Abstract

Conditional punishment is a form of punishment that does not result in the deprivation of the rights from convicted person. In the juvenile justice system are different from adults. The purpose of this research is to know and understand the parole (conditional punishment) comparison of the Criminal Code, Act No. 3 of 1997, Criminal Law Concept of 2012 and Act No. 11 of 2012, as well as knowing how to transform and guiding the implementation and supervision of children in the parole (conditional punishment) conducted by Correctional Center Class I of Semarang and Prosecution Counsel of Semarang. This study uses sociological juridical approach (non-doctrinal) with data collection including interviews, literature study and documents study. The results of comparative of conditional punishment on some categories of comparison inclue the following : the sentencing limitation, general conditions, special requirements, lenght of trial, officials who helped the conditional punishment execution and implementation of education. Implementation guidance and supervision of children who undergo conditional punishment by Correctional Center Class I of Semarang and Prosecution Counsel of Semarang has not been implemented optimally considering coaching (guidance) do not have a standardized system of supervision and monitoring intergrated regulated in legislations and infrastructure constraints faced community supervising officer. The supervision to the convicted person only the implementation of a administrative is required to report row (child) by using the form P-51 as the card control must report to the prosecutor. Summary in this research i.e. basically the guidance and supervision of the implementation of compliance in the Act No. 3 of 1997, but it should be underscored diaris in practice there are still some obstacles and barriers that occur such as limited personnel and limited operational budgets.

Abstract

Based on developmental tasks, adolescents have increased social interest in peers. This has an impact on mental health, so it needs to be analyzed in depth. This study aims to explore the profile of peer support in adolescents. The research approach is descriptive quantitative. The sample of this research is teenagers who study at the junior and senior high school level in Central Java which were selected randomly. The results show that on average, adolescents get peer support at a moderate level. The biggest aspect is support in obtaining awards while the lowest aspect is in terms of emotional support. This has implications for guidance and counseling services in schools in the future fostering the students to grow well.

Abstract

The development of interpretation in the Middle Ages was dominated by science, which at that time was experiencing its heyday. During the 11th century, the interpretation of mufassir tended to be based on the interests and scientific background of the mufassir. The scientific background of the mufassirs, who have different specializations in their interpretations, gradually gives birth to at-Tafsir, or patterns in their interpretation. This study uses a literature study (library research) with qualitative methods and a descriptive approach to discuss the definition of interpretation patterns, the periodization of interpretations, various types of interpretations, and examples of patterns in interpretation. The result of this study is an explanation regarding the style of interpretation, which can be seen from the interpretation products of a mufassir or through the research of a mufassir himself. The research starts with the background of the mufassir, education, and the purpose of the mufassir in compiling a book of interpretations. The variety of colors or patterns of a mufassir in interpreting are grouped into six: fiqh pattern, lughowi pattern, scientific pattern, philosophical pattern, Sufi pattern, and adab ijtima'i pattern. There are many Mufassir who pursued various styles in the medieval period, such as Imam ath-Tabari with his Tafsir ath-Tabari with a fiqh style, Imam Fakhruddin ar-Razi with his Tafsir Mafatih al-Ghaib with a philosophical and scientific style, and Imam Abu Hayyan with his Tafsir Bahr al-Muhith lughowi pattern. The benefits of this research are expected to come in the form of scientific insights and enrich the scientific literacy of the Al-Qur'an interpretation. Also, be able to have an impact in the form of attracting the interest of other researchers to continue to develop similar research.

Abstract

In practice of criminal justice system, a judge plays a fundamental role in making decision that will be imposed on the defendant. The Law on Judicial Power requires judges to widely disclose information and opinions from various groups and public participation. Amicus curiae concept is a mechanism that permits third parties who believe they are interested in a particular criminal case. However, the existence of amicus curiae in positive law has not been regulated explicitly or formally to explain how it is applied in criminal justice. While the judge plays a part in delivering a verdict on the defendant, it is anticipated to be founded on legal principles and a commitment of substantive public justice. This study employs a normative juridical research approach, utilizing secondary data acquired through library research and analyzed using qualitative methods and presented in a descriptive and explanatory format. The findings of this investigation that the position of amicus curiae can be known as stipulated in Article 5, paragraph (1) of the Judicial Power Act. In the application of the judge's decision to realize substantive justice, the judge does not only see a settlement in terms of formal law as a form of legal certainty, but the judge must also be able to see aspects of a sense of substantive justice by the expectations of the community as a seeker of justice.

Abstract

This research aims to describe the students’ difficulties in writing descriptive text and to find out the causes of students’ difficulties in writing descriptive text. This research uses quantitative descriptive methods. The research subjects are X MIPA 6 students of SMAN 1 Sukodadi who had difficulties when writing descriptive text, the data of this research are the result of students’ worksheet and the students’ answer in interview. This research used documentation and interview to collect the data. Data reduction, data display and drawing conclusion was used to analyze the data. The result of this research shows that the students of X MIPA 6 have difficulty in writing descriptive text, the difficulties are difficulties in generic structure, difficulties in grammar, and difficulties in spelling. While the factors that cause the students’ difficulties in writing descriptive text are lack of proficiency in the text production skills, lack of knowledge relating to the subject contents of the script to be written, and lack of interest in learning English.

Abstract

This research aims to determine the practice of buying and selling used clothing from an Islamic economic perspective. The research method is a qualitative case study type. The results of the research are that the practice of buying and selling used clothing (thrift) at the Juni Fitri Store in Banjarwati Village consists of the stages of the process of purchasing used clothing stock, determining the type of goods to be sold, determining the selling price, and selling used clothing. The Islamic economic perspective in buying and selling used clothes (thrift) at the Juni Fitri Store, Banjarwati Village, can be seen from Islamic economic values, namely Tauhid, Morals, Justice, Balance, Individual Freedom in various operational forms such as: the process of purchasing used clothing stock, clothing sales mechanisms used clothes, washing and ironing used clothes, photo media for used clothes, determining prices, promotional media for used clothes, and service and sales of used clothes.

Abstract

Proses pembelajaran yang kurang menarik, dapat menyebabkan siswa tidak berminat untuk mengikuti pembelajaran. Oleh karena itu, diperlukan suatu model pembelajaran yang bisa menjadikan siswa lebih aktif untuk mengikuti pembelajaran yaitu model pembelajaran Problem Based Learning. Oleh sebab itu, peneliti ingin melakukan penelitian ini yang bertujuan untuk mendeskripsikan peningkatan keaktifan dan hasil belajar matematika siswa kelas X-7 SMA Negeri 1 Jombang setelah mengimplementasikan pembelajaran berdiferensiasi dengan menggunakan model pembelajaran Problem Based Learning. Jenis penelitian ini merupakan Penelitian Tindakan Kelas Kolaboratif (PTKK). Penelitian ini dilaksanakan di SMA Negeri 1 Jombang pada tahun ajaran 2022/2023. Subjek penelitian ini adalah siswa kelas X-7 yang berjumlah 34 siswa, yaitu 14 laki-laki dan 20 perempuan. Penelitian tindakan kelas dilakukan melalui 4 tahapan yaitu perencanaan, pelaksanaan tindakan, pengamatan dan refleksi. Pengumpulan data dalam penelitian ini menggunakan metode observasi, tes dan dokumentasi. Disamping itu, penelitian ini juga menunjukkan bahwa terdapat peningkatan keaktifan belajar siswa yang telah memenuhi indikator ketercapaian, yaitu dengan kategori aktif atau sangat aktif pada siklus I yaitu 41,17% menjadi 82,35% pada siklus II. Penelitian ini juga menunjukkan terdapat peningkatan hasil belajar matematika siswa yang telah memenuhi indikator ketercapaian pada siklus I yaitu 47,05% menjadi 82,35% pada siklus II. Sehingga dapat disimpulkan bahwa implementasi pembelajaran berdiferensiasi melalui model pembelajaran Problem Based Learning dapat meningkatkan keaktifan dan hasil belajar matematika siswa.

Abstract

Meskipun berpikir kritis merupakan salah satu keterampilan dasar abad 21, namun kemampuan berpikir kritis siswa pada mata pelajaran fisika khususnya hukum Ohm masih tergolong rendah. Untuk mengatasi hal tersebut, diperlukan media pembelajaran yang menarik dan efektif yang dapat digunakan siswa ketika mempelajari materi hukum Ohm. Tujuan penelitian dan pengembangan ini adalah untuk mengembangkan EPROBAL yang valid sehingga berpeluang untuk meningkatkan kemampuan berpikir kritis terkait hukum Ohm pada siswa SMA. Model desain penelitian pengembangan yang digunakan yaitu DDD-E (Decide, Design, Develop, Evaluate) dengan pedoman wawancara dan lembar validasi media sebagai instrumen yang digunakan. Metode analisis yang digunakan yaitu deskriptif kuantitatif. EPROBAL yang dikembangkan dinyatakan valid, yang ditinjau dari aspek pembelajaran, aspek materi, aspek bahasa, dan aspek berpikir kritis. Berdasarkan hasil penelitian pengembangan, validitas EPROBAL secara keseluruhan didapatkan 88,4% dan tergolong kriteria sangat valid. Oleh karena itu, EPROBAL dapat dijadikan sebagai media pembelajaran yang digunakan untuk meningkatkan dan melatih kemampuan berpikir kritis siswa selama belajar materi Hukum Ohm.

Abstract

Mudarasah Method in Memorising al-Qur'an in Yanbu'ul-Ulum Sukolilo Islamic Boarding School. The aim of this research is to investigate the Mudarasah method for memorising the Qur'an at Yanbu'ul-Ulum Islamic boarding school, its impacts on students' ability to memorise the Qur'an, and the factors that impede the usage of this method.  This study adopted a qualitative field research approach with a focus on students at the Yanbu'ul-Ulum Sukolilo Islamic boarding school. The data was collected through observation techniques, interviews with pesantren caregivers, ustadz, students, alumni, and pesantren administrators. The findings of the study are presented below. 1) The Mudarasah method for Quran memorization at the Yanbu'ul-Ulum Sukolilo Islamic boarding school discusses the application of the method, including the active role of the murobi, formation of the Mudarasah, takrir, and sorogan memorization. 2) The implications of the Mudarasah method for Quran memorization include firstly tahyihah nafsiyah, meaning mental stability, secondly tarkiz, meaning concentration, thirdly taawun, which means cooperative help, and fourthly mumtaz, which means excellence. 3) Hindrances to the Mudarasah method of memorising the Qur'an at the Yanbu'ul-Ulum Islamic boarding school are multifaceted. Secondly, the process is time-consuming and inefficient. Firstly, student independence is lacking. Lastly, there exists inequality in student intelligence levels. Seorang santri pasti memiliki kelemahan berbeda-beda dalam proses menghafal Al-Qur’an di pondok pesantren, untuk mensiasati hal tersebut pastinya seorang pengasuh pondok pesantren tahfidzul qur’an memiliki berbagai cara khusus agar santrinya mudah ketika dalam menghafal Al-Qur’an. Tujuan dari penelitian ini untuk mengetahui metode Mudarasah dalam menghafalkan Al-Qur’an di pondok pesantren Yanbu’ul-Ulum, implikasi metode Mudarasah dalam menghafalkan Al-Qur’an di pondok pesantren Yanbu’ul-Ulum, faktor-faktor yang menjadi hambatan metode Mudarasah dalam menghafalkan Al-Qur’an. Penelitian ini penelitian lapangan dengan pendekatan kualitatif pada santri di pondok pesantren Yanbu’ul-Ulum Sukolilo, pengumpulan data diperoleh teknik observasi, wawancara pada pengasuh pesantren, ustadz, santri, alumni dan pengurus pesantren. Hasil penelitian ini sebagai berikut. 1) metode Mudarasah dalam menghafalkan Al-Qur’an di pondok pesantren Yanbu’ul-Ulum Sukolilo membahas penerapan metode Mudarasah, meliputi, peran aktif murobi, pembentukan Mudarasah, takrir, dan sorogan hafalan. 2) Implikasi metode Mudarasah dalam menghafalkan Al-Qur’an, pertama tahyihah nafsiyah artinya kemantapan mental, Kedua, tarkiz, artinya konsentrasi. Ketiga, Taawwun, artinya tolong menolong. Keempat Mumtaz, artinya lulus. 3) Faktor-faktor yang menghambat metode Mudarasah menghafalkan Al-Qur’an di pondok pesantren Yanbu’ul-Ulum, Pertama Kurangnya sifat kemandirian santri. Kedua Membutuhkan waktu lama dan kurang efisien. Ketiga ketimpangan pada tingkat kecerdasan santri.

Abstract

Studi ini mengkaji tentang problematika penegakan hukum bagi korban penyalahgunaan narkotika dalam proses rehabilitasi. Kasus penyalahgunaan narkotika yang semakin meningkat dan sulit dikendalikan di masyarakat menjadi perhatian yang serius. Penegakan hukum memiliki peran penting dalam mengatasi permasalahan ini. Jenis penelitian ini menggunakan Pendekatan Undang-Undang (Statute Approach) dan pendekatan konseptual (conseptual Approach). Pendekatan Undang-Undang dilakukan dengan menelaah undang-undang dan regulasi terkait isu hukum yang sedang ditangani, serta menganalisis putusan perkara Pengadilan Negeri Nomor : 809/Pid.Sus/2020/PN.Mdn. Penelitian ini diharapkan memberikan manfaat teoritis dalam memutuskan tindak pidana narkotika dengan mempertimbangkan pecandu sebagai korban dalam proses rehabilitasi, dan manfaat praktis dapat meningkatkan pengetahuan dan pengalaman peneliti dalam menghadapi bahaya penyalahgunaan narkotika. Studi ini juga diharapkan dapat menjadi saran serta masukan kepada jaksa dan hakim dalam memutus perkara narkotika, serta memaksimalkan peran rehabilitasi sebagai upaya penyembuhan para pengguna narkotika. Dalam menerapkan peraturan yang ideal, sebaiknya penegak hukum lebih memberikan penekanan pada pengedar narkotika sebagai penyebab utama munculnya penyalahguna narkotika sehingga terlahirnya pecandu narkotika. Dalam Undang-Undang Nomor 35 Tahun 2009 tentang Narkotika peraturan hukum yang mengatur mengenai rehabilitasi terhadap pecandu narkotika diatur dalam pasal 54, 55,103, dan dikaitkan dengan pasal 127 Undang-Undang Nomor 35 Tahun 2009 tentang Narkotika dan Surat Edaran Mahkamah Agung Nomor 4 Tahun 2010. This study examines the problems of law enforcement for narcotics conservation in the rehabilitation process. Cases related to narcotics which are increasing and difficult to control in society are a serious concern. Law enforcement has an important role in overcoming this problem. This type of research uses a statutory approach and a contextual approach. The legal approach is carried out by reviewing the laws and regulations related to the legal issues being handled, as well as analyzing the decision of the District Court case Number: 809/Pid.Sus/2020/PN.Mdn. This research is expected to provide theoretical benefits in deciding narcotics crimes by considering addicts as victims in the rehabilitation process, and practical benefits can increase researchers' knowledge and experience in dealing with the dangers of narcotics abuse. It is also hoped that this study can provide advice and input to prosecutors and judges in deciding narcotics cases, as well as maximizing the role of rehabilitation as an effort to cure narcotics users. In implementing ideal regulations, law enforcement should place more emphasis on narcotics dealers as the main cause of the emergence of narcotics abusers resulting in the birth of narcotics addicts. In Law Number 35 of 2009 concerning Narcotics, the legal regulations governing the rehabilitation of narcotics addicts are regulated in articles 54, 55,103, and are related to article 127 of Law Number 35 of 2009 concerning Narcotics and Supreme Court Circular Letter Number 4 of 2010.
