Abstract

The study is driven by the rise in recidivists in Surabaya's Class I Prisons during the 2022–2023 period. The rise in recidivism at Surabaya's Class I Prison suggests that the coaching program there has not been able to provide targeted guidance to recidivists. As mentioned in Article 2 of Law Number 22 of 2022 concerning Corrections, prisons serve as places where inmates receive guidance to ensure they do not commit crimes again. The purpose of this study is to identify the variables that lead to coaching failures in Surabaya's Class I Prison as well as the barriers that the prison faces in raising recidivists. This study employs qualitative, empirical legal research methods, gathering data through observation, interviews, and documentation, then analyzing it with descriptive analytical methods. The results of the research show that the Surabaya Class I Prison recidivism development program failed because prison officers were still unable to carry out their main responsibilities and the prison development program still carried out activities that were not in accordance with applicable laws and regulations, resulting in poor guidance and recidivism in Prisons Class I Surabaya .

Abstract

Anak terlantar berhak mendapatkan kebahagiaan melalui proses adopsi. Proses adopsi di Indonesia dapat dilakukan melalui lembaga pengasuhan anak seperti yayasan maupun panti asuhan. Namun, dalam fenomena di masyarakat masih ada yayasan yang beroperasi secara ilegal seperti pada kasus “Yayasan Sejuta Anak” dalam putusan No. 30/Pid.Sus/2023/PN.Cbi. Yayasan tersebut diduga telah melakukan praktik perdagangan orang berkedok adopsi anak. Penulis tertarik untuk meneliti dakwaan yang diberikan JPU pada Terdakwa Suhendra dalam Putusan No. 30/Pid.Sus/2023/Pn.Cbi tentang Perlindungan Anak. Tujuan dari penelitian ini yaitu untuk mengetahui ketepatan JPU dalam menentukan dakwaannya serta akibat hukum jika terjadi salah penerapan hukum oleh JPU dalam dakwaannya pada Putusan No. 30/Pid.Sus/2023/Pn.Cbi. Penelitian ini dilakukan dengan metode yuridis-normatif serta pendekatan perundang-undangan, pendekatan kasus, dan pendekatan konsep. Pengumpulan bahan hukum dilakukan dengan teknik studi kepustakaan dan dianalisis dengan teknik preskriptif. Hasil pembahasan menunjukan bahwa perbuatan yang dilakukan Terdakwa telah memenuhi unsur-unsur dalam Pasal 2 Ayat (1) UU No. 21 Tahun 2007 tentang Pemberantasan Tindak Pidana Perdagangan Orang. Hal tersebut menunjukan adanya ketidaksesuaian dakwaan JPU, sehingga Hakim Pengadilan Negeri Cibinong menjatuhkan dakwaan kepada Terdakwa dengan pasal yang kurang tepat. Surat dakwaan merupakan dasar pemeriksaan suatu perkara pidana. Maka dari itu, JPU harus lebih cermat dan teliti dalam mencantumkan pasal yang akan didakwakan, sehingga pidana yang dijatuhkan oleh Hakim juga akan sesuai dengan perbuatan Terdakwa.

Abstract

Peraturan Mahkamah Agung Nomor 1 Tahun 2020 tentang Pedoman Pemidanaan Pasal 2 dan Pasal 3 Undang-Undang Pemberantasan Tindak Pidana Korupsi mengatur mengenai hal-hal yang harus dipertimbangkan oleh hakim dalam memutus suatu perkara tindak pidana korupsi pada Pasal 5 ayat (1). Ketentuan tersebut dibuat untuk menjatuhkan pidana yang bersifat proporsional atau setara, sehingga dapat menimbulkan adanya rasa jera dalam diri pelaku. Putusan Nomor 15/Pid.Sus-TPK/2023/PN Bjm terkait tindak pidana korupsi yang menimbulkan kerugian keuangan negara dengan kategori sedang, tidak mempertimbangkan Pasal 5 ayat 1 Peraturan Mahkamah Agung Nomor 1 Tahun 2020 tentang Pedoman Pemidanaan Pasal 2 dan Pasal 3 Undang-Undang Pemberantasan Tindak Pidana Korupsi. Penelitian ini menggunakan metode penelitian hukum normatif. Metode pendekatan penelitian yang digunakan adalah pendekatan perundang-undangan dengan menganalisis peraturan perundang-undangan terkait, pendekatan kasus dengan menganalisis Putusan Nomor 15/Pid.Sus-TPK/2023/PN Bjm terkait tindak pidana korupsi, serta pendekatan konsep yang berdasar pada kerugian keuangan negara yang menjadi acuan utama. Hasil penelitian menunjukkan bahwa pertimbangan hakim dalam Putusan Nomor 15/Pid.Sus-TPK/2023/PN Bjm tidak sesuai dengan ketentuan Pasal 5 ayat (1) Peraturan Mahkamah Agung Nomor 1 Tahun 2020 tentang Pedoman Pemidanaan Pasal 2 dan Pasal 3 Undang-Undang Pemberantasan Tindak Pidana Korupsi. Pidana yang dijatuhkan tidak setara dengan beratnya perbuatan pelaku sehingga tidak sesuai dengan tujuan pemidanaan yaitu untuk menimbulkan rasa jera dalam diri pelaku. Sebaiknya, dalam memutus perkara tindak pidana korupsi Pasal 2 ayat (1), hakim berpedoman pada Peraturan Mahkamah Agung Nomor 1 Tahun 2020 tentang Pedoman Pemidanaan Pasal 2 dan Pasal 3 Undang-Undang Pemberantasan Tindak Pidana Korupsi untuk dapat menjatuhkan pidana yang bersifat proporsional.

Abstract

The crime of corruption is an extraordinary crime, which should be able to deter the perpetrators from committing the crime again. However, the new rules made in Law No.1 of 2023 concerning the Criminal Code have lightened the prison sanctions and fines for perpetrators of corruption when compared to Law No.31 of 1999 concerning corruption. The purpose of this research is to find out what is the basis for the rules of corruption offenses to be included in the National Criminal Code and to find out the basis for reducing the sentences for corruption offenses in the National Criminal Code. So that problems related to the reduction of criminal sanctions for corruption motivate the author to conduct research using normative legal research methods with a statutory approach, conceptual approach, and historical approach. The data collected is then analyzed prescriptively. The result of the research is that corruption can be included in the National Criminal Code through the principle of codification and it can be seen that the reduction of punishment for corruption offenders is based on the politics of criminal law, individualization of punishment, and punishment. However, this is not in accordance with the existing facts considering that this corruption case is detrimental not only to the state but also to society.

Abstract

Narkotika adalah obat atau bahan kimia yang berasal dari sumber non-tumbuhan maupun tumbuhan yang berfungsi mengurangi atau menghilangkan rasa sakit dan rasa sehingga menimbulkan ketergantungan. Narkotika memiliki sisi positif bagi ilmu kesehatan yakni dapat menjadi obat yang dapat menimbulkan rasa mengantuk, mengurangi rasa sakit, dan menenangkan saraf. Namun jika Narkotika tersebut dikonsumsi secara berlebihan maka akan menimbulkan ketergantungan yang berkepanjangan, tujuan pada penelitian ini ialah untuk mengetahui bagaimana penerapan pasal 103 Undang-Undang Narkotika di kabupaten sidoarjo serta untuk mengetahui bagaimana upaya hakim dalam mengatasi adanya ketidakefektifan pasal tersebut. Metode pada penelitian ini menggunakan penelitian hukum yuridis serta menerapkan teori soerjono soekanto, sehingga pada penelitian menghasilkan bahwasannya adanya ketidakefektifan pada pasal tersebut sehingga Upaya yang dilakukan oleh hakim ialah dengan menerapkan pidana penjara serta pelaku dengan sisa pidana penjara tersebut diberikan rehabilotasi pada perkara penyalagunaan narkotika.

Abstract

The importance of equitable health for all people is part of national development that must be considered by the government. With a high level of health, it will increase strong human resources. The government issued Law No. 23 of 1992 concerning health, which states that every Republic of Indonesia has the right to obtain the highest degree of health and needs to be included in government health efforts. The purpose of this study was to find out how the Internal System of the Muhammadiyah / Aisyiyah Hospital in the Central Region could prevent fraud. The method used is qualitative with descriptive type. The results of this study indicate that the Internal Control System is running rffectively as indicated that all Muhammadiyah / Aisyiyah hospitals in the Central Java region have been fully accredited, which reflects that the Internal Control System is running well fraud will be prevented as early as passible so that the objectives of Good Corporate Governance ( GOG ) can be achieved.

Abstract

Indonesia is the largest batik-producing country in the world. The batik industry is growing rapidly in Indonesia, apart from having a positive impact, there is also a negative impact, namely environmental pollution in waterways and groundwater sources due to liquid waste resulting from batik production. This colored and smelly waste can cause allergies and damage the quality of groundwater which is also a source of drinking water for the surrounding community. Apart from treating wastewater using IPAL, another solution is for batik craftsmen to be motivated and raise awareness to use natural, environmentally friendly dyes. This is what prompted the PKM activity "Training on Making Natural Batik Dye Using a Multifunctional Mixer Machine for Bekasi Batik MSMEs". In terms of quality, batik with natural dyes has a higher value than batik using synthetic dyes. Economically, there is still a large market for environmentally friendly batik, especially from customers who are environmentally conscious both at home and abroad. The method for making natural dyes, which used to be boiled using just a pan, will be improved by using a multi-function stirring machine, making it more productive, efficient, and hygienic so that natural dyes are not easily damaged. The manufacturing process time can also be shorter so that the overall production time is not disrupted. Increasing the awareness and ability of craftsmen in processing natural dyes is expected to also improve the quality of batik products and the environment around the production site. In the end, it is hoped that an increase in craftsmen's business will occur

Abstract

ABSTRACTIntroduction: Caries is an oral cavity infection that attacks the hard tissue of the teeth. Caries are caused by cariogenic bacteria such as Streptococcus mutans (S.mutans). S.mutans plays a role in the process of biofilm and plaque build up. One alternative ingredient that has antibacterial properties is Biduri leaves (Calotropis gigantea). The research aimed to analyze the antibacterial potential of Biduri leaf extract on the growth of S.mutans colonies. Methods: This type of research is a laboratory experimental research in vitro using the post-test-only control group design method. The antibacterial test used the colony counting method. The extraction process used the maceration method for 1 day with a shaker. The concentrations used were concentrations of 20, 40, and 60%. Control (+) used 0.2% chlorhexidine and control (-) used distilled water. Incubation process was for 24 hours. Counting the growth of S.mutans colonies using a colony counter was carried out by three observers. Data analysis used the Kruskal-Wallis test followed by the Mann-Whitney test. Results: The results showed that there was a significant difference in the growth of S.mutans (p<0.05) after being exposed to Biduri leaf extract at a concentration of 20, 40, and 60%. Conclusion: The Biduri leaf extract has antibacterial potential against S.mutans at concentrations of 20, 40, and 60%, and the best concentration in reducing the growth of S.mutans colonies is the concentration of 60%.KeywordsAntibacterial, Calotropis gigantea, 0.2% chlorhexidine, colony counting, Streptococcus mutans

Abstract

ABSTRACTIntroduction: The high number of cases of tooth loss in Indonesia has led to the emergence of dentures. Dentures not appropriately kept clean can trigger cases of denture stomatitis due to Candida albicans. C. albicans is often detected on denture plates and causes denture stomatitis. Cleaning the dentures can prevent denture stomatitis, and  chemical cleaning often uses synthetic materials such as alkaline peroxide. However, alkaline peroxide can cause side effects in the form of increased porosity on the surface of the acrylic plate, so an alternative natural ingredient, namely Biduri leaves (Calotropis gigantea), is needed because it has various active compounds such as alkaloids, flavonoids, phenols, saponins, terpenoids and tannins which have antifungal effects. This study aimed to determine the effective inhibitory power of Biduri leaf extract as a denture cleanser in acrylic immersion against the growth of C. albicans. Methods: Biduri leaves were extracted using the maceration method with 70% ethanol solvent to produce varying concentrations of 20, 30, 40, and 50%. The sample used in this research was an acrylic plate measuring 10x10x1 mm, soaked in artificial sterile saliva for 1 hour, then soaked in each sample group for 8 hours, after that it was placed in 10 ml of Sabouraud Dextrose Broth (SDB) media, and vibrated for 30 seconds using a mixing vortex, spreading 0,1ml SDB on Saboraud Dextrose Agar (SDA) and incubated for 48 hours. The growth of C. albicans was observed and counted using the colony counting method. Results: This research showed an inhibitory power of Biduri leaf extract in concentrations of 20, 30, 40, and 50% on the growth of C. albicans, with a concentration of 50%, having the most significant inhibitory power. Conclusion: Biduri leaf extract as a denture cleanser has an inhibitory power on the growth of C. albicans.KEYWORDS   Biduri leaves, Calotropis gigantea, heat cured acrylic, Candida albicans

Abstract

Purpose: This research on community involvement aims to provide education regarding waste sorting, training in gradual waste sorting, and processing organic and inorganic waste. Methodology: The method combines a structured process including field observations, comprehensive assistance, outreach on waste processing, discussions, and simple organic and inorganic waste sorting. Results: Before this Community Service Activity (PKM), most residents were already accustomed to sorting waste. However, only a few process it further, where only 22.2% process their waste. This training explains the types of waste, the importance of processing waste, and how to process it. After this activity, residents were enthusiastic and interested in learning to process organic and inorganic waste. After CSA activities, more residents wanted to process waste (organic: 64.3%, inorganic: 92.9%). Conclusions: The PKM successfully raised participants' awareness of the importance of waste processing beyond just sorting. Residents were interested in learning more to apply this practice and contribute to a better environment. This PKM activity needs to continue so that the community can fully implement waste sorting and processing in their surroundings. Limitations: The activities did not provide detailed waste processing practices, so the public still doubts carrying out independent waste processing. Time for activities and discussions with participants is also limited. Contribution: This activity increases residents' awareness about waste sorting and processing. The public is given knowledge about types of waste, how to sort waste, and waste processing to increase community participation in waste management.
