Abstract

The pronunciation of amar (order) in the science of jurisprudence is one of the most central linguistic and legal instruments in the establishment of Islamic law. This study aims to analyze the meaning, form, and legal implications of the pronunciation amar in the nash-nash of the Qur’an and hadith, as well as to study how contextual and sectarian differences affect its understanding. The study used a qualitative approach with descriptive-analytic and library study-based methods. Data were analyzed through a thematic-comparative approach and studied within the framework of Shariah maqashid. The results of the study indicate that originally, utterance amar indicates obligation, yet it can change to recommendation, permissibility, or other meanings depending on the contextual qarinah. Differences between sects and social dynamics also influence the interpretation of this pronunciation. This study asserts that an understanding of amar Is not sufficient to rely on textual grammar alone, but must be integrated with maqashid, maslahat, and contemporary legal realities. This study contributes towards strengthening a responsive and relevant legal istinbat methodology in the Islamic legal system in Indonesia.

Indonesia memiliki banyak pesona panorama dan sumber daya alam yang memberikan peluang bagi pemerintah untuk membentuk sektor pariwisata sebagai sektor unggulan yang berpengaruh untuk peningkatan pendapatan nasional. Tujuan penelitian ini yakni untuk mengetahui seberapa besar pengaruh daya tarik wisata dan media sosial Instagram terhadap minat kunjungan wisatawan domestik pada objek wisata pantai Bira Kabupaten Bulukumba baik secara parsial maupun simulant. Penelitian ini merupakan penelitian kuantitatif Hasil penelitian menunjukkan bahwa secara parsial simultan berpengaruh positif dan signifikan terhadap variabel terikat (Minat kunjungan) wisatawan pada objek wisata pantai Bira Kabupaten Bulukumba

Abstract

Abstract: The conflict that occurs between reason and revelation has had a huge impact on the history of the development of Islamic law. And this should be a valuable lesson for Muslims now and in the future. The method used is a literature study with a qualitative approach. The purpose of this research is to find out how reason and revelation go hand in hand in the formation of Islamic law. the results of the research prove that reason and revelation both mean the basis for giving birth to Islamic law. This study also analyzes that there is no contradiction between reason and revelation. Factually the position between reason and revelation can be equal, but theologically revelation is the source of ideas for reason so that revelation (as a subject) has a higher position. conversely, reason cannot be a source of revelation, because reason is a creation while revelation is the word of God. The conclusion of this research is that modern Islamic law must be able to maximize its scientific reasoning (reason) in order to find meanings that are still hidden in the texts of the Qur'an and Hadith in answering the problems of life in the world without neglecting the benefits of the hereafter. Abstract

After the death of Rasulullah saw, the country's economic system, especially in economic matters, was taken over by the khulafaul Rashidun. There were four leading figures in this phase, namely Abu Bakar Assiddiq, Umar bin Khattab, Uthman bin Affan, and Ali bin Abi Talib. The caliphs carried out their government system based on the guidance of the Prophet Muhammad based on the Qur'an and Sunnah. The purpose of this study was to find out the policies among the caliphs in managing the country's economic problems, as well as the relevance of the economic system during the Khulafaul Rashidun era to modern times. This research is a "field research" using qualitative methods. The results of the study show that there are differences between the friends in implementing various economic policies both in terms of state revenues and the method of channeling or distributing state assets to solve economic problems. One of the influencing factors was the existence of new problems arising from the conditions, both in terms of revenue, regional and political, which were faced by each caliph in his government. Until the modern era, the Islamic economy continues to adapt to the conditions of the times so that the Islamic economy continues to exist in the future and become a compatible economic system.

Abstract

Violation of workers' rights in Indonesia is a central issue in labor relations Commonly violations of workers' rights demand the existence of the Confederation of Trade Unions as an organization formed from, by, and for workers both in the company and outside the company, which is free, open, independent, democratic, and responsible to fight for, defend and protect the rights and interests and welfare of workers. For this reason, this research is oriented in the form of normative empirical research that seeks to observe the provisions of laws and regulations from the aspects of the rights and obligations of workers and employers along with law enforcement and direct observations in the Confederation of Maros Trade Unions in their role defending the rights and interests of workers in Maros Regency. The conclusion in this study is that labor relations outline the existence of inseparable rights and obligations as a definite causality, so disputes over rights and obligations between workers and employers require law enforcement that can be pursued outside the court through Bipartite settlements and mediation and litigation settlements through judicial institutions. In addition, the existence of KSPI Maros plays a very important role in industrial relations and efforts to resolve labor rights disputes through Bipartite, mediation and courts.

Abstract

Owners of swallow's nest in Basala District, South Konawe Regency give zakat of tekke wale' (swallow's nest) using gold zakat rate. This implies deviation from Islamic law and striking difference from the provisions of zakat law formulated by most Muslim scholars. This research aims to reveal the business phenomenon and practice of tekke wale' zakat spending, the factors beyond preference to use zakat with gold rate as well as culture-based deviations on Islamic law regarding this specific practice of zakat. This research is qualitative with an empirical-normative approach which includes interviews with swallow nest owners, community leaders, and religious leaders. Besides, it involves literature review to gather the data. The research shows that swallow nest business is a relatively new livelihood for local people so they have no definite guidance on how to spend the zakat. Their preference using gold zakat rate are due to five factors, ranging from lack of knowledge, assumption that swallow's nest is not a part of agricultural business, easy calculation in giving zakat using gold rate, following the previous swallow's nest owners, to easiness to determine the zakat recipients and spending period. Meanwhile, three forms of deviation from Islamic law existing at the practice urges the specific legal product concerning this specific commodity.

Abstract

Penelitian ini menghadirkan tiga item rumusan masalah yaitu: 1) Bagaimana konsep gadai atau arrahn dalam Islam ?, Bagaimana Praktek pasanra tampa?,Bagaimana tinjauan hukum Islam terhadap praktek tradisi pasanra tampa? Jenis penelitian ini adalah jenis penelitian kualitatif, yaitu melakukan analisa yang mendalam terhadap data dan informasi yang diperoleh, dari sumber yang relevan yang mana data dan informasi diperoleh dengan cara observasi di lokasi penelitian dan interview terhadap masyarakat dari berbagai kalangan sehingga data tersebut menjadi bahan perbandingan terhadap hukum Islam. Penelitian ini menggunkan dua metode pendekatan yakni teologis-normatif dan sosiologis.. Teknik pengumpulan data penelitian ini dilakukan dengan tiga metode, yaitu : observasi, wawancara mendalam, dan penggunaan dokumen. Hasil penelitian ini menunjukkan bahwa :1) Dalam tinjauan hukum Islam gadai merupakan bentuk muamalah yang dibolehkan menurut jumhur ulama, akan tetapi mereka berbeda pendapat terkait hukum memanfaatkan barang jaminan dalam transaksi gadai.2) Dalam praktek pasanra tampa pihak yang berutang menawarkan kebun sebagai barang jaminan untuk memperoleh piutang yang diharapkan dan pihak pemberi utang menahan kebun tersebut memanfaatkannya dengan mengambil hasil panen dari kebun jaminan tersebut dan itu menjadi hal yang lumrah ditengah-tengah masyarakat .3) dalam tinjauan hukum Islam bentuk gadai dalam tradisi pasanra tampa berbeda dengan bentuk gadai dalam syariat Islam dalam berbagai aspek. Implikasi dari penelitian ini dapat dinarasikan sebagai berikut: tujuan disyariatkannya gadai dalam Islam adalah terjalinnya rasa saling percaya antar pihak pemberi utang dan pihak penerima utang agar transaksi utang-piutang dapat terlaksana tanpa adanya unsur kezaliman. Sedangkan transaksi gadai untuk mendapatkan manfaat dan keuntungan dari barang jaminan adalah hal yang bertolak belakang dengan urgensi disyariatkannya gadai dalam Islam.

Abstract

Worship is the obligation of a Muslim who is obedient to the Creator. Carrying it out is an obligation for his people, and there is no reason whatsoever to abandon this obligation. These obligations include prayer, fasting, zakat, and the Hajj which are pillars or pillars of Islam that must be believed and implemented. Humans, especially Muslims, have no reason to abandon these obligatory acts of worship, because in Islam there is relief for carrying out these obligatory acts of worship. The relief in question is Rukhsah. Rukhsah can be carried out when someone is of age which is permitted according to the terms and conditions. In this discussion, Rukhsah was carried out because there was an outbreak or pandemic of Covid-19 that had hit the whole world, including Indonesia. Due to the pandemic, all activities that gather the masses have been canceled, including worship and carried out from their respective homes. Therefore, Rukhsah is widely implemented during the current pandemic to make it easier to carry out worship. This article is a literature review sourced from several references relevant to the topic discussed. Data collection techniques come from researching relevant reference sources in the form of journals, articles, websites, books and other scientific works. The analysis technique for this research is through collection, analysis and drawing conclusions.

Abstract

This article examines the issue of forms of legal protection for the rights of wives of domestic violence victims based on the values of justice. This is because victims of domestic violence are increasing from year to year, even though there is a Law on the Elimination of Domestic Violence, this phenomenon still continues. Therefore, this issue is important to study in order to get a clear picture of the forms of legal protection that can be obtained by victims of domestic violence. The research approach is a qualitative approach with a normative juridical scientific approach, the data is in the form of secondary data sourced from statutory regulations and studies of Islamic jurisprudence literature. In the discussion it was revealed that: Firstly, the forms of legal protection in legislation are classified into: 1). Preventive action, namely a form of legal protection by clearly regulating the rights and obligations of husband and wife, this has been regulated in the Marriage Law and KHI. 1). Repressive action, namely a form of legal protection when domestic violence has occurred, then this falls into the category of criminal law where the perpetrator is threatened with a crime, this has been regulated in the 2004 Domestic Violence Law. Secondly, in Islam legal protection is more comprehensive, by regulating the laws between husband and wife, both laws relating to civil matters during and after divorce. Likewise, Islam clearly provides legal protection for victims of domestic violence, by enforcing hudud penalties for perpetrators of domestic violence.
