Abstract

This study aims to analyze the double burden (double burden) of women. The development of the times has transformed the thoughts and movements of women so that they do not only function in the domestic sphere but also in the public sphere. Even though this is a form of gender inequality in one sex. This is very interesting to study using socialist feminist theory and the position of women in Islam in terms of gender analysis of the position of women in the household. The purpose of this research is to look further at the views of feminists and Islam in the double burden experienced by women in various regions. Data analysis techniques in this study used the analytical techniques proposed by Miles and Huberman, namely: data codification, data presentation and drawing conclusions. The result of this study is that the dual role of women in various areas carried out by previous research occurs because there is no knowledge and awareness that there is oppression that they experience, so that its continuity is considered normal. Islam views women and men as having an equal position even in matters of household which must be based on equal principles and an agreement between the two parties. The significance of this study is to offer a micro snapshot of the problem of multiple roles at certain loci and can provide a glimpse into the potential for similar research in other areas.

Abstract

Abstract

This research explores the impact of globalization and modernization on inheritance law in Indonesia, a fundamental legal aspect of the socio-economic life of society. Globalization introduces international legal values and principles that interact with national laws, driving more inclusive and equitable reforms. On the other hand, legal modernization aims to update and simplify inheritance law procedures and regulations, making them more relevant and accessible in the digital age. Using qualitative methods with a descriptive analytical approach, this research analyzes data from legal literature, legislation, and interviews with legal practitioners and academics. The findings show that globalization and modernization have a significant impact, ranging from aligning inheritance laws with international standards to increasing efficiency through digitalization. However, this process also faces challenges such as cultural resistance and infrastructure issues. This article concludes that while globalization and modernization present significant opportunities to enhance justice and accessibility in inheritance law, a sensitive adaptation to the local context is essential to ensure broad acceptance and effective implementation.

Abstract

Siri marriage is still a social phenomenon, which is quite widespread and has become an area of debate in society. The practice of unregistered marriages is carried out by people who do not understand the law, although it does not rule out the possibility that unregistered marriages are carried out by people who understand the law. For some people who still think that unregistered marriage is the best way out and there is no element of sin in it because it has been done, according to religion, it's just not registered through a marriage registrar by the religious affairs office so it doesn't have clear evidence. Even if it is understood in terms of consequences law, then unregistered marriages have an impact on problems that will occur not only for the wife but also for the status of the children. Even though a siri marriage is a marriage that meets the requirements for harmony of marriage, for certain reasons, it is not registered at the religious affairs office. The basic things felt by women carrying out betel marriages include; psychological problems and mental stress as a result of legal uncertainty regarding his marital status. This psychological burden also occurs because of society's stereotypes of women in unregistered marriages who are considered mistresses, pregnant out of wedlock, cheaters and so on, and will affect their education and the most important thing is their religious education. This research uses library research. The method used in this research is a normative juridical research method. Normative juridical research is legal research carried out by examining library or secondary materials. In the library research method, the author uses secondary data, namely data obtained from library materials, such as; books, journals, and more.
