Abstract

This study examines the institutional legal reasoning of the Indonesian National Sharia Council (DSN-MUI) in developing the normative framework for dispute resolution and risk management in Sharia finance. Through a qualitative corpus analysis of fatwas on taʿwīḍ (compensation for loss), debt restructuring, and debt transfer, the research argues that these fatwas do not function as isolated case-by-case rulings. Instead, they form a coherent body of evolving institutional reasoning that shifts Islamic financial law from a rigid, contract-validity-focused paradigm toward a dynamic risk governance paradigm. The findings reveal that DSN-MUI consistently distinguishes between involuntary and willful default, designs restorative rather than punitive compensatory mechanisms, and systematically integrates principles of maqāṣid al-sharīʿah and maṣlaḥah with modern financial governance needs. The analysis further contrasts DSN-MUI's contextualized legal reasoning with the standardized approach of AAOIFI, highlighting how DSN-MUI adapts Islamic legal principles to Indonesia's socio-economic and regulatory context. The study concludes that DSN-MUI fatwas collectively construct a distinct model of Fiqh al-Mukhāṭarah wa al-Nizāʿ (Fiqh of Risk and Dispute Resolution), positioning Islamic law as an integral instrument for systemic risk management, contractual sustainability, and equitable dispute resolution within a modern financial ecosystem.

Abstract

Maqāṣid al-sharī‘ah has not only been understood as a normative concept within ushul al-fiqh, but has also undergone a paradigmatic evolution into a methodological approach for addressing contemporary legal and social issues. This article aims to examine the evolution of the maqāṣid al-sharī‘ah paradigm from both historical and systematic perspectives, beginning with its conceptual roots in the classical tradition of ushul al-fiqh, its emergence as an independent scholarly discipline, and its subsequent transformation into a methodological framework in the development of modern Islamic law. This study employed a qualitative method using a library research approach, drawing upon primary and secondary sources from both classical and contemporary literature. Data analysis was conducted through descriptive-analytical, historical, and conceptual methods. The findings indicate that maqāṣid al-sharī‘ah has developed gradually, reaching its peak of systematic formulation in the thought of Imam al-Shatibi, and later expanding significantly in the modern era through the contributions of contemporary scholars. The paradigmatic evolution of maqāṣid al-sharī‘ah has proceeded through four principal stages: its implicit presence in scriptural texts (nusūs) and in the understanding of the early Muslim generations (al-salaf); its integration into the studies of fiqh and ushul al-fiqh; its establishment as an independent scholarly discipline; and its application as an approach to addressing various contemporary issues. The conclusion of this article affirms that the transformation of maqāṣid al-sharī‘ah from a concept within ushul al-fiqh into a methodological approach strengthens its relevance as an instrument for the renewal of Islamic law, making it responsive to contemporary challenges.

Abstract

This study aims to 1) Describe the difficulty of story problems based on Newman's theory of whole number material for grade V of SDN Blekatuk, 2) Know the factors that influence students to solve story problems based on Newman's theory of whole number material for grade V of SDN Blekatuk. This study uses a descriptive qualitative research method. The subjects of this study were 23 fifth grade students of Blekatuk State Elementary School and 5 students were taken according to high, medium and low difficulty. Data collection techniques were observation, interviews, documentation, and data recording cards. The research instrument used data recording cards, observations and interviews. The results of the study showed that: 1) students with high difficulty, subject 1, had not been able to understand the problem, transformation, process skills and writing answers. While students with subject 2 had not met the indicators of understanding the problem, students had difficulty performing process skills and writing answers. Students with moderate difficulty were two students, subjects 3 & 4 had not met the indicators of understanding the problem, students had difficulty performing process skills and writing answers. One student with low difficulty had not met the indicators of understanding the problem. 2) Internal and external factors influencing students' difficulties in solving word problems on whole numbers: internal factors, interest in learning mathematics, attitudes toward learning mathematics, and motivation to learn mathematics. External factors, learning methods and media, classroom atmosphere, and family environment.

Abstract

While tolerance is often treated as a pedagogical goal within Classroom settings, the systemic mechanisms through which educational institutions engineer holistic environments to foster such values remain underexplored. This study aims to examine how tolerance is systematically engineered as an emergent institutional outcome through the management of a 24-hour educational ecosystem at Pondok Modern Darussalam Gontor. Employing an ethnographic research design, the study involved six months of prolonged field immersion, encompassing 200 hours of participant observation, in-depth interviews with 10 key informants, ranging from leadership to students, and extensive document analysis. The findings reveal that tolerance at this institution is not merely a spontaneous cultural trait but a sophisticated, managed achievement produced through a structured social architecture. This process is sustained by a systematically managed hidden curriculum that translates foundational values into robust governance structures, peer-led conflict resolution, and intentional cross-regional social mixing. The study further identifies a tension between behavioral compliance and deep internalization, highlighting a potential durability gap in value resilience beyond institutional boundaries. It is concluded that character formation is most effective when the institution itself functions as the primary curriculum, mechanically integrating formal policy with everyday social practices. By reframing tolerance as an institutional management output, this research provides a novel framework for stakeholders to move beyond doctrinal teaching toward building resilient, value-based educational ecosystems. Future research should prioritize longitudinal studies to examine the long-term sustainability of such institutionally scaffolded competencies in unregulated social environments.

Abstract

This study investigates the process of internalizing pesantren values in the implementation of Islamic higher education at Universitas Sains Al-Qur'an (UNSIQ) Wonosobo. Data were collected through in-depth interviews, participant observation, and document analysis. The findings reveal that UNSIQ's scientific paradigm is rooted in the values of Ahlus Sunnah wal Jamaah and Pesantren principles, such as the Panca Jiwa Pesantren. This paradigm emphasizes the integration of knowledge and religion, rejects the dichotomy between the worldly and the hereafter, and directs knowledge toward achieving syar'i (Sharia-compliant) goals. The internalization of Pesantren values at UNSIQ includes principles such as al-Amanah (trustworthiness), al-Tawadlu' (humility), al-Istiqamah (steadfastness), al-Uswah al-Hasanah (good role model), al-Tawashshuth (moderation), at-Tasamuh (tolerance), at-Tawazun (balance), simplicity, al-Barakah (blessing), and Tawasul Ilmi (knowledge-seeking). Efforts to internalize these values are carried out through both academic and non-academic activities. As a result, UNSIQ aims to produce graduates who are not only intellectually capable but also possess spiritual resilience and noble character. This study contributes to the development of an Islamic higher education model that integrates pesantren values and aligns with societal needs.

Abstract

This study employs a critical descriptive-comparative approach to examine Matthew Lipman’s concept of multidimensional thinking in Philosophy for Children (P4C) from the perspective of Islamic thought. In the context of global education that prioritizes STEAM disciplines to promote Higher Order Thinking Skills (HOTS), Lipman’s framework highlights critical, creative, and caring thinking as core dimensions. However, Islamic epistemology offers a more holistic understanding of thought. Using qualitative analysis, this study first reconstructs Lipman’s ideas based on Thinking in Education and Philosophy Goes to School, alongside classical Islamic concepts of ‘aql (intellect), qalb (heart), and nafs (soul). A comparative analysis is conducted to identify key similarities and differences, followed by a critical evaluation of the epistemological limitations of Lipman’s model. The findings indicate that, in Islam, thinking transcends rational processes and encompasses spiritual and ethical dimensions. While Lipman’s model is valuable in cultivating reflective thinking, it remains largely secular. Islam, by contrast, integrates reason, intuition, and divine consciousness. This study concludes that multidimensional thinking in Islam reflects the principle of tawḥīd al-‘ilm, offering a more integrated framework that unifies intellectual, moral, and spiritual dimensions of knowledge.
