The analysis covers the narrators (rawi), chains of transmission (sanad), and textual content (matan) to evaluate the authenticity and validity of these traditions as normative foundations for Islamic environmental ethics. The findings reveal that these hadiths are authentic (sahih), supported by continuous chains of transmission, reliable narrators, and consistent textual content that aligns with the principles of the Qur’an. The hadiths on tree planting emphasize that ecological activities possess spiritual value and constitute a form of ongoing charity (sadaqah), as their benefits extend to humans, animals, and other living beings. These findings demonstrate that Islam provides a strong theological foundation for environmental conservation through the concepts of khalifah (stewardship), amanah (trust), and ecological balance. Therefore, environmental hadiths remain highly relevant for addressing contemporary ecological crises and serve as a basis for developing Islamic environmental ethics oriented toward sustainability and ecological responsibility.

Abstract

This study examines the practice of fraud (ghisy) in buying and selling transactions within traditional markets and online marketplaces. Ghisy, linguistically meaning deception or concealing defects, is strictly prohibited in Islam as affirmed by the Prophet Muhammad's saying: "Whoever cheats is not one of us" (HR. Muslim). This research aims to identify three main forms of fraud in trade: concealing product defects, altering product facts (tahrif description), and cheating in measurements and false oaths. Employing a qualitative library research method, this study analyzes primary sources from canonical hadith collections (Shahih Bukhari, Shahih Muslim, Sunan Ibnu Majah) and secondary sources from contemporary Islamic legal literature on commercial ethics. The findings reveal that all three forms of fraud remain prevalent in both traditional and digital marketplaces, causing significant consumer losses and eroding Islamic commercial ethics. Additionally, the study identifies contributing factors including weak regulatory oversight, low trader awareness, and insufficient verification practices by buyers. This research concludes that every trader is obligated to uphold honesty in transactions, while buyers must exercise vigilance and conduct thorough verification before completing payments. The study recommends strengthening oversight mechanisms and enhancing Islamic ethical education for traders to combat commercial fraud effectively.

Abstract

This study examines the concept of gharar (speculation/excessive uncertainty) through a thematic hadith (ḥadīth mawḍūʽī) approach, focusing on its conceptual definition, the grounds of its prohibition, and its relevance to contemporary transactions. The central problem is the persistent gap between the normative prohibition of gharar established in the Prophetic traditions and the empirical reality of modern transaction models e-commerce, conventional insurance, financial derivatives, cryptocurrency, and digital financing that increasingly embed elements of uncertainty. This research aims to reconstruct the meaning of gharar from authentic hadiths and to formulate operational criteria for distinguishing prohibited (fāḥish) from tolerated (yasīr) uncertainty in present-day muamalah. The study employs a qualitative library research design using the thematic hadith method, complemented by content analysis of the matn and a maqāṣid al-sharīʽah reading. The findings show that the prohibition of bayʽ al-gharar in Ṣaḥīḥ Muslim and the sunan collections is grounded in the protection of property, justice, and consent, rather than in the rejection of risk per se. Accordingly, gharar is graded: excessive uncertainty that dominates a contract and exploits one party is forbidden, whereas minor and unavoidable uncertainty is tolerated. Applied to contemporary practice, the criteria of clarity of object, price, quantity, and time of delivery provide a robust instrument for screening digital and financial transactions for Sharia compliance. The study concludes that thematic hadith analysis remains a living source of normative guidance capable of addressing emerging transaction technologies.

Abstract

This study explores the application of mediation values contained in the Prophet Muhammad’s hadith within the framework of Indonesia’s modern judicial system. Using a normative-theological approach and a descriptive-analytical qualitative method, the research examines hadiths related to iṣlāḥ (reconciliation) alongside national regulations, particularly Supreme Court Regulation No. 1 of 2016, as the contextual foundation. The findings reveal that the principles of iṣlāḥ in the hadith emphasize justice (‘adl), compassion (raḥmah), sincerity (ikhlāṣ), and public welfare (maṣlaḥah) as the ethical pillars of mediation. These values parallel and complement the paradigm of restorative justice in contemporary law. However, mediation practices in Indonesian courts are often understood merely as administrative procedures, leaving the spiritual and transformative dimensions of the hadith underrepresented. This paper proposes an integrative model emphasizing the capacity building of mediators based on Islamic ethics, the formulation of a mediation code of conduct combining theological and technical aspects, and judicial policies that assess mediation outcomes not only quantitatively but also qualitatively, such as the restoration of relationships and the inner peace of disputing parties. Further recommendations include developing an “Islamic Mediation Ethics” curriculum in legal education institutions and conducting future research on the application of hadith-based mediation principles in criminal, family, and economic law. Thus, mediation grounded in the Prophetic tradition not only reduces the burden of the judiciary but also strengthens the law’s role as an instrument of moral cultivation and social welfare.

Abstract

Tafsir al-Manār is widely recognized as one of the most influential works of modern Qur’anic exegesis, reflecting the reformist ideas of Muhammad Abduh and his disciple, Muhammad Rashid Rida. This study aims to analyze the interpretive method, characteristics, and intellectual contributions of Tafsir al-Manār to the development of modern Qur’anic interpretation. Employing a qualitative approach through library research, this study relies on Tafsīr al-Qur’ān al-Ḥakīm al-Masyhūr bi Tafsīr al-Manār as the primary source, complemented by relevant books and scholarly publications. The findings indicate that Tafsir al-Manār adopts the taḥlīlī (analytical) method by interpreting Qur’anic verses sequentially while emphasizing their practical guidance for contemporary Muslim society. The commentary integrates tafsīr bi al-ma’thūr and tafsīr bi al-ra’y, accompanied by a critical evaluation of Isrā’īliyyāt narratives. Its dominant interpretive orientation is adabī ijtimā’ī, which seeks to relate the Qur’anic message to social reform, education, morality, and the intellectual revival of the Muslim community. The analysis of the interpretations of Q.S. al-Baqarah [2]: 62 and Q.S. Āli ‘Imrān [3]: 104 demonstrates that Abduh and Rashid Rida emphasize faith, righteous deeds, and social responsibility as the essential foundations for individual and societal progress. This study concludes that Tafsir al-Manār represents not only a Qur’anic commentary but also a significant reformist project that bridges the normative teachings of the Qur’an with the socio-intellectual challenges of the modern era.

Abstract

This study aims to examine the authenticity of Sahih Bukhari Hadith No. 2112 regarding the right of khiyar through a comprehensive takhrij method to ensure the validity of the evidence in muamalah policy. Additionally, this study examines the mechanism of transmitting legal texts without editorial changes and compares the ijtihad of the four schools of jurisprudence regarding time limits to provide consumer protection solutions in the digital age. The methodology employed is normative legal research using a descriptive-analytical qualitative approach through library research. Data collection techniques involved cataloging hadiths on khiyar from the Kutubus Sittah, identifying the structure of the isnad, and analyzing key vocabulary (mufradat). Data analysis was conducted through stages of isnad criticism to assess the quality of the narrators, systematic analysis of the matn, comparative analysis across schools of thought, and the synchronization of traditional principles with modern economic realities. The research results indicate that the hadiths on khiyar possess exceptional chain of transmission quality within the Silsilah adz-Dzahab tradition, ensuring the text’s accuracy free from distortion over fourteen centuries. Regarding the time limit for khiyar syarat, differing viewpoints were identified: the Shafi’i school limits it to a maximum of three days, while the Maliki school allows a duration of up to 38 days depending on the type of object. In conclusion, the principle of khiyar remains relevant in the digital economy through the transformation of the order cancellation feature as a manifestation of khiyar majelis, as well as the return policy as an application of khiyar aib and khiyar syarat. The implications of this research emphasize that the ethical values of khiyar can serve as a foundation for regulators in refining consumer protection laws to minimize information asymmetry and ensure full consent (antaradin) in every online transaction

Abstract

This study examines the etiquette of seeking knowledge from the perspective of the hadith of the Prophet Muhammad SAW as a foundation for learning ethics relevant to the challenges of education in the modern technological era. The development of digital technology has changed the way humans acquire and produce knowledge, but these changes are often not accompanied by the strengthening of ethical values in the learning process. The research gap arises from the lack of studies that systematically integrate the principles of etiquette of seeking knowledge based on hadith with the context of contemporary technology-based learning. This study aims to identify the principles of etiquette of seeking knowledge in hadith and analyze their relevance to modern educational practices. The research approach uses a qualitative method with a library study design through thematic hadith analysis and a review of international educational literature. The results show that etiquette of seeking knowledge in hadith includes righteous intentions, humility, respect for teachers, patience in the learning process, and moral responsibility in the use of knowledge. These findings confirm that the value of etiquette has conceptual significance in building ethical and character-based digital learning. The implications of this study provide theoretical contributions to the development of Islamic education studies and serve as a conceptual basis for the formulation of values-based educational strategies in the technological era.

Abstract

Environmental preservation is becoming an increasingly urgent issue amidst global challenges posed by ecosystem degradation, pollution and climate change. In the context of Indonesia, where the majority of the population is Muslim, it is important to explore the role of Islamic law in supporting environmental conservation efforts. Islamic law, as a comprehensive legal system, not only regulates ritual and social aspects, but also provides moral and ethical guidelines related to nature conservation and ecosystem balance.This research aims to examine the principles of Islamic law that are relevant to environmental conservation and explore the potential for their application in the context of legal regulations in Indonesia. Through a qualitative approach and literature study methods, this research identifies teachings in the Al-Qur'an and Hadith which emphasize human responsibility as caliphs on earth, including the obligation to protect and preserve nature.The results of the study show that Islamic law has great potential to provide a strong ethical foundation for environmental conservation. Principles such as balance (mizan), prohibition of causing damage (fasad), and responsibility as caliph on earth can be used as a basis for formulating environmental policies and legal regulations. This research concludes that the integration of Islamic values ​​in environmental law can strengthen environmental conservation efforts in Indonesia, creating a legal framework that is not only oriented towards short-term interests but also towards long-term sustainability and balance of the ecosystem.
