Abstract

The recent increase in the number of construction accidents, whether caused by process errors or circumstances beyond human control, leaves problems related to the quality and responsibility of providers and users. Aspects of the responsibility of Service Providers need to be emphasized and the regulations must provide guarantees of legal certainty. This thesis focuses on a implementations of RKK Documents created by Service Providers when bidding for construction work. Problems in the research include how to implement and monitor the RKK Document on works of “Penanganan Lereng Ruas Tambu-Tompe-Pantoloan” and what is the form of the Service Provider's legal responsibility if a construction accident occurs. The research sample is works of “Penanganan Lereng Ruas Tambu-Tompe-Pantoloan”, the project which is carried out by PT. Anugerah Karya Agra Sentosa. The party that is the service user for this project is BPJN Sulteng Ministry of PUPR. The method used in this research is juridical-empirical, which focuses on collecting empirical data in the field. The theories used in this research are the theory of legal certainty, the theory of legal awareness, and the theory of legal effectiveness. The data used in this research are primary data and secondary data. Primary data comes from interviews with several parties, including the Directorate of Construction Sustainability of the Ministry of PUPR and Commitment Making Officials (PPK). Meanwhile, secondary legal material in this research includes regulations related to K4 and SMKK standards, the main ones are the 1945 Constitution, Law Number 2 of 2017 concerning Construction Services, and PUPR Ministerial Regulation Number 10 of 2021 concerning Guidelines for Construction Safety Management Systems . The research results show that in the application of the RKK document to the work on handling the slopes of the Tambu-Tompe-Pantoloan section, there are several discrepancies. Firstly, the Service Provider was proven to have used substitute workers who did not have competence in the form of a Work Competency Certificate, which caused construction accidents. Second, the Service Provider does not comply with Standard Operating Procedures when replacing Occupational Safety Experts.

Abstract

This articel examines the dialectical relationship between constitutionalism and Islamic values in the context of executive office appointment systems in Indonesia. Using normative juridical research methodology, this study analyzes how constitutional principles and Islamic values interact in shaping the mechanism of executive office appointments, particularly at national and regional levels. The findings indicate a harmonization between modern constitutional values and Islamic leadership principles, such as the concepts of shura, amanah, and justice. In-depth analysis reveals that Indonesia's executive office appointment system has adopted democratic elements that align with Islamic values, although not explicitly citing their religious sources. This research also identifies challenges in integrating these two value systems, especially in the context of legal pluralism and diversity of interpretations. In conclusion, a more comprehensive approach is needed to harmonize constitutional and Islamic values to strengthen the executive office appointment system in Indonesia.

Abstract

Poverty has the meaning of a condition or situation where a person cannot afford to maintain himself in social life and the inability to utilize his mental or physical energy in society. The purpose of this study is to examine and analyze efforts that can be made by regional heads in overcoming and minimizing poverty in West Sumatra. The research method used is qualitative normative juridical. The results of this study are that the priority of poverty alleviation in the perspective of regional development should prioritize the benefits of regional development carried out by prioritizing the poor in the implementation of development in each region where there are still poor people. The suggestion from this study is that the government is expected in its duties and responsibilities as the executor of the function of the government system to prioritize regional development based on systems or programs that have standard provisions for welfare values ​​in the form of regulations in following up and eliminating poverty gradually so that the provisions in Pancasila and the 1945 Constitution can be created properly.

Abstract

The According to the provisions of Article 28 paragraph (1) of the Basic Agrarian Law, "Utilization rights are the right to cultivate land that is directly controlled by the state for a certain period of time for agricultural, fishing or livestock businesses." The subject of Cultivation Rights (HGU) in article 30 UUPA Junto Article 2 Government Regulation Number 40 of 1996 stipulates that those who can have Cultivation Rights Are Indonesian citizens and legal entities established according to Indonesian law and domiciled in Indonesia. Nowadays, HGU issues often involve the existence of customary land as a forum for the HGU to take place. The law has set a time limit for the use of HGU, but in reality when the HGU has expired, it is not uncommon for conflicts of interest to occur between customary land owners and HGU holders. Therefore, this research will examine the Legal Certainty of the Status of Ulayat Land which is Used as Cultivation Rights After the Validity Period Expires, to find out what the ideal legal parameters are to resolve this legal issue.

Abstract

This research aims to determine the big influence of empowering traditional institutions by the Narcotics Agency of West Sumatra Province as an effort to prevent narcotics use against recidivism. The Narcotics Law mandates that the eradication of narcotics crimes be carried out through the involvement and participation of the community in various activities to prevent or control narcotics crimes, especially in cases of repetition of criminal acts or recidivism. This research is normative juridical supported by empirical juridical and descriptive analysis. The data used is primary, secondary and tertiary legal materials. The results of the study show that the empowerment of traditional institutions by the West Sumatra Province Narcotics Agency has a major influence in preventing repetition of narcotics crimes or recidivism. Through an approach based on local wisdom, social rehabilitation, character development and community support, traditional institutions can play an effective role in helping criminals not fall back into criminal behavior. The involvement of traditional institutions in the rehabilitation process strengthens social ties and ensures that offenders receive the support they need to live a better life and stay away from narcotics. Although empowering traditional institutions has great potential in preventing narcotics and the repetition of criminal acts, there are several obstacles that must be overcome to achieve success. Obstacles such as lack of understanding, limited resources, social stigma, and resistance to change need to be overcome with a careful approach and involving all relevant parties. Empowerment programs for traditional institutions must be adapted to the local cultural context and supported by good coordination between the government, traditional institutions and the community to create an environment free from drug abuse.

Abstract

Recommendations are suggestions from the examiner based on the results of the examination contained in the Audit Report (LHP) of the Supreme Audit Agency (BPK). Law No. 15/2004 mandates that recommendations must be followed up by responsible officials or parties. On several occasions, BPK has stated that its audit results are final and binding. A common recommendation in BPK's LHP is to return state losses to the state or regional treasury by stating the amount of money to be returned. Meanwhile, in other provisions, namely PP No. 38 of 2016 and BPK Regulation No. 3 of 2007, it is stated that the BPK audit results are one of the sources of information on the occurrence of losses, which will then be processed for imposition and compensation claims. In its provisions, all decisions arising from the process may differ from the state losses stated in the BPK's LHP. The purpose of this article is to examine the nature of the recommendations for the recovery of state losses in the BPK's LHP. This research is normative legal research with the approach of principles, cases, laws, and regulations. The results show that the BPK's recommendation is final and binding since the LHP is issued and submitted to the representative institution, so it must be followed up by providing answers and explanations to the BPK. Meanwhile, the state loss stated in the LHP BPK is not final. This is related to the authority of BPK, where the recommendation to recover state losses in the LHP BPK is not in the context of exercising the authority to calculate state losses, as well as assessing and/or determining the amount of state losses.

Abstract

Outsourced labor is a part of employment growth in various economic sectors. As part of the workforce, outsourcing workers must also receive protection for their rights as outsourcing workers. One of the things that needs to be protected is in the event of a transfer of service provider company. Therefore, it is necessary to study the protection of the rights of outsourced workers. In this case, the research was conducted at the M. Zein Painan Hospital. Outsourced workers at M. Zein Painan Hospital must be protected by Indonesian law. The study used empirical research methods by collecting data from related parties, namely outsourcing workers, service provider companies, and service users, in this case, Dr. M Zein Painan. One form of legal protection and certainty, especially for workers, is through the implementation of work agreements. Analysis and discussion of the results obtained are: (a) Forms of legal protection for outsourced workers in work agreements at RSUDi Dr. M. Zein Painan, namely protection of wages, protection of working time, and protection of rest time as well as protection against termination of employment (b) Implementation of work agreements for outsourced workers when there is a change in service provider company can be implemented well with the existence of an agreement Work.

Abstract

In Indonesia, it is known that there is a hierarchy of statutory regulations, known as the hierarchy of statutory regulations, which is based on the provisions of Article 7 paragraph (1) of Undang-Undang Nomor 12 Tahun 2011. This hierarchy of laws and regulations has the consequence of the provision that lower laws and regulations must not conflict with higher laws and regulations. Regional regulations as part of statutory regulations are also subject to this hierarchical concept. To guarantee the concept of hierarchy, it was then determined that there would be harmonization of regional regulations which were standardized in Undang-Undang Nomor 12 Tahun 2011, which was last amended by Undang-Undang Nomor 13 Tahun 2022. However, the provisions for the harmonization process contained in the Law were not accompanied by the establishment of implementing regulations that discussed in detail the procedures and methods for harmonization. This article will discuss further the position of the harmonization process for regional regulations in theory and how the process of harmonizing regional regulations is implemented in practice in Indonesia. So it is hoped that in the future recommendations will be able to be formulated for the process of harmonizing regional regulations which will make a positive contribution to efforts to overcome overregulation in the region.

Abstract

This study aims to find a solution or policy in the case of the termination of the Senior High Officials (Regional Secretary of West Pasaman Regency) by Civil Service Officers (Regent of West Pasaman Regency). The Regional Secretary of West Pasaman Regency who was terminated then filed a lawsuit to Padang Administrative Court (PTUN Padang) which court stating that the decision that termination was invalid, so the Terminated Official had the right to be reinstated. The court decision could not be implemented and came to a dead end because the position had also been filled by another Official (the new Regional Secretary of West Pasaman Regency) by the merit system according to the State Civil Apparatus Law (ASN Law) which was elected by the Committee. The selection of the leaders of the Primary High Offices are based on the recommendations of the State Civilian Bureaucracy Commission (KASN). This research was conducted using a sociologic and juridical method that analyzes the application of laws and regulations. The results showed that the termination of the Regional Secretary of West Pasaman Regency in terms of authority was in accordance with the regulations but in terms of procedural the Regent did not follow the provisions contained in the Civil Servant Discipline Regulation because the tenure of the regional secretary was less than 2 years without any summons, but immediately issued a Termination Letter based on the recommendation from the Inspectorate and the Governor of West Sumatra. Implications of the reappointment of Manus Handri as regional secretary based on the court decision which states that the termination of the regional secretary is illegal, but cannot be implemented because the new regional secretary has been elected based on KASN recommendations during the process of resolving Manus Handri's lawsuit at court. Termination and reinstated are difficult to be implemented because there are unclear provisions on how long the Human Resources Officer can reinstate terminated Officials who submit their cases to the Court. Therefore, there must be clear provisions in Law Number 30 Year 2014 and / or in Law Number 5 Year 1986 concerning the position of Officials who challenge the Decree on Transfer or termination during the trial process until the court's decision has permanent legal force. There should be a clause so that the Civil Service Officer (PPK) does not fill a new official with a position that is currently being processed in court.
