Abstract

Investasi merupakan kegiatan penanaman modal yang bertujuan mendapatkan keuntungan di masa depan dengan memberikan modal (uang). Seiring dengan perkembangan teknologi, kegiatan investasi yang dilakukan masyarakat dapat dilakukan secara online dengan melalui platform online. Upaya dalam mempromosikan dan menawarkan jenis investasi online sering melibatkan influencer sebagai strategi untuk mendapatkan pengikut atau calon investor. Tulisan ini bertujuan untuk menganalisis pertanggungjawaban pidana influencer terhadap investasi ilegal. Metode penelitian dalam tulisan ini adalah normatif melalui studi kepustakaan dengan menggunakan pendekatan konseptual dan analisis. Investasi online dapat menimbulkan risiko dan kerugian bagi pengikutnyå yakni kejahatan dari kegiatan investasi online ilegal itu sendiri. Sedangkan akibat dari kejahatan investasi online maka pelaku yang bertanggungjawab bisa dikenakan unsur dalam Pasal 28 ayat (1) Jo Pasal 45 A ayat (1) UU Informasi dan Transaksi Elektronik.Kata Kunci : Pertanggungjawaban pidana, Influencer, Investasi Ilegal

Abstract

The increasing application of restorative justice in handling cases of child sexual violence in Indonesia has sparked controversy due to its potential to create impunity for perpetrators and neglect victims’ rights. This study aims to analyze the dilemma of restorative justice as a form of impunity in child sexual violence cases and to propose an ideal model that ensures the fulfillment of victims’ rights and the realization of substantive justice. The research employs a normative legal method using statutory and conceptual approaches. Primary and secondary legal materials are examined through qualitative analysis to identify inconsistencies between regulatory norms and practical implementation. The findings reveal that although restorative justice aims to restore victims and rehabilitate offenders, its misapplication especially when diversion is carried out without sufficient attention to the victim’s recovery may result in impunity and re-victimization. Furthermore, the lack of understanding among law enforcement officials, inadequate monitoring mechanisms, and social pressure contribute to ineffective victim protection. The study proposes a victim-centered restorative justice model that emphasizes comprehensive victim recovery, offender accountability, and active community participation supported by trained facilitators and strict supervision. The novelty of this research lies in offering a structured model for implementing restorative justice that balances victims’ and offenders’ rights, thereby ensuring substantive justice and preventing impunity in cases of child sexual violence.

Abstract

In the modern era, criminal cases have become more complex and abuse remains one of the most frequently encountered offenses in court proceedings. The enforcement of criminal law rests on the presumption of innocence, meaning that prosecutors must prove the defendant’s guilt beyond reasonable doubt. If the evidence is insufficient, the judge must acquit the defendant. However, such acquittals often create a dilemma of justice, especially when victims have clearly suffered harm but the legal elements of the offense cannot be proven. The Lubuklinggau District Court Decision No. 186/Pid.B/2023/PN Llg serves as a significant example. In this case, the panel of judges acquitted the defendants even though witness statements and a Visum et Repertum (medical report) were presented. The judges reasoned that the connection between the pieces of evidence was not strong enough to establish the defendants’ direct involvement in the abuse. This study analyzes the judges’ considerations in issuing the acquittal and examines its implications for victims’ rights from the perspective of justice. The findings show that the acquittal was based on the failure to prove the element of “jointly committing abuse.” Although Yoyon Utoyo was found to have committed violence against the victim, Hengki Ternando, there was no concrete evidence linking Bobot Sudoyo to the act, so the element of deelneming (participation) was not fulfilled. Legally, the verdict is valid since the elements of the crime were not proven beyond reasonable doubt. Yet from the victim’s viewpoint, the decision is unjust, as it denies protection and recovery rights guaranteed under Law No. 31 of 2014 on Witness and Victim Protection. This case reflects the tension between legal certainty and justice, where formal procedures often overshadow fairness, weakening public trust in the judiciary.

Abstract

Premeditated murder is a grave criminal offense and is classified as a grave crime because it directly violates the constitutional right to life as one of the most fundamental and non-derogable human rights. This study aims to provide an in-depth analysis of the criminal liability of military personnel involved as perpetrators of premeditated murder, using a normative juridical method through a case approach and an examination of the court’s decision. The discussion focuses on the application of general criminal law provisions to active soldiers tried within the military court system, which has its own distinctive characteristics. The findings show that although the two defendants played different roles one carried out the shooting directly while the other issued the instruction both were considered to share a common will and awareness in committing the criminal act. The court determined that the elements of intent and premeditation were fulfilled, rendering both defendants equally responsible. The author argues that when viewed through the lens of criminal law doctrine, which emphasizes a calm and deliberate mental state as an indicator of premeditation, the defendants’ psychological condition, which was influenced by situational pressure, may give rise to different interpretations of this element. Nevertheless, the court’s decision affirms that military status does not exempt an offender from criminal liability and may even serve as an aggravating factor, as the conduct is deemed to undermine the discipline, honor, and integrity of the armed forces.

Abstract

Indonesian adolescents are increasingly exhibiting reduced engagement in psychological help-seeking. This study investigates the moderating role of Peer Support (PS) in the relationship between Psychological Help-Seeking (PHS) and Psychological Well-Being (PWB), with the hypothesis that PS amplifies the positive effects of PHS. A cross-sectional survey was administered to 1,385 adolescents (510 males, 875 females; M = 14.2, SD = 2.1) in Central Java using stratified random sampling. Three validated self-report instruments were employed: the 42-item PWB scale (α = .91), whose six-factor structure was confirmed via CFA in the present sample (N = 1,374; CFI = .962, RMSEA = .042); the 14-item PHS scale (α = .83); and the 23-item PS scale (α = .88). Hierarchical regression controlling for gender and age showed that PHS significantly predicted PWB (β = .35, p < .001, R² = .28). The interaction term PHS × PS accounted for an additional 3% of the variance (ΔR² = .03, p = .002). Simple slope analyses indicated that the positive association between PHS and PWB was stronger among adolescents with high PS (+1 SD; β = .53) than among those with low PS (−1 SD; β = .17), confirming the strengthening effect of peer support. Findings highlight the role of peer support in moderating the relationship between PHS and PWB in collectivist contexts, supporting the use of peer networks to enhance the effectiveness of help-seeking. Practically, these results encourage school counselors to prioritize peer-support training and integrate peer-facilitator programs to strengthen adolescents’ help-seeking and psychological well-being.

Abstract

Latar Belakang: Kampung Wisata Kuliner RW 4 Haurpancuh II di Bandung memiliki potensi besar untuk pengembangan UMKM lokal, namun masih menghadapi kendala berupa rendahnya pemanfaatan teknologi digital, minimnya literasi sertifikasi halal, dan kurangnya strategi pemasaran modern. Melalui program pengabdian kepada masyarakat ini tim pelaksana mengimplementasikan Framework AIDA untuk pemasaran digital, menyelenggarakan pelatihan literasi sertifikasi halal, dan memberikan pendampingan penggunaan aplikasi GoHaur sebagai platform promosi dan transaksi daring. Metode: Aplikasi GoHaur digunakan untuk menampilkan katalog produk, mempermudah proses pemesanan, serta memperluas jangkauan pemasaran. Hasil: Hasilnya, 85% peserta meningkat pemahamannya tentang pemasaran digital, 70% UMKM aktif menggunakan GoHaur, 40% memulai proses sertifikasi halal, dan omzet beberapa usaha naik 15–20%. Kesimpulan: Kolaborasi dengan Dinas Koperasi dan UKM serta DPMPTSP Provinsi Jawa Barat memastikan pendampingan berkelanjutan bagi pelaku UMKM.

Abstract

Kontribusi awal Kesultanan Pontianak dalam membentuk sistem pendidikan Islam di wilayah Kalimantan Barat. Fokus pembahasan diarahkan pada peran strategis Sultan Syarif Abdurrahman Al-Qadri dalam merancang model pendidikan Islam yang berakar pada nilai-nilai budaya lokal dan praktik keagamaan masyarakat. Penelitian ini menggunakan pendekatan kualitatif dengan metode studi pustaka dan pendekatan historis yang mencakup tahapan heuristik, kritik sumber, interpretasi, dan penulisan historiografi. Temuan penelitian menunjukkan bahwa sejak masa pendiriannya, Kesultanan Pontianak tidak hanya berperan sebagai pusat kekuasaan politik, melainkan juga sebagai penggerak utama dalam dakwah dan pengembangan pendidikan Islam. Pendidikan berlangsung secara nonformal melalui lembaga tradisional seperti surau dan masjid yang menjadi pusat utama pembelajaran agama. Materi yang diajarkan mencakup fikih, tauhid, tasawuf, dan Al-Qur’an, yang disampaikan melalui metode talaqqi dan ceramah. Para ulama yang mengajar umumnya merupakan lulusan Makkah dan Madinah, yang memiliki pengaruh keilmuan dan sosial yang kuat dalam masyarakat. Sistem pendidikan yang diterapkan bersifat fleksibel, berbasis komunitas, dan mengedepankan pendekatan personal antara guru dan murid. Model pendidikan ini mencerminkan suatu bentuk integrasi antara nilai spiritual, pengetahuan keislaman, dan realitas sosial lokal. Dengan demikian, kontribusi Kesultanan Pontianak dalam pendidikan Islam tidak hanya bersifat historis, tetapi juga memberikan landasan konseptual bagi sistem pendidikan Islam yang kontekstual, adaptif, dan berkelanjutan pada era kontemporer. Peneliti berharap hasil temuan ini dapat memberikan kontribusi ilmiah bagi pengembangan wacana pendidikan Islam di masa kini dan mendatang.

Abstract

The general definition of adolescents is our young people who are still considered children, for example, if we look at it from the perspective of the general understanding or stance of society, usually their ages are between 13 and 15 years (unmarried). And when viewed in terms of age, they may seem like adults, but in terms of behavior they actually still have a lot to learn, both through parental education and experiences in life. If we look at the contents of the Civil Code, Article 330 explains that those categorized as minors are those who are 21 years old and even then must have never been married. From other aspects such as religious and customary in general, those who are considered adults are those who have menstruated if a woman and if a man has ejaculated while unconscious, his voice changes to a high pitch. Meanwhile, in the Criminal Code in Article 45, it is regulated that those who are considered minors are those who are under 16 years old. The sheer number of differing opinions, as outlined above, demonstrates the importance of understanding the concept of children and adolescents. This is because it is closely related to the judicial process or the handling of crimes committed by these children and adolescents.

Abstract

This study aims to describe the forms of emotion and depression experienced by the character Lengkara in the novel 00.00 by Ameylia Falensia using Beck’s Cognitive Triad approach. The research was conducted in 2024 employing a descriptive qualitative method. The data source consisted of the printed and digital versions of the novel 00.00. Data were collected through reading and note-taking techniques, while the data analysis referred to Miles and Huberman’s model, including data reduction, data display, and conclusion drawing. The research instrument was the researcher herself, supported by a categorization table of emotions and cognitive triad indicators. The findings show that Lengkara experiences various negative emotions, such as fear, sadness, anger, disappointment, hopelessness, and recurrent psychological pressure. Based on Beck’s Cognitive Triad, Lengkara’s depression is reflected in three main aspects: negative view of self, negative view of the world, and negative view of the future. Lengkara tends to blame herself, perceive herself as worthless, view her environment as emotionally threatening, and believe that her future holds no hope. These results indicate that the novel 00.00 presents a complex representation of depression relevant to the psychological dynamics of modern adolescents. This study contributes to literary psychology research, particularly in understanding character cognitive distortions through the Cognitive Triad theory.

Abstract

Penelitian ini dilatarbelakangi oleh fenomena variasi bahasa berdasarkan gender yang hadir dalam media populer, khususnya film, sebagai representasi praktik berbahasa dalam masyarakat urban. Kajian ini memanfaatkan teori sosiolinguistik, terutama konsep variasi bahasa Lakoff terkait karakteristik bahasa perempuan serta teori Wardhaugh mengenai kecenderungan topik dan gaya bahasa laki-laki. Penelitian ini menggunakan metode deskriptif kualitatif dengan teknik pengumpulan data berupa dokumentasi melalui penayangan berulang film The Architecture of Love. Data berupa tuturan tokoh kemudian ditranskripsi, diklasifikasikan, dan dianalisis berdasarkan kategori gaya bahasa gender dan topik pembicaraan. Hasil penelitian menunjukkan bahwa perempuan lebih banyak menggunakan bentuk kebahasaan seperti lexical hedges, tag question, intensifier, dan penghindaran kata kasar, sedangkan laki-laki cenderung menggunakan bahasa yang lebih langsung, tegas, dan dominan. Dari aspek topik, perempuan lebih sering membicarakan isu personal, emosi, dan relasi sosial, sementara laki-laki membahas pekerjaan, fakta objektif, dan situasi yang menuntut rasionalitas. Temuan ini menegaskan bahwa variasi bahasa gender dalam film mencerminkan konstruksi identitas sosial para tokoh dan selaras dengan teori-teori sosiolinguistik. Penelitian ini menyimpulkan bahwa film mampu menjadi medium representatif untuk mengamati dinamika bahasa berdasarkan gender dalam konteks masyarakat modern.
