Abstract

Pemilihan kepala desa tidak jarang menimbulkan perselisihan, hingga berujung pada pembatalan SK Bupati oleh putusan PTUN. Sebagaimana kasus dalam perkara nomor 50/G/2020/PTUN.Sby juncto. Perkara Nomor 228/B/2020/PT.TUN.SBY juncto. Perkara Nomor 106 PK/TUN/2021, dimana dalam perkara tersebut gugatan Penggugat dikabulkan kemudian SK Bupati terkait dibatalkan oleh PTUN. Selanjutnya  Bupati terkait menerbitkan SK baru tentang pengangkatan PJ kepala desa kemudian dilakukan PAW. Pengaturan mengenai PAW pasca pembatalan SK Bupati oleh putusan PTUN sama sekali belum diatur dalam perundang-undangan desa, sehingga Peneliti merumuskan isu atau masalah, pertama : Apakah PAW yang dilakukan oleh Desa pasca pembatalan oleh putusan PTUN, sah dan telah sesuai dengan peraturan yang berlaku ? dan kedua,  bagaimana seharusnya pengaturan ke depan mengenai langkah yang dilakukan jika kepala desa diberhentikan atas dasar putusan PTUN ?. Penelitian ini adalah penelitian normatif dengan pendekatan perundang-undangan, pendekatan konsep dan pendekatan kasus. Adapun hasil dari penelitian ini bahwa : Pertama, Pengaturan mengenai PAW pasca pembatalan SK Bupati oleh putusan PTUN tidak satupun disebutkan dalam perundang-undangan desa. Sehingga tindakan BPD dalam melaksanakan PAW pasca pembatalan SK Bupati oleh putusan PTUN, tidak benar dan tidak sesuai dengan perundang-undangan. Kedua, pemerintah sudah seharusnya merivisi dan merumuskan pengaturan PAW pasca pembatalan SK Bupati oleh putusan dalam perundang-undangan desa baik dari Undang-Undang hingga pada peraturan paling rendah mengenai pelaksanaan pilkades yakni Peraturan Bupati.

Abstract

Marriage is a sacred and noble procession to build a household that is considered legitimate from a religious and state perspective. Positive law prohibits interfaith marriages as stated in SEMA No. 2 of 2023 concerning Judges' Instructions in Adjudicating Cases of Applications for Registration of Marriages Between People of Different Religions and Beliefs. However, the judge in Stipulation Number 423/PDT.P/2023/PN.Jkt.Utr granted the request for registration of interfaith marriage applications. The legal research used in this article is normative juridical, based on an internal perspective that is able to provide legal arguments when conflicts, ambiguities, or legal gaps are found. The results of the study show that the judge's considerations in Stipulation Number 423/PDT.P/2023/PN.Jkt.Utr are inappropriate in using the legal basis. The judge is of the view that Catholicism and Protestant Christianity are still within the same scope of faith so that they are in harmony. However, the judge did not refer to SEMA Number 2 of 2023 as a legal basis for deciding the case, did not consider the norm of Article 2 paragraph 1 of the Marriage Law, did not consider the rejection from the Dukcapil Office, did not consider evidence in the form of the Applicants' Identity Cards, and finally the Judge did not consider the prohibitions of each of the Applicants' religions. The Judge should have made a decision based on the correct legal basis as a consideration so that in the future there would be no more inappropriate decisions. Abstract

Failure to comply with the registration of the marriage agreement causes the agreement to be null and void because it does not fulfill one of the conditions for a valid agreement according to Article 1320 of the Civil Code and is contrary to Article 29 paragraph (1) of Law no. Therefore, this research will write about the role of registration of marriage agreements in ensuring legal certainty and protection of the rights of the parties concerned and the legal consequences of non-compliance in registering marriage agreements. The type of research used is a normative juridical method, namely research guided by positive legal regulations in accordance with the laws and regulations applicable in society. In resolving a legal issue, the author uses two approaches, namely the Statute Approach which is carried out by examining all statutory regulations relating to the legal issue to be studied, and the Conceptual Approach which carries out the interpretation. principles, laws and legal concepts according to the legal issue being studied. The legal materials used are primary legal materials and secondary legal materials using the library research method of collecting legal materials (Library Research) with research analysis using deductive methods. The result is registration of a marriage agreement has permanent legal force, thereby providing optimal protection for both parties from potential disputes in the future. Failure to comply with the obligation to register a marriage agreement, even though it has been made in the form of an authentic deed by a notary, has the implication that the agreement is null and void. It is hoped that in the future the government can increase outreach and education as well as simplify the procedures for registering marriage agreements. Abstract

The principle of monogamy as stated in the Indonesian Marriage Law is the principle adopted by the law, which states that in a marriage a husband may only have one wife and vice versa. However, the law also explains the permissibility of a husband practicing polygamy or having more than one wife by fulfilling the stipulated requirements. Often in practice, the right to polygamy is misused so that injustice or gender inequality arises. In addition, the Compilation of Islamic Law (KHI) is also the basis for regulating polygamy, which is regulated in Articles 55 to 59. Article 55 of the KHI firmly states that a man who practices polygamy will be limited to up to four wives by fulfilling the main requirement, namely that there must be fair treatment from the husband towards his wife and children. If the husband violates the main requirements, then he is not allowed to practice polygamy. The researcher uses a normative legal method in research or is generally called doctrinal legal research, this method is a method that emphasizes the investigation of the application of legal norms or positive rules that are enforced and associated with the enforcement of the principle of monogamy in Indonesian marriage law. In addition, this study uses a comparative technique between marriage law and a compilation of Islamic law related to the principle of monogamy that is enforced in marriage in Indonesia. Polygamy in marriage in Indonesia must be understood as an alternative path or a choice to do it or not in a truly emergency situation. Therefore, the principle of monogamy needs to be enforced, namely by a man being limited to having more than one wife except in urgent conditions.

Abstract

Law enforcement in wildlife protection is a crucial issue involving environmental, legal and social justice aspects. This article examines the dynamics of law enforcement in wildlife protection cases through a legal sociology approach, with a focus on issues of justice and social inequality. Although various regulations have been implemented to protect endangered wildlife, the effectiveness of law enforcement remains weak and often uneven. Factors such as social inequality, corruption, and economic power exacerbate wildlife law violations. Émile Durkheim's sociological theory can be connected to the case of wildlife protection through the social concepts he developed, such as social solidarity, collective morality, and the function of law in society. Local communities, especially those who live around conservation areas, are often the ones most affected by conservation policies, while violations by economically powerful groups are not always subject to appropriate sanctions. This analysis shows that unfair law enforcement and inequality in access to justice affect the success of wildlife conservation efforts. Therefore, a more inclusive and fair approach is needed in the application of the law, which not only protects wildlife but also ensures justice for the communities involved. This article concludes that increasing the effectiveness of law enforcement, strengthening regulations, and empowering local communities are important steps to overcome social inequality in the case of wildlife protection, so as to create a balance between environmental conservation and social justice.

Abstract

The philosophical thought of law in a new paradigm that identifies reason as the primary source of law, emphasizing rationality and humanism in the development of modern law. This emphasizes the inseparability of law from social life and the formation of legal values within communities, shaping norms that guide social behavior and reflect the essence of law. The discussion extends to studying indigenous communities, especially in Kalimantan, where customary law arises from experiential actions, recognized and regulated by the Indonesian constitution, acknowledging the existence of written and unwritten laws within the framework of customary law. The research method used is normative juridical with a conceptual approach based on these issues. The research findings indicate that the conception of legal philosophy studies related to Sociological Jurisprudence becomes important because it enables law to become an instrument that promotes social justice and equality, recognizing that law must reflect respected social values and be executed within society based on the thoughts of Hugo Grotius regarding justice, equality, and human rights, grounded in rationality and humanism, emphasizing the need to treat individuals with respect and consider the welfare of society. The implementation of Hugo Grotius's thought in Indonesia has made a significant contribution to a paradigm shift in legal construction, particularly related to Sociological Jurisprudence. Grotius emphasizes the importance of rational law that does not solely rely on dogma or religious beliefs. His views on justice based on reason and human rights as an integral part of natural law have shaped a modern legal perspective that prioritizes justice and equality. Grotius's thoughts are highly relevant, especially in efforts to build a fair legal system based on morality.

Abstract

Aspects of positivism with its normative approach are often taught in various law schools as a single perspective. The study of law can be based on legal realism. Nevertheless, there is still a debate about legal realism's working pattern and contribution to juridical science. This study that introduced legal realism worked with socio-legal method based on the literature review. It aimed to elaborate on the concept of legal-realism as an epistemology of the socio-legal school, which leads to the conception of customary law and legal anthropology. With a naturalistic approach and supported by theories of customary law and legal anthropology. This study showed that legal realism as a school in philosophy and juridical studies based on empirical studies need to be developed. It referred to legal realism conceptualized in Scandinavia and America that was suitable to Indonesia's legal context, especially customary law as the law that lives in society. Therefore, the law that lives in society is strengthened through verdict and law enforcement officers as symbols of the state. It suggested that legal realism is also taught in law schools at universities, so that legal academics have diverse points of view, both in the legal discipline and as a research method. Abstract

In essence, a notary as a public official has the authority to make deeds authentic in accordance with norms, values ​​and provisions of laws and regulations applicable so that the law can work in society. Every deed made by the notary must be kept in the notary's protocol, and the protocol must be transferred in the case of the notary died or his term of office has expired or retired. The existence of a lawsuit addressed to the notary protocol holder regarding the forgery of authentic deeds that have been transferred to him will become a problem in the future. The notary who receives the protocol will still be summoned for information if there are problems related to the protocol in his control, because this is one of the responsibilities of the notary protocol recipient. Article 65 of the Notary's Position Law explains that a notary is responsible for every deed he makes even though the Notarial Protocol has been submitted and transferred to the party holding the Notarial Protocol. The notary holding the Protocol only has the obligation to care for and maintain the deed that has been submitted to him, and is not responsible for the contents of the deed. The storage of notary protocols as state archives is also not regulated in detail in the Notary Public Law. So there needs to be special arrangements regarding policies, guidance and management of notary protocols. In order to create legal certainty for notaries in storing and maintaining notary protocols.

Abstract

A covernote is a statement letter containing the notary's ability to carry out what the debtor wants. The notary has full responsibility for the contents contained in a cover note. Covernotes are not textually part of the authority of a Notary, this is interesting to study in more depth regarding the form of notary responsibility for the covernote that has been made. The research method used in this research is a normative juridical method. The conclusion obtained is that covernotes are not part of the authority of a notary as regulated in the Law on the Position of Notaries, but are a habit that grows and develops in society and is made into customary law. So that the notary's responsibility regarding the covernote that is made can be called for criminal, civil or moral sanctions imposed by the community.

Abstract

The criminal law paradigm has begun to change since the emergence of the new Criminal Code (KUHP), where criminal punishment is emphasized not only as retaliation but also as recovery. Diyat punishment is one solution to restore victims. By giving property to the victim, you can make the victim's life easier financially. However, it is different from the diyat punishment for perpetrators of murder, not torture, which in this case has a perspective from the view of Islamic inheritance law. How is the diyat punishment given to the victim who is the heir of the murder victim from the perspective of Islamic inheritance law? This research uses normative legal research methods, namely by examining legal norms regarding diyat punishment from the perspective of Islamic inheritance law. Meanwhile, this research approach uses a statutory approach and a case approach related to diyat punishment. The results of research into the diyat punishment which should be the victim's right will be transferred to the victim's heirs considering that the victim has died as a result of murder. The concept of diyat punishment from the perspective of Islamic inheritance law is one of the appropriate solutions and is in accordance with the principles of the new Criminal Code.
