Abstract

This study aims to examine the tradition of determining the auspicious day before a marriage contract using titen science from the perspective of ‘urf in Andongsari Village, Ambulu Sub-district, Jember Regency. Ilmu titen, as part of Javanese customs, is a method based on custom and observation of past events (niteni), which is used to determine the right time for important events such as marriage. This research uses empirical legal method with legal sociology approach and conceptual approach. Data were obtained through interview, observation, and documentation techniques, with primary and secondary sources. The results show that although this tradition is highly upheld by the local community, the practice of determining a good day does not contradict the provisions of Islamic law. The pillars and conditions of marriage are still fulfilled, so this tradition can be seen as part of an effort to preserve Javanese cultural customs that are harmonious with Islamic teachings. The implications of this research show that the implementation of titen science not only helps maintain local wisdom, but also strengthens social and cultural harmony in the Andongsari Village community, which is predominantly Muslim.

Abstract

This study aims to examine the characteristics of the PBJP dispute settlement conducted by LKPP, as well as legal certainty and the ideal concept of PBJP dispute settlement by LKPP in the future. The method utilized by this study is a normative legal review using a legal regulatory approach that examines a rule of norms and a case approach that is linear with the issues to be resolved. The results of this study show that the characteristics of dispute resolution through mediation and arbitration by an independent and professional LKPP, as well as the adoption of technology in dispute resolution can increase efficiency and transparency in procurement in accordance with the culture of deliberation in Indonesia. The regulation of dispute resolution by LKPP has not provided legal certainty, because the provisions related to dispute resolution that are excluded are contrary to higher regulations and the principles of the agreement, thus not providing legal certainty for the parties. The ideal concept of PBJP dispute resolution in Indonesia can combine local wisdom with technological developments to provide more effective and credible solutions. This will improve the efficiency and transparency of the procurement process, ensure dispute resolution is in line with local culture and values, and provide the desired legal certainty.  ABSTRAK Penelitian ini mencoba untuk melihat karakteristik penyelesaian sengketa PBJP yang dilakukan oleh LKPP, serta kepastian hukum dan konsep ideal penyelesaian sengketa PBJP oleh LKPP kedepan. Metode yang dimanfaatkan oleh kajian ini berupa penelaahan hukum normatif dengan memakai pendekatan peraturan yang legal yang menelaah suatu aturan norma serta pendekatan kasus yang linier dengan isu yang akan dipecahkan. Hasil dari penelitian ini menunjukkan bahwa Karakteristik penyelesaian sengketa melalui mediasi dan arbitrase oleh LKPP yang independen dan profesional, serta adopsi teknologi dalam penyelesaian sengketa dapat meningkatkan efisiensi dan transparansi dalam pengadaan sesuai dengan budaya musyawarah di Indonesia. Pengaturan penyelesaian sengketa oleh LKPP belum memberikan kepastian hukum, karena ketentuan terkait penyelesaian sengketa yang dikecualikan kontrdiktif dengan peraturan di atasnya dan asas-asas perjanjian, sehingga tidak memberikan kepastian hukum bagi para pihak. Konsep ideal penyelesaian sengketa PBJP di Indonesia dapat mengkombinasikan kearifan lokal dengan perkembangan teknologi untuk memberikan solusi yang lebih efektif dan kredibel. Ini akan meningkatkan efisiensi dan transparansi proses pengadaan, memastikan penyelesaian sengketa sesuai dengan budaya dan nilai-nilai lokal, serta memberikan kepastian hukum yang diinginkan.  Kata Kunci: Karakteristik, penyelesaian sengketa; PBJP; LKPP

Abstract

Sebaran potensi panas bumi untuk pengusahaan tidak langsung yang meliputi tujuan pembangkit listrik tersebar di wilayah dan kawasan yang selektif dan terlarang untuk digunakan, seperti hutan lindung, hutan koservasi, dan zona inti pada Taman Nasional. Penggunaan kawasan hutan untuk kepentingan pembangunan di luar kegiatan kehutanan secara limitatif diatur di UU Kehutanan yang kemudian dirubah dengan UU Cipta Kerja.  Jenis penelitian adalah penelitian normatif, dengan pendekatan conseptual approach dan statute approach. Teori Hukum Alam yang diusung oleh Aquinas dan Hart memotret fenomena pergeseran penggunaan kawasan hutan untuk pengusahaan panas bumi tidak langsung sebagai suatu hubungan yang komprehensif dan menjiwai hukum positif pengaturan penggunaan kawasan hutan untuk pengusahaan panas bumi tidak langsung

Abstract

Mahkamah Agung memiliki visi dan misi untuk mewujudkan peradilan yang agung berdasarkan cetak biru pembaruan peradilan pada periode tahun 2010 sampai dengan tahun 2035 yang salah satu misi untuk mewujudkannya melalui peradilan modern berbasis teknologi informasi terpadu. Hal ini diwujudkan dengan membuat aplikasi persidangan elektronik melalui E-Court.  E-Court adalah layanan bagi Pengguna Terdaftar untuk mengajukan perkara secara online, mendapatkan perkiraan biaya perkara, dan melakukan pembayaran dan panggilan yang dilakukan melalui saluran elektronik dan online. Layanan yang termasuk dalam aplikasi E-Court adalah e-Filing (pengajuan gugatan secara online), e-Payment (pembayaran biaya hukum secara online), dan e-Summons (pemanggilan pihak secara online).  E-Court merupakan bagian dari upaya Mahkamah Agung dan pengadilan di bawahnya untuk memberikan akses kemudahan kepada masyarakat dan para pencari keadilan (justice seeker), selain tentunya menjadikan pengadilan semakin transparan, efektif dan efisien.

Abstract

Otoritas Jasa Keuangan (OJK) satu-satunya lembaga yang dapat melakukan pungutan terhadap kegiatan di sektor jasa keuangan dan pungutan tersebut bersifat wajib. Dalam UU P2SK mengatur ketentuan terkait dengan pengelolaan pungutan yang dilakukan oleh OJK. Pasal 37 ayat (3) UU P2SK mengatur bahwa pungutan dan penerimaan lainnya dikelola sesuai dengan ketentuan peraturan perundang-undangan di bidang keuangan negara dengan ketentuan hasil pungutan dapat digunakan sebagaian atau seluruhnya secara langsung oleh OJK untuk memenuhi kebutuhan pendanaan kegiatan. Sedangkan Pasal 23A UUD NRI Thn 1945 yang menyatakan bahwa “Pajak dan pungutan lain yang bersifat memaksa untuk keperluan negara diatur dengan undang-undang”. Jenis penelitian adalah penelitian normatif, dengan pendekatan conseptual approach dan statute approach. Teori hukum positivisme yang diusung oleh Hans Kelsen tentang stufenbau theory memotret fenomena hierarki dan norma hukum yang lebih rendah bergantung kepada norma hukum yang lebih tinggi.

Abstract

Artikel ini meneliti pengaruh aktivisme yudisial Mahkamah Konstitusi terhadap perkembangan hukum kepolisian di Indonesia melalui lensa realisme hukum. Menggunakan metode analisis dokumen, artikel ini mengevaluasi bagaimana keputusan Mahkamah Konstitusi (MK) telah mempengaruhi praktik dan kebijakan hukum kepolisian, menyoroti perbedaan antara hukum teoritis dan praktik hukum sesungguhnya. Dalam konteks realisme hukum, keputusan MK tidak hanya mengubah teks hukum tetapi juga cara hukum itu diterapkan, dipersepsi, dan berevolusi dalam masyarakat. Oleh karenanya, putusan MK juga memiliki dampak yang luas dan mendalam terhadap cara kepolisian menjalankan tugasnya, baik dalam hal prosedur, praktik, maupun interpretasi hukum. Jenis penelitian adalah penelitian normatif, dengan pendekatan conseptual approach dan statute approach. Hal ini menunjukkan bahwa realitas hukum adalah dinamis dan responsif terhadap interpretasi yudisial serta kebutuhan sosial, dan keputusan MK berperan penting dalam membentuk realitas hukum tersebut.

Abstract

The kinship system used in Indonesia, especially in customary inheritance law, is considered to have the potential to result in gender inequality because the distribution of inheritance given is considered unfair, especially implemented in the modern era like now. Therefore, the purpose of this study is to analyze the application of inheritance law in Indonesia and examine the views of customary inheritance law on gender equality, as well as a comparison of its application in other countries. The researcher used a normative legal method by conducting a literature review. The results of the study show that Indonesia applies patrilineal, matrilineal, and bilateral systems in the customary inheritance law kinship system. In practice, the patrilineal and matrilineal systems are considered less appropriate in terms of inheritance distribution because they use a system of drawing the father's or mother's lineage or can be said to be based on gender. If we look at the systems used by other countries, it seems that they are also inseparable from systems that end up ignoring gender equality.

Abstract

The legal issues related to insults by state officials against judicial institutions highlight two important aspects. First, the application of sanctions for this action raises questions about legal certainty, because it can damage the integrity of the judicial institution and reduce public trust. Second, there are challenges in proving elements of insult that are often subjective, especially when state officials use the right to freedom of speech as a defense. The complex process of proof requires strong evidence, and a balance between protecting the honor of the judiciary. This study discusses the application of criminal evidence related to insults by state officials against judicial institutions in the context of legal certainty. Based on Article 240 of the Criminal Code which regulates insults against state institutions, including the judiciary, this study highlights the uncertainty in the application of sanctions due to the ambiguous definition of insult and the complaint procedure that depends on the party who feels aggrieved. Gustav Radbruch's legal approach to legal certainty is raised to explain the importance of consistency and clarity of law in these cases. Inconsistent law enforcement can lead to injustice, especially when state officials are protected from criticism under the pretext of insult, which ultimately undermines public trust in the judicial system.

Abstract

Lawmaking is one of the fundamental instruments in realizing legal certainty and justice in national and state life. In practice, the legislative process in Indonesia still often sparks debate, both regarding substance and procedure. One of the prominent issues is the formation of the Indonesian National Army Law (UU TNI), which is being questioned due to alleged formal defects in its formulation stage. In this study, the type of research used is normative legal research or library research. The approaches used in this study are the statute approach, the conceptual approach, and the case approach. The main issue underlying the formal review of the TNI Law is the alleged failure to meet the principles of public participation and transparency in the legislative process, which has implications not only for the technical aspects of the law but also touches upon the dimensions of legitimacy and the quality of procedural democracy in Indonesia. Formal testing of the TNI Law within the framework of constitutional oversight of the legislative process certainly faced much debate. Out of the 10 cases submitted, all were rejected because the Constitutional Court found that the TNI Bill did not violate the law regarding its non-inclusion in the national legislation program, that the TNI Bill was a carryover, that the TNI Bill was in accordance with TNI reform, that the discussion of the TNI Law was transparent and accountable, that there was no limitation on document access or information access, and that the other 5 cases were still in the trial process.
