Abstract

Fuqaha have played a highly strategic historical role as the heirs of the Prophet in formulating Islamic law and guiding the Muslim community. Their trajectory, from the time of the Prophet Muhammad, through the period of the Rightly Guided Caliphs, to the formation of the classical schools of fiqh, demonstrates the importance of cadre formation in maintaining the continuity of the Islamic intellectual tradition. However, the dynamics of the modern era present new challenges distinct from the classical period, such as issues of medical bioethics, the development of Islamic fintech, gender justice, environmental crises, and the rights of persons with disabilities. These challenges require the formation of fuqaha who are not only grounded in textual sources but also oriented toward the objectives of Islamic law and contemporary fiqh methodologies. This article argues that the urgency of cadre formation of fuqaha in the modern era lies in the ability to produce a generation of scholars capable of integrating the classical fiqh tradition with modern interdisciplinary approaches. The prospect is the emergence of fuqaha who are responsive, visionary, and solution oriented, enabling Islamic fiqh to remain a relevant moral and legal guide for global society.

Abstract

Artikel ini mengkaji hubungan antara hukum Islam dan modernitas dalam kerangka teoretis-filosofis serta aplikatif-sosiologis, dengan fokus pada dinamika pembaruan hukum keluarga Islam di Indonesia. Modernitas sering kali dipersepsikan sebagai ancaman terhadap keutuhan nilai-nilai syariat, padahal ia juga dapat menjadi peluang bagi revitalisasi hukum Islam melalui pendekatan ijtihād kontekstual dan maqāṣid al-syarī‘ah. Penelitian ini menggunakan metode normatif-analitis yang dipadukan dengan kajian pustaka dari berbagai jurnal nasional bereputasi SINTA, dengan tujuan menelusuri sejauh mana prinsip-prinsip hukum Islam mampu beradaptasi terhadap perkembangan sosial, ekonomi, dan budaya modern. Hasil kajian menunjukkan bahwa hukum Islam memiliki fleksibilitas epistemologis yang tinggi karena fondasinya yang berbasis pada rasionalitas maqāṣid dan keterbukaan terhadap realitas empiris. Dalam konteks hukum keluarga Islam, modernitas mendorong reinterpretasi terhadap sejumlah isu kontemporer seperti kesetaraan gender, hak-hak anak, keadilan dalam relasi suami istri, serta perlindungan hukum terhadap kelompok rentan. Reinterpretasi ini tidak dimaksudkan untuk menggantikan syariat, melainkan untuk memperkuat aktualisasinya dalam kehidupan sosial yang terus berubah. Oleh karena itu, pembaruan hukum Islam di era modern seyogianya dipahami bukan sebagai bentuk sekularisasi, tetapi sebagai manifestasi dari tajdīd al-fiqh yang berorientasi pada kemaslahatan manusia dan keadilan universal

Abstract

Changing the law is a necessity in this life. This work is here to explore the influence of Ibn Qayyum al-Gauziyah's thoughts on one of the theories of legal change. Ibn Qayyim al-Jauziyah in his legal thinking provides the widest possible space for the door of ijtihad in responding to change as a reality that cannot be avoided. Qualitative research methods using literature research while the analysis knife used is by analyzing information that has been collected from library data and social theory, or what is called the doctrinal-deductive method. The results of the discussion are that the legal change paradigm method is inseparable from the factors of the era, place, situation, intention and custom. Ibn Qayyim al-Gauziyah's theory of legal change is a concept of renewing Islamic legal thought. This means that Islamic law is a law that is dynamic, responsive and adaptable to demands for change. The implication of al-Jauziyah's theory of legal changes to society is in the context of achieving universal benefit in society as the purpose of the law itself.

Abstract

Imam Syafi'i's ideas regarding qaul qadim and qaul jadid are interesting to observe. From the idea that shows flexibility in the application of Islamic sharia, Islamic law, or Islamic fiqh, it appears that Imam Syafi'i has provided a methodical framework in addressing the application of Islamic sharia, Islamic law, or Islamic fiqh which has relevance to various social contexts that covers it. This implies that Islamic sharia, Islamic law, or Islamic law is a process of grounding theocentric values ​​that are ideal and sacred to anthropocentric values ​​that are very dynamic and profane. In this process, Imam Syafi'i's constructive and innovative ideas regarding qaul qadim and qaul jadid, along with various sociological factors that became the background for changing his views, had practical implications for the birth of a methodical framework for the application of Islamic sharia, Islamic law, or Islamic fiqh that can be applied in different contexts of place, time or circumstances

Abstract

Blasting is used to break hard rock in mining, but the vibrations can destabilize the slope through the resulting soil vibrations. The resulting blasting vibration must be in a safe condition, especially the stability of the mine slope around the blasting. This study aims to analyze the value of the slope factor of safety (FS), blasting soil vibration, and the influence of soil vibration on the value of the factor of safety (FS). The research method involves data collection followed by slope stability analysis utilizing the Bishop Simplified Method within Slide software and blasting vibration analysis using regression models to determine Maximum Horizontal Acceleration (Amax). The study results showed that the value of FS varied based on location and geological conditions. The A-A' section in the upper western part of the mine has the highest FS value of 2.36, while the C-C' cross-section in the lower eastern part of the mine has the lowest FS value of 1.16. Analysis of soil tremors in Amax values showed the highest values in August and the lowest at the end of October. The Amax value has an effect on the decrease in the FS value based on the blasting distance. The B-B' cross-section has the largest influence, the A-A' and C-C' cross-sections have a fairly small influence, and the D-D' cross-section has no influence.

Abstract

This article examines the validity of ijab-qabul in Ethereum-based smart contracts and reconstructs classical contract concepts within the framework of contemporary Islamic law in the Society 5.0 era. It focuses on how principles of fiqh muamalah—such as mutual consent (taradhi), clarity (al-wuduh), and the absence of gharar—can adapt to automated contract systems. The study employs a normative-conceptual approach through library research, drawing on classical fiqh literature, contemporary Islamic legal studies, and technical smart contract documents, analyzed descriptively, comparatively, and through a maqasid al-shariah perspective. The findings indicate that smart contracts structurally fulfill the essential elements and conditions of a valid contract but face challenges regarding free will, intention (qasd), and limited corrective mechanisms such as khiyar. While enhancing transparency and legal certainty, they also pose risks of injustice due to assumed consent, digital literacy gaps, and insufficient consumer protection. The novelty of this study lies in reconstructing ijab-qabul as a digitally validated expression of intent rather than a purely verbal one. The study highlights the need for ethical smart contracts, adaptive regulation, and strengthened digital literacy to ensure alignment with justice, public interest, and consumer protection within Islamic law.

Abstract

This study examines the status of unregistered marriages (nikah siri), unregistered divorces (talak siri), and online marriages from the perspective of Islamic law and Indonesian positive law. These three phenomena emerge as forms of marriage and divorce practices that do not fully comply with state law, although some are considered valid according to Sharia. The study used a qualitative method with a normative-juridical approach through analysis of literature, laws and regulations, and Islamic legal perspectives. The findings indicate that unregistered marriages (nikah siri) and unregistered divorces (talak siri) are valid according to religion, but lack legal force before the state because they are not officially registered. Online marriages have sparked debate regarding the validity of the contract, guardians, and witnesses, thus creating legal uncertainty. The impact of these practices is weak protection of women's and children's rights and the potential for legal disputes. This research is useful for providing a more comprehensive understanding of the importance of registering marriages and divorces to ensure legal certainty and protection in family life in Indonesia.

Abstract

Penelitian ini menganalisis pergeseran makna dispensasi kawin di Pengadilan Agama dari instrumen eksepsional (emergency exit) menjadi legitimasi prosedural, serta implikasinya terhadap sinkronisasi hukum Islam dan standar hak asasi manusia internasional. Penelitian merupakan penelitian hukum normatif yang dilaksanakan melalui studi kepustakaan (library research) dengan memadukan pendekatan perundang-undangan, pendekatan perbandingan, dan pendekatan konseptual. Bahan hukum primer berupa UU No. 16 Tahun 2019, PERMA No. 5 Tahun 2019, dan Convention on the Rights of the Child (CRC), didukung bahan hukum sekunder berupa putusan-putusan dispensasi kawin yang terpublikasi serta literatur hukum keluarga Islam. Data dianalisis secara kualitatif melalui content analysis dengan kerangka maqāṣid al-sharī‘ah Jasser Auda dan teori keadilan substantif. Berdasarkan analisis penulis, secara ontologis dispensasi telah tereduksi dari mekanisme darurat yang terbatas menjadi alat legitimasi pernikahan dini; secara epistemologis terdapat ketegangan antara pendekatan legalistik dan perlindungan hak anak sehingga konsep maslahah diterapkan secara pragmatis; dan secara aksiologis harmonisasi prosedural dengan standar internasional belum diikuti keadilan substantif sehingga melahirkan apa yang penulis sebut “ilusi sinkronisasi.” Kebaruan penelitian terletak pada perumusan konsep “ilusi sinkronisasi” sebagai kerangka untuk membaca kesenjangan antara harmonisasi normatif dan perlindungan substantif. Penelitian merekomendasikan rekonstruksi paradigma hukum berbasis martabat manusia (karāmah insāniyyah).
