Abstract

Latar belakang: Maraknya pinjaman online ilegal belakangan ini telah menimbulkan keresahan di masyarakat. Tak jarang, mereka terjebak menerima perlakuan tak etis, bahkan teror saat ditagih pinjaman online ilegal. Rumusan masalah dalam penelitian ini tindak pidana pinjaman online illegal. Pertanggungjawaban pidana penyedia aplikasi pinjaman online ilegal dalam hukum positif. Metode penelitian: Jenis penelitian yang digunakan yuridis normatif. Pendekatan masalah yang digunakan Pendekatan peraturan-undangan dan pendekatan kontekstual.Bahan hukum yang menggunakan bahan hukum primer, Bahan hukum sekunder dan Bahan hukum tersier. Pengumpulan semua bahan hukum yang diperoleh dari studi Pustaka. Analisis pada penelitian hukum menggunakan metode deduktif dalam menjawab permasalahan Hasil penelitian: Tindak pidana pinjaman online ilegal. Ketentuan pidana bagi fintech yang beroperasi secara ilegal pada Pasal 32 Juncto (jo), juncto Pasal 48 UU ITE tidak secara eksplisit mengatur sanksi yang harus dijatuhkan pada fintech ilegal. Namun Pasal 26 UU ITE dan POJK No. 77/POJK.01/2016.Pertanggungjawaban pidana penyedia aplikasi pinjaman online ilegal dalam hukum positif. Kesimpulan: Pertanggungjawaban pidana dijatuhkan terhadap penyedia aplikasi. Pidana yang dikenakan terhadap penyedia aplikasi pinjaman online ilegal ini akan dijerat sesuai dengan tindak pidana yang dilakukan, seperti termaktub dalam Pasal 17 ayat (2) Undang-Undang Nomor 11 Tahun 2011 tentang Informasi dan Transaksi Elektronik Kata kunci : Tindak Pidana, Penyedia Aplikasi, Pinjaman Online, Ilegal

Abstract

The development of 21st century learning is always associated with advances in Information and Communication Technology used in learning activities. Therefore, teaching material products are needed that are in line with the application of 21st century learning. The aim of this research is to develop electronic student worksheets teaching materials containing Problem Based Learning based on live worksheet websites in geography learning. Using a type of development research or R&D (Research and Development) with the ADDIE (Analyze, Design, Development, Implementation, and Evaluation) development model. The research results obtained show that electronic student worksheets containing Problem Based Learning based on the live worksheet website was declared very valid by expert validators with a total percentage result of 92.77%. The e-LKPD product developed also produced good responses from students with a total percentage of 82.75%. The electronic student worksheets product developed is considered capable of improving student learning outcomes as proven by obtaining a total percentage of 91.60% of students who obtained a score above the minimum completeness.

Abstract

Copyright infringement in the form of software piracy has various modes that lead to crime. This research aims to analyze forms of copyright infringement, enforcement and protection of software copyright based on the Copyright Law. This research used normative juridical method with statute approach and conceptual approach. The research results show that piracy of computer software is a violation of copyright, because in economic use/commercial use of computer software, written permission is required in the form of license. Person who feels aggrieved by the occurrence of this violation can file a lawsuit with the Commercial Court. Law enforcement is carried out by the government, police and judicial institute. Perpetrators of illegal computer software license can be subject to criminal sanctions, especially in Article 112 and 113 of the Copyright Law. Apart from that, there are several alternative non-litigation dispute resolution methods. Preventive protection is carried out by the government in terms of supervising software creation and collaborating with various parties. Repressive measures include fines, imprisonment and additional penalties.Keywords: protection; enforcement; piracy; software, copyright

Abstract

Perberdayaan air sebagai sumber energi terbarukan untuk pembangkit listrik tenaga air (PLTA) dapat dilakukan untuk membantu program elektrifikasi di Indonesia, mengingat sebanyak 526.980 rumah tangga di IIndonesia tidak memiliki akses listrik. Sementara 80% sumber air sebagai sumber energy listrik. Energy listrik di Indonesia belum dimanfaatkan secara optimal. Artikel ini bertujuan untuk mengetahui bagaimana cara memberdayakan air sebagai sumber energy listrik terbarukan untuk mendukung program elektrifikasi di Indonesia. Berdasarkan hasil studi literature, ditemukan bahwa pembangkit listrik tenaga air memiliki keunggulan seperti biaya operasional dan perawatan yang rendah, masa pakai yang relative lama, dan lebih ramah lingkungan. Pemberdayaan air sebagai sumber energy listrik terbarukan dilakukan melalui beberapa tahapan yaitu pembangunan bendungan dengan menggunakan karung pasir, pemasangan pipa pesat, pembangunan rumah pembangkit, pemasangan turbin, pemasangan puli, dan pemasangan genset.

Abstract

This research is entitled " THE JUDGE'S CONSIDERATIONS IN DECISIONING THE VERDICT ON COPYRIGHT INFRINGEMENT OF THE SONG "LAGI SYANTIK" (CASE STUDY Number: 910 PK/Pdt.Sus-HKI/2021.JKT.Pst". The writer is interested in this title because he examines more deeply the copyright infringement of the song "More Beautiful". with reference to the title, the author will examine it using normative legal research methods or what is commonly known as normative juridical. examine all laws and regulations that are related to ongoing legal issues. Conceptual approach, moving from the views and doctrines that develop in the science of law, researchers will find ideas that give birth to legal notions. Understanding of these views and doctrines is the basis for researchers in building a legal argument in solving legal issues at hand and a case approach that functions to study legal norms and principles applied in practicing law. In the case of a cover version of a song that does not meet the elements listed in Articles 43 and 44, this action is considered a form of copyright infringement. Copyright violations by the defendants in this case included making cover versions of songs, modifying songs, and recording them in the form of video clips.

Abstract

Purpose – This study aims to enhance the motivation and learning outcomes of 4th-grade students at SDN Ngaglik 01 Kota Batu through the implementation of the Sort & Match Board learning media. This medium integrates physical and cognitive activities to actively involve students in the learning process, thereby fostering academic improvement.Method – The research employed Classroom Action Research (CAR) using the Kemmis & McTaggart model, which includes the stages of planning, implementation, observation, and reflection. The study was conducted from November 14 to December 13, 2024, involving 23 fourth-grade students. Data was collected through observation, interviews, questionnaires, documentation, and analysis of student learning outcomes. Findings – The results revealed a significant improvement in both student motivation and academic performance. The proportion of motivated students increased from 21.7% in Cycle I to 100% in Cycle II, while the average test score rose from 60.43 to 85.57. A paired sample t-test confirmed the statistical significance of this improvement (p < 0.05). Enhancements in the visual design and instructional clarity of the media were identified as contributing factors to increased student engagement. Research Implications – The findings suggest that interactive learning media can effectively boost student motivation and academic outcomes. Nevertheless, the study's generalizability is limited by its small sample size and specific context. Future research is recommended to investigate the application of the Sort & Match Board across various subjects and educational levels.

Abstract

Contractual disputes due to breaches often occur in business relationships, including the case between CV. Karya Putra Bersama and the plaintiff. This study aims to analyze the legal basis and resolution process of breach of contract disputes and their impact on the parties. The research questions include the causes of the breach, dispute resolution steps, and court decisions. The study employs a normative juridical approach by analyzing contract documents, legal facts, and court rulings. Findings indicate that the defendant breached the contract due to delayed deliveries and violations of contractual commitments, leading to a court ruling requiring the defendant to pay penalties and damages. Furthermore, non-litigation efforts such as legal notices failed due to the defendant's lack of goodwill. This study emphasizes the importance of detailed contract drafting and optimizing non-litigation dispute resolution to prevent legal and financial losses.

Abstract

The rapid development of information and communication technology has transformed the trade sector through the emergence of digital transactions. In this context, there has been a shift in the relationship between businesses and consumers, giving rise to new challenges in consumer rights protection. The complexity and intensity of digital transactions open up opportunities for exploitative practices that harm consumers as the more vulnerable party. The main issue examined in this paper is how the state, from a constitutional law perspective, exercises its authority to ensure legal protection for consumers in digital transactions as part of fulfilling the constitutional rights of citizens. This study employs a normative legal method with a qualitative analytical approach, through literature review and grammatical and systematic legal interpretation. The results indicate that consumer protection in digital transactions is an integral part of the principles of the rule of law and human rights protection as stipulated in Article 28D paragraph (1) of the 1945 Constitution. The state is obligated to actively implement adaptive regulations, strong oversight, and consumer education to create a fair, safe, and sustainable digital trade ecosystem in accordance with the values of social justice and humanity as enshrined in Pancasila.

Abstract

Pembelajaran merupakan proses interaksi siswa, guru dan media sumber belajar pada suatu lingkungan pembelajaran. Pemanfaatan model dan media pembelajaran yang tepat dapat meningkatkan motivasi belajar siswa. Penelitian ini bertujuan untuk menganalisis pengaruh model pembelajaran Real Quest Outdoor Learning (REQOL) berbasis nearpod terhadap kemampuan berpikir kreatif dan hasil belajar siswa. Metode penelitian eksperimen dengan desain posttest only control group design. Hasil post-test kemampuan berpikir kreatif kelas eksperimen memiliki rata-rata 71.25 sedangkan pada kelas kontrol memiliki rata-rata 58.13. Data hasil uji t-test berdasarkan pest-test kemampuan berpikir kreatif menunjukkan nilai sig. (2-Tailed) 0,001. Sehingga didapatkan ada pengaruh yang signifikan antara model pembelajaran REQOL berbasis nearpod terhadap kemampuan berpikir kreatif dan hasil belajar siswa di kelas eskperimen dan kelas kontrol.
