Abstract

Penyalahgunaan narkotika pada anak terjadi pada putusan Pengadilan Negeri Mataram Perkara Nomor 26/Pid.Sus.Anak/2022/PN.Mtr. Anak bertindak sebagai pengguna, perantara jual beli narkotika Golongan I, dan pelaku penggelapan. Hakim menjatuhkan pidana berupa pembinaan dalam Lembaga BRSAMPK “Paramita” Mataram. Penelitian ini mengkaji dan menganalisis pertimbangan hakim dalam putusan Perkara Nomor 26/Pid.Sus.Anak/2022/PN.Mtr apa telah sesuai dengan ancaman pidana Pasal 114 Ayat (1) UU Narkotika dan apakah telah sesuai dengan kesalahan terdakwa. Tujuan yang hendak dicapai adalah untuk mengetahui kesesuaian pertimbangan hakim dalam putusan Perkara Nomor 26/Pid.Sus.Anak/2022/PN.Mtr dengan ancaman pidana pada Pasal 114 Ayat (1) UU Narkotika dan untuk mengetahui kesesuaian pertimbangan hakim dalam memutus Perkara Nomor 26/Pid.Sus.Anak/2022/PN.Mtr dengan kesalahan terdakwa. Penelitian ini merupakan penelitian hukum normatif. Pendekatan yang dipakai adalah pendekatan perundang-undangan dan pendekatan kasus. Penelitian ini menggunakan sumber bahan hukum primer dan bahan hukum sekunder. Pengumpulan bahan hukum dilakukan melalui studi kepustakaan. Hasil penelitian ini adalah Putusan Hakim Pengadilan Negeri Mataram dengan Perkara Nomor 26/Pid.Sus.Anak/2022/PN.Mtr belum sesuai dengan ancaman pidana yang terdapat dalam Pasal 114 Ayat (1) UU Narkotika. Dalam Putusan Hakim Pengadilan Negeri Mataram dengan Perkara Nomor 26/Pid.Sus.Anak/2022/PN.Mtr, anak pelaku bertindak sebagai menjadi perantara jual beli narkotika Golongan I, pemakai dan pelaku tindak pidana penggelapan, dikategorikan dalam concursus idealis. Maka kasus yang diputus oleh Hakim Pengadilan Negeri Mataram perkara Nomor 26/Pid.Sus.Anak/2022/PN.Mtr  sudah sesuai dengan Pasal 81 UU SPPA terutama jika mendasarkan pada ayat (5) nya.

Abstract

Disparitas pidana menimbulkan rasa ketidakadilan pada diri terdakwa maupun pada masyarakat pada umumnya. Dalam penelitian ini, penulis menganalisa perbedaan perimbangan hakim hingga menimbulkan disparitas pidana dalam Putusan Nomor 1981/Pid.Sus/2021/PN Sby diaman terdakwa divonis pidana selama 4 tahun 6 bulan dan Putusan Nomor 1822/Pid.Sus/2021/PN Sby dimana terdakwa divonis pidana selama 2 tahun 6 bulan. Kedua putusan tersebut memuat kasus yang hampir sama yaitu kasus penyalahgunaan narkotika golongan I kristal metamfetamina yang diputus dengan pasal yang sama dan fakta persidangan terbukti bahwa barang bukti yang ditemukan juga hampir sama. Adanya disparitas pidana dapat disebabkan oleh faktor hukum dan faktor hakim. Faktor hukum disparitas pidana dapat disebabkan karena tidak terdapat pedoman pemidanaan dalam Kitab Undang-Undang Hukum Acara Pidana. Sedangkan faktor hukum disparitas pidana dapat disebabkan karena faktor internal hakim. Dalam penelitian ini, penulis menggunakan metode penelitian hukum empiris. Sumber datanya didapatkan dengan mengamati perilaku hakim dengan wawancara dengan hakim. Berdasarkan hasil wawancara, didapatkan bahwa faktor yang menimbulkan disparitas pidana dalam kedua putusan tersebut disebabkan oleh perbedaan pandangan hakim mengenai rasa keadilan yang ada dalam masyarakat dan perbedaan pedoman hakim Ketika memutus suatu perkara. Hakim pada putusan Nomor 1981/Pid.Sus/2021/PN Sby berpedoman pada konsep hukum progresif yang menganggap bahwa dalam memberikan putusan tidaklah harus berpatokan pada bunyi undang-undang melainkan pada rasa keadilan dalam masyarakat dikarenakan undang-undang tidak selalu relevan. Sedangkan hakim pada putusan Nomor 1822/Pid.Sus/2021/PN Sby berpedoman pada konsep hukum positivistik legalistik yang berpegang teguh pada bunyi undang-undang. Kata Kunci: Analisis Putusan, Anak, Narkotika, Perlindungan Anak.

Abstract

Eksibisionisme merupakan perilaku menunjukkan bagian tubuh atau alat vital kepada orang lain untuk mencapai kepuasan seksual. Hal tersebut dilakukan untuk mendapatkan kepuasan seksual dengan cara masturbasi sembari berimajinasi. Eksibisionisme sendiri termasuk dalam kategori gangguan preferensi seksual (parafilia). Permasalahan yang akan dibahas disini adalah mengenai penjatuhan pidana penjara terhadap pelaku eksibisionisme yang terdapat dalam putusan pengadilan No. 40/Pid.Sus/2021/PN. Skw. Kasus ini bermula dari seorang Terdakwa Bernama Otniel Kwolomine yang melakukan tindak pidana eksibisionisme. Hakim memutuskan bahwa Terdakwa Otniel Kwolomine dinyatakan bersalah melanggar Pasal 36 Jo Pasal 10 Undang-Undang Nomor 44 Tahun 2008 tentang Pornografi dan Pasal 197 ayat (1) KUHAP (Kitab Undang-Undang Hukum Acara Pidana) dengan menjatuhkan pidana penjara selama 7 (tujuh) bulan. Penelitian ini memiliki isu hukum yang berupa konflik antara putusan No. 40/Pid.Sus/2021/PN. Skw dengan tujuan pemidanaan yang akan ditinjau dengan teori double track system. Jenis penelitian yang digunakan adalah metode interpretasi yang bertujuan untuk mengetahui dan memahami dasar pertimbangan Hakim pada putusan pengadilan No. 40/Pid.Sus/2021/PN. Skw dan memahami akibat hukum yang terjadi. Kemudian metode yang digunakan dalam penelitian ini adalah yuridis normatif dengan menggunakan pendekatan undang-undang, pendekatan konseptual dan pendekatan kasus. Bahan hukum yang digunakan meliputi bahan hukum primer, bahan hukum sekunder dan bahan non-hukum. Hasil penelitian merupakan masukan terhadap pertimbangan Majelis Hakim dalam menjatuhkan pidana terhadap pelaku eksibisionisme seharusnya ditambahkan rehabilitasi medis. Hal ini diperkuat dengan teori tujuan pemidanaan terutama pada double track system. Kata Kunci: Putusan Hakim, Eksibisionisme, Pemidanaan.

Abstract

Abstract Narcotics addicts in Mojokerto from 2016 to mid-2022 there were 257 clients. In 2019, there were 33 addicts, and in 2020 there were 38 addicts. During 2021 there were 50 people then by mid-year of 2022, there were 42 addicts. This case has impacted the overcapacity of Correctional Institutions in prisons in Mojokerto. One effort that had be done is to use a restorative justice approach. This study aims to identify and explain the application of restorative justice in cases of narcotics crimes by the Mojokerto BNN, to identify and describe the supporting and inhibiting factors for implementing restorative justice in tackling narcotics crimes by the Mojokerto BNN. The results of this study indicate that the BNN in Mojokerto has never succeeded in implementing restorative justice in cases of narcotics crimes because it only handles cases with suspects as dealers. There are five supporting factors while implementing restorative justice in narcotics crime cases at BNN Mojokerto, regulations, and law enforcement have been formed, facilities and infrastructure have also been fulfilled, increasing public knowledge of settlements through restorative justice. As well as there are two main factors inhibiting the application of restorative justice in narcotics crime cases at the BNN in Mojokerto. These two supporting factors are at the same time hindering its implementation, the rules regarding the implementation of restorative justice which have a limited period, and the absence of team members in the integrated assessment that are not represented by other officers. Abstract

Law Number 17 of 2016 concerning Child Protection introduces chemical castration as an additional punishment for perpetrators of child sexual violence, regulated under Article 81 paragraph (7). The implementation of this punishment is mandated to doctors under Article 9 letter b of Government Regulation Number 70 of 2020, based on orders from prosecutors. However, this obligation conflicts with the medical ethical code and the doctor's oath, prompting the Indonesian Medical Ethics Honorary Council (MKEK PB IDI) to issue Fatwa No. 1 of 2016, expressing professional opposition to doctors performing chemical castration. Despite this, doctors—especially those with civil servant status—are legally required to obey state orders, with refusal risking sanctions as outlined in Article 216 paragraph (1) of the Criminal Code. This research aims to examine the legal position of doctors in carrying out chemical castration and possible legal avenues to resist this duty. Using a normative legal research method with statutory and conceptual approaches, and literature-based data collection, the study concludes that doctors are legally bound to implement chemical castration if mandated by law, particularly as civil servants subject to disciplinary rules. However, doctors who object may pursue a judicial review to the Supreme Court, arguing that the duty infringes upon their professional ethics and mental integrity. Such legal recourse seeks to balance state obligations with individual professional conscience.

Abstract

Organic waste can decompose naturally, but organic waste also has the potential to damage the environment. Piles of organic waste that do not receive oxygen can produce dangerous methane gas. Piles of organic waste are a habitat for animals such as mice, flies, cockroaches, and mosquitoes. These animals carry infectious diseases through various bacteria and viruses. One way to reduce waste reaching final disposal sites is to process organic waste at the household level so that it has economic benefits and added value. The solution offered in this Community Service (PKM) is to process fresh organic waste, namely fresh vegetable waste and fresh fruit peels, and utilize the enzyme content of these organic materials through anaerobic fermentation, which produces coenzymes. The eco-enzyme produced is processed into a solid eco-enzyme soap derivative product. Apart from being used for household purposes, it can also be sold, increasing family income. Community service is carried out in collaboration with the Ikhlas Mandiri Charitable Foundation. The PKM was carried out in Pagerageung village, Tasikmalaya Regency. The results of the PkM showed that the participants felt capable of making eco-enzyme soap and were interested in making it in the future. Factors that support the sustainability of PKM activities are the availability of organic waste (fresh fruit and vegetable peels), coconut oil as a raw material for soap, and the support of the Yayasan Amal Ikhlas Mandiri.

Abstract

Semarang City is one of the areas in Central Java Province that has various potential superior regional products, one of which is soybean processing in Sumurrejo Village, Gunungpati District. The abundant potential for soybean processing has made Sumurrejo Village designated as a Thematic Soybean Processing Village (OKE Village). There are a total of 16 soybean processing producers divided into 8 tofu producers and 8 tempeh producers, including Berkah Hambida and UD Jaya Makmur which focus on tofu processing. The problems faced by the two producers include the production aspect, namely the lack of standardized and adequate infrastructure, the absence of Appropriate Technology (TTG) and the lack of hygiene in the production area. In addition, problems in terms of quality, marketing and the environment are also still very minimal. There is no standardized Wastewater Treatment Plant (IPAL) and the market segment is still limited to the local and regional scope. The purpose of community service is to overcome problems in terms of production and marketing. More specifically, these problems include aspects of production, quality, hygiene and environmental aspects. The service methods used are through socialization, training, technology application, mentoring and evaluation as well as program sustainability. The results of the service in the 1st year (2024) were to create and implement 1 unit of steam boiler machine, 1 set of food grade stainless steel boiling pans and optimization of the Wastewater Treatment Plant (IPAL).

Abstract

Adoption of digital civil registration services in Kebumen Regency through Lawet Kebumen and Pancen Maen applications is still low, although these technologies are designed to improve the efficiency of civil registration administration. This study used descriptive qualitative and quantitative methods, with surveys, interviews, and secondary data analysis from Disdukcapil Kebumen. The data showed that out of 1,271,875 residents, only 5.69% had activated the Digital Population Identity (IKD), reflecting the low acceptance of the technology. Based on the Technology Acceptance Model (TAM), Theory of Planned Behavior (TPB), and Diffusion of Innovations (DOI) theories, the main barriers include perceived usefulness and ease of use, social norms that support conventional methods, and limited access to technology in peripheral areas. Concerns over personal data security are also a significant factor slowing down adoption. This research recommends socialization of digital literacy, equitable infrastructure development, strengthening data security, and community approaches to change social norms. These strategies are expected to increase the adoption of digital services in Kebumen, thereby accelerating a more inclusive and efficient civil registration modernization.

Abstract

Energy is one of the main factors in supporting mobility in activities. Gas Stations (SPBU) are one way that people can get energy. In its operations, gas stations must be able to provide the best service to consumers so that maintaining consumer loyalty. This study aims to be able to choose the best Gas Stations (SPBU) with Analytical Hierarchy Process (AHP) method. The criteria used are based on previous research and based on the results of expert analysis so that the selected criteria are used as a model in decision making, namely management, sales, services, facilities and variations of fuel products. For alternatives to be evaluated are 5 gas stations located in the Legok area, Tangerang, Banten. Based on the calculation of the pairwise criterion comparison matrix in the AHP method, eigenvalues are obtained to perform consistency tests. after processing and analysis, it is known that the highest criterion is service and the lowest is sales. And alternative calculation results obtained that the gas station 5 is the best alternative chosen.

Abstract

Pendahuluan. Daun biduri (Calotropis gigantea) digunakan oleh masyarakat sebagai obat tradisional khususnya mengobati sakit gigi. Ekstrak daun biduri diketahui memiliki kandungan senyawa flavonoid, triterpene glycosides, abrin, dan alkaloids. Salah satu syarat untuk menjadikan tanaman obat sebagai sediaan farmasi diperlukan standarisasi cemaran mikroba dan uji antibakteri. Tujuan penelitian ini untuk menganalisis aktivitas antibakteri dan cemaran mikroba daun biduri. Metode: Uji cemaran mikroba menggunakan metode angka lempeng total bakteri dan kapang. Sedangkan uji aktivitas antibakteri menggunakan metode difusi cakram dengan konsentrasi ekstrak daun biduri 15%, 20%, 25% dan 30% terhadap bakteri Streptococcus mutans dan Porphyromonas gingivalis. Data  untuk uji aktivitas antibakteri dianalisis menggunakan Anova One Way sedangkan untuk uji cemaran mikroba menggunakan metode deskriptif kuantitatif dibandingkan dengan standar cemaran mikroba berdasarkan Peraturan Kepala Bidang Pengawas Obat dan Makanan (BPOM). Hasil: Uji antibakteri terhadap S. mutans menunjukkan hasil zona hambat kategori sedang, dengan rata-rata diameter zona hambat dari kontrol negatif (0 mm), konsentrasi 15% (8,94 mm), 20% (9,05 mm), 25% (9,65 mm), 30% (9,79 mm), dan kontrol positif (22,43 mm). Sedangkan pada P. gingivalis tidak ada zona hambat. Hasil uji statistik didapatkan nilai signifikansi p=0,00 (p<0,05). Hasil uji cemaran mikroba menunjukkan hasil perhitungan jumlah bakteri 13.300 cfu/gram dan tidak ditemukan pertumbuhan kapang. Simpulan: Ekstrak daun biduri memiliki daya hambat terhadap Streptococcus mutans, tetapi tidak memiliki daya hambat terhadap Porphyromonas gingivalis. Cemaran ekstrak daun biduri masih memenuhi syarat batas cemaran sesuai standar bahan baku obat herbal.Antibacterial Activity Test and Microbial Contamination of Biduri Leaves (Calotropis gigantea L.) according to Quality Standards for Herbal Medicine: Experimental Laboratory StudiIntroduction. Biduri leaves (Calotropis gigantea) are used by the community as traditional medicine, especially to treat toothache. Biduri leaf extract is known to contain flavonoid, triterpene glycosides, abrin, and alkaloids. One of the requirements for making medicinal plants as pharmaceutical preparations requires standardization of microbial contamination and antibacterial test. Objective: to analyze the antibacterial activity and microbial contamination of biduri leaves. Method: The microbial contamination test uses the total bacterial and fungal plate count method. While the antibacterial activity test uses the disc diffusion method on 15%, 20%, 25% and 30% biduri leaf extract against Streptococcus mutans and Porphyromonas gingivalis. Data for antibacterial activity test were analyzed using Anova One Way while for microbial contamination test using quantitative descriptive method and compared with microbial contamination in accordance with Regulation of Head of Drug and Food Supervisory Division (BPOM). Results: Antibacterial test against S. mutans showed moderate inhibition zone result, with average diameter of inhibition zone from negative control (0 mm), concentration 15% (8,94 mm), 20% (9,05 mm), 25% (9,65 mm), 30% (9,79 mm), and positive control (22,43 mm). Meanwhile, in P. gingivalis there is no inhibition zone. Statistical test result obtained significance value p=0.00 (p<0.05). Microbial contamination test result showed bacterial count result 13,300 cfu/gram and no mold growth was found. Conclusion: Biduri leaf extract has inhibition against S. mutans, but has no inhibition against P. gingivalis. The contamination of Biduri leaf extract still meets the contamination limit according to the standard of herbal medicinal raw materials.
