Abstract

Pencurian adalah salah satu dari tindak pidana yang meresahkan masyarakat sehingga perlu di antisipasi dan ditindak lanjuti. Tindak pidana pencurian telah diatur dalam Kitab Undang-undang Hukum Pidana (KUHP) Buku II Bab XXII Pasal 362 hingga Pasal 367. Penelitian ini menggunakan metode penelitian hukum normatif. Penelitian hukum normatif pada dasarnya merupakan suatu kegiatan yang akan mengkaji aspek-aspek (untuk menyelesaikan masalah-masalah yang ada di dalam). hasil penelitian menunjukkan bahwa majelis hakim memutuskan  pidana penjara 4 (Empat) Tahun dan 3 (Tiga) Bulan kepada terdakwa Maka dalam hal mengenai unsur dan disesuaikan dalam fakta di persidang penulis melihat hakim sependapat dengan jaksa penuntut umum yaitu mendakwa tererdakwa I Fransisco terdakwa II Muhammad Rizki terdakwa III Tamim benar telah melakukan tindak pidana pencurian sebagaiman diatur dalam Pasal 363 KUHP.  Hakim setelah menguraikan fakta yang terungkap dipersidangan selanjutnya akan mempertimbangkan mengenai unsur Pasal yang didakwakan oleh jaksa penuntut umum dengan fakta yang terungkap dipersidangan. Dalam perkara Pidana (Pustusan No. 1287/Pid.B/2023/PN Mdn) hakim mepertimbangkam megenai dakwaan yaitu dengan mendakwakan pasal 363 KUHP pencurian dengan pemberatan, yang terjadi ketika seseorang melakukan pencurian dengan menggunakan kekerasan atau ancaman kekerasan terhadap orang, menggunakan senjata, atau bersekongkol dengan orang lain.

Abstract

The research is entitled "Judge's Decision Regarding the Crime of Theft of 2 (two) Green Metal Plates (Case Study Decision Number 1357/Pid.B/2023/PN Mdn)". The crime of theft is increasing and developing rapidly, causing the security of a country to be disrupted. This is a negative impact of the progress that has been achieved by a country. The crime of theft committed by many people is caused by economic factors which are getting worse due to low income and also The high unemployment rate is because it is difficult to find work. Other factors that support someone committing the crime of theft include environmental influences, the opportunity to commit theft, lack of awareness of the law by the perpetrator and can be caused by other social factors. This research is descriptive analytical in nature with the aim of describing a research object or data as thoroughly as possible which contains explanations about humans, conditions or various kinds of symptoms to emphasize several types of hypotheses to make it easier to strengthen theories with the ultimate aim of making a comprehensive conclusion. the results of the research are that the defendant Wawan M. Nur has been legally and convincingly proven guilty of committing the crime of "theft under aggravating circumstances"; as in the public prosecutor's single indictment; namely the Defendant together with Mr. SUKMA (DPO) in taking 2 (two) pieces of green iron plate 5 (five) millimeters thick with a size of 150cm x 40cm without the knowledge and/or permission of Witness ROBERT H as Tembekang Belawan Pusbekangad TNI AD's attorney as the owner, which caused the TNI AD Tembekang Belawan Pusbekangad suffered a loss of approximately Rp. 5,000,000 (five million rupiah). The judge's decision is a decision that has been reviewed as carefully as possible and thoroughly, therefore a prison sentence of 3 (three) years and 6 (six) months for the defendant is a fair decision for the defendant and also the victim. Thus, it is hoped that from this case no one else will commit acts of theft which could be detrimental to the perpetrator and victim if discovered, and from this case it can also have a deterrent effect on the defendant so that they do not commit other criminal acts and from this case it can give fear to the accused. readers not to commit acts that can be punished.

Abstract

Criminal law consists of regulations. which determines what is prohibited and what is permitted in criminal cases, and determines the punishment that can be given to people who commit them. It is easy to measure the success of Indonesia's legal reform. One of the criminal acts of theft that is often considered to occur very often is motorbike theft. Motorbikes are an important means of transportation for most Indonesian people because the price is affordable for most people with middle to lower incomes, where the increase in the number of motorized vehicles is in line with the increase in the number of crimes involving motorbikes which has led to the crime of motorbike theft. The author uses qualitative legal research with secondary data sources in this research. In this article, the research method used is the normative news method. The Police of the Republic of Indonesia have direct authority to carry out all criminal acts, including theft with violence. This is in accordance with the police's duty to maintain security and public order, protection, protection and community service, as well as law enforcement. In the law enforcement process, efforts are made to uphold functions with legal norms as guidelines for behavior in traffic or legal relations in society and the state where there are perpetrators who commit the criminal act in question, in the sense of people who, with some intention or something unintentional, as required by law, have left a consequence of climbing the law whether it is subjective elements or other elements and in article 362 of the Criminal Code it is explained that the act of taking an item which in whole or in part includes a statement by another person with the intention of possessing the item in violation of the rights.

Abstract

The aim of this research is to find out how criminal responsibility is for perpetrators of theft with weights in the Legal Area of ​​the Medan District Court. The research method used is a normative legal method with a type of normative juridical research, where research focuses on studying the application of rules or norms in positive law. The results of this research show that the criminal and his partner were legally proven and promised to be guilty of committing the crime of "aggravated theft", the factor that caused the perpetrator to commit the crime of theft was because the criminal was addicted to drugs. The judge's decision stated that the fraudster did not find anything that could eliminate criminal liability for himself. Criminal liability for the defendant is imprisonment for: 10 (ten) months in prison minus the period of isolation that has been served and with an order that the defendant remain in detention.

Abstract

This research aims to help people know the procedures for resolving land grabbing disputes. Land grabbing is an unlawful act that can harm the land owner. Settlement of land grabbing disputes can be done through two channels, namely the non-litigation route and the litigation route. This research uses a legal method that combines doctrinal research (normative legal research) and socio-legal research (empirical legal research). The legal materials used in this research consist of primary legal materials and tertiary legal materials.

Abstract

Narcotics are substances or drugs that are very useful, especially in the medical world and are needed to treat certain diseases. However, if it is misused or used not in accordance with treatment standards, it can have very detrimental consequences if accompanied by the abuse and illicit trafficking of narcotics which results in greater danger to the life and cultural values ​​of the nation which will ultimately weaken national resilience. Abstract

The monetary crisis has greatly impacted Indonesian society, leading to a moral crisis. This can be seen from the increasing crime rate and unemployment. This tends to cause one of the crimes that often occurs, which is theft. The application of standard articles in cases with relatively small valued goods will certainly increase the piling up of cases and the prolonged handling of a case. Not infrequently, these cases are forced to be resolved in a long period of time and end up in the Supreme Court. This study aims to find out the decision of the Medan High Court Number 1287/Pid.B/2023/PN Mdn regarding theft. In this study, the author uses a normative juridical approach, which is an approach carried out by analyzing and interpreting theoretical matters regarding principles, legal interpretation and comparative law. The results of the analysis and discussion in this study are that in the case of the criminal act of theft with case number 1287/Pid.B/2023/PN Mdn, the Defendant, Tamim Hasyim Als Tamim, was found guilty by the Panel of Judges for committing the criminal act of "Aggravated Theft Committed Repeatedly" based on the alternative indictment submitted by the Public Prosecutor. As a result, the Defendant was sentenced to 3 years and 10 months in prison. In the case of the criminal act of theft with case number 1287/Pid.B/2023/PN Mdn.

Abstract

Violence is becoming more common as society, technology, and human individualism develop. In this study, acts of violence against people or objects together in public occurred one day, Sunday, February 19, 2023, at approximately 02.15 WIB. carrying out a brawl on the Titi Besi Bridge (Bridge 39), which is on Jalan Yong Panah Hijau, Environment V, Labuhan Deli Village. Based on this case, the problem that the author wants to study is: what are the stages in the process of criminal acts of violence against people or property in the Medan District Court based on the procedural law in Decision Number 899/Pid.Sus/2023/Pn Mdn, and what is the decision of the Council? The judge is in accordance with the laws that regulate acts of violence, one of which is Article 170 Paragraph 1. In this research, the method used is qualitative, namely juridical-normative, which means that this legal research only uses secondary data or related library materials, and the data collection technique used is examining the results of Decision Number/899.Pid.Sus/2023/Pn Mdn and also related books and journals. The aim is to obtain an in-depth understanding and theoretical basis regarding the problem being researched. In the verdict of the crime of violence against the defendant Muhammad Saidi Amri Number (899.Pid.Sus/2023/Pn Mdn), he was proven to have violated Article 170 Paragraph (1) and received a prison sentence of 2 years in prison, including a period of detention and arrest. So it is not in accordance with Article 170 Paragraph (1), which states that if someone commits a criminal act of violence openly in public, he will be sentenced to 5 years and 6 months.

Abstract

This article aims to examine what law enforcement is like in class 1 narcotics crime cases and based on Law of the Republic of Indonesia Number 35 of 2009 concerning narcotics which has been proven. This research uses the method. This research was carried out by examining the main problem through a juridicalnormative approach so that in terms of its type, this research is normative legal research. The scope of normative legal research in this research is limited to legal history in the form of court decisions that have permanent legal force against narcotics abusers in the jurisdiction of the Medan District Court.

Abstract

Penelitian ini bertujuan untuk mengeksplorasi praktik demokrasi yang positif dalam menerapkan profil pelajar Pancasila. Program kurikulum "Merdeka Belajar" melibatkan enam indikator dalam memperkuat pembelajaran yang lebih fokus pada nilai-nilai, sikap, dan perilaku. Indikator tersebut mencakup keyakinan dan ketaqwaan kepada Tuhan Yang Maha Esa serta sikap yang luhur; kemandirian; semangat gotong royong; penerimaan terhadap keberagaman global; kemampuan berpikir kritis; dan kreativitas. Penelitian ini menggunakan metode penelitian kualitatif dengan pendekatan studi kasus. Data dikumpulkan melalui teknik wawancara, observasi, dan dokumentasi. Informan dan partisipan berperan sebagai sumber data, dan studi literatur juga digunakan untuk memperkuat hasil dan kesimpulan melalui triangulasi data. SMA Gadjah Mada berupaya menerapkan pendekatan pembelajaran yang inklusif dan mengembangkan karakter pelajar Pancasila melalui kurikulum merdeka belajar dan projek profil pelajar Pancasila. Praktik demokrasi berkarakter terlihat dalam berbagai aspek kehidupan di sekolah, termasuk dalam kegiatan pembelajaran, ekstrakurikuler, dan pengambilan keputusan bersama. Meskipun terdapat kendala dalam penyesuaian kurikulum merdeka secara utuh namun sekolah tetap berkomitmen untuk memberikan pembinaan dan kesempatan kepada siswa dalam mengembangkan potensi mereka secara holistic secara optimal dalam capaian profil pelajar Pancasila yaitu beriman, bertakwa kepada Tuhan yang maha esa dan berakhlak mulia; mandiri; gotong royong; berkebhinekaan global; berpikir kritis;dan kreatif.
