Abstract

The purpose of this study is to investigate the formulation of the dilemma concerning the incorporation of revelation and reason in the foundation of Islamic law in the contemporary era. The inquiry that has been posed for investigation is as follows: In what ways might the combination of reason and revelation have an impact on the evolution of Islamic law in the present day? The method that is utilized is library research with a descriptive-analytical approach. In this method, the author examines relevant material in order to get insights into this integration. The findings of this study suggest that the combination of reason and revelation has the potential to not only offer solutions to the problems that are currently confronting Islamic law, but also to encourage the construction of laws that are more sensitive to the advancements that have occurred in the areas of social governance, politics, and the economy. It is anticipated that this research will make a contribution to the creation of Islamic law that is both adaptable and just in the context of the modern world.

Abstract

Child marriage is a complex and multidimensional social issue occurring in various parts of the world, including Indonesia. This phenomenon is influenced by diverse cultural norms, social pressures, and economic conditions. The practice of early marriage is often regarded as a deep-rooted tradition, where marrying off young girls is seen as a way to protect family honor and reduce economic burden. Although there are laws regarding the minimum age for marriage, their implementation is often inconsistent, and cultural norms frequently dominate. This research employs a qualitative approach to analyze early marriage from cultural, social, and Islamic private law perspectives. Data were collected through literature studies, including books and journals, to produce a comprehensive understanding of this issue. The analysis results indicate that early marriage negatively affects the quality of education and life for adolescents, their health, and contributes to the cycle of poverty. Therefore, this research advocates for a holistic approach involving all stakeholders to protect children's rights and reduce the practice of early marriage in society.

Abstract

The profound impact of cultural and religious modernity on various aspects of life has brought about significant changes in regional akkattere traditions in Ammatoa society. According to this hadith, the pilgrimage which is in harmony, the conditions and obligations are in accordance with Islamic law, and which must be performed at a certain time and place, can be completed easily through the akkattere ritual. This research is an empirical law using an anthropological approach to Islamic law. The purpose of this study is to examine the incorporation of customary values and Islamic law in the Akkattere tradition of the Ammatoa community in the region, and to evaluate its impact. Data was collected using interviews and literature studies. The research was conducted in Tanah Towa Village in Kajang District, Bulukumba Regency, South Sulawesi Province. The research concluded that the akkatere ritual obviated the need to wait in long lines or have the financial resources to perform the pilgrimage to the holy land of Mecca. Based on the findings of this study, anthropologically the akkattere traditional law is the result of a dialectic between Islam and local traditions and has resulted in new local pilgrimage practices, which is now a religious characteristic of the Ammatoa people. Nonetheless, the understanding of Hajj by the Ammatoa community has deviated substantially from the normatism of Islamic law, so that it fundamentally influences aspects of religious belief and ideology.

Abstract

The general election contest that is being held is very prone to causing conflict in society. This research aims to identify forms of social conflict, factors that cause social conflict, and the sociological perspective of Islamic law on the vulnerability of social conflict in general elections. So far, social conflict studies in general elections have mostly been studied from a social and norm perspective, but this research tries to look at the vulnerability of social conflict during general elections from the sociological perspective of Islamic law. This research is qualitative research using data obtained from online news. This research found that social conflict during general elections can take the form of arguments or debates and physical conflicts. There are at least three causes of social conflict, namely polarization or negative campaigns, selective fanaticism, and allegations of fraud. Preventing social conflict needs to be carried out using a sociological approach to Islamic law by upholding human rights, being moderate towards differences maintaining the value of balance, and being gentle. This research concludes that the sociological conception of Islamic law can be a solution to resolving social conflicts by prioritizing Islamic values. Therefore, the author suggests the need for government attention to avoid social conflict in general elections. Apart from that, support from religious figures and ulama is needed through counseling and issuing fatwas regarding the prohibition of social conflict in general elections because social conflict can damage relationships and values in society.

Abstract

In hadith studies, many conclusions state that textual reasoning towards hadith is the main cause of intolerance and radicalism. This makes some scholars such as Yusuf al-Qardhawi and Ali Mustafa Yakub offer a more complex understanding of hadith involving asbab wurud al-hadith, al-wahdah al-maudhu'iyyah fi al-hadith, ikhtilaf al-ahadith and so on. Hadith reasoning like this is considered by some as a contextualization of hadith that will prevent someone from religious radicalism. This study wants to answer the question, to what extent does contextual reasoning in hadith prevent a person from religious radicalism? Researchers will examine the formulation of contextual hadith reasoning initiated by Ali Mustafa Yaqub in al-Thuruq al-Shahihah fi Fahm al-Sunnah al-Nabawiyyah and standards of religious radicalism initiated by LIPI in the Strategy for Anticipating Radicalism and Religious Intolerance in Indonesia. Each will be used as an independent variable and dependent variable. This research is mixed research with the type of field research. The data processing technique used is a simple regression test using the SPSS 20 program. The research object of this study is the Mahasantri Darus-Sunnah International Institute for Hadith Sciences with a total of 32 people. While the sampling system in this study is a random sample. The results of this study indicate that contextual hadith reasoning has a sig. 0.008 which is less than 0.05 so it is said to have a significant effect between contextual hadith reasoning on religious radicalism. The magnitude of the influence of this hadith reasoning itself is 21.2%. The direction of the effect is negative with a magnitude of -.643 at a constant of 69.792. This means that there is a negative relationship between contextual hadith reasoning and religious radicalism. The more contextual a person's understanding of hadith is, the further away he is from radicalism.

Abstract

This study addresses the challenges of integrating Islamic jurisprudence with family planning policies in Egypt and Indonesia, two Muslim-majority countries with distinct socio-political contexts. The research aims to analyze the alignment and divergence of these policies with Islamic legal principles, focusing on the practical application of Ibn Qayyim’s legal philosophy. Employing a qualitative approach, the study combines semi-structured interviews, focus group discussions, observations, and document analysis to gather comprehensive data from over 50 stakeholders and 100 legal and policy documents. Findings reveal that while Egypt’s centralized governance benefits from Al-Azhar’s religious endorsements, rural resistance highlights cultural challenges. In Indonesia, decentralized governance fosters regional diversity, but inconsistent fatwa issuance complicates policy implementation. The study contributes practically by recommending enhanced collaboration between policymakers and religious leaders and theoretically by extending Ibn Qayyim’s framework to contemporary governance. Its novelty lies in its cross-cultural approach, demonstrating how Islamic legal principles can adapt to diverse societal needs through balanced and context-sensitive reasoning

Abstract

Tesis ini mengkaji permasalahan pokok terkait perspektif hukum Islam terhadap transaksi jual beli emas non tunai secara online. Jenis penelitian ini adalah kualitatif dalam bentuk field research, menelusuri fakta-fakta yang terjadi dilapangan, pendekatan penelitian yang digunakan adalah: teologis-normatif, dan yuridis. Adapun sumber data penelitian ini adalah pegawai pegadaian, tokoh ahli bidang syariah, nasabah pegadaian dan pemerintah daerah Majene. Selanjutnya, metode pengum­pulan data yang diguna­kan adalah observasi, wawancara, dokumentasi, dan penelusuran referensi. Lalu, teknik pengolahan dan analisis data dilakukan dengan melalui tiga tahapan, yaitu: reduksi data, penyajian data, dan pena­rikan kesimpulan. Hasil penelitian ini menunjukkan bahwa analisis terkait transaksi emas non tunai secara online pada aplikasi pegadaian ini boleh dilakukan, sebab semua rukun dan syarat jual beli berdasarkan hukum Islam telah terpenuhi. Serta adanya fatwa Majelis Ulama Indonesia Tentang jual beli emas tidak tunai megatakan hukumnya mubah. Adapun etika bisnis sudah diterapkan dipegadaian Majene sesuai dengan Standar Operasonal Perusahan (SOP) dan terkait tanggung jawab sosial (CSR) di Pegadain Majene telah di laksanakan sebagai bentuk komitmen Pegadaian yang tidak hanya fokus pada pelayanan jasa keuangan, tetapi juga untuk berkontribusi secara sosial.

Abstract

Child custody is one of the crucial aspects in divorce cases, often becoming a dispute between separating spouses. This study aims to analyze how Islamic law regulates child custody and how it is implemented in decisions of the Religious Court in Indonesia through a sociological approach. The research method used is library research, drawing from primary sources such as the Qur’an and Hadith, as well as various relevant scholarly works on child custody determination after divorce based on the enforcement and practice of Islamic law in Indonesia. The findings indicate that, in Islam, child custody is generally granted to the mother. However, its implementation in the Religious Court does not always follow this principle, as custody may also be awarded to the father based on specific considerations. Judges’ decisions regarding child custody take multiple factors into account, with the primary objective of safeguarding the child's best interests and well-being. As victims of divorce, children require protection, care, and affection from both parents to ensure proper growth and development while avoiding harmful psychological effects. Therefore, child custody determination is not solely based on normative texts but also considers the principle of child welfare (mashlahah al-thifl) as a fundamental guideline.

Abstract

The purpose of this research is to reveal the history of the emergence of Ahmadiyya and its entry into Indonesia, the facts of violence against the Ahmadiyya Congregation in Indonesia and the government's role in protecting the Ahmadiyya Congregation, as well as social justice for the Ahmadiyya Congregation in Indonesia in the perspective of Islam and Pancasila. This qualitative research is a library research that collects data through literature such as journals and books. The results show that Ahmadiyya is a faith-based organization initiated and propagated by Mirza Ghulām Ahmad. There are two sects within this organization; Lahore and Qadian. The Lahore Ahmadiyah sect was spread to Indonesia through Mirza Wali Ahmad and Maulana Ahmad in 1924. Meanwhile, the Ahmadiyah Qadian sect was spread by Rahmat Ali in 1925. The Lahore sect stated that Ahmadiyah was born in 1888 while the Qadian sect stated that Ahmadiyah was born the next year. The existence of the Ahmadiyya Congregation in Indonesia is marked by a series of episodes in the form of neglected facts of social justice. Various acts of attacks, violence, persecution, and so on are portraits of the life of the Ahmadiyya Muslim Community in Indonesia as legal citizens before the law. It is understandable that the government's role in protecting the Ahmadiyya Congregation has not been maximized due to various acts of violence against the Ahmadiyya Congregation in Indonesia. Based on the fifth precept of Pancasila and from an Islamic perspective, in this case the preservation of life, lineage, property and reason, social justice has not been realized for the Ahmadiyya Congregation in Indonesia with violent attacks in the form of indiscriminate acts. vigilantes against the Ahmadiyya Congregation are still found.

Abstract

Shari'ah and Hakikah are two sciences in Islam that are seen as conflicting sciences. The science of Shari'ah which is oriented to the deeds of human birth and the science of hakikah oriented to the inner deeds of man. Both tend to be viewed differently in their practice. However, if understood and explored, the two sciences have a very close relationship and cannot be separated from practice. Man consisting of both lahiriyah and batiniyah elements desperately need both knowledge to achieve the goal of human creation, namely worship and worship God. The science of Shari'ah as a form of embodiment of human slavery through concrete behavior, while the science of nature as the embodiment of human slavery through abstract and only known emotional and inner activities of the individual who does it. Through the fusion of shari'ah and hakikah, the application of Islamic law can be enforced in a mannered manner with law enforcement through a method of gentle approach or upholding ihsan. The enforcement of Islamic law with ihsan has been enforced since the time of the Prophet Muhammad (peace be upon him), enforcement in a polite manner is expected to uphold the sharia law of Islam to all human beings around the world without any violence and compulsion.
